Public Minutes of the meeting held at The Old Vicarage, on 15 January 2015.

01/15 Minutes

Resolved: That the minutes of the meeting held on 11 December 2014, having been printed and circulated, be taken as read and be confirmed and signed by the Chair as a correct record.

02/15 Members Interests

Members were reminded of their responsibility to declare any personal, prejudicial and/or discloseable interests relating to any agenda item prior to its consideration.

03/15 Emergency Evacuation Procedure

The Chairman informed Members of the Public of the emergency evacuation Procedure.

04/15 Miscellaneous Items

Considered:

Resolved: That the report be noted.

05/15 Tree Preservation Order 2014/1 – Robin Hood Close, Castleton

Considered:

The report of the Natural Environment Team Leader

Resolved: That Members authorised the confirmation of Tree Preservation Order 2014/1 at Robin Hood Close, Castleton.

06/15 York Potash Planning Application – Update to Members

Considered:

The report of the Director of Planning The Authority’s solicitor Richard Smith declared a perceived potential conflict of interest in this Item due to his connection with Scarborough Borough Council and left the room.

Resolved: Members noted the contents of the report and requested that time is set aside at the Member Training Day on 12 March 2015 to discuss the interpretation of planning policies relating to the application.

07/15 Revised ‘interim’ Local Development Scheme 2015

Resolved: Members authorised the adoption of the revised ‘interim’ Local Development Scheme 2014-2017.

08/15 Affordable Housing Quota – Government Planning Guidance (verbal update)

Considered:

The verbal update of the Senior Planning Officer (Policy)

Resolved: Members noted the verbal update.

09/15 Applications for Planning Permission

The following members of the public addressed the meeting regarding the Plans List Items indicated:

Plans List Item 1 – Davina Fillingham spoke in favour of the application.

Considered:

The report listing applications and the Director of Planning’s recommendations thereon. Members also considered further information circulated on the Members’ Update Sheet at the meeting including; updated recommendations from the Director of Planning and comments received after the agenda was printed from: consultees, objectors and supporters.

Resolved: (a) That with regard to all applications listed in the report and subject to: (i) the amendments specified below; and (ii) the imposition of conditions in accordance with the relevant provisions of Sections 91-94 of the Town and Country Planning Act 1990, except in those instances where an alternative condition is contained in the Director of Planning’s recommendation or in an amendment referred to in (i) above; decisions be given in accordance with the Director of Planning’s recommendations:

List Plan No and Description of Proposal No 1. NYM/2014/0700/FL - Use of existing building to include the housing of livestock together with erection of extension for storage purposes and livestock housing at land on Little Field Lane, for Mr M Mullins, Peasholme Cottage, Lockton, Pickering, North , YO18 7PZ. Decision Refused as recommended. 2. NYM/2014/0761/CU - Change of use from storage building to retail (Use Class A1) (retrospective) at Millbry Hill Country Store, Road, , for Armstrong Richardson & Co Ltd, Mount Pleasant Way, Stokesley Business Park, Stokesley, , TS9 5NZ. Decision David Chance declared a personal interest in this item as a Member of Scarborough Borough Council (who objected to the application) and as the site falls within his County Division. David Hugill and Heather Moorhouse declared a personal interest in this item as they conduct a small amount of business with Armstrong, Richardson and Co Ltd. Approved as recommended with an additional condition as set out on the Members Update Sheet: 3. MISC00 Within two months of the date of this decision full details of the installation to generate energy on site from renewable sources to displace at least 10% of predicted CO2 emissions have been submitted to and approved by the Local Planning Authority. The approved details and measures shall then be completed within 8 months of the date of this decision and shall be maintained in working order unless the prior written agreement of the Local Planning Authority has been obtained. 3. NYM/2014/0755/FL – Conversion of outbuildings to form 2 no. dwellings at Low Farm, Bank Lane, for Miss Pauline Saddington, 36 Trinity Mews, Darlington, DL3 7XB. Decision Bryn Griffiths declared a personal interest in this item as the site falls within his County Division. David Hugill declared that he had been lobbied. Approved as recommended with an additional condition as set out on the Members Update Sheet and subject to the Director of Planning to clear an amendment to the condition relating to windows and additional conditions relating to domestic paraphernalia and hard landscaping: 15.
