The Essex Council (City of ) (Waiting, Loading and Parking Consolidation) (Variation No.34) Order 201*

The Essex in exercise of its powers under Sections 1(1), 2(1) to (3), 3(2), 4(1), 4(2), 32(1), 35(1), 45, 46, 49, 53 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 (“the Act”) and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Parts III and IV of Schedule 9 of the Act, hereby make the following Order:-

1. This Order shall come into operation for all purposes on the *********** day of ******* 201* and may be cited as The () (Waiting, Loading and Parking Consolidation) (Variation No.34) Order 201*.

2. In this Order –

“2002 Regulations” means the Traffic Signs Regulations and General Directions 2002;

"24 hour clearway”, means that part of B1137 Road, Springfield specified in Schedule B to this Order and includes the main carriageway, verge or footway, but excludes any lay-by or bus stop;

"footway, means a way comprised in a highway which also comprises a carriageway over which the public have a right on foot only;

"lay-by, means any area of road intended for use for the waiting of vehicles and lying at the side of the main carriageway and bounded partly by the outer edge of that carriageway on that side of the road;

"main carriageway, means any carriageway of the road used primarily by through traffic, includes any carriageway of a slip road, but excludes any lay-by;

"verge, means any part of a road which is not a main carriageway, footway or lay-by.

"bus" means (i) motor vehicles constructed or adapted to carry more than 8 passengers (exclusive of the driver), and (ii) local buses not so constructed or adapted

"local bus" has the same meaning as in the 2002 Regulations “bus stop” means any area of carriageway, intended for the waiting by buses, which is comprised within and indicated by road markings complying with either diagram 1025.1, 1025.3 or 1025.4 and incorporating the words “Bus Stop” in Schedule 6 to the 2002 Regulations

3. Save as provided in Article 4 of this Order no person shall, except upon the direction of or with the permission of a police officer in uniform or of a civil enforcement officer, cause or permit any vehicle to stop or to wait on the main carriageway, verge or footway comprised in the lengths of road specified in Schedule B to this Order.

4. Nothing in Article 3 of this Order shall apply-

(a) to render it unlawful to cause or permit a vehicle to stop or to wait on the main carriageway, verge or footway referred to therein, for so long as may be necessary to enable that vehicle to be used in connection with –

(i) any building, demolition or excavation operations,

(ii) the removal of any obstruction to traffic,

(iii) the maintenance, improvement or reconstruction of the road comprising the carriageway, verge or footway,

(iv) the laying, erection, inspection, maintenance, alteration, repair or cleaning of any sewer, main, pipe, conduit, wire, cable or other apparatus for the supply of gas, water, electricity or of any telecommunications apparatus as defined in Schedule 2 to the Telecommunications Act 1984, or

(b) in relation to a vehicle being used-

(i) for police , ambulance or fire and rescue authority purposes,

(ii) in the service of a local authority in pursuance of statutory powers or duties,

(iii) in the service of a water or sewerage undertaker within the meaning of the Water Industry Act 1991, or

(iv) as a bus or local bus stopping in a bus stop,

(c) in relation to a vehicle waiting when the person in control of it is-

(i) required by law to stop,

(ii) obliged to stop in order to avoid an accident, or

(iii) prevented from proceeding by circumstances outside his or her control.

5. With effect from the date set out in Article 1 of this Order, The Borough Council of Chelmsford (Waiting, Loading and Parking Consolidation) Order 2009, “the 2009 Consolidation Order” as varied shall have effect as though in Schedule 3 to that Order (“Waiting, Stopping, Loading and Unloading Restrictions”) –

(i) The references to those roads or parts of roads already in that Schedule and indicated in Schedule A to this Order were deleted and the references in Schedule A to this Order were substituted therefor; and (ii) The references to those or parts of roads not already included in that Schedule and indicated in Schedule A to this Order were inserted therein.

To introduce Waiting, Stopping, Loading and Unloading Restrictions

LOCATION RESTRICTION EXTENT B1137 No Waiting At Any NORTH WEST SIDE: from its junction with Colchester Time A130 White Hart Lane/A130 Colchester Road, Road in a generally south Springfield westerly direction for a distance of approximately 158 metres. SOUTH EAST SIDE: from its junction with the A130 White Hart Lane/A130 Colchester Road roundabout in a generally south westerly direction for approximately 80 metres. B1137 No Waiting Mon – Fri, SOUTH EAST SIDE: from a point Colchester 8am – 6pm approximately 80 metres from its junction Road, with A130 White Hart Lane/A130 Springfield Colchester Road roundabout in a generally south westerly direction for a distance of approximately 78 metres. Access Road No Waiting At Any BOTH SIDES: From its junction with B1137 leading to Time Colchester Road/Springfield Lyons Hedgerows Approach roundabout, in a generally north Business Park, westerly direction for approximately 18 Springfield metres.
