THE BATTLE ABOUT A SYMBOL by Orazio Z. Buttafuoco As amply reported by the Italian Mass Media over the last weeks, a battle has been raging over the pres- ence of the crucifix in Italian classrooms, and in Courtrooms. Christian Europe has been waging a campaign aimed at the ‘status quo’, i.e. to keep the symbol of the Christian faith where, as they say, legitimately belongs. Needless to say, the Vatican has been the most vocal in this campaign, which has become quite dreadful of late. A few years ago, an Italian Tribunal ruled that the crucifix did not belong inside a classroom. The rea- son of the Court’s ruling was plainly ‘constitutional’. The European Court meeting in Strasbourg had found that there was no legitimacy in the constitutional sense, for it conflicted also with the European Convention which had established the principle of human, equal rights of the individual. The European ‘Convention’, furthermore, doesn’t mention anything of relevance, and significance, of one reli- gion, but it recognizes the absolute importance of the parents’ rights to educate their children according to their conviction and religious freedom of the pupils. The European Court’s ruling underscores the fact that the school is a place where students’ diversity is real, thus not one single religion to have pre-eminence of choice. Therefore, the European Court clearly ruled against the presence of the crucifix in the classroom, for it simply intended to prevent disturbing situations among the non-Christian pupils. Therefore, the Court was making an attempt to pre-empt any emotions among students, of other religions, or even agnostics ones.
