Information collected for this Study and this Deposition is the sole property of the Mountain Cree (Asini Wachi Nehiyawak) Traditional Band. POSITION STATEMENT

The ASINI WACHI NEHIYAWAK (Mountain Cree) Traditional Band (AWNTB) accepts and adheres to the Supreme Court of Canada rulings pertaining to the rights and obligations of non-Treaty bands (Bands In Fact) as laid out in the Supreme Court Rulings and to the Consultation Process mandated by the Supreme Court as well as the Consultation, engagement and Community Capacity funding mandated the National Energy Board.

These mandated obligations include the

Duty to Consult Duty to mitigate damages Duty to compensate Duty to fund Community Development Duty to fund Capacity/Economic Development

The AWNTB is committed to positive, fruitful and mutually beneficial participation in the Consultation process as laid out in DELGAMUUKW insofar as it does not infringe on the rights of the AWNTB, as laid out in DELGAMUUKW, and is committed ot the principle of biparty discussion, negotiation and concesus in matters affecting the development within traditional AWNTB lands. We prefer to see this as a Partnership arrangement that is mutually beneficial.

ABORIGINAL INCLUSION: Community and Indigenous Engagement

On April 24th, 2017 Enbridge published it's Line 3 Replacement Program Community and Indigenous Engagement Aboriginal Construction Monitoring - Draft Plan (The Plan).

The ASINI WACHI NEHIYAEA/Bobtail Descendants Traditional Band (AWNTB) has been unilaterally excluded by Enbridge from this plan. This in spite of the fact that our historically affilial bands of the ASINI WACHI WI INIWAK/YE XA YA BINE division of the NEHIYAW-PWAT (Cree-Nakoda) Nation, who share a common history, the

Alexis Nakoda Sioux Nation Bearspaw First Nation Chiniki First Nation Enoch Cree Nation Louis Bull First Nation Paul First Nation Sapotaweyak Cree Nation and the related

Montana Cree Nation were included.

A. Duty To Consult

The Government of Canada is charged with the protection of aboriginal rigts, Cultural and Historic sites.

The Supreme Court rulings in DELGAMUUKW vs. laid down the base rulings laying out the Consultation process required in the Duty To Consult with aboriginal groups.

Among these obligations are the requirement that Developers and developments that involve ground distrubance MUST consult with and obtain the approval of such First Nationas/Aboriginal groups in who's traditional Lands such development is to be conducted. Natural Resources Canada (NRC) is charged with the protection of sites on Crown and Federal Lands. The National Energy Board (NEB) is charged by NRC with assuring that developments on such lands consult with and adhere to the rulings laid out in DELGAMUUKW vs. BRITISH COLUMBIA.

To this end the NEB has tasked the Enbridge Line 3 ("Enbridge") with Consulting with the Aboriginal parties/First Nations through who's traditional lands the Line 3 passes.

The ASINI WACHI NEHIYAWAK/Bobtail Descendants Traditional Band (AWNTB) has a documented history of Land Use in the Line 3 Right of Way (ROW) area dating back to before 1600 A.D.

AWNTB has detailed knowlege of the land use

and personal histories and Land Use Maps of hundreds of historic band members who are known to have been in that area and used that area.

AWNTB was a recognized Intervenor in the NEB hearings for the Line 3.

Enbridge was made aware of AWNTB knowlege and possession of this date.

Enbridge has not entered into any Consultation with AWNTB.

In failing to Consult with and obtain approval from AWNTB Enbridge is in contraven- tion of the legal requirements laid out in DELGAMUUKW.

As noted, the Government of Canada is tasked in DELGAMUUKW to guarantee that the legal requirements laid down in DELGAMUUKW are implemented. This task has been delegated to NRC and the NEB.

NRC/NEW have failed to insure that Enbridge fulfilled its legal requirements to AWNTB.

B. Duty To Employ

Among these DELGAMUUKW rulings is the ruling that developers MUST employ qualified aboriginals and aboriginal companies in suitable positions.

Enbridge did not employ qualified and trained aboriginal archaeologists in the HRA process.

In Alberta the ASSOCIATION OF FIRST NATION ARCHAEOLOGISTS AND HISTORIANS has 41 qualified members and 3 aboriginal groups who can supply qualified services to conduct Heritage Resources Studies (HRA) work.

Not one of these was employed or approached by Enbridge.

AWNTB/Heritage Consulting Archaeology Crew 1978

The AWNTB affiliate Heritage Consulting has the capacity to undertake archaeological, anthropological, sociological and community economic development studies. The principal owner of the firm has 45 years of archaeolgical research experience and an extensive publication record (Addenum 1), including a number of significant archaeological finds. Enbridge was aware of the AWNTB/Heritage Consulting capacity.

Heritage Consulting was never approached by Enbridge.

In failing to employ qualified aboriginal archaeologists and HRA researches and qualified aboriginal firms, such as Heritage Consulting, Enbridge is in contraraven- tion of the legal requirements laid out in DELGAMUUKW.

As noted, the Government of Canada is tasked in DELGAMUUKW to guarantee that the legal requirements laid down in DELGAMUUKW are implemented. This task has been delegated to NRC and the NEB.

NRC/NEW have failed to insure that Enbridge fulfilled its legal requirements to AWNTB.

Archaeological and HRA studies of western Canadian history is essentially the study of aboriginal/First Nations culture and history.

The engagement of Non-Natives (usually with no knowlege of local history and culture) to conduct HRA studies (and tell the Native community about their history and culture) is both Insulting and Colonialist.

C. Duty To Capacity, Community and Economic Development

Among these DELGAMUUKW rulings is the ruling that developers MUST engage with the affected First Nation/Aboriginal Group to engage in mutually agreed development.

AWNTB approached Enbrige with a proposal to increase and expand archaeolocigal/ HRA capacity in the AWNTB and affilial bands.

Enbridge did not engage with AWNTB with regards to Development.

D. HRA Research Failure

Enbridge did not, or did not insure that the consultants did a complete and compre- hensive background research of existing HRA information and research for their report. Rather, they relied solely on the simple expedient of information copying single-source data held by a government agency that has only a narrow mandate.

Furthermore, the Heritage Consulting maintains the largest historic Database has the most existing comprehensive existing files pertaining to western Canadian aboriginal history.

This resource is detailed at the Heritage Consulting/ASINI WACHI website www.inewhistory.com, which is independently ranked as the #1 AboriginalSite on the web and in the Top 10 Percentile of websites.

Enbridge was made aware of this and their consultants should have been aware of this resource.

Enbridge at no time accessed or referenced any of this data.

As a result, the TMX data has missed important aspects in the HRA and has not identified sites noted in these sources. Furthermore

Enbridge failed to employ or engage qualified aboriginals and/or aboriginal firms to conduct HRA studies of aboriginal culture and history.

In failing to employ qualified aboriginal archaeologists and HRA researches and qualified aboriginal firms, such as Heritage Consulting, Enbridge is in contraraven- tion of the legal requirements laid out in DELGAMUUKW.

Archaeological and HRA studies of western Canadian history is essentially the study of aboriginal/First Nations culture and history.

D. Field Studies Failure

By law, the Developer (Enbridge) is tasked with conducting archaeological/field studies of the proposed development ROW. Under DELGAMUUKW rulings these are to be conducted with aborignal contractors and to include aboriginals from the affected Aboriginal groups/First Nations for Ground Truth Verification.

AWBTB was not included either in the capacity of archaeologists, consultants or Ground Truth Monitoring.

This was a unilateral decision by Enbridge.

In Independent Ground Truth Verification studies conducted by AWNTB on other projects it has been found that the HRA studies done for Developers generally do not meet acceptable standards.

Independent Ground Truth Verification has been done by AWNTB for

30 km. of the Trans Mountain Pipeline ROW in Alberta 15 km. of the Trans Mountain Pipeline ROW in Jasper National Park Assessment of the Archaeologcial Sites FdOt-1, FdOt-9 and FdOt-10 at Hardisty Preliminary assessment of the ATCO EASTERN ALBERTA TRANSMISSION LINE Heritage Resources Inventory Assessment Report 11-049 Assessment of the South Burial Assessment of the North Bypass ROW Heritage Resources Study, Red Deer

Invariably these Independent Ground Truth Verification studies have found serious problems and deficiencies.

Based on the findings of the Independent Ground Truth Verification studies we can say that

- the Trans Mountain HRA did not identify or list the 74 Homestead (c. 1890-1920) Log Cabins and remains remains identified along the ROW in the 1973 inventory.

- the TMX HRA did not identify, list or record 80% of the sites along the ROW in Alberta from Edmonton to the British Columbia border.

- the estimated number of sites not identified or recorded number some 204 sites in addition to the missing Homestead sites.

- sites not reported include several significant sites including i. Height of Land Cultural Site

- the Hardisty Sites had serious errors in soil and depositional interpretation as a result of inadequate experience

- Preliminary assessment of the ATCO EASTERN ALBERTA TRANSMISSION LINE Heritage Resources Inventory Assessment indicated that there were substanti- ally fewer sites reported than would have been the statistical norm for the area.

- Interpretation of the South Edmonton Burial was completely wrong and subject to continual revision in response to our specific questions, with the ultimate acceptance of the Heritage Consulting interpretation as accurate.

- the Assessment of the Red Deer North Bypass ROW HRA found that 70% of the sites were not reported, including i. A spring hunting site dating to ca. 1812 or earlier, including recovery of a dateable gunflint requirinf further mitigation. ii. failure to record a Grandfather Tree site iii. failure to record a Sacred Grove iv. failure to record a buried site showing evidence of an ancient buffalo kill requiring further mitigation v. failure to record a campsite requiring further mitigation

Furthermore, as noted above

AWNTB and Heritage Consulting has considerable knowlege of the history, archaeo- logical sites, historic sites and cultural sites in the Enbridge ROW area (see also map, above).

Furthermore

The Enbridge ROW lies along what has been archaeologically and historically identified as the Battle River-Souris River Corridor, which has a documented archaeological use since 3,000 B.C., first identified by this author and published in

2013 ALBERTA ARCHAEOLOGY: CONTRIBUTIONS; First Nations Publishing (with forthcoming publication in ARCHAEOLOGY and CANADIAN GEOGRAPHIC magazines).

Enbridge and/or their Consultants did not consult with AWNTB about AWNTB knowlege of the Enbridge ROW.

In view of these demonstratable failures of these HRA consultation studies and the failure of Enbridge to use or include the AWNTB and/or qualified aboriginal archaeologists, AWNTB can not endorse, support or approve the project.

E. Environmental Studies

AWNTB was not included in the Environmental Studies. However, given the problems that AWNTB found in HRA studies we can not have confidence Enbridge Environmental studies were any more complete or comprehensive.

Enbridge and/or their Consultants did not consult with AWNTB about AWNTB knowlege of the Enbridge ROW.

In view of these demonstratable failures of these HRA consultation studies and the failure of Enbridge to use or include the AWNTB and/or qualified aboriginal archaeologists, AWNTB can not endorse, support or approve the project.

SUMMARY

AWNTB has been unilaterally excluded from the Consultation Process and from the Construction Monitoring Plan by Enbridge.

This is in contravention of the DELGAMUUKW rulings. The reason stated to us by Enbridge is that AWNTB is not an " Band" and/ or unincorporated organization.

This is in contravention of the DELGAMUUKW rulings. This in spite of AWNTB indicating that AWNTB would be amenable to adopting a reporting process suitable to Enbridge.

The DELGAMUUKW rulings recognize the existence of two kinds of First Nations Bands in Canada

- Indian Act Bands: Bands/Nations that have signed a Treaty with Canada and fall under the Department of Indian Affairs regulation, including the Indian Act.

- Bands In Fact: Bands/Nations who have not signed a Treaty with Canada, who have a historic continuety from pre-Treaty times and remain a Sovereign Nation with a recognized history and structure.

DELGAMUUKW has laid out the legal requirements to be considered as a Band In Fact. AWNTB has met these requirements.

DELGAMUUKW recognizes that both types of bands have Equal rights and legal status excepting that Bands In Fact do not have the benefits or obligations incurred under Treaty by Indian Act Bands.

These rights are delineated in a number of Supreme Court rulings (Addenum 2).

DELGAMUUKW affirms that Bands In Fact fall under the Consultation rulings in the same manner as Indian Act Bands.

Enbridge has failed to enter include the AWNTB in the Consultation Process in contravention of the DELGAMUUK legal requirements.

As noted, the Government of Canada is tasked in DELGAMUUKW to guarantee that the legal requirements laid down in DELGAMUUKW are implemented. This task has been delegated to NRC and the NEB.

NRC/NEW have failed to insure that Enbridge fulfilled its legal requirements to AWNTB.

AWNTB noted that Enbridge initially began to engage with AWNTB in a Consultation process, including agreement to fund certain HRA work to document AWNTB history in the ROW area. In return Enbgridge requested that AWNTB sign a letter supplied by Enbridge indicating an blanket statement of unconditional support for the Line 3 project.

When AWNTB refused to sign this letter of unconditional support Enbridge withdrew it's support and Consultation engagement. Such action has all he hallmarks of attempts to pressure AWNTB into support without any guarantee from Enbridge about future inclusion of AWNTB.

AWNTB further notes that in it's submission to the NEB Enbridge stated that it intended to include AWNTB in the Monitoring process.

Enbridge has failed to follow though on this inclusion promissed in the NEB filing.

Furthermore,

Given the problems and deficiencies that AWNTB found in HRA work done, the exclusion of the AWNTB in Verification, and the resultant questions regarding the quality of other mandated requirements Enbridge is subject to, AWNTB can not support Line 3 until such time as these issues are addressed and corrected.

AWNTB recommends that these issues be addressed before Enbridge constuction continues. ADDENUM 1: Significant Publications
