Dear Mr. Chairman:

This letter is a follow-up to the President's letter to Senator Baker and Speaker O'Neill of March 29, indicating his concern that House and Senate conferees considering legislation to amend the Export Administration Act (EAA) , achieve a balance between national security and exporting interests.

In recent weeks, the conferees have sought to negotiate a compromise which, among other matters, delineates the roles of the Departments of Commerce, Defense and Treasury in the implementation of the EAA. The specific issue of DOD licensing review and export control enforcement was considered personally by the President, as recently as March 1984, at which time he issued an interagency directive. The President administratively defined responsibilities and authorities while indicating his opposition to the inclusion of any statutory change in authorities in the pending EAA legisla­ tion. In reaching deci~ions on these issues, the President indicated that he views with great concern efforts to curtail Presidential authority and discretion in the management and administration of export controls.

Another concern in the proposed compromise is the provisions on national security import controls. Under this proposal, the U.S could control imports of goods from violators of COCOM regulations if a majority of COCOM concurred. This provision could serve to undercut the consensual nature of COCOM, as well as raise troubling extraterritorial problems. The President continues to oppose authority for import controls against violators of COCOM regulations. - 2 -

The President stands by these decisions. We respectfully request that the Congress give due consideration to the Administration's views on this matter.

Thank you for the statement. As you asked me last Friday to advise you of any changes I felt necessary, I made bold to do so. Specifically, I request consideration of the following modifications in the section headed "Policy Objectives."

Number one, amend the beginning of the last sentence of the fourth paragraph to read as follows (added language underscored) :

"The U.S. will also call for concrete assurances

that the UNFBA is not engaged in, or does not

provide funding for, abortion or coercive family

planning programs ... "

Number two, amend the fifth paragraph to read as follows

(new language underscored) :

"In addition, when efforts to lower population

growth are deemed advisable, U.S. policy considers

it imperative that such efforts respect the religious

beliefs and culture of each society, and the right

of couples to determine the size of their own

families. Accordingly, the U.S. will not provide

family planning funds to any nation which engages in

coercion to achieve population growth objectives." 2

If these changes are acceptable and assuming an appropri­ ate delegation and staffing, I will be pleased to head the ' delegation to Mexico City. Again, I must emphasize that time is very short.

Dear Jesse:

Thank you for your letter to the President concerning your meeting with Ambassador Dobrynin about participation by the U.S.S.R. in the Summer Olympic Games and for our telephone conversation regarding this matter. We are pleased that a bipartisan cross section of Congresspersons, athletes and distinguished citizens will appeal to the Soviet represen­ tatives on the International Olympic Committee to reconsider their decision. We all wish you well in this endeavor, and hope that you are successful because the Soviet withdrawal from the games is a great disappointment to our athletes and many others throughout the world.

As you know, the matter of participation in the Olympic Games has not been a government to government matter but, rather, a matter conducted by the International Olympic Committee, and its private sector representatives. Your bipartisan group would be private sector in nature and this is as it should be.

I can assure you, however, that this matter has received considerable attention from the U.S. Government in the past, and that we have given the Soviets extensive assurances regarding the safety of their athletes and the conditions under which they would participate. In this connection, you should know that the President has personally and publicly assured the International Olympic Committee that the has lived and will live up to the Olympic Charter. The assurances have been repeated publicly and privately to the Soviets. Further, the United States Government has taken the following actions:

Authorized at least 25 Aerof lot charter flights for the Olympics.

-- Assured the Soviets by diplomatic note and privately that, as agreed by the IOC, all Olympic participants could enter the U.S. on the basis of their Olympic identity cards without visas.

-- Authorized a month-long port call for a Soviet cruise ship to serve as their Olympics headquarters. Assured Soviets privately that after initial customs and safety inspection, subsequent searches of ship would be only for cause (e.g., bomb threats) and not for purpose of harassment. - 2 -

-- Authorized entry of Aerof lot and shipping personnel in advance of games to do preparatory work.

-- Indicated our willingness to receive an Olympic attache with full diplomatic status (but not the individual originally proposed) .

-- Informed them we would be ready to rent vehicles (normally prohibited) to Soviet officials during the Olympics.

-- Told the Soviets publicly and privately that emigre groups opposing Soviet participation, organizing demonstrations or inciting defections have no USG sanction whatsoever.

-- Opened all areas containing Olympic sites, hotels, airports, etc. to Soviet travel from June 1 - August 15.

-- Undertook full responsibility for security of the Soviet ship, at a preliminarily estimated cost in excess of $500,000

-- Told the Soviets privately that every possible security precaution was being undertaken.

In addition, security preparations to protect Olympic partici­ pants have been underway for a long time and have been extra­ ordinary in their scope. Over 17,000 people will have Olympic security-related duties in Los Angeles. The United States Government has committed $50 million to provide federal support for the Olympic security effort~

We have also taken some specific steps to meet Soviet concerns. As mentioned, the United States Government assumed full responsibility for security for the Soviet ship and had planned to spend in excess of $500,000 for this purpose. No demonstrations would have been permitted in the vicinity of the pier where the Soviet ship would have berthed.

The Los Angeles Olympic Organizing Committee (LAOOC) has also been very responsive to Soviet concerns about security issues. During the visit of the Soviet sports committee delegation to Los Angeles in December 1983 , the delegation did not express any dissatisfaction with the security arrangements. LAOOC informed the Soviets that there would be no demonstrations in facilities under LAOOC control, including all sites and the Olympic Village. - 3 -

Under the circumstances, I think you will agree with me that we have been most forthcoming in trying to meet the concerns of the Soviets.

You have all of our best wishes for success. If those involved in this bipartisan effort are successful in securing Soviet participation in the Games, our country will owe them a debt of gratitude. If there is anything further that we can do to assist in this, please do not hesitate to let us know.

Both Jack and Joanne Kemp have contacted me regarding the April 2 - 5 conference that the Congressional Wives for Soviet Jewry are hosting for parliamentary spouses from approximately six different countries.

I have run the attached correspondence by Bud McFarlane and his NSC office. Bud has advised that it is not necessary for the President to drop-by, but that it would be "entirely appropriate and usefql" for Mrs. Reagan to consider this request.

Would you please review this invitation and ask Mrs. Reagan to "take a look at it"? I would appreciate ~our letting me know what the final determination is.

Thank you for your recent letter and please forgive my delay in responding. I enjoyed hearing your news from Texas and hope that your speech in Dallas went well.

Your question about the White House Fellows Program is easily answered. There has been no change in policy here toward this program. There has been an effort to remind Assistants to the President to stay within their personnel ceilings. This includes not only their permanent, full-time staff positions, but also any detailees. White House Fellows billeted in another department would fall into this detailee category.

This emphasis on maintaining personnel ceilings certainly has not focused on the White House Fellows Program, but neither does it exempt them from the strict ceilings. I hope you will explain this to your fellow commissioners.

I just learned that you have been ill and wanted to send off a quick note to let you know that I am thinking of you. I hope that your recovery will be a speedy one.

As you may have heard, I have not been in the good graces of your fine Commonwealth of late. Unfortunately my comment about a "Communist country" was taken out of context. I thought that you might enjoy seeing the attached copy of my letter to Mike Dukakis .
