The Board of County Commissioners met this day at 8:30 a.m. in Regular Session with all Commissioners present. The meeting opened with the Pledge of Allegiance.

Approval of Agenda

Commissioner Thoman requested to amend the agenda by removing pre-decisional under executive session. Commissioner Smith requested to amend the agenda by adding a resolution supporting passenger rail expansion in the greater northwest. Chairman Wendling entertained a motion to approve the agenda as amended. Commissioner Smith so moved. Commissioner Lloyd seconded the motion. The motion carried.

Federal Aviation Administration Airport Improvement Program Grant Agreement AIP-44 Airport Director Devon Brubaker presented and requested approval of the Federal Aviation Administration Airport Improvement Program Grant Agreement AIP-44. Following discussion, Commissioner Thoman moved to approve the signing of the proposal as presented and authorize the Chairman to sign. Commissioner Lloyd seconded the motion. The motion carried.

Publication of Name, Position, Base Annual Salary of and Amount of Overtime Pay Paid to Each Full-Time County Employee and Each Elected Official Due to being ahead of schedule, County Clerk Cindy Lane presented the Sweetwater County, Wyoming Public Salary Disclosure pursuant to Wyoming State Statute 18-3-516 (b). Following discussion, Commissioner Schoenfeld moved to approve the publication as presented to be published in the Green River Star. Commissioner Smith seconded the motion. The motion carried.

Resolution Supporting Sweetwater County as Future Location for Natrium Reactor Project Due to being ahead of schedule, Planning & Zoning Director Eric Bingham presented, and read aloud, Resolution 21-08-CC-01, Support of the Natrium Reactor Project in Sweetwater County. Following discussion, Commissioner Schoenfeld moved to approve. Commissioner Thoman seconded the motion. The motion carried.

RESOLUTION 21-08-CC-01 SUPPORT OF NATRIUM REACTOR PROJECT IN SWEETWATER COUNTY

WHEREAS, Rocky Mountain Power and TerraPower have announced Wyoming as a future location of an innovative advanced nuclear reactor facility to replace an existing coal-fired plant named the Natrium Reactor Project which will provide a technology that is one of the fastest and lowest-cost paths to provide world changing advanced clean energy;

WHEREAS, Rocky Mountain Power has announced the location of four different retiring coal fire power plants, which includes our existing Jim Bridger Power Plant as a potential site for the proposed Natrium project which would allow for mitigation and diversification rather than retirement;

WHEREAS, Sweetwater County has engaged with local leaders, legislators, stakeholders, community partners, local business owners, educators whom expressed overwhelming support for the Natrium Project;

WHEREAS, On July 7, 2021, the Sweetwater County Board of County Commissioners wrote a letter of support for the Natrium Reactor Project with a proposal that highlighted the Sweetwater County’s greatest amenities, facilities, quality of life and workforce along with letters of support from local legislators, municipalities, airport, chambers, bus service providers, school districts, college, and enterprise committee;

WHEREAS, Sweetwater County Board of County Commissioners believe that Sweetwater County offers a qualified and well- trained workforce, extraordinary quality of life, housing, recreation, K-12 education, arts and culture, family activities along with immense opportunities for its residents and potential workforce to live, work and play;

WHEREAS, Sweetwater County has Western Wyoming College that is a hub for workforce and economic development with a number of signature programs that fall within the division of Manufacturing and Industrial Technology, which will provide workforce needs for the Natrium project including retraining of existing plant employees and development of programs to support future nuclear technology jobs;

WHEREAS, Sweetwater County also offers the necessary infrastructure to support your project, which includes transportation infrastructure such as Interstate 80, , a rapidly growing commercial airport, and a robust fiber backbone that continues to expand;

WHEREAS, Sweetwater County has shown continued support of the extractive industry through continuous upgrades to road infrastructure, Memorandum of Understanding to assist with roadway maintenance assistance and financial assistance to extraction industry through industrial revenue bonds;

NOW THEREFORE BE IT RESOLVED the Sweetwater County Board of County Commissioners support the placement of the future advanced nuclear facility in Sweetwater County.

Acceptance of the FY2020 Assistance to Firefighters Grant Award Grants Manager Krisena Marchal and Fire Warden Mike Bournazian presented the FY2020 Assistance to Firefighters Grant Award. Following discussion, Commissioner Schoenfeld moved to accept the Fiscal Year 2020 Assistance to Firefighters Grant Award as presented. Commissioner Smith seconded the motion. The motion carried.

Request to Restaff Vacant Position in the Facilities/Custodial Department Public Works Director Gene Legerski and Human Resource Specialist Brenda Rael presented the request to restaff a vacant custodian position. Following discussion, Commissioner Smith moved to approve the request to restaff the position in custodial immediately. Commissioner Schoenfeld seconded the motion. The motion carried.

Subordination and Relocation Agreement with Dominion Energy Public Works Director Gene Legerski presented the Subordination and Relocation Agreement with Dominion Energy Utah. Following discussion, Commissioner Schoenfeld moved to approve and accept the Subordination and Relocation Agreement with Questar Gas Company dba Dominion Energy Utah. Commissioner Lloyd seconded the motion. The motion carried.

Donation of Culvert to the Gateway Trails System Public Works Director Gene Legerski presented the request to donate a culvert to the Gateway Trail System. Following discussion, Commissioner Smith moved to approve the donation of the culvert to the Gateway Trails system. Commissioner Schoenfeld seconded the motion. The motion carried.

RESOLUTION 21-08-CC-02 A RESOLUTION SUPPORTING PASSENGER RAIL EXPANSION IN THE GREATER NORTHWEST

WHEREAS, much of rural America is underserved by long-distance intercity passenger rail options, and ’s recent service announcement and accompanying ConnectUs plan service map fails to recognize that shortcoming and bring passenger rail service to long-overlooked communities in much of rural America, including the Greater Northwest, defined as , , , Utah, , Wyoming, , , , and portions of and ; and

WHEREAS, for many years, Americans living in the Greater Northwest have not had good access to passenger rail services;

and

WHEREAS, the lack of rail service, loss of air service at smaller airports in the region, and significant economic impact intercity passenger rail service can provide has fueled interest at the local, county, and state level in the Greater Northwest region to join forces to find innovative ways to move our people; and

WHEREAS, Long-distance passenger routes are ideal for connecting major urban areas with each other and with smaller cities and communities—many in rural areas—which are becoming more isolated as regional airline and intercity bus services disappear; and

WHEREAS, passenger rail has multiple service capabilities that airlines cannot match, a single rail line can simultaneously serve local, regional, and long-distance travel needs safely transporting some passengers long distances while carrying local passengers to work, medical providers, or social events; and

WHEREAS, passenger rail serves a variety of travelers needs in places where other modes of travel are not available or less convenient including those travelers who cannot drive, prefer not to drive in inclement weather or otherwise prefer the choice of rail travel; and

WHEREAS, passenger rail provides multiple environmental benefits as one of the greenest modes of ground transportation. According to the 2019 U.S. Department of Energy Data Book, travel by Amtrak train is 47 percent more energy efficient than traveling by car and 33 percent more energy efficient than domestic air travel; and

WHEREAS, in 2008, Congress directed Amtrak to review several routes across the Greater Northwest as part of the Railroad Safety Enhancement Act of 2008 and that study proposed restoring the line from Portland through Boise to and the North Coast line serving Montana and North Dakota, yet the Pioneer and Hiawatha Lines were not restored; and

WHEREAS, President Biden has expressed interest in “sparking the second great railroad revolution.”

WHEREAS, railway investment can spur economic growth by inducing travel and tourism spending; and

WHEREAS, expanding rail infrastructure can promote economic opportunity by fostering a business environment that attracts investment and creates jobs;

NOW THEREFORE BE IT RESOLVED by the Sweetwater County Board of County Commissioners:

Section 1. To support restoration of daily Amtrak passenger rail service on the Pioneer route from Portland to Salt Lake City through Boise and other cities in Idaho and eastern Oregon and the route serving Montana and southern North Dakota and connecting in Idaho to the Pioneer and routes by:

a. Advocating to a bipartisan group in Congress representing this region to work toward restoring passenger rail service to the Greater Northwest b. Requesting passage of legislation in the 117th Congress that direct the Secretary of Transportation to study discontinued long-distance Amtrak routes and determine if they should be restored to the national system. c. Supporting passage of the Interstate Rail Compacts Advancement Act of 2021 by the 117th Congress, which authorizes the formation of up to ten Interstate Passenger Rail Compacts/Commissions, modeled after the Southern Rail Commission, to carry the Secretary’s studies forward to implementation. d. Supporting congressionally authorized funding sufficient to restore and revitalize passenger rail service in the United States for rural long-distance routes through a combination of reinvestment in existing long-distance routes and expansion of the national rural long-distance network to include restoration of both the Pioneer and North Coast Hiawatha routes.

Section 2. The Wyoming Department of Transportation, the Governor’s Office, the Wyoming Legislature and other state and county agencies work together to evaluate expanded rail infrastructure in Wyoming.

Section 3. That this Resolution shall be in full force and effect immediately upon its adoption and approval. Dated this 17th day of August, 2021.

Maintenance Agreement for Clearview Acres Improvement District Streets/Roads Due to no representative being present, Chairman Wendling entertained a motion to postpone until a future date when Clearview Improvement District wishes to get back onto the agenda. Commissioner Lloyd so moved. Commissioner Schoenfeld seconded the motion. Following discussion relative to the history of the roads received from Public Works Director Gene Legerski and Chairman Wendling requesting Deputy County Attorney John DeLeon to review all the history regarding Clearview Acres to allow the Commission to be prepared, the motion carried.

Chairman Wendling called for a twenty-minute break.

Update for Western States and Tribal Nations Natural Gas Initiative Western States and Tribal Nations Natural Gas Initiative President Andrew Browning provided a PowerPoint Presentation sharing that Western States and Tribal Nations is led by sovereign tribal nations and is focused on creating rural economic development, advancing tribal self-determination, and reducing global emissions through the export of clean natural gas from western North American Basins to international markets. Following discussion, the Commission expressed appreciation to Mr. Browning for the presentation. Discussion ensured relative to the Commission entering into an annual agreement with the Western States and Tribal Nations Natural Gas Initiative in the amount of $5,000.00. Commissioner Thoman moved to support the Western Tribal Nations with dues in the amount of $5,000 annually. Commissioner Schoenfeld seconded the motion. The motion carried with Commissioner Lloyd voting in opposition.

Commissioner Comments/Reports

Commissioner Thoman Commissioner Thoman expressed appreciation to all involved in providing a great fair. Commissioner Thoman reported on the meetings she attended for the collaborative initiative and the Airport Board. Commissioner Thoman expressed that she is planning a meeting for the Sublette Mule Deer Corridor.

Commissioner Lloyd Commissioner Lloyd expressed appreciation to all involved in providing a great fair. Commissioner Lloyd expressed appreciation to Airport Director Devon Brubaker for the efforts made on the projects being done at the airport. Commissioner Lloyd reported on the meetings he attended for the Library Board, Conservation District, and the Tripartite Board. Commissioner Lloyd shared that he met with Grants Manager Krisena Marchal, Public Works Director Gene Legerski, Human Resource Director Garry McLean, Planning & Zoning Director Eric Bingham, and several elected officials. Commissioner Lloyd shared that the strategic meetings will be held during the first Tuesday of each month. Commissioner Lloyd apologized for making an unnecessary comment during the appointment process.

Chairman Wendling Chairman Wendling shared that Planning and Zoning Director Eric Bingham sent an email providing pictures of the Gateway Trail System. Chairman Wendling shared the agenda for the upcoming Intergovernmental Meeting. Chairman Wendling expressed appreciation to all involved for providing a great fair. Chairman Wendling reported on the meeting he attended with the City of Rock Springs relative to putting together a storm sewer study group and requested that Commissioner Schoenfeld be the lead on that committee and he would be the co-lead.

Commissioner Smith Commissioner Smith read aloud the Public Works report. Commissioner Smith reported on the meeting he attended for Memorial Hospital of Sweetwater County.

Commissioner Schoenfeld Commissioner Schoenfeld reported on the meetings she attended for the Next-Gen workshop and STAR Transit. Commissioner Schoenfeld read aloud the SEDC report. Commissioner Schoenfeld expressed appreciation to all involved in providing a great fair.

Executive Session

Chairman Wendling entertained a motion to enter into an executive session for legal and personnel. Commissioner Schoenfeld so moved. Commissioner Lloyd seconded the motion. The motion carried.

After coming out of the executive session, Chairman Wendling explained that no action was required.

Chairman Wendling explained that the Board of County Commissioners will hold a budget workshop at 1:00 p.m.
