The activity report of the Subcommittee on Human Rights (DROI) before you is a concise stock- taking exercise considering the 7th parliamentary term (2009-2014) and highlighting to what extent DROI has succeeded in advancing the EU's human rights policy. It is divided into two parts: the first part is a presentation of the main horizontal aspects dealt with in DROI and as endorsed by the DROI Enlarged Bureau at its last meeting on 20 March 2014. The second part is composed of nine annexes which include the main statistical data for the above-mentioned period such as the number of reports, delegations, guest speakers etc.

During the 7th parliamentary term, the focus has been by and large on implementing the provisions of the Lisbon Treaty and its new institutional architecture, and on contributing to the mainstreaming of human rights issues into all aspects of the EU’s external relations. The Subcommittee has done so by, inter alia, promoting guidelines for all the EP's Interparliamentary Delegations with third countries which foresee the raising of human rights issues by Members when on delegation visits.

As part of its scrutinizing role DROI has vigorously monitored the EU Strategic Framework on Human Rights and Democracy, and, more specifically, the EU Action Plan on Human Rights and Democracy by organising consultations ahead of the formal adoption of new EU Guidelines on, for example, the protection and promotion of LGBTI rights and on freedom of expression online and offline. DROI fully intends to strengthen this scrutinizing role in the 8th legislature.

At the end of 2011, DROI’s capacities were strengthened through its being granted the status of DROI+ whereby it has the right to draw up three own-initiative reports simultaneously, to invite a greater number of paid guests to its hearings, and to commission a larger number of studies.

Over the last five years, besides the four Annual Reports on Human Rights, the Subcommittee has drafted nine reports which, after adoption in plenary, represents the official position of Parliament. The topics range from democratization to protecting human rights defenders, to the impact of the economic crisis on human rights, as well as an in-depth exploration of the links between corruption and human rights.

The report before you is intended as a useful point of reference (and a helpful starting point) for the work of the forthcoming Subcommittee on Human Rights during the 8th parliamentary term of the European Parliament.

Since 2009, the Subcommittee on Human Rights (DROI) has seen its work and its impact increase with significant achievements in some key working areas. Below is a summary of the main attainments.

1. Reinforcing Human Rights policies after the Lisbon Treaty

In 2011 DROI was upgraded to what is known as “DROI+”. This upgrading has tripled the number of own-initiative reports that the Subcommittee is authorised to draw up at any one time (from 1 to 3).

DROI has also seen the amount of funding allocated for it to commission studies increased as well as the number of paid experts for hearings doubled (from 6 to 12). While welcoming the increased number of reports, hearings and studies, the DROI coordinators have stressed they would welcome greater follow-up to be given to relevant recommendations contained in some of the studies and the allocation of more time to hearings and speaking time for guest presentations in hearings and exchanges of views.

2012 was a watershed year for EU human rights policy. The EU revamped its human rights policy and put it on a new three pillar foundation through the adoption of the ‘human rights package’ on 25 June 2012. The package consisted of the EU Strategic Framework, a comprehensive EU Action Plan on Human Rights and Democracy (valid until the end of 2014) and the appointment of an EU Special Representative for Human Rights. These developments came about partly as a result of calls from Parliament for the EU to review and strengthen its action in the field.

Relations with the EEAS

One of the notable points of DROI’s evolution during the 7th legislature was the development of cooperation between DROI and the European External Action Service (EEAS). In 2012 DROI made a significant contribution to the drafting of the Strategic Framework on Human Rights and Democracy, adopted by the Council in June 2012. It also substantially contributed to the drafting of the EU Guidelines on Freedom of Religion and Belief (FoRB), on the rights of LBGTI persons, and on Freedom of Expression.

The Action Plan is regularly monitored through a ”Contact Group” specifically designed as a tool for DROI Members and the EEAS to discuss the implementation of the activities provided for in the action plan, as well as to raise any other issues of mutual interest.

Another success was the establishment and appointment of a European Union Special Representative for Human Rights (EUSR). DROI had called for the creation of this role both in some of its annual reports and in its interactions with the EEAS.

DROI had also repeatedly called on the EEAS to set up human rights focal points in all EU Delegations and to identify human rights defender liaison officers in all third countries. This process is now close to Stavros Lambrinidis completion. EU Special Rapresentative on Human Rights

Relations with other EP committees and inter-parliamentary delegations

As one of the two Subcommittees under AFET, DROI enjoys a close working relationship with its “parent” committee AFET. The Chair of DROI is a member of the Enlarged Bureau of AFET, and DROI-led reports are voted on in AFET prior to their adoption in the plenary. Equally, human rights issues are also debated in AFET meetings when the Committee deals with parliamentary reports on EU foreign policy or with different types of international agreements which include human rights clauses.

During the 7th legislature DROI reinforced its cooperation with other EP committees, in particular with the SEDE1, DEVE and FEMM Committees. DROI also developed very good relations and furthered its cooperation with the LIBE Committee on several dossiers. However, cooperation with the INTA Committee has not developed as significantly as it should have, and further efforts will be needed during the forthcoming legislature. Finally, DROI strengthened its cooperation with the inter-parliamentary delegations by, for example, holding meetings in association with relevant inter-parliamentary delegations or having the DROI Chair accompany a delegation on a country visit, such as was the case with a mission to Burma/Myanmar in 2012. In terms of practical arrangements, the fact that meetings or hearings in different committees or delegations, including the "parent" committee AFET, sometimes overlapped with those held by DROI made full participation by all relevant MEPs more difficult on occasion.

Relations with National Parliaments

DROI has continued to strengthen its relations with national parliaments. Two inter- parliamentary meetings took place during the 7th legislature, one on human rights conditionality, held on 11 October 2011 jointly with the Committee on Development (DEVE), and the other on the implementation of the Human Rights Action Plan with a focus on internal/external coherence, on 25 September 2013, held jointly with the Committees on DROI inter-parliamentary committee meeting Foreign Affairs (AFET) and Civil Liberties, Justice 25 September 2013 and Home Affairs (LIBE). Both meetings were very well received by the national parliamentarians who participated and contributed to reinforcing the links the European Parliament and national parliaments.

DROI has worked to deepen its engagement with national Ombudsmen and national human rights institutions, including the European Group of National Human Rights Institutions, with frequent exchange of views with invited representatives.

The Subcommittee maintains close working relations with civil society, especially human rights NGOs, whose representatives regularly participate in DROI hearings. The Enlarged Bureau of the Subcommittee has also held meetings with the Brussels-based Human Rights and Democracy Network (HRDN) and DROI Members also participate regularly in EU NGO human rights forum events.

2. Some key working areas

Annual Reports on human rights and democracy in the world

The annual report on human rights and democracy in the world which DROI drafts in response to the EU report adopted by the Council is usually adopted in plenary in December. This report has continued to represent the primary tool at our disposal for scrutiny of the EU’s human rights policy, including the implementation of the strategic framework and the action plan. Overall, these annual reports form the backbone of our work on human rights and, while they respond to the annual EU reports, they have an important role to play in their own right as forward-looking reports on EU human rights policy from Parliament’s perspective. Over the course of the legislature, the annual reports have raised ambitious policy goals for the future, several of which have also been

CM\1032965EN.doc 9/127 PE536.033v03-00 EN European Parliament Subcommittee on Human Rights Activity Report – 7th parliamentary term, 2009-2014 ______realised, such as the adoption of the EU human rights strategy, the establishment of the mandate of the EU Special Representative, the creation of a specific human rights directorate inside the EEAS, the setting-up of the Brussels-based Council Working Group on human rights (COHOM), and the creation of a network of human rights focal points in the EU Delegations around the world. Parliament has also used its annual reports to draw attention to problematic or new and emerging issues, such as the need to coordinate EU and EU Member State policies at the United Nations. Equally imperative is the need to enhance EU support for human rights defenders as well as to respond adequately to the human rights challenges presented by the Internet and other new information and communication technologies. Parliament's annual reports have also addressed the challenges facing the EU’s policy-makers when responding to the dramatic uprisings in the EU's neighbourhood and to the consolidation of human rights and democracy principles in the potential enlargement countries.

Urgency resolutions

In its monthly plenary part-sessions in Strasbourg, in line with on-going practice, the European Parliament adopted up to three topical resolutions on cases of breaches of human rights, democracy and the rule of law. These so-called “urgency resolutions” were political responses to acute human rights crises around the world. The adoption of an urgency resolution is always accompanied by a dedicated plenary debate involving a direct response by a Member of the European Commission regarding the action required by the EU institutions. On average, approximately 26 urgency resolutions were adopted each year during the 7th legislature. Parliament’s rules allow for their quick adoption without the normal committee procedure in order to make a prompt political reaction possible. While DROI was therefore not directly involved in the preparation of the urgency resolutions, the relevant issues were often raised in DROI to follow up on the resolutions.

Sport and Human Rights

In February 2014 the Subcommittee on Human Rights organised a major hearing on sport and human rights focussing on the situation of migrant workers in Qatar, with the participation of high- level representatives from the sport’s governing body FIFA, the International Labour Organisation, the International Trade Union Confederation and other stakeholders. The hearing allowed the European Parliament to engage in a critical and constructive fashion with the key interlocutors, and to hold the EU Institutions to account regarding the EU's approach to the situation in Qatar as well as to other major sporting events. The hearing was linked to an urgency resolution (Rule 135, former Rule 122) adopted at the November 2013 plenary session on the situation of migrant workers in Qatar. The Conference of Presidents also authorised an ad hoc delegation to Qatar, which took place in March 2014 and in which the Chair of DROI participated.

In the DROI report on EU policies in favour of human rights defenders (HRDs), adopted in plenary in June 2010, Parliament pays tribute to the invaluable contribution human rights defenders make to the protection and promotion of human rights all over the world; it also calls on the EU to give greater priority to a more effective implementation of the existing tools and mechanisms in order to better and more systematically protect human rights defenders within the European Union. The report stresses that the promotion of human rights is both a basic value and an objective of the Union’s foreign policy. It also calls for practical measures such as emergency visas and temporary protection/shelter in Europe for HRDs and their families.

Business and Human Rights/Corporate Social Responsibility

Regarding the external policy aspect of Corporate Social Responsibility (CSR), the Subcommittee on Human Rights drafted an opinion to two EP own-initiative reports by other committees (EMPL and JURI) which were adopted in response to the Commission Communication on a renewed CSR Strategy. To feed into the drafting of these resolutions, the Subcommittee organised an expert hearing on business and human rights in September 2012.

Recommendations made in the two reports included a proposal for increased, more inclusive and more transparent monitoring of CSR principles in EU trade policy, with the setting of clear benchmarks in order to measure improvements; and a proposal for a system of trans-national legal cooperation to be set up between the EU and third-country signatories to bilateral trade agreements in order to ensure that victims of failures to respect CSR have effective access to justice in the country where the infringement took place. The two EP committees also voiced support for the establishment of international judicial procedures to ensure that, where necessary, breaches of the law by companies are punished. They tasked the Commission to undertake a series of actions. The EU, in its dealings with third countries, should ensure adequate awareness and capacity- building at the level of host country governments in order to guarantee effective implementation of CSR principles.

United Nations

DROI has a well-established “tradition” of sending two delegations to the UN each year. The first one is normally to the March session of the UN Human Rights Council (HRC) in Geneva, and it is preceded by a European Parliament resolution detailing the current human rights priorities for the EP. The second is to the EP delegation meeting UN SG Ban Ki-moon autumn session of the United Nations General

These delegations have been a successful tool in strengthening cooperation and communication with the UN and are also welcomed by EU Member States. As recognised on several occasions, these delegations have contributed to enhancing the status of the EU at the UN.

Security and good governance

Another very relevant area of work for DROI has been good governance, with reports adopted on, among other topics, the human rights implications of counter-terrorism and the fight against corruption. DROI worked with LIBE notably on the follow-up to the previous legislature’s temporary committee responsible for examining the issue of CIA flights and illegal renditions (TDIP). DROI drafted a resolution on this topic and organised Manfred Nowak several hearings and exchanges of views, all of Former UN Special Rapporteur on torture which were extensively covered in the media. Corruption and human rights in third countries was the subject of a wide-ranging report drafted by DROI and adopted in plenary in October 2013.

Another area within the sphere of good governance and which has had a huge impact on human rights is the economic and financial crisis. DROI drew up a report on this subject with a specific focus on individual rights and vulnerable groups. This was welcomed by the UN, particularly its Special Rapporteurs on extreme poverty and the right to food, when the latter attended a DROI hearing in July 2012.

The fight against impunity

During the 7th legislature DROI actively promoted the issue of mainstreaming support for the ICC in the EU’s policies. A report on the EU’s support for the ICC was adopted in October 2011, and several exchanges of views and hearings were held with the participation of the ICC President and its second Vice- President as well as the ICC Registrar.

DROI also held a hearing on the crime of aggression and the Kampala amendments. A number of DROI members took part in the Kampala Review Conference in 2010. The relationship between peace and justice DROI hearing on transitional justice was the focus of discussion at a well-attended hearing (video-link with New York and Tripoli) on transitional justice held in October 2013.

Migration and Asylum

During the 7th legislature DROI examined the issue of migrants’ rights. The DROI opinion to LIBE on the new FRONTEX regulation called on the Agency to fulfil its duty to protect the human rights of migrants when controlling EU borders. Thanks to amendments to the new regulation requested by the European Parliament, the post of FRONTEX Fundamental Rights Officer as well as a consultative forum were established to monitor respect for the human rights of migrants by FRONTEX.

The death penalty and torture

DROI has continued to advocate for the abolition of the death penalty worldwide with a strong focus on those countries such as Iran and China where capital punishment is widely used and in those countries which have broken a de facto moratorium, such as Japan. A specific campaign supported by DROI concerned production in the EU of chemicals used for executions. A resolution on the occasion of the International Day against the Death Penalty was adopted in 2010 with a call to the EU’s Member States to actively sponsor the UNGA resolution against the death penalty. The number of countries in favour of this resolution is in fact increasing thanks to EU and Member State pressure on retentionist countries.

Torture was also a key topic covered in DROI. Apart from discussions linked to the follow-up to the TDIP resolution (see above), DROI drafted an own initiative report on torture. The focus of this report was to move towards torture practices being abolished: the EU was urged to step up its efforts to fully live up to the commitments made in the EU Guidelines on torture and the EU Action Plan on Human Rights and Democracy.

Arab spring

The European Parliament has followed closely the situation of human rights within the transformative changes taking place in the Arab world, including by looking at topics such as transitional justice, the fight against impunity, women’s rights, political rights and democratic reforms. In April 2012 DROI held a major hearing on justice in the Arab Spring countries, with participants from across the region. The human rights situation in the Middle East - North Africa (MENA) region was also the subject of exchanges in a number of other DROI meetings.

The human rights and humanitarian law abuses occurring within the internal conflict in Syria were raised in 2012 and 2013, with input from the UN Office of the High Commissioner for Human Rights and several NGOs. DROI delegation visits to Yemen (May 2012) and to Bahrain (December 2012) were organised in order to monitor the situation in these two countries where the Arab Spring had led to significant uprisings and demands for democratic reform and the protection of human rights. In 2013 DROI followed up on these delegation visits by arranging Maryam al-Khawaya, Bahrain Center for Human Rights DROI Hearing on "Justice in the Arab Spring countries” exchanges of views with the EU Ambassador to Yemen, as well as with visiting parliamentarians from Bahrain.

Enlargement

The issue of EU enlargement was also frequently raised by DROI. Human rights mainstreaming in the EU enlargement process in the Western Balkans, with a special focus on minorities, was examined in the course of a hearing and in a specific study. A DROI delegation to Serbia in late 2013 noted the importance of European Parliament pressure in strengthening human rights in the country with a view to the country’s future accession to the EU.

The above are just some of the highlights of the work of the Subcommittee (DROI) during the 7th legislature. The annexes which follow give a more complete picture of DROI’s activities over the past five years.
