Rights defense and new citizen’s movement Teng Biao 28.1 THE RISE OF THE RIGHTS DEFENSE MOVEMENT The ‘Rights Defense Movement’ (weiquan yundong) emerged in the early 2000s as a new focus of the Chinese democracy movement, succeeding the Xidan Democracy Wall movement of the late 1970s and the Tiananmen Democracy movement of 1989. It is a social movement ‘involving all social strata throughout the country and covering every aspect of human rights’ (Feng Chongyi 2009, p. 151), one in which Chinese citizens assert their constitutional and legal rights through lawful means and within the legal framework of the country. As Benney (2013, p. 12) notes, the term ‘weiquan’is used by different people to refer to different things in different contexts. Although Chinese rights defense lawyers have played a key role in defining and providing leadership to this emerging weiquan movement (Carnes 2006; Pils 2016), numerous non-lawyer activists and organizations are also involved in it. The discourse and activities of ‘rights defense’ (weiquan) originated in the 1990s, when some citizens began using the law to defend consumer rights. The 1990s also saw the early development of rural anti-tax movements, labor rights campaigns, women’s rights campaigns and an environmental movement. However, in a narrow sense as well as from a historical perspective, the term weiquan movement only refers to the rights campaigns that emerged after the Sun Zhigang incident in 2003 (Zhu Han 2016, pp. 55, 60). The Sun Zhigang incident not only marks the beginning of the rights defense movement; it also can be seen as one of its few successes. -

The People's Republic of China (PRC) is an authoritarian state in which, as directed by the Constitution, the Chinese Communist Party (CCP or Party) is the paramount source of power. Party members hold almost all top government, police, and military positions. Ultimate authority rests with the 24-member political bureau (Politburo) of the CCP and its 9-member standing committee. Leaders made a top priority of maintaining stability and social order and were committed to perpetuating the rule of the CCP and its hierarchy. Citizens lacked both the freedom peacefully to express opposition to the Party-led political system and the right to change their national leaders or form of government. Socialism continued to provide the theoretical underpinning of national politics, but Marxist economic planning has given way to pragmatism, and economic decentralization increased the authority of local officials. The Party's authority rested primarily on the Government's ability to maintain social stability; appeals to nationalism and patriotism; Party control of personnel, media, and the security apparatus; and continued improvement in the living standards of most of the country's 1.3 billion citizens. The Constitution provides for an independent judiciary; however, in practice, the Government and the CCP, at both the central and local levels, frequently interfered in the judicial process and directed verdicts in many high-profile cases. -

Ryan - Final (Do Not Delete) 7/21/2014 4:29 PM THE ELABORATE PAPER TIGER: ENVIRONMENTAL ENFORCEMENT AND THE RULE OF LAW IN CHINA ERIN RYAN† ABSTRACT In recent decades, the eyes of the world have been trained on China’s remarkable feats of rapid economic development. Yet the enormous environmental toll associated with China’s growth has also drawn global attention, as Chinese air and water quality plummet to historic lows. Epic levels of environmental degradation have fueled a growing domestic consensus that China must do better at reconciling these competing goals. This article reviews the contemporary challenges facing the second wave of environmental governance in China (with an addendum addressing important environmental law amendments enacted as it went to press). In the first wave of environmental governance, the government promulgated a series of environmental statutes that seem comprehensive— at least on paper. Nevertheless, it has become an article of faith among observers that they are superficially designed and too often unrealized for lack of meaningful implementation. Many environmental law and policy directives are crafted in aspirational form, and even those that do contain enforceable provisions are too often obstructed, for reasons both political and economic. When political patronage and economic interests take precedence over the faithful implementation of these laws, environmental protection suffers alongside other fundamental goals of good governance. For Chinese environmental law to succeed at its increasingly urgent objectives, it must become more than an elaborate paper tiger, moving from the present era of exhortation toward a more mature era of consistent implementation and enforcement. Chinese citizens who challenge the official version of what happened in June 1989 are subject to swift reprisals from security forces. These include relatives of victims who demand redress and eyewitnesses to the massacre and its aftermath whose testimonies contradict the official version of events. Even those who merely seek to honor the memory of the late Zhao Ziyang, the secretary general of the Communist Party of China in 1989 who was sacked and placed under house arrest for opposing violence against the demonstrators, find themselves subject to reprisals. TRANSPARENCY AND AUTHORITARIAN RULE IN SOUTHEAST ASIA The 1997–98 Asian economic crisis raised serious questions for the remaining authoritarian regimes in Southeast Asia, not least the hitherto outstanding economic success stories of Singapore and Malaysia. Could leaders presiding over economies so heavily dependent on international capital investment ignore the new mantra among multilateral financial institutions about the virtues of ‘transparency’? Was it really a universal functional requirement for economic recovery and advancement? Wasn’t the free flow of ideas and information an anathema to authoritarian rule? In Transparency and Authoritarian Rule in Southeast Asia Garry Rodan rejects the notion that the economic crisis was further evidence that ulti- mately capitalism can only develop within liberal social and political insti- tutions, and that new technology necessarily undermines authoritarian control. Instead, he argues that in Singapore and Malaysia external pres- sures for transparency reform were, and are, in many respects, being met without serious compromise to authoritarian rule or the sanctioning of media freedom. This book analyses the different content, sources and significance of varying pressures for transparency reform, ranging from corporate dis- closures to media liberalisation. It will be of equal interest to media analysts and readers keen to understand the implications of good governance debates and reforms for democratisation. For Asianists this book offers sharp insights into the process of change – political, social and economic – since the Asian crisis.
