24th August 1847 Removal Order (Elizabeth Woolcock & children)

CORNWALL TO WIT} To the Churchwardens and Overseers of the Parish of Lanivet in the County of and to the Churchwardens and Overseers of the Poor of the Parish of Luxulian in the County of Cornwall and to each and every of them. Whereas Complaint hath been made unto us Henry Peter Rawlings and Richard Gully Bennet Esquires whose Names are hereunto set, and Seals affixed, being two of Her Majesty’s Justices of the Peace, acting in and for the said County of Cornwall, (one whereof is of the Quorum) at the parish of Saint Columb Major in the said County of Cornwall, on the twenty fourth day of August One Thousand Eight Hundred and forty seven by the Churchwardens and Overseers of the Poor of the Parish of Lanivet in the said County of Cornwall, That Elizabeth Woolcock Widow and Elizabeth Ann aged about 9 years, Sarah aged about 7 years, Mary aged about five years and William aged about 4 years her Children have lately come to inhabit and are now inhabiting in the said Parish of Lanivet not having gained a Legal Settlement there, nor produced any Certificate acknowledging them to be settled elsewhere, and that the said Elizabeth Woolcock and Elizabeth Ann, Sarah, Mary and William her children are now actually chargeable to, and are now receiving Relief from, the said Parish of Lanivet the said Elizabeth Woolcock and Elizabeth Ann, Sarah, Mary and William her children not having become chargeable in respect of Relief made necessary by Sickness or Accident, and that the said Elizabeth Woolcock and Elizabeth Ann, Sarah, Mary and William her children have not resided in the said Parish of Lanivet for Five Years next preceding the Application now made for this Order or Warrant and that the said Elizabeth Woolcock hath been a widow more than 12 calendar Months preceding the same application We the said Justices upon due Proof made thereof, as well upon the Examination of Witnesses, to wit, of the said Elizabeth Woolcock, Jacob Thomas & Elizabeth Davies upon oath, as otherwise, and upon due Consideration had of the Premises, do adjudge the same to be true, and we do likewise adjudge that the lawful Settlement of the said Elizabeth Woolcock and Elizabeth Ann, Sarah, Mary and William her children is in the said Parish of Luxulian These are therefore to require you, the said Churchwardens and Overseers of the Poor of the said Parish of Lanivet or some or one of you, to convey the said Elizabeth Woolcock and Elizabeth Ann, Sarah, Mary and William her children from and out of your said Parish of Lanivet to the said Parish of Luxulian and them to deliver to the Churchwardens and Overseers of the Poor there, or to some or one of them, together with this our Order or Warrant, or a true Copy thereof, at the same time shewing to them the original: and We do hereby require you, the said Churchwardens and Overseers of the Poor of the said Parish of Luxulian to receive and provide for them as Inhabitants of your said Parish of Luxulian according to the Statutes in that case made and provided. Given under our Hands and Seals, at the parish of Saint Columb Major in the said County of Cornwall, the twenty fourth day of August in the Year of our Lord One Thousand Eight Hundred and forty seven (signed) H.P. 24th August 1847 Examination of Elizabeth Davies

CORNWALL (TO WIT) } The Examination of Elizabeth Davies at present residing in the parish of Lanivet in the said County of Cornwall, touching the last place of Legal Settlement of Elizabeth Woolcock, and Elizabeth Ann, aged about 9 years, Sarah aged about 7 years, Mary aged about 5 years, and William aged about 4 years, her children taken on oath before us Henry Peter Rawlings and Richard Gully Bennet Esquires two of Her Majesty’s Justices of the Peace, in and for the said County, at the parish of Saint Columb Major in the said County, this twenty fourth day of August in the Year of our Lord One Thousand Eight Hundred and forty seven upon the Complaint of the Churchwardens and Overseers of the Poor of the said Parish of Lanivet unto us the said Henry Peter Rawlings and Richard Gully Bennet that the said Elizabeth Woolcock, and Elizabeth Ann, Sarah, Mary and William her children have come to inhabit and are now inhabiting in the said Parish of Lanivet not having gained a Legal Settlement therein, nor having produced any Certificate acknowledging them to be settled elsewhere and that the said Elizabeth Woolcock, and Elizabeth Ann, Sarah, Mary and William her children are now actually chargeable to and are in receipt of Relief from the said Parish of Lanivet the said Elizabeth Woolcock, and Elizabeth Ann, Sarah, Mary and William her children not having become chargeable in respect of Relief made necessary by Sickness or Accident, and that the said Elizabeth Woolcock, and Elizabeth Ann, Sarah, Mary and William her children have not resided in the said Parish of Lanivet for Five Years next before the present Application for a Warrant for the removal of the said Elizabeth Woolcock, and Elizabeth Ann, Sarah, Mary and William her children and the said Elizabeth Woolcock has been a widow for more than 12 Calendar Months next preceding the same application The said Elizabeth Davies upon her Oath, saith, I am about 67 years old, and am the wife of William Davies of the parish of Lanivet. My first husband was called William Woolcock. I was married to him at the parish Church of Luxulian in the County of Cornwall and had by him 7 children. John Woolcock the late husband of the pauper Elizabeth Woolcock, now present, was one of them. I recollect their marriage at the Parish Church of Lanivet about 11 years ago. About 40 years ago when my late husband and myself were residing at , in Lanivet aforesaid, my husband was taken ill and applied for relief to the Churchwardens and Overseers of the Poor of the parish of Luxulian and they granted him relief. He continued ill for upwards of 30 years, and with the exception of about 10 or 11 weeks resided the whole of that time in the said parish of Lanivet, and during the whole of the said 30 years received relief from the said parish of Luxulian. I frequently received the relief during these years from the following Persons, who were respectively Overseers of the Poor of the said parish of Luxulian viz. Mr Hart Udy of Trevellan, an Overseer, Charles Roach, of Bodiggo, an Overseer, William Brent of Bodiggo, Overseer, Nicholas Roach, Bodiggo, Overseer, Mr Richard Hick, Lower Menadue, Overseer. I used frequently to talk unto each of them about our residence in the said parish of Lanivet and they used to threaten to make us come into their own parish to reside. The Mark of Elizabeth Davies Taken and sworn before us the Justices aforesaid this 24 day of August, 1847, the same having been first read over and explained to the said examinant who appeared perfectly to understand the same, in our presence (signed) H.P. The parishes of Luxulian and Lanivet are respectively within and form part of that Union. I know Elizabeth Woolcock the Pauper now present. From the Michaelmas Quarter 1843 to the 11th week of the Christmas Quarter 1846 I relieved the said Elizabeth Woolcock and her husband John Woolcock who died about two years and a half since and their children, with weekly relief by order of the said Board of Guardians of the said Bodmin Union, and by their order charged the said relief to the said parish of Luxulian. The whole of the relief I thus gave to the said Elizabeth Woolcock and her said husband and children amounts to £63.15.13/4. During part of the time the said Elizabeth Woolcock was receiving the said relief she was residing with her said husband in the parish of Saint Blazey in the said County of Cornwall and the remainder of the time at the village of Lanivet in the said County of Cornwall. From the 11th week of the Christmas Quarter 1846 to the present time I have relieved the said Elizabeth Woolcock and her children with weekly relief, some weeks at the rate of eight or ten shillings per week and at other times less by order of the said Board of Guardians and by their order I have charged such relief to the said parish of Lanivet. I relieved her on the nineteenth day of August inst with four shillings and sixpence and have charged her relief for the present week on account of the said parish of Lanivet. I produce a Certificate of chargeability of the said Elizabeth Woolcock and her said children. It was signed by the Chairman to the said Board of Guardians and countersigned by their Clerk and the Common Seal of the Board of Guardians attached thereto in my presence at their Weekly Meeting held on the 21st day of August instant.
