I. INTRODUCTION

[1] ThepublicationoftwelvecartoonsoftheProphetMuhammadinlate2005was onlythebeginningofaseriesofeventsinacartooncontroversythathastakenthelives ofmanypeopleandinjuredothers.Muslimsbelievethatthesecartoonsareprohibited under Shari’a ,orIslamiclaw.Thesecartoonswereprotestedagainst,however,notonly becauseoftheirdepictionoftheProphetMuhammadbutthemannerinwhichhewas depicted.

[2] This Article argues that while these cartoons do violate Shari’a , the violent

response in protest only perpetuates negative stereotypes of Muslims and Arabs.

Moreover,thisArticleexplains why thecartoonsviolate Shari’a .PartIIofthisArticle

outlinesthecartooncontroversybybothexaminingthecontentofthecartoonsandthe

timelineofevents.PartIIIexaminestheresponsetothepublicationofthecartoons.Part

IIIdiscussesboththeviolentandnonviolentresponsestothepublicationofthecartoons.

Part IV of this article provides an indepth explanation of Shari’a and the sources of

Islamic law, including a discussion of the importance of the Prophet Muhammad to

Islam.PartVexplainstheresponsetothecartooncontroversybyanalyzingtwodifferent arguments. The first argument is that the cartoons are absolutely prohibited under

Shari’a. Drawing on the main sources of Shari’a —the Qur’an and the Sunna—the prohibitionofthecartoonsisexplained. Thesecondargumentisthatthecartoonsare basedonnegativestereotypesofMuslimsand.PartVIconcludesbyarguingthat violentresponsestothecartoonsarenotjustifiedevenifthecartoonsviolate Shari’a.

II. THE CARTOONS

[3] The Danish Newspaper JyllandsPosten first published twelve cartoons of

MuhammadonSeptember30,2005. 1Thereasoningbehindpublishingthecartoonswas based upon an “experiment to overcome what the editors perceived as selfcensorship reflected in the reluctance of illustrators to depict the Prophet.” 2Thetwelvecartoons pictured Muhammad in a variety of ways. The cartoon that has received the most attentionisadrawingoftheProphetMuhammadwithabombashisturban. 3 On his

Prophet. 4VariousgroupsincludingtheAmericanArabAntiDiscriminationCommittee

(ADC) have come out strongly against the cartoons. The ADC released a statement about the cartoons arguing that the “cartoons depict[ed] Prophet Mohammed in a negative,hateful,andracistfashion.Theseracistattacks...donothingbutperpetuate hateandviolenceagainstMuslims.” 5

[4] Othercartoonsarealsotroublesome. 6OneoftheimagesshowsMuhammadwith

alargeswordinhishand,seeminglypreparedforbattle,anditappearsthatheishappy.

Hehasawomanoneachsidedressedina niqab .Thedrawingonlyshowsthewideeyes

of the two women, and Muhammad’s eyes are covered. Thiscartoonplaysupontwo

stereotypes. The first is that Muslims are violent and eager to fight. The second

stereotyperegardsMuslimwomenandtheirportrayal,hereemphasizingtheirwideeyes

as their only defining characteristic. Another cartoon has Muhammad standing on a

[5] AnotherdrawingshowsMuhammadtalkingtotwovery angry looking Muslim

menwithlargesabersandabomb.Muhammadissaying"Rolig,venner,nåraltkommer

tilalterdetjobareentegninglavetafenvantrosønderjyde,"intalkingaboutadrawing

heisholding.ThegeneralEnglishtranslationis“‘Relaxguys,it’sjustadrawingmade bysomeSouthJutlander.’ThereferenceistoacommonDanishexpressionfora personfromthemiddleofnowhere.” 8Theothercartoonsalsovaryintheirdepictions, butthecartoonsthatfocusedonviolencesuchastheonewiththebombinMuhammad’s turbanareparticularlyvolatile.

III. THE REACTION

[6] Thefirstreactionstothecartoonsdidnotoccuronaverylargescale.Therewas, however, some negative reaction to the September publication, particularly with the

Muslim community in Denmark. 9 On October 14, 2005, approximately 3,500 people heldapeacefulprotest againstthecartoonsin Copenhagen. 10 Thefollowingday,the

4 Egyptianpaper AlFagr publishedthecartoons. 11 AndonOctober19,2005,agroupof

Muslim ambassadors requested a meeting with Danish Prime Minister Anders Fogh

Rasmussen, but he declined to meet with them. 12 In December 2005, delegations of

Danish Muslims visited the Middle East to raise awareness of the cartoons. The

delegationvisited,Damascus,andBeirut,withafortythreepagedossierregarding

thecartoons. 13

[7] InDecember2005,anemergencyconferencewasheldbytheOrganizationofthe

IslamicConference,andwhilethemeetingwassupposedtobeaboutsectarianviolence, the cartoon issue overshadowed other problems. 14 The Organization of the Islamic

Conference strongly condemned: “[We express our] concern at rising hatred against

IslamandMuslimsandcondemnedtherecentincidentofdesecrationoftheimageofthe

HolyProphetMohamed.” 15

[8] The Organization for the Islamic Conference and the Arab League wanted interventiononbehalfoftheUnitedNations.Thegroupssought“abindingresolution banning contempt of religious beliefs and providing for sanctions to be imposed on

5 contraveningcountriesorinstitutions.” 16 TheU.N.highcommissionerforhumanrights,

LouiseArbour,respondedpositivelytotheOrganizationfortheIslamicConference.She statedthat,“Ifindalarminganybehaviorsthatdisregardthebeliefsofothers,”and an investigationintothecartooncontroversywasinitiated. 17

[9] Other newspapers, however, had a different perspective. In January 2006, the

Norwegian paper, Magazinet, republished the cartoons. 18 Subsequently in February

2006, other newspapers published the cartoons. In total, seven European newspapers

republishedthecartoons.Italy’s LaStampa ,Germany's DieWelt, Spain's ElPeriodico , theNetherlands' Volkskrant, andFrance’s FranceSoir .19 TheFrenchpaperarguedthatit hadarighttopublishthecartoonandhaddonesoinanefforttotakeastanceagainst

“religiousdogma.” 20 Beneathaheadlinestarting,“‘Yes,wehavetherighttocaricature

God’, FranceSoir ranafrontpagecartoonofBuddhist,Jewish,MuslimandChristian gods floating on a cloud. It shows the Christian deity saying: ‘Don't complain,

[10] WhilemanyEuropeanpapersrepublishedthecartoons,majorpapersinboththe

UnitedStatesandtheUnitedKingdomdidnotfollowsuit.TheUnitedStateswentsofar astocallthedrawings“offensive.” 23 StatedepartmentofficialJanelleHironimuscalled

specificallyfortoleranceandrespectforreligiousbeliefs. 24 WhileU.SandU.K.papers

haverefrained fromprintingthecartoons,there hasbeensomesupportfortherightto publishthecartoons. 25 SecretaryofStateCondoleezzaRicesaidshefoundthecartoons personallyoffensive. 26 PresidentBushmadeastatementinsupportoffreespeech,but

encouragedsensitivitytoreligiousbeliefs. 27

7 [11] Thereactionstotherepublicationofthecartoonshavevaried,butmanyviolent protests ensued around the globe. In Syria, the Danish embassy was set afire. 28 In

Tehran, hundreds gathered and violently protested at the Danish embassy throwing

firebombs and stones. 29 In the Gaza strip, protestors threw stones at the EU flag. 30

PalestinianmilitantsprotestedattheEUheadquarters,andtherewasonereportofabrief kidnappingofaGermancitizen. 31 InBeirut,Lebanon,theDanishembassywasseton firebyprotestorswhenthousandstooktothestreets,completelydestroyingthetenstory consulate. 32 In Afghanistan, four were killed during a demonstration against a

Norwegian controlled military base. 33 More deaths and injuries followed in

[12] Notalloftheprotestswereviolent.InBrussels,4,000Muslimsprotestedina peaceful,spontaneousmanneragainstthecartoons. 36 InCopenhagenonFebruary5th, almost3,000MuslimsandnonMuslimspeacefullyprotestedthecartoonsandcalledfor understanding. 37 In Tanzania, thousands of Muslims also protested peacefully. 38

However,theviolentprotestshavegreatlyovershadowedthepeacefuldemonstrations.

IV. ISLAM AND ISLAMIC LAW

[13] IslammeanssubmissiontoAllah. 39 Islamiclaw,or Shari’a ,isnotasystemof lawthatisseparatefromreligion. 40 Shari’a itselfisareligiousconcept,andonemusttry

9 tounderstandthekeyconceptsofIslamtotrulyappreciate Shari’a .41 TheQur’an 42 is the first and most important source in understanding both Islam and Shari’a. Qur’an means reading or recitation. 43 The cornerstone of Islam is the idea of , or the

oneness of Allah. Sura (chapter) 112 of the Qur’an explains the concept of tawhid.

“Say:HeisGod,[t]heOneandOnly;God,theEternal,theAbsolute;Hebegettethnot,

[n]orisHebegotten,[a]ndthereisnonelikeuntoHim.” 44

[14] ThisconceptisveryimportantindistinguishingIslamfromChristianityandthe inthetrinity.Moreover,thefirstpillarofIslamisthe shahada whichmeans“to

testify”or“tobearwitness.” 45 The shahada is: ThereisnogodbutAllah;Muhammadis

10 His Prophet, or lā 'ilaha 'illāllāhu Muhammadur rasūlu llāh .46 The first part of the shahada statestheonenessor tawhid ofAllah.Thesecondpart“speaksofprophecy.” 47

[15] Muhammadisthe rasulAllah ,ortheMessengerofGod. 48 Shari’a iscomposed oftheQur’anandtheSunna.Muhammad’sSunnaismadeupofthe“thingshesaid,i.e. hishadith ,aswellasthethingshedidorrefrainedfromdoing.” 49 Moreover,the“sunnah

referstothepracticeoftheProphetexpressedinactions,inoralpronouncements,orin

concurrence in action by others.” 50 The hadith is actually “subsumed under

[Muhammad’s] Sunnah because his sayings were one of the things that he did, and

11 ,orreasoningbyanalogy,isthefourthsourceofShari’a .54 Qiyas isafairlylimited concept,andpersonalopinion, ra’y,cannotbeusedtoargueforachangeinShari’a.

[16] usulalfiqh istranslatedas“thescienceoftherootsofunderstandingGod's law”and fiqh isthescholarlyinterpretationof Shari’a .55 Thesescholarlyinterpretations, however, may vary. Scholars come up with their “‘rulings’ (ahkam) which, taken together, represented their fiqh their interpretation of shari'a.” 56 In classical Islamic thought,twoapproacheswereusedforinterpretingIslamiclaw, ijtihad and taqlid .The processof Ijtihad usesthefourmainsourcesof Shari’a whichiscomposedoftheQur’an,

Sunna, Ijma ,and Qiyas .57 Taqlid isasystembaseduponprecedent. 58

[17] SunniIslamandShi‘iIslamhavedifferentconceptionsof Shari’a. Therearefour

V. UNDERSTANDING THE RESPONSE

[23] ManynewssourceshavecitedthecartoonsofMuhammadasbeingaviolationof

Islamiclaw. 78 Onenewsreportstated,“Islamiclawforbidsdepictionsoftheprophet.” 79

Usuallynoexplanationisprovidedforwhythisisthecase.Thereisanunderstanding both under Shari’a ,andIslamgenerally,thatdepictionsoftheProphet are prohibited.

However, there is no explicit Sura in the Qur’an that prohibits the imagery of the

Prophet. 80 ThelackofaspecificSuraoutlawingdepictionsoftheProphet,however,is not controlling.Thereisalongtraditionunder Shari’a ofprohibitingthesedrawings.

Thesourceofthisprohibitioncanbetracedbacktotheprohibitiononidolatrythatis discussedintheQur’an.Sura42:11states“(Heis)theCreatorOftheheavensandThe earth:HehasmadeForyoupairsFromamongyourselves,Andpairsamongcattle:By thismeansdoesHeMultipleyou:thereisnothingWhateverlikeuntoHim,andHeisthe

[24] Moreover,Sura21:5254alsocondemnsidolworship.“Behold!HesaidTohis father and his people, ‘What are these images, To which ye are (So assiduously) devoted?’ They said, ‘We found Our fathers worshipping them.’ He said, “Indeed ye

condemnidolworship.Sura5:3states

Forbiddenuntoyou(forfood)are...thatwhich hath been immolated untoidols.And(forbiddenisit)thatyeswearbythediviningarrows.This isanabomination.Thisdayarethosewhodisbelieveindespairof(ever harming) your religion; so fear them not, fear Me! This day have I perfectedyourreligionforyouandcompletedMyfavourunto you,and havechosenforyouasreligionalIslam.Whosoisforcedbyhunger,not bywill,tosin:(forhim)lo!AllahisForgiving,Merciful. 84 Sura5:60alsocondemnsthosewhoworshipandserveidols. 85 Sura5:90furtherstates,

“Oyewhobelieve!Strongdrinkandgamesofchanceandidolsanddiviningarrowsare

only aninfamy ofSatan'shandiwork. Leaveit aside in order that ye may succeed.” 86

Thus,theQur’anclearlyprohibitsidolatryandidolworship.Theconnectionbetweenthe

17 cartoons andidolatry cannotbe easily understoodoutside the historical context where

MuhammadbroughtthemessageofIslamtothepaganArabs.

[25] The hadith alsoprohibitsidolworship.TheEnglishtranslationofSahihBukhari

narrated by Abdullah states, “When the Prophet entered Mecca on the day of the

Conquest,therewere360idolsaroundtheKa'ba.TheProphetstartedstrikingthemwith

astickhehadinhishandandwassaying,"TruthhascomeandFalsehoodwillneither

startnorwillitreappear.” 87 Ontheusageofpictures,thehadithisalsoabundantlyclear.

ThenarrationbyIbnAbbasfollows:“TheProphetenteredtheKa'baandfoundinitthe picturesof(Prophet)AbrahamandMary.Onthathesaid‘Whatisthematterwiththem

(i.e.Quraish)?Theyhavealreadyheardthatangelsdonotenterahouseinwhichthere are pictures; yet this is the picture of Abraham. And why is he depicted aspracticing divinationbyarrows?’”88

[26] Moreover,theIbnAbbasnarrationcontinues“WhentheProphetsawpicturesin theKa'ba,hedidnotenterittillheorderedthemtobeerased.Whenhesaw(thepictures ofAbrahamandIshmaelcarryingthearrowsofdivination,hesaid,‘May Allah curse them(i.e.theQuraish)!ByAllah,neitherAbrahamnorIshmaelpracticeddivinationby arrows.’” 89

[27] From a Sunni perspective, these ahadith present a strong argument against pictures and depictions of the Prophet Muhammad. Shiites have demonstrated more

[28] Inthecartooncontroversy,however,therehasbeencondemnationofthecartoons frombothSunnisandShiites.Therearetwoseparate critiques that are leveled at the cartoons.ThefirstisthatIslamiclawor Shari’a prohibitsthesedepictionsoftheProphet becausetheyencourageidolworshipandgoagainsttheprinciplesofIslam.Thesecond

criticismofthecartoonsistheyareracistandperpetuatethestereotypethatallMuslims

Muhammadreceivedthemessageisveryimportant.Itwasaperiodwhenidolworship wasengrainedinsociety.However,themessagethatMuhammadbroughtthatthepeople should“acknowledgethegloryofAllahandpraytohim” 94 wasseenasadirectthreatto people of Mecca’s way of life. 95 Muhammad’s challenge to idol worship was an important part of the new message of Islam which focused on the oneness of Allah.

Tawhid ismuchmorecomplexthantheEnglishtranslationmakesitappear.The“all encompassingnature”ofAllahisacornerstoneofIslam.

[30] Asdiscussed,theoutrageagainstthecartoonsisgroundedin Shari’a .However,

thespecificviolentresponseismuchmoredebatable. Many Muslims would strongly

argueagainstanytypeofviolentresponse.TheCouncilonAmericanIslamicRelations

(CAIR)hascomeoutstronglyagainsttheviolentattacks.TheCAIRcommunications

director specifically stated, “Everyone has the right to peacefully protest defamatory

attacksontheirreligiousfigures,butprotestersshouldnotreinforceexistingstereotypes byresortingtoviolenceorinflammatoryrhetoric.”96 InthesamemannertheAmerican

Arab AntiDiscrimination Committee stated, “ADC completely rejects any acts of

[31] Some violent protestors have called for a jihad against the West for the publicationofthecartoons. 98 Jihadisderivedfromtheroot j.h.d. andisaverbal

nounoftheroot jahada .99 Jahada isdefinedas“tostrive,toexertoneself,tostruggle.” 100

Jihadalsayf ,orJihadofthesword,is“religiouslygroundedwarfare.” 101 Thereismuch

debateintheMuslimcommunityovertheexactmeaningofJihadandwhetherthereis bothanoffensiveanddefensivejihad. 102 BasedontheQur’an,onecancontendthatthere

isanoffensivejihadavailablewhennecessarytobring about a “just public order.” 103

However,itwouldbeverydifficultinthiscasetoarguethattheentirepublicorderwas threatenedbythepublicationofthecartoons.Additionally,thereareotherinterpretations

“cartoonjihad.” 105

[32] TheQur’anhasmanyversesaboutfightingandwaging war. Sura 9:73 orders fighting:“OProphet!Striveagainstthedisbelieversandthehypocrites!Beharshwith them.Theirultimateabodeishell,ahaplessjourney’send.” 106 However,otherSuras placelimitationsonviolentresponses.Sura2:190statesspecificallythat“Fightinthe

cause of God those who fight you, But do not transgress limits; For God loveth not

transgressors.” 107 ThisSuracanbeinterpretedaslimitingjihadintwoways.First,you

are only supposed to fight if you are being fought against. Second, even if you are

fighting, you must not transgress. Most legal scholars would agree that the violent protestsarenotanappropriateuseofjihad.Thereisnothreatofthe Muslimsbeing

exterminatedastherewaswherejihadhadbeenemployedinthepast. 108

The stereotyping of Arabs and Muslims has gained more attention sincethehorrificeventsof9/11,butstereotypingagainstArabsandMuslimshasbeen occurring for many years. 109 The stereotyping of Arabs and Muslims has roots in

Orientalist thought. Edward Said explained the concept in his famous book

Orientalism .110 One explanation of Orientalism is “an imaginative and yet drastically polarizedgeographydividingtheworldintotwounequalparts,thelarger‘different’one called the Orient, the other, also known as ‘our’ world called the Occident or the

West.” 111 VariousstereotypeshaveoftenbeenusedtocharacterizeArabsandMuslims.

Racial epithets such as “sand nigger” and “camel jockey” are just a couple of

examples. 112 Other popular stereotypes include the notion that all Arab and Muslim womenareoppressedandthatharemsabound. 113

hasalmostbeenacceptedasfactpost9/11.Onescholararguesthatthereisaprevalent

trainofthoughtpost9/11that:“(1)becausealloftheSeptember11terroristswereArab

andMuslim;(2)becausemostArabsareMuslims;and(3)becausetheterroristsclaim

religious motivation for their actions; (4) all Arabs and Muslims are likely to be

terrorists.” 115

[35] ThusthepublicationofacartoonoftheProphetMuhammadwithabombinhis turban lent credence to the argument that Muslims and Arabs were stereotyped as terroristsandthatIslamisaviolentreligion.Inarecentpoll,nearlyonehalf,fortysix percent,ofallAmericanshaveanegativeviewofIslam,asevenpercentincreaseover theimmediateaftermathof9/11. 116 ThepollalsoshowedthatmostAmericansbelieve

[36] Tomakethingsworse,theIraniannewspaper Hamshahri announcedthatitwas

goingtohaveaHolocaustcartooncontest. 118 Editorsatthenewspaperarechallenging

Western papers to publish the Holocaust cartoons if they previously published the

Muhammad cartoons. 119 Thenewspaperstatedits’positionas“DoestheWest extend freedomof expressiontothecrimescommittedbytheUnitedStatesand Israel,or an eventsuchastheHolocaust?Orisitsfreedomonlyforinsultingreligioussanctities.” 120

ConservativeleadersofIran,includingPresidentAhmadinejad,havemadetheirfeelings clearregardingtheHolocaustincludingtherevisionisthistorypositionthattheHolocaust wasa“myth.” 121 Thiscombinationofeventsonlyaddstotheanimosityharboredagainst

VI. CONCLUSION

[37] ThisArticleexaminedthecurrentcartooncontroversythathasspreadacrossthe globeandarguedthatthecartoonsoftheProphetMuhammadwereproblematicfortwo reasons.ThefirstreasonisthatthedepictionoftheProphetMuhammadisprohibited underIslamiclaw.ThisArticlepresentedthevarioussourcesofIslamiclaw,including theQur’anandtheSunnathatsupporttheprohibitionofthecartoons.Byanalyzingboth historyandthelaw,astrongargumentwaspresentedthatthecartoonsviolate Shari’a.

Second, the cartoons perpetuate a negative stereotype of Muslims and Arabs. By showingtheProphetMuhammadwithabombinhisturbanthestereotypethatMuslims are violent is perpetrated. Other cartoons also portrayed the Prophet Muhammad and

Muslimsasviolentandreadyforbattle.Unfortunately,aviolentresponsetothecartoons onlysolidifiesthealreadynegativestereotypesthatexist.ThisArticleconcludesthatthe best response to the cartoons is peaceful protest and a meaningful dialogue over the reasonwhyMuslimsobjecttothecartoonsinthefirstplace.Instead,theviolenceonly increasesthealreadywideningriftbetweenIslamandtheWest.
