    SHAH WALIY ALLAH ATTEMPTS TO REVISE WAHDAT AL- WUJUD BY ABDUL HAQ ANSARI HE theosophical system of re?ahdat al-zvujud', or ontological/ Texistential monism, which Ibn al-'Arabi (d. 638/1240) for- mulated, became very soon popular among the sufis. Some of them, however, did not agree with it, others disliked, and some even denounced it. Nevertheless, the doctrine continued to dominate sufi speculation for four hundred years till Shaykh Ahmad Sirhindi (d. 1034/1624) subjected its basic concepts as well as its moral and religious consequences to searching criticism, and came out with a parallel theosophy 2, popularly known as wahdat al-shuhud. Sirhindi said that mystical experience has three levels: One is the level of pure union which in modern terminology is called unitive experience; next is the experience of separation after union (farq bald al-j*amc) in which the mystic is one with God in one sense, and different from him in another; the final stage of the experience is that when the feeling of oneness or union completely disappears and God is perceived as transcending the world absolutely. Sirhindi said that some sufis like Al-Hallaj 3 (d. 309/922), remained at the first stage till the end of their life; others moved to the second stage, but stayed on there; only a few rose up to the third stage. Abstract This article attempts to deliberate on the child custody laws in classical Islamic texts and the contemporary Muslim World with special focus on development of child custody laws in Pakistan. For classical Islamic law, the article refers to the laws as stated in the compendiums of fiqh of sunni and shi’ i schools of thought as well as decisions of Prophet Mohammad (PBUH) his companions and leading Muslim jurists. For the purpose of this study, contemporary Muslim world is divided into Muslim majority regions of Central Asia and Caucasus, South Asia, Southeast Asia, North Africa, South Africa, West Africa, Horn of Africa and Middle East. A thorough analysis of customary practices, personal status laws and trends of courts in these Muslim majority regions is carried out. Effort is made to bring out similarities, differences and developments in child custody laws in contemporary Muslim world. The article is delimited to the discussion on child custody in cases of divorce, judicial separation or dissolution of marriage only. In the end it is suggested that uniform laws can be formulated for the entire Muslim world, in the light of Islamic principles and contemporary practices of the Muslim world. Tulisan ini mengkaji pandangan Abû Ishâq al-Shâthibî (w. 790/1388) tentang bidah versus al-mashlahah al-mursalah dan al-istihsân. Karya al-Syâthibî tentang konsep bidah dalam kitabnya, al-I'tishâm, sebagai respons terhadap ulama di zamannya yang menganggap bahwa al-mashlahah al-mursalah dan al-istihsân sebagai bentuk inovasi (al-bid‘ah). Tulisan ini akan mengelaborasi signifikansi gagasan al-Syâthibî dalam isu bidah yang memformulasikan kerangka syariah berbasis teks dan rasio dengan non-syariah. Pembahasan tentang bidah sebagai perbuatan yang bertentangan dengan prinsip syariah akan dianalisis dengan prinsip legalitas al-mashlahah al-mursalah dan al-istihsân sebagai bagian dari metodologi penggalian hukum setelah Alquran, Sunah, ijmak, dan qiyâs. Abstract The following article focuses on the Islamic Emirate of Afghanistan Rules for the Mujahideen** to determine their conformity with the Islamic jus in bello. This code of conduct, or Layha, for Taliban fighters highlights limiting suicide attacks, avoiding civilian casualties, and winning the battle for the hearts and minds of the local civilian population. However, it has altered rules or created new ones for punishing captives that have not previously been used in Islamic military and legal history. Other rules disregard the principle of distinction between combatants and civilians and even allow perfidy, which is strictly prohibited in both Islamic law and international humanitarian law. This paper attempts to provide a survey into the issue of money in Islam. Specifically, it looks at the views of Muslim scholars (primarily past fiqh scholars), on whether money has to be limited to gold and silver or not and discusses some implications of the findings of this brief survey on present day opinions. In this connection it discusses some general points on gold and silver as money, from a historical and ‘contextual’ perspective, followed by some points that are agreed upon by the majority of scholars. It also compares the views of scholars who take the position that only gold and silver can be used as money and the evidences given to support their stand with the views of those who do not limit money to only gold and silver, together with their evidences. 1. Introduction The discussion of money is certainly as old as the economics discipline itself. Early definitions of the discipline were even focused on money/wealth while most measurements today in economics are based on some money value. In the years since the 1997/98 financial crisis, there has been a renewed interest in and perception popularised by some that the Islamic currency as sanctioned in the shari’ah is gold and silver.(2) The crisis created renewed interest in the discussions and debates on money, the monetary system and even calls for a new international financial architecture.

    Al Azhar - Study Exchange Programme Egypt and England – a significant study exchange: Christians and Muslims learning about each other’s faith A significant development and strengthening of the relationship between the Anglican Communion and Al Azhar Al Sharif, the centre of Islamic learning in Cairo, Egypt, has taken place during November through two significant study visits. The first is that of the Grand Mufti of Egypt, His Eminence Dr Ali Gomaa, who delivered a talk at the University of Cambridge during the first week of November. A longer stay for study, of a month’s duration, was made by three younger Muslim scholars (El Sayed Mohamed Abdalla Amin, Farouk Rezq Bekhit Sayyid, Sameh Mustafa Muhammad Asal, graduate teaching assistants at the Faculty of Languages and Translation, Department of Islamic Studies in English, Al Azhar University) to Ridley Hall Theological College, Cambridge, England, November 1-29. Ridley Hall is well-known as a training centre for future Anglican clergy. Study exchange linked to Anglican Communion Al Azhar dialogue This double visit, of both Dr Gomaa, an eminent international Muslim scholar, and of three future Muslim religious leaders, is linked to the study exchange agreement signed by the Anglican Communion and Al Azhar Al Sharif in September 2005 at Lambeth Palace and ratified in the presence of Sheikh Al Azhar, Dr Mohamed Tantawy, at a meeting held at Al Azhar in September 2006.
