1.1 Goals and Objectives of the Public Consultation and Disclosure Plan(PCDP) Process

The primary goals of the PCDP process are to:  Ensure transparency and involvement of stakeholders in assessing and managing the potential environmental, socioeconomic, and health impacts of the CWMC Kaštijun project  Help manage risks, concerns and expectations through ongoing dialogue with stakeholders  Improve decision‐making, and build understanding by actively involving key project stakeholders in two‐way communication. Through this process, the project will better understand the concerns and expectations of stakeholders, and the opportunities to increase project value to the local community

1.2 Description of the main project components

Modernisation of waste management requires the construction of vital structures within the County of Istria (CI), which are indispensable for the system functioning. This is in the first place the County Waste Management Centre (CWMC) and then the construction of transfer stations (TS) and supply and organization of the truck fleet.

The CWMC for CI will be constructed at the area of City of – Kaštijun location. It will consist of several technical‐technological units and buildings:

 Working area with weighbridge, wheel wash facility, administration building, maintenance workshop, parking area, recycling yard etc.

 Waste treatment area: Mechanical‐Biological Treatment (MBT) plant;

 Waste disposal area: Disposal area will be divided to two types of landfill cells: controlled bio‐reactive landfill cell and landfill cell for disposing of non‐ hazardous industrial cell, leachate and gas management; waste water treatment plant and landfill gas treatment facility;

 CWMC equipment; phases will provide a capacity for waste management in the County of Istra during the period from 2012 till 2039, based on current assessment of the generation of waste, taking into account waste minimisation, reuse, recycling and waste treatment before final disposing.

A modern county waste management system will be developed in order to accommodate the needs of 206.344 residents of the County of Istria. The project County Waste Management Centre Kaštijun (CWMC) presents the establishment of long term solid waste management through infrastructure development comprising the CWMC Kaštijun and six transfer stations (TS). The project is foreseen to contribute to reaching the objectives of the National Waste Management Plan of the Republic of (NWMP).

The purpose of CWMC is to accept non‐hazardous waste, treatment of municipal waste and disposal of municipal and previously treated non‐hazardous industrial waste. Construction and demolition waste will be also accepted at the CWMC Kaštijun and will be used as a landfill daily cover.

CWMC The CWMC area consists of waste treatment and waste disposal areas:

The waste treatment area consists of Mechanical – Biological Treatment (MBT) Plant with capacity of 90.000 t where biological and mechanical techniques of municipal waste treatment are combined in order to produce Solid Recovered Fuel (SRF), to reduce the volume of waste for disposal (to around of 35 % (mass) of the incoming amount) and to stabilize the waste (“Stage 2”).

Landfill area (“Stage 1”)consists of the working area and its facility (weight bridge, wheel wash facility, transport and maintenance centre, CWMC landfill and transport equipment, waste water treatment plant, recycling yard), landfill area (bio‐reactive landfill cells and landfill cells for non‐hazardous industrial waste) and facility for gas treatment (gas flare).

Transfer stations (“Stage 3”) Six waste transfer stations will be constructed in: , Poreč, , , and . The TS is the place where the municipal waste collected in the surrounding areas is brought and is translated in the large containers which are transported by special vehicles to the CWMC for further treatment.

During the operational phase, the additional space for waste (both municipal and non‐ hazardous) disposal must be ensured thus leading to the enlargement of the disposal area continuously over the entire life time of the disposal area. Due to the sufficient amount of landfilled stabilized municipal waste concentrated in the first bio‐reactive cell, the electrical energy production plant will be constructed in order to recover the energy from the metanogenic fraction of waste activated under controlled conditions (Stage 4).  Development of adequate infrastructure for waste management system in the county for approximately 206.344 inhabitants;  Development of affordable transportation system (7 trucks plus 17 semi‐trailers will be used to transfer waste from 6 TS to CWMC) enabling towns and municipalities from long distances to use CWMC; Reduction of municipal waste amount before landfilling in respect to the generated waste amount to the 28% (in the year 2012) and up to 22% (in the year 2039)  Reduction of the share of biodegradable waste in the municipal waste;  Pre‐treatment (MBT Plant) of waste before disposal and further treatment at the bio‐ reactive landfill cell:  Recycling and re‐use of waste (recycled metal)  Extraction of solid recovered fuel (SRF)  Generation of waste management on the principles of sustainable development;  Energy recovery of waste;  Implementation of AEL concept (Avoidance – Evaluation – Landfilling);  Development of public awareness, regarding waste management issues in general, reuse /recycling of waste and prevention of illegal dumping of waste in nature in particular.  Reduction of adverse impacts of waste on the environment: o Reduction of the emission to soil and waters (preservation, protection and improvement of the quality of the environment in urban areas in 41 municipalities of the CI); o Reduction of greenhouse gas emissions from landfills; o Prevention of negative climate changes; o Minimization of adverse impacts on human health;  Education of administrative structures, professionals and general public;  Self‐sustainable financing of the municipal waste management system;  Reduction of risk from waste with remediation of existing landfills in the County (all 7 landfills on the area of the county will have to be rehabilitated and permanently closed by 2012).

Prior to the beginning of the construction of CWMC “Kaštijun”, it is necessary to complete the following activities, which were initiated earlier:  the issuance of location permits for the construction of Stage 1 and Stage 2, expected soon  Construction of the required infrastructure (access road, electricity and water supply) before the start of the CWMC construction.

The incentives are to be paid before the issuance of the building permits ‐ in Stage 1 for the landfill, in Stage 2 for the MBT Plant, in Stage 3 for TSs and in Stage 4 for the new landfill cells.

1.5 Description of location

The County of Istria includes a large part of Istria ‐ the largest Adriatic peninsula. The most extreme west point of the Republic of Croatia is in the County of Istria (Bašanija, promontory Lako) at the 45° of the northern latitude. Situated in the North‐West of the , Istria is surrounded by the sea from three sides, while the northern border towards the continent is made up by a line between the Miljski Bay (Muggia) in the direct vicinity of and the

Both EU Landfill directive as well as Croatian relevant legislation requirements must be fulfilled when making decision on the landfill location. When the location of the landfill was considered the following requirements was fulfilled:

 The distance from the boundary of the site to residential and recreation areas, waterways, water bodies and other agricultural or urban sites  The existence of groundwater, coastal water or nature protection zones in the area  The risk of flooding, subsidence, landslides or avalanches on the site  The protection of the nature or cultural heritage in area.

The future CWMC is located south from the City of Pula (5km), right next to existing landfill Kaštijun and 2km from the first settlement. The location is connected with the main road with asphalt access road.

Physical Plan of the County of Istria (Official Journal of the County of Istria 02/02, 01/05, 04/05 and 14/05) defined in its Articles 119 and 120 the Waste Management System of the County of Istria consisting of the following: o County Waste Management Centre Kaštijun in area of 16,4 ha, o Recycling Yards with transfer stations and composting facilities – upgrade of the existing landfills Donji Picudo (Umag), Košambra (Poreč), Lokva Vidotto (Rovinj) and Griža (Buzet) into transfer stations with recycling yards and composting facilities o transfer stations ‐ Cere (Sv.Nedelja ‐ Labin) and Jelenčići (Pazin) o construction material deposit areas o facilities for treatment of waste with high energy value o facility for primary treatment and provisional storage of hazardous waste o sanitary landfill – waste deposit area.

In the procedure of adoption of the Physical Plan of the County of Istria, public discussions took place and, before the adoption, consents were obtained from all local self‐government units (municipalities and towns of the County of Istria) as well as from the Croatian Ministry of Environment Protection, Physical Planning and Construction.

The Ministry of Environment Protection, Physical Planning and Construction, after having conducted an evaluation of environmental impact of the County Waste Management Centre “Kaštijun”, City of Pula, project sponsor: the County of Istria, represented by the Faculty of Mechanical Engineering and Naval Architecture, I. Lučića 5, Zagreb, based on Article 30 of the Law on Environment Protection (Official Journal No. 82/94 and 128/99) had adopted on 12.08.2008 the DECISION that the proposed project, construction of the County Waste Management Centre “Kaštijun”, City of Pula, on land lots: 3337/1, 3354/1, 3355 and 3356, all in the Land Registry of Pula, is acceptable from environmental aspect.

The request for issuing the location permit was submitted to MEPPPC on 04. September 2008. The issuing of the location permit is in the process. The project is based on following national and EU legislation:

There are a number of other regulations which in some manner, that is, indirectly effect or regulate methods of waste management such as the Utilities Act (OG 26/2003 – revised text, 178/2004 and 178/2007), the Chemicals Act (OG 150/05), the Transport of Hazardous Substances Act (OG 97/93, 151/03), etc. Waste Framework Directive 2006/12/EC

2.2 Responsibilities according to the NWMP

 The CI is responsible for the county waste management system  The CI has to verify the price and every change of it determined by the service provider  Cities and municipalities are responsible for municipal waste management,  CI is responsible for waste management of non‐hazardous industrial waste

Under the effective legal regulations public involvement starts during the procedure of developing physical planning documentation, and on that basis the public was involved into the project for the construction of the county waste management centre on several occasions in the last 6 years, i.e., through the following several parallel activities: o Public insights and public debates during procedures of adopting and amending physical planning documentation (for the physical planning documentation encompassing the County Waste Management Centre, 6 public insights and 6 public debates were held). o Press (the county and local self‐government units publish information on public insight and public debate in Glas Istre local newspaper. o Informing the public via the web sites www.istra‐istria.hr,, www.mzopu.hr, www.nn.hr and official web sites of local self‐government units (physical plans, Regional Operational Plan), o The possibility to access information such as minutes of meetings of county, city and municipal executive bodies, assembly and council, management boards etc. o Round tables o Project presentation

Public insight and public debate was carried out for:

1. Adoption of physical plan of the County of Istria – 2002; before adoption, the Physical Plan of the County of Istria (Official Journal of the County of Istria, No. 2/02) was submitted to public insight and public debate, and in those procedures no comments were forwarded in relation to the site of County Waste Management Centre Kaštijun.

2. Amendments to the Physical Plan of the County of Istria were carried out on three occasions (Official Journal of the County of Istria, Nos. 1/05, 4/05, 14/05), each time under implementation of public insight and public debate, and in those procedures no comments were forwarded in relation to the site of County Waste Management Centre Kaštijun.

4. Physical Plan of the Municipality of – Prior to the adoption of the Physical Plan public insight and public debate were carried out, and in those procedures no comments were forwarded in relation to the site of Regional Waste Management Centre Kaštijun.

The public was informed about the project of construction of the County Waste Management Centre Kaštijun, in the following way:

1. The County Waste Management Centre Kaštijun site was included in the regional Operational Plan of the County of Istria (document available on www.istra‐istria.hr) 2. The Kaštijun site was included in the Waste Management Plan of the Republic of Croatia for the period 2007­2015 (Official Gazette of the Republic of Croatia, No. 85/07) on the basis of the proposal of the Waste Management Plan of the County of Istria (www.nn.hr, www.mzopu.hr ). Presentations of the Waste Management Plan in the Republic of Croatia were attended by representatives of the County of Istria, while the presentation of the treatment technologies at the Brodarski Institute (October 2007) was attended also by representatives of Zelena Istra (NGO).. 3. In November 2007 the County of Istria held the presentation “Establishing a Waste Management System in the Territory of the County of Istria” attended by 45 persons, among which were representatives of the media, non‐governmental organisations (Zelena Istra) and other interested parties. 4. Within the framework of the project of the waste management system in the County of Istria all representatives of municipalities and cities gave their approval to the establishment of an integral system of waste management in the territory of the County of Istria and the construction of the County Waste Management Centre Kaštijun. 5. In the environmental impact assessment for the Environmental Impact Study for the construction of the County Waste Management Centre Kaštijun, 21 public insights in the area of the town of Pula and Municipality of Medulin were carried out, besides two public debates (in the territory of the City of Pula and Municipality of Medulin). On the basis of the request of the County of Istria (coordination body for performing public insight and public debate) extension of public insight was approved for additional 14 days with two

A great number of activities have been carried out for the purpose of informing the public: o From 18 until 20 May 2008 a study visit to a similar facility in was organised for interested parties as well as the media in which articles were published, and a short movie was made and broadcast on two local television stations. o Since 30 March 2007 until today the project was presented at assemblies, coordination body consisting of all Istrian mayors, several times to citizens in the Municipality of Medulin as well as to the Municipality government and Council, two times to the Local Board (Valdebek and Pješčana uvala, Valbonaša, Vinkuran, Vintijan – villages closest to Kaštijun), the Council of City of Pula and at several media presentations. o In that period 152 articles appeared in the pressand all activities have been broadcast on the local web portals as well as on television and radio.. o Three educational leaflets (in Croatian and Italian) have monthly been inserted in the local press, for a period of three months (Glas Istre, La voce del popolo, Naši foji). o Our web site, www.kastijun.hr has been active since December 2008, for now only in , however, texts in Italian (because of bilingualism) and in English are under preparation.

None. There are no residents or physical structures within 500m area surrounding the project site Part of Stage I of the Project except construction works is public relation service contract. This contract will include all necessary activities to introduce the whole project to the inhabitants of the County of Istria, but also the entire population of Croatia, in order to gain support for EU funded projects. This will ensure acceptance and approval of the purpose of the entire project from all potential stakeholders, education and training about the necessity of the project and its goals in a matter of long term environmental protection, education and training of the Kaštijun Ltd employees and recipients in public relations, long term public relations strategy and a number of visibility events.

As the Project CWMC Kaštijun is under IPA Implementing regulation the Croatian Government has adopted its own legal act/s to designate specific bodies for IPA management and implementation1. Under the provisions of this Regulation, the following individuals/bodies have been designated / established:  National IPA Coordinator  Strategic Coordinator for the regional development and the human resources development components  Competent Accrediting Officer  National Authorising Officer  National Fund  Audit Authority  Operating Structure. The Operating Structure (OS) is composed of the following specific bodies:  The Ministry of Environment Protection, Physical Planning and Construction (MEPPPC);  The Ministry of Regional Development, Forestry and Water Management (MRDFWM);  Croatian Waters (CW);  The Environment Protection and Energy Efficiency Fund (EPEEF);  The Central Finance and Contracting Agency for EU Programmes and Projects (CFCA). Within the Operating Structure, MEPPPC is the Body responsible for the Environment Protection Operational Programme (EPOP) and acts as the Body responsible for Priority/Measure 1 (BRPM) of the Environment Protection Operational Programme (EPOP) under which this project will be implemented. The EPEEF is responsible for tendering, contracting and paying for the project (acts as contracting and implementing body) and is Final Beneficiary of EU funds according to the Financing Agreement.

The stakeholders and affected groups and individuals can provide their suggestions, comments, complaints, concerns and grievances related to the Project. Grievance form shall be returned to the Kaštijun Ltd by mail, fax or e‐mail at any time during the Project implementation. Grievance can be submitted anonymously or it could be requested not to disclose identity to the third parties.

Kaštijun Ltd will respond to the grievances with included contact information in 25 working days.
