Disinformation and Covid-19 : An attack on the European rule of law

On April 24, 2020, the New York Times published an article which triggered many institutional reactions, particularly within the : "Pressured by China, EU softens report on Covid-19 disinformation” [1]. It presents the pressure exerted by Beijing to limit criticism by European actors of its disinformation policy during the pandemic. These pressures are part of a more general context of attack against the European rule of law by the new illiberal powers. Whether internal or external to the Union, explicit or implicit, these attacks undermine the European project of protection of fundamental liberties. The policies of disinformation that have emerged during the pandemic are a flagrant example of the reality of these attacks, their purpose and the limited response of European actors.

Since 2015 and Federica Mogherini, therefore since the predecessor of , High Representative of the Union for Foreign Affairs and Security Policy, the EU has been saying that it fights against disinformation. A specific service was created following the of March 2015 [2]: the governments of the Member States agreed to establish the so-called StratCom Task Force to "respond to the disinformation campaigns currently being conducted by ". The task force's mission, together with the other relevant Commission services, is to improve the EU's response to anticipate and respond to pro-Kremlin disinformation activities and to raise public awareness. The context of the creation of a disinformation task force is the ambition of the European Commission to become a “geopolitical Commission”. It aims to respond to pressure from state actors outside the Union. Unfortunately, based on this Times’ article, we realise that this mission is far from having been fulfilled.

Admittedly, some progress has been made, we no longer limit ourselves to Russian disinformation and a code of good practice signed with the "Web Giants" has been put in place. We are promoting so-called fact-checking activities with news agencies and the various information sectors, but we have to admit that as far as the response and public awareness are concerned, we are a long way from taking it as seriously as we should. Though the reports of this task force are public [3], there is little or no press coverage.

This is also an opportunity to emphasise the role of education and training providers. Declarations of intent and budget publications must be followed by visible actions. This means that future calls for projects must be in line with these fundamental rights, must uphold democratic liberties and must help private and public actors from different disciplines to join forces. This is a cross-cutting point: we cannot just limit it to Mrs Jurova's jurisdiction. The Commission must stop reasoning by topic as if each topic were only relevant to one subject.

In the light of the above, the Conference on the Future of Europe must, therefore, bring together institutions, researchers and those involved in information, education and training in its deliberations. These results must also be visible and accessible. We can expect the following from them: to develop methods for teaching critical thinking and analysing information. Having the keys to understanding the world in which we live must be a right open to all. Understanding the European construction cannot remain a monopoly of the knowledgeable. These paradoxes weigh on us: there is a misunderstanding between those who feel they are subjected to Europe and those who are living it.

The geopolitical ambition of the European Commission cannot be limited to institutional reactions. It is the responsibility of European actors to put the protection and promotion of the European values and rule of law at the centre of its responses. This requires full awareness of the basis of European sovereignty and the legitimacy of fundamental rights that make up European unity and which are essentially the target of attacks by autocratic threats.
