RESOLVED that the public minutes;

1. Pla/121/12/16 to Pla/125/12/16 of the site visit meeting of this Committee held on 1 December 2016; 2. 1 Pla/150/01/17 Declarations of Interest

The Chairman gave a personal explanation on behalf of all the Members of the Committee in respect of Item 6 on the agenda, stating that they had all been lobbied by the applicant.

Pla/151/01/17 Planning Issues

Councillor Holden raised a query regarding application 15/0799 which had been approved under officer delegated powers. She asked if the application should have been approved by members.

In response the planning officer explained that although approval had been given work would not be able to commence on the site until the applicant had discharged all of the conditions attached to the approval. This would include condition 8 of the planning permission relating to the gateway feature which could not be discharged until it received approval from the Committee in accordance with a previous resolution of the Committee. It was confirmed that a report regarding the condition would be brought before Members in due course.

RESOLVED that the attached lists of the Deputy Chief Executive: a) applications determined under officer delegated powers for the month December 2016; be noted.

Pla/152/01/17 Planning Issues - Applications for Debate (Green Papers)

The Committee was advised of the applications requiring a decision by Members as detailed in a report of the Deputy Chief Executive.

RESOLVED that

1. the following applications for planning permissions ("those applications") are determined as indicated hereunder;

2. those applications which are approved be approved under the Town and Country Planning Act, 1990, subject to any detailed conditions set out in the Report, to any conditions set out below and to any conditions as to time stipulated under Sections 91 and 92 of the Act;

3. those applications which are refused be refused for the reasons set out in the report and/or any reasons set out below;

4. those applications which the Deputy Chief Executive is given delegated powers to approve under the Town and Country Planning Act 1990, be approved by him subject to any detailed conditions set out in the Report, to any conditions as to time stipulated under Sections 91 and 92 of the Act, to the receipt of satisfactory replies.

2 Pla/153/01/17 Planning Application 16/0960 Erection of 9 dwellings including 2 affordable dwellings (partly retrospective), Land adjacent to Prospect House, Kings Meaburn, Penrith

The Committee received a presentation from Mrs C Cross, a local resident, objecting to the application.

The Committee received a presentation from Mr D Addis, the applicant’s agent, in support of the application.

The Planning Services Development Manager requested that in the event that Members considered approval of the application that condition 1 as drafted within the report be removed, given that the application was retrospective, in nature and the following additional conditions be added;

“6. None of the dwellings hereby approved shall be occupied until: -

a) The approved remediation works have been carried out in full compliance with the approved methodology. If during the works, new areas of contamination are discovered which have not previously been identified, then all work shall stop until the nature and extent of the contamination has been evaluated and the remediation strategy revised and approved by the Local Planning Authority;

b) Upon completion of the approved remediation works a verification report prepared by a competent person shall be submitted to and approved in writing by the Local Planning Authority. The verification report shall include details of the remediation works and Quality Assurance/Quality Control results to show that the works have been carried out in full and in accordance with the approved methodology. Details of any validation sampling and analysis to show the site has achieved the approved remediation standard, together with the necessary waste management documents shall be included.

Reason: - In the interests of human health.

7) Prior to occupation of any of the approved dwellings full details of both hard and soft landscape works, including a phased programme of works, shall be submitted to and approved in writing by the Local Planning Authority and these works shall be carried out in accordance with the programme agreed by the Local Planning Authority. Any trees or other plants which die or are removed within the first five years following the implementation of the landscaping scheme shall be replaced during the next planting season, unless the local planning authority gives written consent to any variation.

Reason: To ensure that the development is landscaped in the interest of the visual character and appearance of the area.”

3 and RESOLVED that delegated authority is given to the Deputy Chief Executive to grant planning permission subject to securing a S106 agreement securing two affordable homes on the site and subject to the following amended conditions:

Reason: To ensure a satisfactory development and to avoid any ambiguity as to what constitutes the permission.

Pre-Occupancy or Other Stage Conditions

2. Prior to occupation of the development a sustainable drainage management and maintenance plan for the lifetime of the development shall be submitted to the local planning authority and agreed in writing. The sustainable drainage management and maintenance plan shall include as a minimum:

a. Arrangements for adoption by an appropriate public body or statutory undertaker, or, management and maintenance by a resident’s management company; and b. Arrangements for inspection and ongoing maintenance of all elements of the sustainable drainage system to secure the operation of the surface water drainage scheme throughout its lifetime.

The development shall subsequently be completed, maintained and managed in accordance with the approved plan.

Reason: To ensure that management arrangements are in place for the sustainable drainage system in order to manage the risk of flooding and pollution during the lifetime of the development.

Ongoing Conditions

4 3. The drainage for the development hereby approved, shall be carried out in accordance with principles set out in the submitted Drainage Layout, ref: KMD-CAP- 00-XX-DR-C-003 Revision C01, dated 22-3-16 which was prepared by Capita. No surface water will be permitted to drain directly or indirectly into the public sewer. Any variation to the discharge of foul shall be agreed in writing by the Local Planning Authority prior to the commencement of the development. The development shall be completed in accordance with the approved details.

Reason: To ensure a satisfactory form of development and to prevent an undue increase in surface water run-off and to reduce the risk of flooding.

4. No construction activity that can be heard beyond the site boundary shall take outside the hours 8am to 6pm Monday to Friday, 9am to 1pm on Saturdays. There shall be no construction activity taking place on site on Sundays or Bank Holidays.

Reason: To protect residential amenity of nearby properties.

5. Prior to the completion of plot 1, samples of the external windows shall be submitted to and approved in writing by the Local Planning Authority. Thereafter, the approved scheme shall be implemented and retained in accordance with the approved details.

Reason: To conserve the character of the conservation area.

6. None of the dwellings hereby approved shall be occupied until: -

The Committee received a presentation from Mr S McKenzie, the applicant, in support of the application.

And RESOLVED that planning permission be GRANTED subject to the following conditions:

Time limit for commencement

1. The development permitted shall commence before the expiration of three years from the date of this permission.

Reason: In order to comply with the provisions of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

Approved Plans

2. The development hereby permitted shall be carried out strictly in accordance with the following drawings and documents hereby approved by the Local Planning Authority:

The development hereby approved shall not commence until visibility splays have been provided in accordance with the plan ‘Visibility Splays (ref: 16-19-05) dated December 2016, received 05 December 2016’, at the junction of the access road with the County Highway. Thereafter, the visibility splays shall be maintained free of obstruction.

Reason: In the interest of highway safety.

Pla/155/01/17 Tree work application 16/1064, proposed removal of Wellingtonia, Christopher Cottage, Warcop protected by TPO 162-01 2014

The Committee received a presentation from Mr D Keetley, Chairman of Warcop Parish Council, supporting to the application.

The Committee received a presentation from M S Hodgson, the applicant’s agent, in support of the application.

Members considered report CD4/17 from the Deputy Chief Executive which provided information to assist the Committee in determining an application to remove a tree protected by a Tree Preservation Order in Warcop.

The report recommended the refusal of the application and that remedial pruning be carried out.

Proposed by Councillor Patterson Seconded by Councillor Owen and RESOLVED that the application is GRANTED to approve the felling of the tree protected by TPO 162-01 2014 subject to a condition requiring replacement planting in the interests of continued public amenity.

Pla/156/01/17 Planning Application No 16/0682 Outline planning application for development with all matters reserved, Land behind Tanglewood, High Street, Morland

Proposed by Councillor Lynch Seconded by Councillor Clark and RESOLVED that members give delegated authority to the Planning Services Development Manager to grant planning permission subject to a Section 106 agreement being entered in to the absolute satisfaction of the Deputy Chief Executive and requiring the payment of a commuted sum involving 12% of the GDV for the development sought and the Council’s reasonable costs being paid in relation to that Section 106 Agreement, and subject to the following condition:

1. The development permitted shall be begun either before the expiration of three years from the date of this permission or before the expiration of two years from the date of approval of the last of the reserved matters to be approved, whichever is the later.

7 Reason: In order to comply with the provisions of the Town and Country Planning Act 1990.

2. Approval of the reserved matters shall be obtained from Local Planning Authority in writing before any development is commenced.

Reason: The application is in outline form only and is not accompanied by full detailed plans.

3. The development hereby granted shall be carried out strictly in accordance with the location plan and details hereby approved (drawing number 1, dated as received on 20 July 2016 and shall not be varied other than by prior agreement in writing by the Local Planning Authority.

Reason: To ensure a satisfactory development and to avoid any ambiguity as to what constitutes the permission.

4. No consent is given to the layout of the houses on drawing number 2.

Reason: To define the planning permission.

5. The Shared Access Way shall be designed, constructed, drained and lit to a standard suitable for adoption and in this respect full engineering details shall be submitted for approval before work commences on site and until a full specification has been approved. These details shall be in accordance with the standards laid down in the current Design Guide. Any works so approved shall be constructed before the development is regarded as complete.

Reason: To ensure a minimum standard of construction in the interests of highway safety.

6 The accesses and parking areas etc shall be designed, constructed and drained to the satisfaction of the Local Planning Authority and in this respect full engineering details, shall be submitted for approval before work commences on site. No work shall be commenced until a full specification has been approved.

Reason: To ensure a minimum standard of construction in the interests of highway safety 7. Ramps shall be provided in the footway opposite the junction, to enable wheelchairs, pushchairs etc to be safely manoeuvred at the kerb line; and be constructed as part of the development.

Reason: To ensure that pedestrians and people with impaired mobility can negotiate road junctions in relative safety.

8. No dwelling shall be occupied until the vehicular access and parking requirements have been constructed in accordance with the approved plan and brought into use. These facilities shall be retained and capable of use at all times thereafter and shall not be removed or altered without the prior consent of the Local Planning Authority.

8 Reason: To ensure a minimum standard of access provision when the development is brought into use.

9. The access and parking/turning requirements, shown on the plan, shall be substantially met before any building work commences on site so that constructional traffic can park and turn clear of the highway. Once complete they shall be retained capable of use thereafter and shall not be altered without the prior consent of the Local Planning Authority.

Reason: The carrying out of building works without the provision of these facilities is likely to lead to inconvenience and danger to road users. Retention of the facilities ensures an appropriate standard of parking and access for as long as the use continues.

10. Prior to commencement of development, details of the root protection area within 15 metres radium of the stem of the protected tree (Ash tree: Tree Preservation Order No 142, 2012), shall be submitted to and approved in writing by the Local Planning Authority. Any approved measures to protect the root system shall be in place prior to commencement of development and shall remain in place until completion of the development.

Reason: To prevent damage to the tree in the interest of the visual character and appearance of the area.

11 The land within the aforementioned root protection area shall not be used for the storage of building materials, plant machinery or other items, or for vehicular access or for the burning of materials of any kind.

Reason: To prevent damage to the tree in the interest of the visual character and appearance of the area.

12. Prior to the commencement of any development, a surface water drainage scheme, based on the hierarchy of drainage options in the National Planning Practice Guidance with evidence of an assessment of the site conditions (inclusive of how the scheme shall be managed and maintained after completion) shall be submitted to and approved in writing by the Local Planning Authority.

Surface water drainage scheme must be in accordance with the Non-Statutory Technical Standards and unless otherwise agreed in writing by the Local Planning Authority, no surface water shall discharge to the public storage system either directly or indirectly.

The drainage scheme submitted for approval shall also be in accordance with the principles set out in the Drainage Strategy and report dated 15 January 2015 proposing surface water discharging to Morland Beck. The development shall be completed, maintained and managed in accordance with the approved details.

Reason: To promote sustainable development, secure proper drainage and to manage the risk of flooding and pollution.

9 13. No development shall commence until a construction surface water management plan has been agreed in writing with the Local Planning Authority.

Reason: To safeguard against flooding to surrounding sites and to safeguard against pollution of watercourses downstream of the site.

14. No development shall commence until the appropriate Flood Defence consent or permit has been granted for the proposed changes to watercourse for the discharge to Morland Beck.

Reason: To protect and enhance the natural environment surrounding the watercourse.

15. The drainage for the development hereby approved, shall be carried out in accordance with principles set out in the submitted Drainage Strategy and Report, dated 15 January 2015, ref SM/JD 5029 proposing surface water discharging into Morland Beck, which was prepared by Tweddell & Slater. No surface water will be permitted to drain directly or indirectly into the public sewer. Any variation to the discharge of foul shall be agreed in writing by the Local Planning Authority prior to the commencement of the development. The development shall be completed in accordance with the approved details.

Reason: To ensure a satisfactory form of development and to prevent an undue increase in surface water run-off and to reduce the risk of flooding.

16. Prior to the commencement of the development a sustainable drainage management and maintenance plan for the lifetime of the development shall be submitted to the Local Planning Authority and agreed in writing. The sustainable drainage management and maintenance plan shall include as a minimum:

a) The arrangements for adoption by an appropriate public body or statutory undertaker, or, management and maintenance by a Resident’s Management Company; and

b) Arrangements concerning appropriate funding mechanisms for its ongoing maintenance of all elements of the sustainable drainage system (including mechanical components) and will include elements such as ongoing inspections relating to performance and asset condition assessments, operation costs, regular maintenance, remedial works and irregular maintenance caused by less sustainable limited life assets or any other arrangements to secure the operation of the surface water drainage scheme throughout its lifetime.

The development shall subsequently be completed, maintained and managed in accordance with the approved plan.

Reason: To manage flooding and pollution and to ensure that a managing body is in place for the sustainable drainage system and there is funding and maintenance mechanism for the lifetime of the development.

And RESOLVED that the planning permission be REFUSED for the following reason:

The design, proportions and external finish of the proposed extension is at odds with the character of the Listed Building. The development would be an inappropriate addition which fails to preserve the character of the Conservation Area or the setting of the Listed Building, and is therefore contrary to Policies CS17 and CS18 of the Core Strategy, the NPPF and the Planning (Listed Building and Conservation Area) Act 1990.

4. That prior to the commencement of excavation works on site, the existing boundary facing the highway shall be reduced to a height not exceeding 1.1m above the carriageway level of the adjacent highway in accordance with details submitted to the Local Planning Authority and which have subsequently been approved (before development commences) and shall not be raised to a height exceeding 1.1m thereafter. Pla/160/01/17 Review of the Code of Planning Conduct and Practice

Members considered report G12/17 from the Deputy Chief Executive which reviewed the Council’s Code of Planning Conduct and Practice in relation to the operation of ‘minded to’ decisions. The Committee had previously deferred consideration of the subject matter to allow time for additional information to be provided. The Deputy Chief Executive indicated that if the Committee approved the recommendations within the report he would consult with the Chairman of the Scrutiny Co-ordination Board about whether the Board should also be consulted on the proposal prior to the matter being considered by Council.
