These are the October 2011 consultation letters and lists of addressees together with letters to district councils and libraries concerning public display copies of the Site Allocations Policies and Proposals Map.

Cumbria Minerals and Waste Development Framework Site Allocations Policies and Proposals Map Repeated Regulation 27 Consultations

In 2009 and 2010 we consulted you about the above policies and maps. They were subsequently submitted to the Secretary of State, examined by the Planning Inspectorate and formally adopted by the County Council in January 2011.

At a very late stage in the process, there was a successful legal challenge in connection with a procedural matter and the documents were quashed by the High Court. It is, therefore, necessary for the consultations to be repeated before the documents can be resubmitted to the Secretary of State.

The challenge was about the inclusion, without a further round of consultations, of an Area of Search for sand and gravel known as M12 Roosecote quarry extension in Site Allocations Policy 7. This Area of Search was intended as a possible replacement for the nearby sand and gravel quarry near Barrow in , which is a Preferred Area in the policy.

The Inspector who examined the documents, concluded that the Area of Search needed to be included in the policy. The document on which we are now consulting includes the Area of Search in Policy 7, but with a reduced area that relates better to field boundaries.

Copies of the Site Allocations Policies document and Proposals Map Insert G are enclosed, together with a CD of the other documents that are intended to be submitted. The documents can also be seen on the County Council website www.cumbria.gov.uk under Environment and Planning and then Minerals and Waste Development Framework.

Your comments on the documents are invited and need to be received no later than Monday 5 December 2011.

Repeated Regulation 27 Consultations

In 2009 and 2010 we consulted Corus about the above policies and maps. They were subsequently submitted to the Secretary of State, examined by the Planning Inspectorate and formally adopted by the County Council in January 2011.

At a very late stage in the process, there was a successful legal challenge in connection with a procedural matter and the documents were quashed by the High Court. It is, therefore, necessary for the consultations to be repeated before the documents can be resubmitted to the Secretary of State.

The challenge was about the inclusion, without a further round of consultations, of an Area of Search for sand and gravel known as M12 Roosecote quarry extension in Site Allocations Policy 7. This Area of Search was intended as a possible replacement for the nearby Roose sand and gravel quarry near Barrow in Furness, which is identified as a Preferred Area in the policy. The Inspector who examined the documents, concluded that the Area of Search needed to be included in the policy.

The documents can be seen on the County Council website, under Environment and Planning and then Minerals and Waste Development Framework, and at county council and district council offices. A statement about the consultation and the representations procedures is on the other side of this page.

Following the successful legal challenge to the adopted Site Allocations Policies, the County Council has decided to repeat the Regulation 27 publication and consultation stage with Area of Search M12 Roosecote quarry extension included in Policy 7. The change from the version that the County Council adopted in January is that a smaller Area of Search is now identified that relates better to field boundaries.

Copies of the Site Allocations Policies, Proposals Map Insert G and a CD with the other documents are enclosed and your Council’s comments are invited. These need to be received no later than Monday 5 December 2011.
