1.0 EXECUTIVE SUMMARY

1.1 This report provides the notes of the meeting of the Highways and Transportation Working Group (the Working Group) held on 21st February 2018 and includes recommendations for consideration by the Local Committee.

2.0 POLICY POSITION, BUDGETARY AND EQUALITY IMPLICATIONS AND LINKS TO CORPORATE STRATEGY

2.1 The policy position, links to corporate strategy, and the budgetary implications are set out in the individual Working Group reports previously circulated to Members.

3.0 RECOMMENDATIONS

3.1 that Local Committee note the Minutes of the Working Group meeting of 21st February 2018 attached as Appendix 1;

3.2 that

(1) The Local Committee approves the devolved highways revenue original allocations for 2018/ 2019 as set out in the appendix to the Working Group report and attached as Appendix 2 to this report

(2) The Local Committee approves the devolved highways capital original allocations for 2018/2019 and the named surface treatment, carriageway, footway and drainage scheme for 2018/2019 as appended to the Working Group report (and attached

146 as appendices 3, 4, 5, 6 and 7 to this report) with the following amendments:-

Carriageway resurfacing – Castle Crescent to replace Langdale Crescent.

3.3 that Local Committee note the briefing papers

(1) informing Members of progress made in delivering the 2017-18 Devolved Capital Programme since the last meeting of the HTWG (attached as appendix 8 to this report); (2) informing Members of progress made in respect of Mintsfeet TRO (attached as Appendix 9 to this report); and (3) setting out the next steps to Infrastructure Planning in . (attached as Appendix 10 to this report)

4.0 BACKGROUND 4.1 The Minutes of the Working Group held on 21st February 2018 are attached to this report at Appendix 1.

4.2 TheWorking Group at its meeting on 21st February considered a report by the Corporate Director – Economy and Highways which advised Members of the Local Committee’s devolved highways revenue allocations for 2018/19. The original allocation for 2018/19 is £1,152,017 which is the same as the allocation received in the 2017/18 financial year. Members considered the summary of the recommended devolved revenue allocations for 2018/19 as appended to the report.

Although the overall original allocation for 2018/19 is the same as 2017/18 the block allocations were varied slightly to reflect the Local Committees desire to undertake urban weed spraying during 2018/19. The £12,000 allocated was expected to be a third of the costs with the remainder of the cost to be shared between the Local Committee communities revenue budget and South Lakeland District Council.

The 2017/18 Devolved Highways Revenue Budget reported to Local Committee on 31 January 2018 and was predicted to overspend by £79,902, although the service was working to reduce this before the end of the financial year. It was agreed that devolved highways underspends and overspends as at 31 March 2017 be carried forward to 2017/18. Therefore it is expected that overspend incurred on the 2017/18 Devolved Highways Revenue Budget is likely to be carried forward into 2018/19 reducing the available funds for 2018/19 and restricting the delivery of works.

The Working Group recommended that South Lakeland Local Committee approve the devolved highways revenue provisional allocations for 2018/ 2019 as set out in the appendix to the Working Group report and attached as Appendix 2 to this report.

147 4.3 The Working Group also considered a report from the Corporate Director – Economy and Highways, regarding the Local Committee’s devolved highways capital allocations for 2018/19 and to make a recommendation to the South Lakeland Local Committee meeting on 26 March 2018. The original allocation for 2018/19 is £4,203,000 which is a reduction of £233,000 in the allocation received in the 2017/18 financial year. In addition the needs based allocation of £571,000 in the 2017/18 financial year had been removed from budget allocations. The summary of the recommended devolved capital allocations for 2018/19 was appended to the report.

The Working Group were asked to consider the proposed NPRN schemes for the 2018/19 financial year capital programme which was devolved to Local Committee, with indicative schemes for 2019/20 and 2020/21, and to make a recommendation to the South Lakeland Local Committee meeting on 26 March 2018.

The local Member for Kendal Nether requested that carriageway resurfacing works in Castle Crescent be undertaken as part of the 2018/19 programme of works with carriageway resurfacing of Langdale Crescent being deferred to a following year.

A Member asked for a presentation on the Priority Assessment Scheme to be given at the next meeting of the Highways and Transportation Working Group.

It was resolved that Highways and Transportation Working Group recommend to South Lakeland Local Committee to approve the devolved highways capital provisional allocations for 2018/2019 and the named carriageway, footway and drainage scheme for 2018/2019 as appended to the Working Group report and set out as Appendices 3 – 7 inclusive of this report with the following amendments:-

 Carriageway resurfacing – Castle Crescent to replace Langdale Crescent.

4.4 The Working Group received a briefing paper from the Highway Network Manager informing Members of progress made in delivering the 2017-18 Devolved Capital Programme since its last meeting.

It was recommended that the briefing paper, attached as Appendix 8 to this report, be noted.

4.5 The Working Group also received a briefing paper from the Corporate Director – Economy and Highways which updated and informed Members of the progress made to date on the Mintsfeet traffic regulation order (TRO).

It was recommended that the briefing paper attached as Appendix 9 to this report, be noted.

The full report with recommendations is presented to today’s Local Committee Meeting under a separate paper.

148 4.6 Consideration was given to a briefing paper by the Corporate Director – Economy and Highways which set out the proposed approach to the further development of infrastructure proposals for Kendal.

The report advised that developing the next stage of the business case for the Kendal Northern Access Route would be a major and costly exercise. South Lakeland District Council were starting to develop their next local plan and this would pose and answer major questions around land use and growth.

It was highlighted that certainty on the direction of future growth in the town would be vital for the business case to be effective. As the Local Plan had not yet been progressed there was a lack of certainty, creating the risk that a business case would be abortive or sub-optimal.

An extensive discussion took place regarding the importance of a Kendal Northern Access Route. The commitment of all parties moving forward was positive and it was agreed that an update be given at a future meeting.

It was recommended that the briefing paper, attached as Appendix 10 to this report, be noted.

4.7 Items for future meetings of the Working Group are set out in Paragraph 43 of the minutes which are attached as Appendix 1.

5.0 OPTIONS

5.1 The Local Committee may accept, amend or reject the recommendations.

6 RESOURCE AND VALUE FOR MONEY IMPLICATIONS 6.1 The non principal road highways revenue and capital works are devolved to Local Committee to determine and deliver within the overall revenue and capital budgets that Council has agreed and in accordance with the Council’s policies and the overall objectives as laid out in the current Local Transport Plan (recommendation 3.2). The devolved capital budget cannot be vired to the devolved revenue budget.

6.2 If the non principal road highways revenue or capital budgets are overspent at the end of 2017/18, any accelerated spend may be carried forward as a reduction to the 2018/19 budget. Local Committee may wish to note the potential future need to review the proposed allocations following any decision regarding the 2017/18 outturn.

7 LEGAL IMPLICATIONS 7.1 The legal implications in respect of the Recommendations is set out in the reports to the Working Group which are attached as Appendices which are attached to this report).

149 8 CONCLUSION 8.1 The Local Committee is asked to note or approve (where applicable) the recommendations set out in paragraphs 3.1 to 3.3 inclusive.

36 MINUTES

RESOLVED, that the minutes of the previous meeting held on 13 December 2017 be agreed with the following amendment:-

Removal of Mr G Cook in the attendance list as his name was included twice.

RESOLVED, that the minutes of the special meeting held on 10 January 2018 be agreed with the following amendments:-

Minute Number 33:-Spelling change of Breezon road to Beezon Road, and Spelling change of Strammongate to Stramongate

Matters Arising Under Minute Number 33- Wildman Street Trial, the Local Member for Kendal Nether informed the Committee that the Project Lead- Mr O David had walked the proposed route with her and felt reassured that there would be green space left.

152 A discussion took place regarding better ways to school and Members suggested that it be looked at in a future meeting.

39 UPDATE ON THE DELIVERY OF THE 2017/18 DEVOLVED AND NON DEVOLVED CAPITAL PROGRAMME

The Working Group received a briefing note from the Corporate Director – Economy and Highways. The briefing note informed Members of the progress made to date on delivering the 2017/18 devolved and non-devolved Capital Programme.

Members received commentary on progress of the following:-

Surface Treatment Programme (Surface Dressing)

Work was being done on the pre-surface dressing patching works required during 2017/18 for the 2018/19 surface dressing programme. Since the last meeting of the Highways and Transportation Working Group works had commenced on the PRN pre-surface dressing patching. All beds had been completed with the exception of the A6 surface dressing bed over Shap which had been suspended due to inclement weather. Works would recommence at the end of February/ early March depending upon weather. The NPRN patching had been ongoing when the weather and resources allowed.

Carriageway Resurfacing

Since the previous meeting of the Highways and Transportation Working Group the following carriageway resurfacing schemes had been delivered from the devolved and non-devolved capital programmes:-

 U5743 College Road Windermere

154 It was also programmed to undertake resurfacing works in March 2018 to conclude the devolved NPRN programme of works  U5847 Shap Road Industrial Estate, Kendal;  U808 Low Fellside Kendal

The IRP team had undertaken the following resurfacing works:-  A684 Hill Top  Mintsfeet Trading Estate  A6 works- currently ongoing

The Network Manager informed the meeting that since the report had been written the IRP team resurfacing of the A591 had been postponed from March 2018. A new date has yet to be agreed.

Footway Resurfacing

Since the last meeting of the Highways and Transportation Working Group the following footway resurfacing schemes had been delivered:-

 Birchwood Drive,  Kirk Flatt, Great Urswick  Mowbray Drive, Burton in Kendal  Sycamore Drive, Ulverston  Orchard Road, Bardsea

Works were ongoing at Castle Garth, .

Drainage Works

Since the last meeting of the Highways and Transportation Working Group drainage works had focussed mainly on reactive works.

Progress on the named schemes had been affected by both winter maintenance activity and the Highway Network Officer vacancy within the team, it was explained that this post was instrumental in delivering drainage projects. It was anticipated that the following named schemes would be delivered in the next financial year and were included in the named drainage schemes draft list for 2018/19 which was tabled at the meeting.

 Red Lane, Ulverston Local Lead Flood Authority colleagues were working with the local landowner to agree remediation measures. County Council Highways would contribute to the highway element of the scheme once agreed.

 Grange Fell Cemetery Soakaway Permission was still awaited from the parochial church council to install soakaway in the cemetery and formalise the natural drainage that was occurring.

155  Ambleside, The Struggle Investigation works were to be undertaken this financial year with measures next year.

 Natland, Natland Green Soakaway An agreement was required with the owners of The Green to progress improvements to existing soakaway.

 Kendal, Heron Hill and Rinkfield Confirmation was still awaited of ground conditions prior to installing a new pipe. Works were to be undertaken in 2018/19.

At the time of the meeting the County Council were still awaiting confirmation of a formal announcement that Cumbria had been awarded an additional £5m from DfT to further resilience to Bridges and Drainage assets. It was explained that the DfT were keen to see funding invested in resilience measures to ensure that the PRN network was accessible during times of poor weather. This was essential to ensure that goods and services could be delivered around the County and to promote economic growth within Cumbria. Highways Officers were collating together sites which would benefit from this investment across the County. This funding would enable the Local Committee funding to be directed at issues on the NPRN network for 2018/19 as detailed in the Draft Capital Programme report tabled at the meeting.

Winter Maintenance Activities The Highways Network Manager explained that although winter maintenance activity was not devolved to Local Committee and was funded centrally; the winter maintenance activity impacted on works delivered through Local Committee budgets as staff were diverted onto winter maintenance. Up to 12 February 2018 in the South Lakes Area (South Lakes and Barrow) 1054 winter treatments had been delivered. This compared to 587 treatments up to 12 February 2017 and 751 treatments for the whole of 2016/17 south area winter season.

The team had worked hard to ensure that, wherever possible, the named schemes in the capital programme be delivered, albeit to a revised programme, with other works such as IRP work and other maintenance activity, delayed.

RECOMMENDED, that the briefing paper be noted.

40 FOOTBRIDGES

Following on from a request to consider footbridges at a future meeting Members were asked what they wish to see on a future report. Members advised that they would like to receive information on damaged bridges and the plan for repair which they would be able to share with Members of the public.

156 41 BRIEFING NOTE FOR MINTSFEET TRAFFIC REGULATION ORDER

Members received a briefing note from the Corporate Director – Economy and Highways which updated and informed Members of the progress made to date on the Mintsfeet Traffic Regulation Order (TRO).

Members were informed that the TRO had been drafted and at the time of the meeting was being advertised and consulted upon as a statutory requirement. A copy of the full Statement of Reasons and Statutory Notice for the proposals were appended to the briefing note. Formal consultation and advertising began on Thursday 15 February 2018 and would finish on Friday 9 March 2018.

The Working Group were informed that a full report regarding the TRO with recommendations as to making the Order permanent would be presented to the Local Committee at its meeting on 26 March 2018. Officers had only received comments from the Parking Manager at this stage and therefore Members would receive a verbal update of responses received at the Local Committee meeting.

RECOMMENDED, that the briefing paper be noted.

42 INFRASTRUCTURE PLANNING AND NEXT STEPS IN KENDAL

The Working Group considered a briefing note from the Corporate Director – Economy and Highways which set out the proposed approach to the further development of infrastructure proposals for Kendal.

1.0 PURPOSE OF BRIEFING

1.1 The purpose of this briefing note is to inform Members of the progress made to date on delivering the 2017/18 devolved and non-devolved Capital Programme.

2.0 BACKGROUND

2.1 At the Local Committee meeting on 21st March 2017, Members approved the Devolved Capital Programme for 2017/18 together with indicative programmes for 2018/19 and 2019/20.

3.0 PROGRESS

3.1 The paragraphs below provide members with a commentary on progress.

3.2 Surface Treatment Programme (Surface Dressing)

Work is ongoing on the pre-surface dressing patching works required during 2017/18 for the 2018/19 surface dressing programme. Since the last meeting works have commenced on the PRN pre-surface dressing patching. All beds have been completed with the exception of the A6 surface dressing bed over Shap which has been suspended due to inclement weather. Works will recommence at the end of February/early March depending upon the weather. The NPRN patching has been ongoing when the weather allows and resources are available.

3.3 Carriageway Resurfacing

Since the last meeting of the HTWG the following carriageway resurfacing schemes have been delivered from the devolved and non-devolved capital programmes

It is also programmed to undertake resurfacing works in March 2018 to conclude the devolved NPRN programme of works.

3.4 Footway Resurfacing

Since the last meeting of the HTWG the following footway resurfacing schemes have been delivered

Birchwood Drive, Ulverston; Kirk Flatt, Great Urswick; Mowbray Drive, Burton in Kendal; Sycamore Drive, Ulverston and Orchard Road, Bardsea.

At the time of writing works are ongoing at

Castle Garth, Sedbergh.

The remaining footway resurfacing schemes listed below are still expected to be delivered before the end of the financial year although winter maintenance activity has taken priority over some planned work.

Cavendish Street, Ulverston and Main Street, Greenodd.

3.5 Drainage Works

Since the last HTWG drainage works have focussed mainly on reactive works.

Progress on the named schemes has been affected by both winter maintenance activity and the Highway Network Officer vacancy within the team. This post is instrumental in delivering drainage projects. It is now anticipated that the following named schemes will be delivered next financial year and are included in the named drainage schemes draft list for 2018/19 tabled today as a separate paper.

175 1) Red Lane, Ulverston – Local Lead Flood Authority colleagues are working with the local landowner to agree the remediation measures. CCC highways will contribute to the highway element of the scheme once agreed.

2) Grange Fell Cemetery Soakaway. Still awaiting permission from the parochial church council to install soakaway in the cemetery and formalise the natural drainage that is currently occurring.

3) Ambleside, The Struggle. Investigation works to be undertaken this financial year with measures next year.

4) Natland. Natland Green soakaway. Agreement required with the owners of The Green to progress improvements to existing soakway.

5) Kendal. Heron Hill and Rinkfield. Still awaiting confirmation of ground conditions prior to installing new pipe. Works to be undertaken in 18/19.

At the time of writing, Cumbria County Council expects a formal announcement that Cumbria has been awarded an additional £5m from DfT for further resilience to our Bridges and Drainage assets. The DfT are keen to see this funding invested in resilience measures to ensure, firstly, that the PRN network is accessible during times of poor weather. This is essential to ensure that goods are services can be delivered around the County and to promote economic growth within Cumbria. We are collating together sites which would benefit from this investment across the County. Receiving this additional funding will enable the Local Committee funding to be directed at issues on the NPRN network for 2018/19 as detailed in the Draft Capital Programme report also tabled at this meeting.

4.0 WINTER MAINTENANCE ACTIVITIES

4.1 The winter maintenance activity is not devolved to local committee and is funded centrally. However the winter maintenance activity does impact on works delivered through local committee budgets as staff are diverted onto winter maintenance. Upto 12th February 2018 in the South Area (South Lakes and Barrow) 1054 winter treatments had been delivered. This compared to 587 treatments up to 12th February 2017 and 751 treatments for the whole of the 2016/17 south area winter season.

4.2 The team have worked hard to ensure that, wherever possible, the named schemes in the capital programme have been delivered, albeit to a revised programme, with other works, such as some IRP works and other maintenance activity, delayed.

5.0 FUTURE REPORTS

5.1 A further briefing note will be presented to Members at the next meeting of the Working Group.

2.0 BACKGROUND

2.1 Cumbria County Council has received central government funding to improve productivity linked to the highway called the National Productivity Investment Fund (NPIF). One scheme that has been identified is for junction improvements to Mintsfeet Road / Shap Road.

2.2 Currently businesses, customers and residents exiting Mintsfeet Road onto Shap Road experience around a 1min delay. With the developments planned in SLDC’s Local Plan and the new Sainsbury’s development it has been modelled that this 1 min delay would increase to over 6min if nothing is done.

2.3 Following initial consultation it was considered that traffic lights would be the most suitable option for improvement to the junction. To improve the efficiency of the junction it was proposed in the consultation that a time limited parking restriction along Mintsfeet Road be introduced. It is felt that the restriction should be in place during business hours 8am to 6pm on Monday through to Saturday.

2.4 The restrictions are proposed to encompass the Mintsfeet Road / Shap Road junction and continue on Mintsfeet Road on both sides of the road. On the south side of Mintsfeet Road they would continue until the first junction on the left and on the north side they would continue outside the properties until the boundary of number 8/9. The proposal is indicated on the plan attached in Appendix 1

3.0 PROGRESS

3.1 The Traffic Regulation Order has been drafted and is now being advertised and consulted upon as is a statutory requirement. A copy of the full Statement

178 of Reasons and the Statutory Notice for the proposals are included as Appendix 2 and Appendix 3 to this briefing note.

3.3 Formal consultation and advertising of the Order, the statutory requirement for 21 days, began on Thursday 15th February 2018 to finish on Friday 9th March 2018. Letters were hand delivered to all affected properties and businesses on Mintsfeet Road and Shap Road and proposals were advertised in the Gazette on Thursday 15th February. The full list of consultees is attached as Appendix 4 to this briefing note.

3.4 At the time of writing this update Officers have received comments from only Austin Shields, Parking Manager. A verbal update on the responses received and the likely recommendations for the Local Committee report on 26 March 2018 to be given by Officers at the HTWG meeting.

4.0 NEXT STEPS

4.1 It is intended that a full report regarding the Traffic Regulation Order with recommendations as to the making of the Order permanent be presented to Local Committee at its meeting on 26 March 2018.

STATEMENT OF REASONS

Cumbria County Council considers that it is expedient to propose to make the above Order for the following reasons: -  for avoiding danger to persons or other traffic using the road or any other road or for preventing the likelihood of any such danger arising, or

 for facilitating the passage on the road or any other road of any class of traffic (including pedestrians) Cumbria County Council has received central government funding to improve productivity linked to the highway called the National Productivity Investment Fund (NPIF). One scheme that has been identified is for junction improvements to Mintsfeet Road / Shap Road.

Mintsfeet Road is a primarily industrial road with access to some residential properties. At present vehicles such as businesses, customers and residents exiting Mintsfeet Road experience delays joining Shap Road. Delays are expected to increase in future years following changes to land use on Shap Road. Following consultation with residents and businesses in Mintsfeet Road it was found that traffic signals would be the most effective improvement to the junction.

To ensure the efficiency of the junction it is proposed to introduce a No Waiting 8am – 6pm Monday to Saturday (single yellow line) restriction. The restriction is proposed over a short length of Mintsfeet Road near to the Shap Road end and a short section on Shap Road to ensure parked vehicles do not obstruct the use of the junction.

1. The Cumbria County Council hereby give notice that it proposes to make the above Order under Sections 1, 2, 19, 32, 35, 35A, 38, 45, 46, 47, 49, 51, 53 and 64 of the Road Traffic Regulation Act 1984.

2. The effect of the proposed Order will be to introduce “No Waiting, 8 am – 6 pm, Monday to Saturday” restrictions on: -

(i) both sides of Mintsfeet Road, Kendal, from a point 14 metres from its junction with Shap Road, extending for a distance of 60 metres in a westerly direction on the north side and for a distance of 38 metres on the south side; and (ii) on the west side of Shap Road, Kendal, from a point 10 metres from its junction with the northern kerb line of Mintsfeet Road in a northerly direction for a distance of 24 metres.

1.0 PURPOSE OF BRIEFING

1.1 The purpose of this briefing note is to set out a proposed approach to the further development of infrastructure proposals for Kendal.

2.0 BACKGROUND

2.1 In July 2016 the consultants Mott McDonald were commissioned to undertake a study to consider what infrastructure intervention could best deliver the following objective:

 Support delivery of the future strategic growth of the town;  Reduce congestion and increase the resilience within the town centre;  Improve resilience and accessibility to existing employment areas; and  Ensure that, when the M6 is closed, diverted traffic is not reliant on single lane bridges in Kendal.

2.2 These questions were strategic and the study advised that new road to the north of Kendal (connecting the A591 at Plumgarths roundabout with the A6/A685), the “Kendal Northern Access Route”, would be best placed to meet these.

2.3 Notwithstanding this recommendation, the study also identified benefits in delivering two-way traffic on Aynam Road primarily through the provision of a new bridge over the River Kent.

3.0 MOVING FORWARD

3.1 Department for Transport guidance is clear that the development of evidence for major transport proposals should take place on a phased basis with business cases required at the end of each phase.

3.2 Developing the next stage of the business case for the Kendal Northern Access Route will be a major and costly exercise. South Lakeland District Council are starting to develop their next local plan. This will pose and then answer major questions around land use and growth.

3.3 For any business case to be effective, certainty on the direction of future growth in the town will be important. In advance of the Local Plan progressing

184 we lack this certainty, creating the risk that a business case would be abortive or sub-optimal.

3.4 Within Kendal there has been significant transport planning activity over recent years. This includes:

 The Kendal Strategic Transport Infrastructure Study  The Kendal Town Centre Masterplan  Kendal Fell / A591 Junction  Kendal X and Kendal Transport Improvement Study

3.5 Each of these work areas have had differing objectives and resulted in differing conclusions aligned to their respective objectives.

3.6 This early stage in the development of the Local Plan creates opportunities. There is a chance to review all proposals; considering their relationships, and benefits to identify a “whole place” perspective on the potential phasing of improvements. It is suggested that this be the next step we take around infrastructure planning in Kendal.

3.7 As part of this process it would be possible to explore the wider and cumulative opportunities projects would create, for example less town centre flows may enable further prioritisation of sustainable travel.

3.8 Undertaking this work now will ensure momentum on a series of projects, but it is fundamental that there is robust evidence to support the development of business cases when they progress.

3.9 Funding for this work will need to be secured and it is proposed to undertake dialogue with partners to create a funding package. Subject to the confirmation of funding the next stage would be to develop a brief and commence procurement.

3.10 It should be pointed out that although the next stage of the study can suggest programme of enhancements, delivery funding for any improvements would need to be secured. This is a key challenge, but also highlights the need to develop a strong evidence based case for investment.

4.0 CONCLUSION

4.1 There is an essential need to ensure the integration of planning and infrastructure. This work proposed will bring the benefit of maintaining momentum on a number of schemes helping to create a balanced programme of enhancements that can support development of the next Local Plan and further business case development.
