Terms and Conditions

Entry Eligibility

1.1 This project is open to all residents of Braunton and surrounding areas including Marwood, Ashford, Heanton Punchardon, Chivenor, Wrafton, Saunton, Croyde, Georgeham, Mortehoe, Woolacombe, West Down, and those having a substantial connection having grown up here, aged 18 or over. If you are under 18 we are delighted you wish to take part but you must obtain parental or guardian consent to enter and claim any prize or Opportunity. You accept that we may require further information reasonably necessary to verify your eligibility.

1.2 By submitting an entry you are agreeing to be bound by these terms and conditions and the information set out in the publicity materials. If there is a conflict these terms and conditions take precedence.

1.3 Members of the Rotary Club of Braunton Caen and their immediate families ( which means their spouse or partner and children ) are eligible to enter and will be able to take part in any opportunities open to a group but will not be entitled to be selected for individual prizes

1.4 Entries for any Challenge must be received by the date stated in any publicity. Entries received after the closing date will not be accepted.

How to Enter

2.1 Entries must be made using the online form . You must enter a valid name and e-mail address and complete all the required fields in the form.

2.2 We accept no responsibility for entries that are lost, delayed, mislaid or damaged, regardless of the cause. This includes, for example, a technical malfunction of either the sender or us. Proof of submission is not proof of receipt.

Entries

3.1 Any entries which are deemed by us in our sole discretion not to be suitable for a family audience, are offensive in any way or promote political or religious views or tend to detract from principles of equality and diversity will not be accepted and no correspondence will be entered into.

3.2 Any entry may also be withdrawn at any time by us in our sole discretion for any failure to comply with these terms and conditions, cheating in any way, or exploiting the challenge or project in any way and no correspondence will be entered into.

3.3 You agree not to use your selection for public show or prize or opportunity for commercial gain.

3.4 There will need to be a selection made of work submitted and shown on the website social media and subsequently at any physical exhibition and you accept that your entry may not be displayed and acknowledge that by not being selected the reason for this is not because it falls within clause 3.1 or 3.2. The selection of work is at our sole discretion and work may be withdrawn from public show at any time

Prizes/Opportunities

4.1 We may for some challenges offer a prize or opportunity. This is not transferable and has no cash value. No alternative can be offered. 4.2 We will select winners in accordance with the details issued for the challenge from all completed and valid entries received by the closing date. Our decision will be final.

4.3 The winners will be notified by e-mail or telephone as soon as practicable after the selection. The winner must respond within 7 days to accept or will forfeit the prize or opportunity and another winner will be selected. If that person also does not respond to accept the prize within 7 days then the prize or opportunity will be forfeited and not offered to another person.

4.4 Details of the winners will be published giving their first name only ( unless the winner consents to their full name being published ) on Braunton Caen Rotary's website, Instagram, Facebook and Twitter sites.

Ownership of Entries

5.1 The copyright in any image, music or document sent in to us remains with you. You warrant that you own all rights to entries and that no third party rights are infringed. You agree to a non- exclusive licence of the rights in your entry to us without further consent or any payment. You allow the use of your entry until the close of the project or 30th June 2021, whichever is the earlier. You also retain the right to use the entry throughout that period for your own purposes. You authorise us to record, publish, reproduce, exhibit, transmit, broadcast, digitise, display and otherwise use the entry in any manner whatsoever and whether on the internet or social media or in printed format for any purpose connected with the project without further consent or any payment to you.

5.2 You agree to provide to us any physical work created from which the image is taken if an exhibition is staged and will deliver it to the venue and remove it at the end of the exhibition at their own cost. If you do not remove it at the end of the exhibition and further do not collect it from us where we choose to store it within 7 days we shall be entitled to destroy the work or otherwise deal with it as we think fit and at that point all rights in the work shall pass to us. All risk at any exhibition shall remain with you and we cannot be held responsible for any loss or damage to the work.

5.3 We reserve the right to edit any image of the entry within reason for the purpose of display on the website or social media.

General

6.1 We have the right to withdraw any prize or opportunity or close the project at any time. Any entry may be withdrawn from the display or removed from any competition at any time at our sole discretion.

6.2 We will not be liable for any loss or damage suffered ( including but not limited to indirect or consequential loss ) or for any personal injury suffered other than liability which cannot be excluded by law. We will not be responsible for any incorrect inaccurate or incomplete information communicated outside its reasonable control extending to technical malfunction

6.3 We are not responsible for any technical problems affecting any computor servers or software including damage to entrants' or other persons' computors resulting from participation in the project

6.4 Entry is deemed acceptance of these terms and condition and the Laws of England apply to the exclusion of any other law
