2020 MUNICIPAL BUDGET BY TITLE

WHEREAS, N.J.S. 40A:4-8, as amended by Chapter 259, P.L. 1995, provides that the budget may be read by title only at the time of the public hearing if a resolution is passed by not less than a majority of the full governing body, providing that at least one week prior to the date of hearing, a complete copy of the budget has been made available for public inspection; and WHEREAS, these two conditions have been met.

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Evesham, County of Burlington, State of New Jersey that the 2020 Municipal Budget shall be read by title only.

AN ORDINANCE AMENDING CHAPTER 97 OF THE TOWNSHIP CODE, CREATING A NEW SECTION 97-22.4 OF THE CLEAN COMMUNITY CODE TO BE ENTITLED “INTENTIONAL RELEASE OF BALLOONS PROHIBITED”

WHEREAS, the Township Council finds that balloons inflated with lighter than air gases and released into the air pose a danger and nuisance to the environment, particularly to wildlife and marine animals that are attracted to bright colors, and therefore, mistake them for food, which can cause severe injury, entanglement from balloon strings, and even death; and WHEREAS, the Township Council finds that Mylar balloons contain conductive material that when released can come into contact with power lines and electrical equipment, and can lead to damage resulting in power outages, fires, and possible injuries; and WHEREAS, several municipalities in the State have prohibited the intentional release of balloons inflated with lighter than air gasses due to the danger and nuisance such acts pose to the environment, particularly to wildlife and marine animals; and WHEREAS, the Township Council has determined that in order to protect the health, safety and welfare of the community, the intentional release of balloons containing lighter than air gases should be prohibited within the Township of Evesham.

NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Evesham in the County of Burlington, State of New Jersey that: SECTION 1. NEW SECTION. Section 97-22.4 of the Evesham Township Code entitled “Intentional Release of Balloons Prohibited” is hereby created as follows: § 97-22.4 Intentional Release of Balloons Prohibited. A. Intent. This ordinance is adopted in order to protect the environment, particularly marine and other wildlife, and the health, safety and welfare of persons and property by prohibiting the intentional release of balloons inflated with lighter than air gasses into the atmosphere.

B. Prohibited Conduct. It shall be unlawful for any person, corporation, firm or other entity to

C. Enforcement; Violations; Penalties. The enforcement of this section and penalty for violations shall be governed by Sections 97-23 and 97-24(B) of the Township Code.

SECTION 2. REPEALER. Any and all Ordinances inconsistent with the terms of this Ordinance are hereby repealed to the extent of any such inconsistencies. SECTION 3. EFFECTIVE DATE. This ordinance shall take effect upon its final passage, adoption, and publication on the earliest date permitted by law. SECTION 4. SEVERABILITY. If any section, paragraph, sentence, clause, phrase, term, provision or part of this ordinance shall be adjudged by a court of competent jurisdiction to be invalid or inoperative, such judgment shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the section, paragraph, sentence, clause, phrase, term, provision or part thereof directly involved in the controversy in which such judgment shall have been rendered.

AN ORDINANCE CREATING CHAPTER 65 OF THE TOWNSHIP CODE ESTABLISHING “STANDARDS FOR KEEPING CHICKENS ON RESIDENTIAL PROPERTY” IN THE TOWNSHIP OF EVESHAM AND AMENDING CHAPTER 160 OF THE TOWNSHIP CODE WHEREAS, the Township of Evesham (“Township”) has a long- standing history of supporting the “Right to Farm” through its adoption of Section 166-33.1 of its Zoning Code, which permits agricultural activities as a permitted use in all zoning districts that qualify for such protection by State Statute; and WHEREAS, the Township Council of the Township of Evesham (“Township Council”) has determined that in addition to the permitted agricultural activities, keeping chickens on residential property in the Township requires establishing safeguards and standards to ensure proper health and safety are maintained, as well as to protect against any related nuisance activities; and WHEREAS, the Township Council has determined that it is in the best interest of the health, safety, and welfare of the Township to revise the Township Code to incorporate standards for keeping chickens on residential property within the Township. NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Evesham in the County of Burlington, State of New Jersey that: SECTION 1. NEW SECTION. Chapter 65 of the Evesham Township Code entitled “Standards for Keeping Chickens on Residential Property” is hereby created as follows: § 65-1. General. A. Chickens may be kept and maintained on residential property within the Township of Evesham only in accordance with the provisions of this Chapter. The following general requirements shall apply:

i. The keeping and maintenance of chickens and other egg-laying poultry on residential property that is farmland assessed pursuant to the provisions of N.J.S.A. 54:4-23.1, the “Farmland Assessment Act of 1964,” is not subject to the provisions of this article.

§ 65-2. Definitions.

As used in this Chapter, the term “Animal Control Officer” shall mean a certified Municipal Animal Control Officer or, in the absence of such an officer, the chief law enforcement officer of the municipality or his or her designee.

B. As used in this Chapter, the term “residential property” shall mean property that is purposed as a Detached Single Family, Single Family Semi- Detached, or Duplex or Two-Family as defined in Section 160-5 of the Township Code. Further, for the purposes of this Chapter “residential property” shall not include property that is purposed as a Townhouse or Apartment House or Multiple Dwelling as defined in Section 160-5 of the Township Code.

C. As used in this Chapter, the term “chickens” shall include hens but shall not include roosters.

D. As used in this Chapter, the term “shelter” or “coop” refers to an accessory structure where female chickens or poultry are typically kept secure consisting of an indoor area containing nest boxes for egg-laying and perches on which the birds sleep, as well as a fenced-in outdoor area typically made from chicken wire or similar non- solid fencing capable of containing the chickens, where chickens feed and may roam during the day.

E. As used in this Chapter, the term “licensing authority” refers to the Township Clerk.

§ 65-3. License Required. A. No person shall be permitted to keep chickens on their residential property in accordance with this Chapter without having first obtained a license from the licensing authority.

B. No license shall be issued unless the applicant is the owner of the land to be used to keep the chickens, or if renting, has the permission of such owner. Further, the licensure or keeping of chickens under this Chapter is only permitted so long as such activity is not prohibited or restricted by any master deed, covenants, restrictions, easements, homeowners' association documents, including bylaws, and any similar documents as well as any amendments to any such documents. Applicants who are part of a homeowners’

C. Any person who shall own, keep or harbor a chicken on residential property pursuant to this Chapter shall apply for and procure a license from the licensing authority for each such chicken, which license shall expire on January 31 of the following year. License renewals shall be obtained for each chicken in the month of January of each subsequent year from the Township Clerk. i. Any person who shall fail to procure a license renewal for any chicken pursuant to this Chapter by January 31 of any year shall pay a late fee in addition to the licensing fee in accordance with the fee schedule contained in Chapter 72 of this Code. Said licenses and renewals thereof shall expire on the last day of January of the following year.

D. Before obtaining a license, the applicant must certify: i. he or she has taken necessary measures to educate themselves about raising chickens or other egg laying poultry. Such measures include but are not limited to education regarding hygiene and sanitation, appropriate fencing and knowledge of veterinarians who specialize in poultry; ii. he or she is the owner of the residential dwelling and the property where the coop is located, or if an applicant rents his or her residential dwelling, has obtained permission from the property owner to keep and maintain chickens on said property; iii. he or she has provided and will maintain an appropriate shelter or coup for the number of chickens sought to be licensed and has obtained all necessary permits and approvals required for such accessory building or structure; iv. his or her keeping of chickens under this Chapter is not prohibited or restricted by any master deed, covenants, restrictions, easements, homeowners' association documents, including bylaws, and any similar documents as well as any amendments to any such the documents. Applicant must affirmatively

The applicant’s lot meets the required definition of residential property under Section 65-2(B) of this Chapter and the size of the applicant’s lot meets the minimum lot size required under Section 65-4(D) for the number of chickens he or she is seeking to license.

§ 65-4. General Regulations. A. The keeping of roosters is prohibited.

B. The sale of eggs or other chicken by-products is prohibited.

C. The slaughtering of chickens owned or kept by a licensee pursuant to this Chapter on the residential property, or otherwise in public view, is prohibited.

D. The number of chickens permitted will be based upon the lot area of the residential property in question in accordance with the following table:

E. No owner of any chicken nor any person in charge of any chicken shall suffer or permit such animal to run at large upon any public street, public park, public building or other public place within the Township, or on private property without the permission of the owner of said property or other person having control thereover.

F. Every person owning, keeping or harboring any chicken under this Chapter shall prevent such chicken from running at large upon the lands of any person, other than the person owning, keeping or

G. No person who shall own or be in charge of any chicken shall cause, suffer or allow such chicken to soil, defile, defecate on or commit any nuisance on any common thoroughfare, sidewalk, passageway, bypath, play area, park or any other place where people congregate or walk or upon any public property whatsoever or upon any private property, without the permission of the owner or person in control of said property.

H. Every person owning, keeping or harboring any chickens pursuant to this Chapter shall prevent such chickens from becoming a public nuisance.

I. The shelter and adjoining areas must be kept clean and free from vermin and rodents.

J. The resident or owner (as appropriate) shall be obligated to notify the Animal Control Officer within ten (10) days of any rapid die-offs of their flock.

K. Any person who shall own, keep or harbor a chicken shall provide it with proper and adequate food and water, proper shelter and protection from the weather and with humane care and treatment. No person shall inhumanely beat, ill-treat, torment or otherwise abuse a chicken.

§ 65-5. Violations. A. The governing body shall have the power to appoint annually an Animal Control Officer who shall enforce the provisions of this Chapter.

B. The Animal Control Officer shall take into custody and impound or cause to be taken into custody and impounded and thereafter destroyed and disposed of any chicken, whether licensed or not:

i. that shall be found running at large upon any public street or other public place at any time, or

ii. that is being kept in a manner that is in violation of any regulations listed in this Chapter.

Any officer or agent authorized or empowered to perform any duty under this chapter is hereby authorized to go upon any premises to seize for impounding any chicken which he or she may lawfully seize and impound when such officer is in immediate pursuit of such chicken, except upon the premises of the owner of the chicken if said owner is present and forbids the same.

D. No person shall hinder, molest or interfere with anyone performing any duty which he or she is authorized or empowered to perform under this chapter.

§ 65-6. Required Shelters. A. Chickens shall be housed in structures commonly known as “coops” with enclosed runs, which shall be maintained to ensure the safety of the chickens and individuals. The following minimum standards shall be maintained at all times:

i. Each shelter and enclosed run shall be located in the rear yard only of a residential property.

ii. Each shelter and enclosed run shall be located at least ten (10) feet from any property line and at least fifteen (15) feet from any principal residential dwelling unit on an adjoining property. This fifteen (15) foot setback does not include garages either attached or detached, or other accessory buildings and structures.

iii. Shelters may not exceed 100 square feet in area, or eight (8) feet in height.

iv. Fences for each enclosed run shall be a minimum of four (4) feet in height and shall not exceed a maximum of six (6) feet in height, and shall comply with §160-22 Fences.

v. Each shelter and enclosed run and all areas within which chickens are allowed to roam shall be kept clean and free from vermin and rodents.

Chickens may be permitted to roam outside of the shelter and enclosed run during daylight hours in the side and rear yards only of the residential property only if said residential property is appropriately fenced in accordance with the Township Code.

vii. Shelters established under this Chapter shall constitute accessory buildings pursuant to Chapter 160, Section 160-13 of the Township Code, but shall not count toward the maximum permitted Impervious Coverage or Building Coverage for the zone.

§ 65-7. Penalties. Any individual owning, keeping, maintaining, or harboring a chicken in violation of this Chapter shall be liable for penalties as prescribed by Article I, Chapter I, Section 1-15 of the Township Code. SECTION 2. AMENDED SECTION. Subsections D and E of Chapter 160, Section 160-13, titled “Accessory Buildings”, are hereby amended and supplemented as follows: D. Location. An accessory building may be erected in side and rear yard areas and not in front yards and shall be set back from side and rear lot lines as prescribed in this chapter, except that, if erected on a corner lot, the accessory building shall be set back from the side street to comply with the setback line applying to the principal building for that side street and, except further, that no poultry or livestock shelter shall be erected nearer than one hundred (100) feet to any lot lines, and any shelter or coop for the keeping of chickens on residential property pursuant to Chapter 65 of the Township Code shall only be erected in rear yard areas and not nearer than ten (10) feet to any lot lines. E. Chicken coops or shelters are considered accessory buildings as applicable for the purposes of this Chapter, and are exempt from obtaining a zoning permit provided they comply with all provisions of Chapter 65 of the Township Code. Said coops shall not count toward any Building or Impervious Coverage limitations of the respective zoning district. All runs or enclosures shall comply with §160-22 Fences, except that runs attached to compliant coops that are no higher than 4 feet in height, less than 100 square feet in area, and otherwise comply with the fence

AN ORDINANCE OF THE TOWNSHIP OF EVESHAM AMENDING CHAPTER 72 OF THE CODE OF THE TOWNSHIP OF EVESHAM (SCHEDULE OF FEES) BY ESTABLISHING RESIDENTIAL CHICKEN REGISTRATION FEES

BE IT ORDAINED by the Township Council of the Township of Evesham, County of Burlington, State of New Jersey, as follows:

SECTION 1. CHAPTER 72 OF THE CODE OF THE TOWNSHIP OF EVESHAM AMENDED BY ADDITION:

Chapter 72 of the Code of the Township of Evesham (Schedule of Fees) be and hereby is amended by addition. Section 72-1 of the Code of the Township of Evesham under the subheading Miscellaneous Fees and Services shall be amended to read as follows:

SECTION 2. INCONSISTENT ORDINANCES:

Any ordinances or portions thereof, which are inconsistent with the provisions of this Ordinance, are hereby repealed as of the effective date of this Ordinance.

SECTION 3. DECLARATION OF INVALIDITY:

If any provision of this ordinance, or the application of any such provision to any person or circumstance, shall be held invalid, the remainder of this ordinance shall not be affected thereby. The provisions found or held to be invalidated shall be stricken and the remaining provisions shall be considered severable and shall continue in full force and effect

RESOLUTION APPROVING LETTER OF INTENT WITH FIELDSTONE ASSOCIATES, LLC FOR TOWNSHIP’S FORMER PUBLIC WORKS FACILITY

WHEREAS, the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq. as amended and supplemented, ("Act") provides a process for Redevelopment Entities to participate in the redevelopment and improvement of areas designated as in need of redevelopment; and WHEREAS, in order to stimulate redevelopment for the Township of Evesham, the Township has formally designated the property within the Township which formally housed the Township’s Department of Public Works yard (the “Project Site”) as an "area in need of redevelopment" in accordance with the Act; and WHEREAS, the Township has engaged with Fieldstone Associates, L.P. which owns and has developed the lands surrounding the Project Site with multi-family housing, in discussions directed toward facilitating the redevelopment of the Project Site in a fashion consistent with the Township's vision and the existing Redevelopment Plan; and WHEREAS, the Township believes, according to Fieldstone Associate's proposal and representations, that Fieldstone Associates, L.P. is able and willing to implement a redevelopment project that will positively affect the surrounding community and further the best interests of the Township and its citizens and the Township desires to designate Fieldstone Associates, L.P. as Redeveloper; and WHEREAS, the Township desires to approve of letter of intent between the Township and the Redeveloper, substantially in the form attached hereto as Exhibit A (the “Letter of Intent”), concerning the development of the Project Site and directing that the Township’s professionals and consultants to draft of Redevelopment Agreement on terms consistent with the Letter of Intent, and, upon proper application by the Redeveloper or affiliate thereof, a Financial Agreement for the Project, each C:\Users\EASYPD~1\AppData\Local\Temp\BCL Technologies\easyPDF 105 8\@BCL@E00E0EB5\@[email protected] agreement consistent with the terms and conditions set forth in the Letter of Intent.

NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Evesham, County of Burlington, and State of New Jersey that Fieldstone Associates is hereby designated as Redeveloper for the Project Site as set forth above; provided however that such designation shall terminate if the Redevelopment Agreement is not executed within one year of the date of this Resolution; and

AND BE IT FURTHER RESOLVED, that the Township Manager and Township Clerk are hereby authorized to execute the Letter of Intent with Fieldstone Associates, L.P.;

AND BE IT FURTHER RESOLVED, that the Township Manager, Director of Community Development and Township Attorney are hereby authorized to draft a Redevelopment Agreement and, upon proper application by the Redeveloper or affiliate thereof, a Financial Agreement based on the terms and conditions set forth in the Letter of Intent and to present such agreements to the Township Council of the Township of Evesham for approval.

WHEREAS, permission is required of the Director of the Division of Local Government Services for approval as a dedication by rider of revenues received by a municipality when the revenue is not subject to reasonable accurate estimates in advance; and

WHEREAS, N.J.S.A. 39:4-139.9 provides for receipt of assessed parking offense penalties by the municipality to provide for the operating costs to administer this act; and

WHEREAS, N.J.S.A. 39:4-139.9 provides the dedicated revenues anticipated from the Parking Offenses Adjudication Act are hereby anticipated as revenue and are hereby appropriated for the purpose to which said revenue is dedicated by statute or other legal requirement.

RESOLUTION INCREASING THE BID THRESHOLD AND APPOINTING A QUALIFIED PURCHASING AGENT

WHEREAS, the recent changes to the Local Public Contracts Law gave local contracting units the ability to increase their bid threshold up to $44,000.00; and WHEREAS, N.J.S.A. 40A:11-3a, permits an increase in the bid threshold if a Qualified Purchasing Agent is appointed as well as grants the authorization to negotiate and award such contracts below the bid threshold; and WHEREAS, N.J.A.C. 5:34-5 et seq. establishes the criteria for qualifying as a Qualified Purchasing Agent; and WHEREAS, Elizabeth Peddicord possesses the designation of Qualified Purchasing Agent as issued by the Director of the Division of Local Government Services in accordance with N.J.A.C. 5:34-5 et seq.; and WHEREAS, the Township of Evesham desires to take advantage of the increased bid threshold;

NOW, THEREFORE, BE IT RESOLVED, that the governing body of the Township of Evesham, in the County of Burlington, in the State of New Jersey hereby increases its bid threshold to $44,000.00; and BE IT FURTHER RESOLVED, that the governing body hereby appoints Elizabeth Peddicord as the Qualified Purchasing Agent to exercise the duties of a purchasing agent pursuant to N.J.S.A. 40A:11-2(30), with specific relevance to the authority, responsibility, and accountability of the purchasing activity of the contracting unit; and BE IT FURTHER RESOLVED, that in accordance with N.J.A.C. 5:34- 5.2 the local unit Clerk is hereby authorized and directed to

RESOLUTION OF THE TOWNSHIP OF EVESHAM AUTHORIZING THE ACCEPTANCE OF A STATE OF NEW JERSEY SFY 2020 SAFE AND SECURE COMMUNITIES GRANT

WHEREAS, the Township of Evesham was awarded a grant in the amount of $60,000 through the 2020 Safe and Secure Communities Grant Program; and WHEREAS, said grant award will be supported by $206,191.55 in matching funds, provided by the Township of Evesham in the form of salary and fringe benefits not covered by the grant award, towards this project for a total project cost of $266,191.55; and WHEREAS, said grant award has been assigned the Sub-Award # of P-20-0313 by the State of New Jersey, Office of the Attorney General, Department of Law and Public Safety; and WHEREAS, the Township of Evesham has between 07/25/2019 and 07/24/2020 to complete all project related activities associated with said grant award.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Evesham that:

1. The Township of Evesham is hereby authorized to accept said grant award for the purposes described within the grant application.

RESOLUTION AUTHORIZING THE CANCELLATION AND REFUND OF PROPERTY TAXES BLOCK 32.07, LOT 2

100% Totally & Permanently Disabled Veteran

WHEREAS, the Evesham Township Tax Collector has informed the Evesham Township Council that certain taxes are to be cancelled and refunded for Block 32.07, Lot 2, since the owner of the lot in question is a totally disabled veteran and has overpaid taxes, as reported in the Tax Collector’s memorandum dated July 6, 2020, attached hereto and made a part hereof; and WHEREAS, N.J.S.A. 54:4-3.30 et seq. permits the exemption from property taxes for any citizen and resident of the State who is a 100% Totally and Permanently Disabled Veteran; and WHEREAS, the United States Department of Veteran Affairs has classified the veteran, Gary P. WHEREAS, in accordance with N.J.S.A. 54:3-27.2, the Tax Collector, by way of a Memorandum dated June 19, 2020, has informed the Township Council that a certain owner of certain blocks and lots has overpaid a certain amount of taxes with respect to a certain year for the reasons set forth in said Memorandum, a copy of which is attached hereto and made a part hereof; and WHEREAS, the Tax Collector has recommended that the Township Council refund said overpayment of taxes to said owner; and WHEREAS, the Township Council may revise or adjust taxes when in error and desires to act favorably on the Tax Collector’s recommendation.

SUMMARY: Resolution No. 247-2020: Award of Contract - 2020 Tree and Stump Removal and Tree Trimming Services Department of Public Works

RECOMMENDED ACTION:

One of the many responsibilities of the Public Works Department is the maintenance and trimming of trees on township property as well as addressing public safety issues as they relate to trees throughout the township’s right- of-ways. Currently, as well as the past several years, tree work has been outsourced to a professional tree contractor working for the township under an approved contract for these services. Bid specifications and related pricing has four categories which are required in this contract. These categories are complete tree removal, stump grinding, emergency tree removal, tree trimming and Brush/Vegetative Debris Collection. Tree and stump removal pricing is based on the diameter measurement of the tree or stump. Emergency tree removal and trimming and debris collection are an hourly rate.

Several bid packets were sent to vendors with bids received and opened on June 19, 2020. Hyperion Tree Service submitted the best overall pricing as well as having all satisfactory references for comparable services and contracts. In addition, Hyperion’s proposal included all services as required and had no deviations to the bid specifications.

Based on the bid results and additional required bid information, I recommend the contract be awarded to Hyperion Tree Service with a not to exceed amount of $150,000.00. Hyperion Tree Service is also known by the Public Works Department to provide a quality and professional level of service. The contract term will be from 7/14/2020 through 7/13/2021, with a renewal option of one additional year if both parties are in agreement. Since this will be an as needed service, a certification of funds is not included.

AWARD OF CONTRACT 2020 TREE AND STUMP REMOVAL AND TREE TRIMMING SERVICES DEPARTMENT OF PUBLIC WORKS

WHEREAS, the Township of Evesham has determined to provide for the 2018 Tree and Stump Removal and Tree Trimming Services for the Department of Public Works in the Township of Evesham, said services being more particularly described in specifications which are on file in the Office of the Township Clerk and available for public inspection during regular business hours; and WHEREAS, the Township Manager has informed the Township Council that the cost of the aforementioned items will be paid with municipal funds and will exceed $40,000.00 in the current fiscal year; and WHEREAS, N.J.S.A 40A:11-4 states that a contract, the cost of which will exceed $40,000.00 in the fiscal year, shall be awarded only after public advertising for bids and bidding therefor; and WHEREAS, the Superintendent of Public Works has informed the Township Council that he has publicly advertised for bids and has received and opened bids in the Municipal Complex on June 19, 2020 in accordance with the Local Public Contracts Law for the purpose of awarding a contract for the aforementioned purpose. The Superintendent of Public Works has informed the Township Council that a certain entity is the lowest qualified responsible bidder for said contract and has recommended that the Township award such contract to said entity; and; WHEREAS, this is an open end contract and the Township is not obligated to order, accept or pay for the goods and services hereunder until an order is placed, and required certification of available funds shall be made when goods or services are ordered.

This agreement made and entered into this day of ______, 2020 by and between the TOWNSHIP OF EVESHAM, having its principal place of business at 984 Tuckerton Road, Marlton, New Jersey 08053 (hereinafter referred to as “Township”) and HYPERION TREE SERVICE, P.O. Box 569, Moorestown, New Jersey 08057 (hereinafter referred to as “Contractor”);

W I T N E S S E T H

WHEREAS, the Township of Evesham, pursuant to the Local Public Contract Law, solicited bids for the purpose of providing for the 2020 Tree and Stump Removal and Tree Trimming Services for the Department of Public Works; and WHEREAS, the Contractor has submitted the lowest, qualified, responsible bid, and the Township Council, by way of a resolution, has accepted same and awarded a contract for said purpose. NOW, THEREFORE, in consideration of the mutual covenants, terms and conditions, the parties hereby agree as follows: 1. MATERIALS AND SERVICES. The Contractor shall provide for the 2020 Tree and Stump Removal and Tree Trimming Services on an “as needed” basis in accordance with the terms and conditions of the Notice to Bidders, Instructions to Bidders, specifications, and the Bid Proposal, hereinafter referred to as the Bid Documents, copies of which are on file in the Office of the Township Clerk and available for public inspection during regular business hours. 2. COMPENSATION. The Contractor shall receive payment as set forth in his bid proposal dated June 19, 2020 and in the manner specified in the bid documents; total payment for the term of this contract shall not exceed $150,000.00. This is a term contract permitting the purchase of items at a stated price on an

TERM. The term of this agreement shall be for twelve (12) consecutive months commencing July 14, 2020 to July 13, 2021, with an option to renew for an additional twelve (12) months by mutual agreement, for the aforesaid purpose for a price not to exceed the cost of the items specified in the bid proposal in a twelve (12) month period for the term of the contract. 4. AFFIRMATIVE ACTION MANDATORY LANGUAGE. See Exhibit A attached hereto. 5. INSURANCE. The Contractor shall provide and maintain all the necessary insurance including, but not limited to, workmen’s compensation, general liability, automobile and professional liability in the amounts and in the type as recommended by the Township insurance broker and as referenced in the bid documents. 6. HOLD HARMLESS. The Contractor shall indemnify and save harmless the Township, its officers, employees and agents for all claims, suits or actions brought against the said Contractor, its officers, employees and agents, for or on account of any injuries or damages received or sustained by any party or parties by or from the acts of Contractor or its servants, agents and employees in doing the work and rendering the services herein contracted for, or by or in consequence of any negligence in operations or any improper material or equipment used, or on account of any act or omission of Contractor or of its servants, agents and employees; or account of or in consequence of the performance of this contract; and also from all claims or damage for infringement or any patent in fulfilling this contract. This indemnity shall include attorneys’ fees and costs and all other expenses incurred in the defense of any suit.

The Contractor shall comply with the requirements of the American Disabilities Act where applicable. 8. TERMINATION. The Township reserves the right to terminate the contract upon fourteen (14) days notice. The contractor may terminate the contract upon fourteen (14) days notice in the event the Township fails to comply with its responsibilities under the terms of this Agreement. 9. CHOICE OF LAW/FORUM/VENUE. In the event that any disputes arise between the parties, or should any litigation be instituted over this Contract, this Contract shall be governed by the laws of the State of New Jersey. Moreover, any action that might arise between the parties, arising from this Contract, shall be venued in the Superior Court of New Jersey, Law Division, Burlington County, New Jersey. 10. INTEGRATION. The parties agree that the terms and conditions of this Agreement contain the Complete Agreement of the parties and any oral understandings to the contrary are specifically disavowed.

One of the many responsibilities of the Public Works Department is the maintenance and trimming of trees on township property as well as addressing public safety issues as they relate to trees throughout the township’s right-of-ways. Currently, as well as the past several years, tree work has been outsourced to a professional tree contractor working for the township under an approved contract for these services. Bid specifications and related pricing has four categories which are required in this contract. These categories are complete tree removal, stump grinding, emergency tree removal, tree trimming and Brush/Vegetative Debris Collection. Tree and stump removal pricing is based on the diameter measurement of the tree or stump. Emergency tree removal and trimming and debris collection are an hourly rate.

Several bid packets were sent to vendors with bids received and opened on June 19, 2020. Hyperion Tree Service submitted the best overall pricing as well as having all satisfactory references for comparable services and contracts. In addition, Hyperion’s proposal included all services as required and had no deviations to the bid specifications.

Based on the bid results and additional required bid information, I recommend the contract be awarded to Hyperion Tree Service with a not to exceed amount of $150,000.00. Hyperion Tree Service is also known by the Public Works Department to provide a quality and professional level of service. The contract term will be from 7/14/2020 through 7/13/2021, with a renewal option of one additional year if both parties are in agreement. Since this will be an as needed service, a certification of funds is not included.

RECOMMENDED ACTION:

Revisions made, which included reducing the square footage to the Building 3 addition project, created the need to shift some of the proposed use over to Building 6, both located at 100 Sharp Road. To properly execute this plan, Building 6 will require a restroom to be constructed. A proposal from RYEBREAD was received to provide the professional services to engineer and design, complete the bidding process and construction administration for the restroom.

Therefore, I’m requesting to amend the current Building 3 contract with RYEBREAD to include this additional work. The amount proposed for their service is a total of $10,350.00. A copy of RYEBREAD’s proposal is included for review.

RECOMMENDED ACTION: I would like to recommend that a Resolution be prepared and scheduled for Council’s consideration at the next regular Council Meeting. The Police Department has been very happy working with Extra Duty Solution for the scheduling and financial obligations of all extra duty employment required of the Department to keep the town safe. The initial 2018 contract agreement will continue as stated through 12/31/2020.

RENEWAL OF CONCESSION CONTRACT FOR VENDOR TO ADMINISTER EXTRA DUTY SERVICES AND RELATED CONCESSION RIGHTS

WHEREAS, by Resolution 31-2018, the Township Council authorized competitive contracting procedures for the procurement of a Vendor to Administer Extra Duty Services and Related Concession Rights in accordance with N.J.S.A. 40A:11-4.1 et seq.; and WHEREAS, after public advertisement and opening of singular received proposal on April 10, 2018, Extra Duty Solutions was awarded a contract by way of previous resolution for a Vendor to Administer Extra Duty Services and Related Concession Rights for the Police Department, for the period May 8, 2018 to December 31, 2018, with the option for one-year renewals not to exceed five years, with the collection of administrative fees directly from contractors/clients (excluding Evesham Township), adopted on May 8, 2018; and WHEREAS, the Chief of Police has advised Township Council that, based upon the provisions of said proposal, the Contractor has requested renewal of the contract for the period of May 9, 2019 to December 31, 2020; and WHEREAS, the Township Council deems it in the best interest of the Township to renew said contract as provided by the provisions of the attached specifications.

NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Evesham, County of Burlington, State of New Jersey, as follows: 1. WHEREAS, Section 111-14 of the Code of Evesham Township states that it shall be unlawful either directly or indirectly for any itinerant merchant who holds a license to operate or conduct a business at the location of a Special Event, which is to be held on certain days or to conduct or operate said business within five hundred (500) feet from the boundaries of said Special Event in any direction; and WHEREAS, Section 111-14 states that the Township Council shall by resolution designate the Special Event, informing the public of the location of the Special Event, and the requirement that only permit holders may sell articles of value at said location or within five hundred (500) feet of the boundaries of said location; and WHEREAS, the Township Council has been informed that the Evesham Harvest Fest is scheduled for September 26, 2020, from 10:00 AM to 4:00 PM and wishes to designate said day as a Special Event Day. CLOSING OF PORTION OF MAIN STREET FOR 2020 EVESHAM HARVEST FEST SUBJECT TO APPROVAL OF BURLINGTON COUNTY BOARD OF CHOSEN FREEHOLDERS

WHEREAS, the Township Council of the Township of Evesham has determined that the annual Evesham Harvest Fest will be held on Saturday, September 26, 2020 from 10:00 AM to 4:00 PM in and along a certain location on Main Street from Maple Avenue to Plymouth Drive; and WHEREAS, the Coordinator of said event has requested that said portion of Main Street be closed; and WHEREAS, Title 39 provides that the Municipality may adopt, by resolution, and for a temporary and lawful public purpose, a regulation as authorized by Title 39 with respect to prohibiting the use of public streets in accordance with the temporary conditions with respect to time and date to be imposed by the governing body; and WHEREAS, the Township Council has reviewed the aforementioned request and desires to act favorably with respect thereto.

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Evesham, in the County of Burlington, State of New Jersey as follows: 1. That the Township Council, for the aforementioned reasons, hereby determines that Main Street, from the intersection of Maple Avenue to Plymouth Drive, shall be closed to vehicular traffic from 8:00 AM to 6:00 PM on September 26, 2020. 2. WHEREAS, the Township is the owner of a residential unit located at 111 Quail Road, Whitebridge Village that is identified on the Tax Map as Block 17, Lot 7, C0111 which is deed restricted as an affordable housing unit for low or moderate income residents; and WHEREAS, the Township wishes to sell the property and as such has affirmatively marketed the property pursuant to the Uniform Housing Affordability Controls (UHAC) and specifically N.J.A.C. 5:80-26.15 ; and WHEREAS, pursuant to UHAC the maximum restricted resale price of the unit is $91,039.00; and WHEREAS, Riccardo Caponi has agreed to purchase the unit for the agreed upon sale price of $68,000.00; and WHEREAS, upon the sale, the unit will again be deed restricted for low or moderate income residents for an additional period of 30 years and Evesham Township will receive a unit of credit for its cumulative Third Round Affordable Housing obligations under the Mount Laurel doctrine and the Fair Housing Act (“FHA”); and WHEREAS, the Township believes the sale to be in the public interest and to meet the Township’s Third Round Affordable Housing obligations and the Township’s Constitutional obligation to provide affordable housing to low and moderate income individuals; and WHEREAS, the agreements and understandings of the parties with regard to the above have been documented in the Contract of Sale that is attached hereto as Exhibit “A”, the terms and provisions of which are incorporated by reference herein as if set forth herein at length; and WHEREAS, the purpose of this Resolution is to accept the terms of the Contract of Sale and authorize its execution on behalf of the Township.

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Evesham that:

The Township Manager and Clerk are authorized to execute any and all documents necessary to convey the Property to Riccardo Caponi on or before ______provided that if Riccardo Caponi does not close on the purchase of the property on or before ______, the authority to convey the property to Riccardo Caponi shall be and is hereby rescinded. 2. The Township Manager and Clerk are authorized to execute the Contract of Sale with Riccardo Caponi for the purposes set forth above.
