Communication from the Commission pursuant to Article 4 ( 1 ) (a) of Council Regulation (EEC) No 2408/92 Imposition of public service obligations on scheduled airline services within (95/C 199/03)

1 . Pursuant to the provisions of Article 4 ( 1 ) (a) of Council Regulation (EEC) No 2408 /92 of 23 July 1992 on access for Community air carriers to intra-Community air routes , France has decided to impose public service obligations on the scheduled airline services operating on the following routes , in accordance with the decision by the Corsican authorities :

— Marseille—

— Marseille—

— Marseille—Calvi

— Marseille—Figan — —Ajaccio

— Nice—Bastia

— Nice—Calvi

— Nice——Ajaccio

— Toulon—Bastia

2 . Since is an island, the public service obligations are as follows :

2.1 . in terms of the minimum frequencies , timetables , types of aircraft used and seating capacity supplied : (a) — the frequencies between Marseille and Ajaccio are as follows : (i) at least three round trips per day, from Monday to Friday, apart from statutory holidays , (a) in the morning and evening in such a way as to enable customers to make a round trip in one day and spend at least nine hours at their destination, in either Ajaccio or Marseille ; (b) during the middle of the day ; (ii) at least three round trips per day, evenly distributed throughout the day, on Saturdays and Sundays . — The services must be non-stop between Ajaccio and Marseille . — From Monday to Friday the first and last outward and inward journeys of the day must be made in jet aircraft. — The seating capacity supplied must meet the following conditions : (i) from Monday to Friday the seating capacity supplied in each direction, in both morning and evening, must be at least 100 , carriers being informed that from the end of March to the end of October (31 weeks) demand is heavier at the weekend ; (ii) the following minimum weekly seating capacities must be supplied (total capacity in both directions) : — end of October to end of March (21 weeks): 5 200 seats — during the school summer holidays ( 11 weeks from June to September): 6 500 seats No C 199/4 PEN Official Journal of the European Communities 3 . 8 . 95

— end of March to end of October (outside the school summer holidays, 20 weeks): 5 800 seats ; (iii) in view of the distribution of the traffic peaks throughout the year, due mainly to the school holiday timetable and the statutory holidays (All Saints' Day, Christmas , Easter, Ascension Day, Whitsun, etc.) the following minimum seating capacities must be supplied (total capacity in both directions) : — end of October to end of March (21 weeks): 115 000 seats — during the school summer holidays ( 11 weeks from June to September): 84 000 seats — end of March to end of October (outside the school summer holidays , 20 weeks): 137 000 seats ; (b) — the frequencies between Marseille and Bastia are as follows : (i) at least three round trips per day, from Monday to Friday, apart from statutory holidays , (a) in the morning and evening in such a way as to enable customers to make a round trip in one day and spend at least nine hours at their destination, in either Bastia or Marseille ; (b) during the middle of the day ; (ii) at least three round trips per day, evenly distributed throughout the day, on Saturdays and Sundays . — The services must be non-stop between Bastia and Marseille . — From Monday to Friday the first and last outward and inward journeys of the day must be made in jet aircraft . — The seating capacity supplied must meet the following conditions : (i) from Monday to Friday the seating capacity supplied in both directions both in the morning and in the evening, must be at least 100, carriers being informed that from the end of March to the end of October (31 weeks) demand is heavier at the weekend ; (ii) the following minimum weekly seating capacities must be supplied (total capacities in both directions) : — end of October to end of March (21 weeks): 5 500 seats — during the school summer holidays ( 11 weeks from June to September): 6 700 seats

— end of March to end of October (outside the school summer holidays, 20 weeks): 6 300 seats ; (iii) in view of the distribution of the traffic peaks throughout the year, due mainly to the school holiday timetable and the statutory holidays (All Saints' Day, Christmas , Easter, Ascension Day, Whitsun , etc.), the following minimum seating capacities must be supplied (total capacity in both directions) : — end of October to end of March (21 weeks): 127 000 seats — during the school summer holidays ( 11 weeks from June to September): 81 000 seats — end of March to end of October (outside the school summer holidays , 20 weeks): 140 000 seats ; (c) — the frequencies between Marseille and Calvi are as follows : at least one round trip per day. — The services must be non-stop between Marseille and Calvi . 3 . 8 . 95 5N 1 Official Journal of the European Communities No C 199/ 5

— The seating capacity supplied must meet the following conditions : (i) The following minimum weekly seating capacities must be supplied (total capacity in both directions) : — end of October to end of March (21 weeks): 800 seats — during the school summer holidays ( 11 weeks from June to September): 1 600 seats — end of March to end of October (outside the school summer holidays, 20 weeks): 1 200 seats Carriers are informed that from the end of March to the end of October (31 weeks) demand is heavier at the weekend ; (ii) in view of the distribution of the traffic peaks throughout the year, due mainly to the school holiday timetable and the statutory holidays (All Saints' Day, Christmas, Easter, Ascension Day, Whitsun, etc.) the following minimum seating capacities must be supplied (total capacity in both directions) : — end of October to end of March (21 weeks): 18 000 seats — during the school summer holidays ( 11 weeks from June to September): 23 000 seats — end of March to end of October (outside the school summer holidays , 20 weeks): 25 000 seats ; (d) — the frequencies are as follows between Marseille and Figari : (i) at least two round trips per day, from Monday to Friday, apart from statutory holidays, in the morning and evening in such a way as to enable customers to make a round trip in one day and spend at least eight hours at their desti­ nation, in either Figari or Marseille ; (ii) at least two round trips per day on Saturdays and Sundays . — The services must be non-stop between Figari and Marseille . — The seating capacity supplied must meet the following conditions : (i) the following minimum weekly seating capacities must be supplied (total capacity in both directions) : — end of October to end of March (21 weeks): 1 100 seats — during the school summer holidays ( 11 weeks from June to September): 2 400 seats — end of March to end of October (outside the school summer holidays, 20 weeks) : 1 500 seats Carriers are informed that from the end of March to the end of October (31 weeks) demand is heavier at the weekend ; (ii) in view of the distribution of the traffic peaks throughout the year, due mainly to the school holiday timetable and the statutory holidays (All Saints' Day, Christmas , Easter, Ascension Day, Whitsun , etc.) the following minimum seating capacities must be supplied (total capacity in both directions) : — end of October to end of March (21 weeks): 27 000 seats — during the school summer holidays ( 11 weeks from June to September): 26 000 seats — end of March to end of October (outside the school summer holidays, 20 weeks): 31 000 seats ; No C 199/6 fEN ] Official Journal of the European Communities 3 . 8 . 95

(e) — the frequencies are as follows between Nice and Ajaccio : (i) at least three round trips per day, Mondays to Fridays, apart from statutory holidays, (a) mornings and evenings , in such a way as to enable customers to make a round trip within one day with a stopover of at least nine hours at their destination , in either Ajaccio or Nice ; otherwise during the middle of the day ; (ii) at least three round trips per day, regularly distributed throughout the day, on Saturdays and Sundays . — The services must be non-stop between Ajaccio and Nice . — The seating capacity supplied must meet the following conditions : (i) from Monday to Friday the seating capacity supplied in each direction, in both morning and evening, must be at least 60, carriers being informed that from the end of March to the end of October (31 weeks) demand is heavier at the weekend ; (ii) the following minimum weekly seating capacities must be supplied (total capacity in both directions) : — end of October to end of March (21 weeks): 3 000 seats — during the school summer holidays ( 11 weeks from June to September): 4 000 seats — end of March to end of October (outside the school summer holidays, 20 weeks): 3 500 seats ; (iii) in view of the distribution of the traffic peaks throughout the year, due mainly to the school holiday timetable and the statutory holidays (All Saints' Day, Christmas , Easter, Ascension Day, Whitsun , etc.) the following minimum seating capacities must be supplied for booking (total capacity in both directions): — end of October to end of March (21 weeks): 65 000 seats — during the school summer holidays ( 11 weeks from June to September): 56 000 seats — end of March to end of October (outside the school summer holidays, 20 weeks): 84 000 seats ; (f) — the frequencies between Nice and Bastia are as follows : (i) at least three round trips per day, from Monday to Friday, apart from statutory holidays (a) in the morning and in the evening, in such a way as to enable customers to complete a round trip in one day, and spend at least nine hours at their destination, in either Bastia or Nice and (b) in the middle of the day ; (ii) at least three round trips per day, regularly distributed throughout the day, on Saturdays and Sundays . — The services must be non-stop between Bastia and Nice . — The seating capacity supplied must meet the following conditions : (i) From Monday to Friday the seating capacity supplied in each direction, in both morning and evening, must be at least 60, carriers being informed that from the end of March to the end of October (31 weeks) demand is heavier at the weekend ; (ii) the following minimum weekly seating capacities must be supplied (total capacity in both directions) : 3 . 8 . 95 I EN I Official Journal of the European Communities No C 199/7

— end of October to end of March (21 weeks): 3 200 seats — during the school summer holidays ( 11 weeks from June to September): 3 800 seats — end of March to end of October (outside the school summer holidays, 20 weeks): 3 500 seats ; (iii) in view of the traffic peaks throughout the year, due mainly to the school holiday timetable and the statutory holidays (All Saints Day, Christmas , Easter, Ascension Day, Whitsun, etc.), the following minimum seating capacities must be supplied (total capacity in both directions) : — end of October to end of March (2 1 weeks) : 7 1 000 seats — during the school summer holidays ( 11 weeks from June to September): 47 000 seats — end of March to end of October (outside the school summer holidays, 20 weeks): 79 000 seats ; (g) — the frequencies between Nice and Calvi are as follows : at least one round trip per day. — The services must be non-stop . — The seating capacity supplied must meet the following conditions : (i) the minimum weekly seating capacities supplied must be as follows (total capacity in both directions) : — end of October to end of March (21 weeks): 700 seats — during the school summer holidays ( 11 weeks from June to September): 1 400 seats — end of March to end of October (outside the school summer holidays, 20 weeks): 1 100 seats ; Carriers are informed that from the end of March to the end of October (31 weeks) demand is heavier at the weekend . (ii) In view of the distribution of the traffic peaks throughout the year, due mainly to the school holiday timetable and the statutory holidays (All Saints Day, Christmas , Easter, Ascension Day, Whitsun , etc.), the following minimum seating capacities must be supplied (total capacity in both directions) : — end of October to end of March (21 weeks): 17 000 seats — during the school summer holidays ( 11 weeks from June to September): 19 000 seats — end of March to end of October (outside the school summer holidays, 20 weeks): 23 000 seats ; (h) — the frequencies between Nice and Figari are as follows : at least one round trip per day. — The services must be non-stop between Nice and Figari . — The seating capacity supplied must meet the following conditions : (i) the minimum weekly seating capacities supplied must be as follows (total capacity in both directions) : — end of October to end of March (21 weeks): 700 seats — during the school summer holidays ( 11 weeks from June to September): 1 800 seats No C 199/ 8 fENl Official Journal of the European Communities 3 . 8 . 95

— end of March to end of October (outside the school summer holidays , 20 weeks) : 900 seats Carriers are informed that from the end of March to the end of October (31 weeks) demand is heavier at the weekend ; (ii) in view of the distribution of the traffic peaks throughout the year, due mainly to the school holiday timetable and the statutory holidays (All Saints Day, Christmas , Easter, Ascension Day, Whitsun, etc.), the following minimum seating capacities must be supplied : — end of October to end of March (21 weeks): 16 000 seats — during the school summer holidays ( 11 weeks from June to September): 22 000 seats

— end of March to end of October (outside the school summer holidays, 20 weeks): 19 000 seats ; (i) — the frequencies between Toulon and Ajaccio are as follows : at least seven round trips per week. In addition , on at least two days per week the services must be operated in both the morning and the evening in such a way as to enable the customers to make a round trip in one day, and spend a sufficiently long period at their destination , in either Ajaccio or Toulon .

— The services must be non-stop between Ajaccio and Toulon . — The capacity supplied must meet the following conditions : ( i) the minimum weekly seating capacities supplied must be as follows (total capacity in both directions) : — beginning of January to end of April and beginning of October to end of December (30 weeks) : 252 seats — beginning of May to first week in June and during first fortnight of September (8 weeks) : 324 seats — second week in June to second week in September ( 14 weeks): 432 seats ; (ii) in view of the distribution of the traffic peaks throughout the year, due mainly to the school holiday timetable and the statutory holidays (All Saints Day, Christmas, Easter, Ascension Day, Whitsun , etc.), the following minimum seating capacities must be supplied (total capacity in both directions) : — beginning of January to end of April and beginning of October to end of December (30 weeks) : 8 400 seats — beginning of May to first week in June and during second fortnight of September (8 weeks) : 2 900 seats — second week in June to second week in September ( 14 weeks): 6 200 seats ; (j ) — the frequencies between Toulon and Bastia are as follows : at least seven round trips per week . In addition, on at least two days per week the services must be operated in the morning and in the evening in such a way as to enable customers to make a round trip in one day, and spend a sufficient period at their destination, in either Bastia or Toulon .

— The services must be non-stop between Bastia and Toulon . — The capacity supplied must meet the following conditions : (i) the minimum weekly seating capacities supplied must be as follows (total capacity in both directions) : 3 . 8 . 95 I EN I Official Journal of the European Communities No C 199/9

— beginning of January to end of April and beginning of October to end of December (30 weeks): 252 seats — beginning of May to first week in June and during second fortnight of September (8 weeks) : 324 seats

— second week in June to second week in September ( 14 weeks): 432 seats ; (ii) in view of the distribution of the traffic peaks throughout the year, due mainly to the school holiday timetable and the statutory holidays (All Saints Day, Christmas , Easter, Ascension Day, Whitsun, etc.), the following minimum seating capacities must be supplied (total capacity in both directions) : — beginning of January to end of April and beginning of October to end of December (30 weeks): 8 800 seats

— beginning of May to first week in June and during second fortnight of September (8 weeks) : 2 900 seats

— second week in June to second week in September ( 14 weeks): 6 300 seats .

2.2 . Fares : — The full-rate single fare between Marseille and Ajaccio, Marseille and Bastia, Marseille and Calvi , Marseille and Figari, Toulon and Ajaccio , and Toulon and Bastia must not exceed FF 470 at the 1995 rate . On the routes between Nice and Ajaccio , Nice and Bastia, Nice and Calvi and Nice and Figari , it must not exceed FF 420 at the 1995 rate . These rates do not include the relevant taxes . This maximum fare may be increased on 1 January each year in the light of the GDP price index set out in the Finance Law . The new maximum fare must be notified forthwith to the carriers operating the services and to the European Commission for publication in the Official Journal ofthe European Communities. If an unusual and unforeseeable increase in the cost factors affecting the operation of air routes takes place independently of the carriers , the maximum fare may be raised in proportion to the increase . The new maximum fare must be notified to carriers operating the services and will enter into force at an appropriate time . It will, furthermore , be notified forthwith to the European Commission for publication in the Official Journal ofthe European Communities. — The following categories of passenger must be granted a price reduction of at least 35 °/o as compared with the full fare on at least 50 % of the seats available : (i) young persons (less than 25 years old); (ii) senior citizens (over 60 years old) ; (iii) students less than 27 years old ; (iv) families (at least two members of the same family travelling together). — A fare at least 35 % lower than the full fare must be available on all flights without restriction to passengers whose principal residence is on Corsica, and who use tickets purchased on Corsica , the validity of which is restricted to a stay outside the island of less than 21 days in order to make a round trip starting from Corsica .

2.3 . Continuity of service : — except in the event of , the number of flights cancelled for reasons that can be directly attributable to the carrier must not exceed 1 % of flights entered in the operating schedule per LATA aeronautical season , — pursuant to Article 4 ( 1 ) (c) of Regulation (EEC) No 2408 /92 referred to above, any carrier intending to operate on one or more of these routes must guarantee that he will do so for at least 12 consecutive months, No C 199/ 10 PÉNl Official Journal of the European Communities 3 . 8 . 95

— services may be discontinued by the carrier only after at least six months' advance notice has been given . Community carriers are informed that failure to comply with the public service obligations set out above when operating the routes in question may entail administrative and/or legal sanctions .

Communication from the Commission pursuant to Article 4 ( 1 ) (a) of Council Regulation (EEC) No 2408/92 Imposition of public service obligations on scheduled airline services within France (95/C 199/04)

1 . Pursuant to the provisions of Article 4 ( 1 ) (a) of Council Regulation (EEC) No 2408 /92 of 23 July 1992 on access for Community air carriers to intra-Community air routes France has decided to impose public service obligations on the scheduled airline services operating on the following routes, in accordance with the decision by the Corsican auth­ orities :

(Orly)—Ajaccio

— Paris (Orly)—Bastia

— Paris (Orly)—Calvi

— Paris (Orly)—Figan Pursuant to Article 9 of Council Regulation (EEC) No 95/93 of 18 January 1993 on common rules for the allocation of slots at Community airports, the French authorities have decided to reserve certain slots at Orly airport for the operation of the services referred to above .

2 . Since Corsica is an island, the public service obligations are as follows :

2.1 . in terms of the minimum frequencies, timetables, types of aircraft used and seating capacity supplied : (a) the frequencies between Paris (Orly) and Ajaccio are as follows : (i) at least two round trips per day, in the morning and in the evening, from Monday to Friday, apart from statutory holidays ; the timetables must enable customers to make a round trip in one day and spend at least eight hours at their destination , in either Ajaccio or Paris ;

(ii) at least four round trips during the period Saturday to Sunday ;

— the services must be operated by jet aircraft,

— they must be non-stop between Paris-Orly and Ajaccio ,

— the seating capacity supplied must meet the following conditions : (i) from Monday to Friday, the seating capacity supplied in each direction, in both morning and evening, must be at least 100 , carriers being informed that demand is heavier at the weekend ;
