Stock size is normally 12-24" pending growth during the season. Species such as Ohio buckeye, oak species, Juneberry, hawthorn and others may be smaller due to a slower growth rate. Smaller grades of other species may need to be included to fill orders. Please complete this form and make a copy for your records. Please sign and return your order to our office by November 1, 2010. Confirmations will be sent out as soon as possible. Surplus orders can be made at any time and will be confirmed as they are received. We accept all orders, and all confirmations are considered firm, subject to crop conditions. Cancellations must be made to your order by February 1, 2011. We reserve the right to cancel a portion of the stock, due to windstorm, frost, and other weather conditions, error in count, animal, insect and disease injury, or any other causes beyond our control. All boxing, packaging, special handling, and shipments will be billed at our cost. It is agreed that all trees and shrubs will be for conservation purposes. An attempt is made to be true to name, but we cannot be responsible for variety or strain variations within a species. Seed sources are available upon request. Due to the perishable nature of nursery stock, variability in storage, handling, planting and weather conditions, it is impossible to guarantee planting results. If a loss occurs, we encourage our customers to discuss the problem with us, but in all cases, Lincoln-Oakes Nurseries total liability is limited to the original purchase price of the nursery stock. By acceptance of nursery stock, the purchaser agrees to the above conditions and limitations. Delivery by Lincoln-Oakes Nurseries truck where applicable will be subject to weather and other controlling conditions. Every effort will be made to ship your order in the week of ship date. Items not available at that time will follow as soon as conditions and stock permit. Those districts needing stock before the scheduled tree delivery date may arrange for pickup or UPS shipment at district expense. When picking up your order, please bring a tarp or suitable coverings to protect your plants. Plants will not be loaded without protection. Lincoln-Oakes Nurseries credit terms are NET 30 DAYS. A 1 1/2% interest charge (on the unpaid balance) will be added monthly to overdue accounts. All costs associated with collecting overdue accounts including court and attorney fees, travel, lodging, meals, etc… will be the purchaser's responsibility. ALL OVERDUE ACCOUNTS WILL BE AGGRESSIVELY PURSUED. A 1.5% delivery charge will be added to all deliveries based on the total dollar amount purchased due to fuel costs.
