Regulations of the Chamber of Industry and Commerce -Solingen- for the Use of the Community Collective Mark "Solingen" of30November2005

Preamble TheGermantownofSolingenisthecentreoftheGermancutleryandscissormaking industry.Forcenturiescuttingequipment,suchasswords,daggers,knives,scissors, cutleryandothers,aremadehere.Theseproductsareofaparticularlyhighquality.Thanks tohighgradematerials,qualifiedworkersandexcellentcraftsmanship,theseproductsare renownedandappreciatedtheworldover. Thename“Solingen”isprotectedasgeographicalindicationbylawin.Theuseof thenameisonlypermittedinconjunctionwithproductswhichoriginatefromthatregionand conformwithacertainstandardofquality.Thustheterm“Solingen”isanappellationof originandquality. Althoughtheindication“Solingen”isprotectedbytherulesoffaircompetition,itisoften usedinanillegalwayforcheapproductswhicharenotproducedinSolingen.Therebythe consumerisdeceived,thereputationofgenuinearticlesfromSolingenisharmedandthe industryinSolingensuffersfromvastdamage. Theregistrationoftheterm“Solingen”ascollectivemarkisdedicatedtoenhancethe famousname. § 1 Organisation, Domicile, Representation (1) TheChamberofIndustryandCommerceWuppertalSolingenRemscheid(inthe following:IHK)isaGermancorporationunderpubliclaw.Itbelongstoitslegalfunctionsto takemeasuresagainstunfaircompetitionandtopromotethebusinesseconomyofthe chamber'sdistrict.ThusIHKpleadsfortheprotectionofthename"Solingen"andtakes preventiveandrepressiveactionsagainstinfringementsofthethisname. (2) ThedomicileofIHKisWuppertal,Germany.Itsdistrictcoverstheareasofthethree towsWuppertal,SolingenandRemscheid. (3) AccordingtotheGermanChambers'ofIndustryandCommerceActinconnectionwith thechamber'sconstitutionIHKisrepresentedbythePresidentandtheGeneralManager. § 2 Membership to IHK AccordingtotheGermanlegislationeverytradesmanorindustrial,whomaintains eithera placeofbusinessorasalesoutletinthechamber'sdistrict,ismemberofthechamberof industryandcommerce.Thereforethemanufacturersofcuttingequipmentsituatedwithin Solingen'stownboundaryaremembersofIHK. § 3 Collective Mark IHKisownerofthecollectivemark "Solingen". ThemarkhasbeenenteredintotheregisterofCommunityMarksoftheOfficefor HarmonisationintheInternalMarketunderno.002988285inclasses7,8,14and21. 2

§ 4 Conditions for the Use of the Mark (1) Themark"Solingen"mayonlybeusedinbusinessforcuttingequipment,which (a) wasprocessedandfinishedinallmajorstagesofmanufacturingintheSolingen industrialareaand (b) conformstothequalityrequirementsmentionedinclause4. (2) TheSolingenindustrialareaincludestheareaoftheurbancommuneSolingenandthe areaofthetownwhichisinthedistrictof. (3) Majorstagesofmanufacturingforcuttingequipmentaccordingtoclause1letter(a) are: (a) manufacture:  warmforging  coldforging  mechanicalprocessing  heattreatment  surface,mechanical  surface,galvanic/chemical  finishingtouch (b) assembly:  ofsynthetichandles  ofwoodenhandles  ofsteelhandles  ofcasthandles  ofhandlesmadefromothermaterials  ofcomponenthalvesandothercomponentparts (c) finalassemblyofinstruments (4) Requirementsaccordingtoclause1letter(b): Alltypesofmaterialswhicharesuitablefortheappropriatemanufacturingandprocessing methodtoachievethecharacteristicuseoftheproductareadmissible.Whenusingmaterial otherthansteeloranotherkindofsteel,aminimumqualityaccordingtothefollowing requirementsmustbeachieved.Thedescriptionofthefeaturestobeexhibitedbyindividual piecesofflatwareorcutleryisaimedattheusualformsofthoseproducts.Itisnotthe objectiveoftheSolingenregulationstoexcludespecialpurposeproductswithfunction specificfeaturesfitfortheirintendedpurposewhichdeviatefromthenorm.  Tweezers Material:nospecificdetails Thecharacteristicsofthematerialmustbesuchthattherequiredspringand tippositiondependingontheusewillremainunchanged. (c) Other Requirements and Regulations  FeaturesoftheHardness Alldetailsregardinghardnessrefertothecuttingorfilingpartsoftheproducts. Forknivesthecompletebladeismeantherebyandnotjustthecuttingedge. Thematerialsmustbehardenedinconsiderationofthetemperaturecontrol requiredfortherespectivesteel.Examinationsofthehardnessand microstructuresmustbeappliedtothewholeblade.  Roughness Theroughnessofthebladesoftableknivesmaynotgobeyond3.0m accordingtoRzmaxandforotherknivesandscissorsnotbeyond6m accordingtoRzmax.  FeaturesoftheCoating Thecoatingofscissorsaswellasmanicureandchiropodyinstruments,such asnailfiles,nippers,clippersandtweezers,musthaveathicknessofatleast7 7m.  FurtherStandards InasmuchasfurtherDINENorISOstandardsareapplicableforindividual productgroups,thesestandardsaretobeapplied. (d) Additional criteria regarding the functions of specific cutting implements and flatware  Scissors Thebladesofapairofscissorsareofequallength.Thehandlesoreyesare paralleltoeachotherinoneplane.Thecuttingedgeisgrounduniformlyasa singlesurfacefromoneendofthebladetotheotherwithoutastep.Thepoints arealignedwitheachother.Thescissorshaveasmooth,uniformcutting actionalongtheentirelengthoftheblades.Thescissorsmustcutin accordancewiththeintendedpurposeatlatestafterclosingonethirdofthe bladelength(measuredfromthescrew).Thescissorsmustcloseuniformly withoutdifferencesinpressure.Thejointmustnotcomeundonebyitself duringthecuttingaction.Topreventthetwohalvesofapairofscissors seizing,i.e.wheretheharderbladewearsintothesofterblade,thehardness ratingsofthetwobladesofscissorsuptoanoveralllengthof130mm(5") mustnotdifferbymorethan2HRC,withlargerscissorsthedifferencemust notexceed1HRC. Wheninspectingscissorstoassesstheirsuitabilityforthe"Solingen"label,the joint,stalksandeyesofthescissorsmustalsobeinspected.Thesurfacemust befreeofcracks,burrsandcorrosionscarring.  NailNippers Bothlegsofthenippersmustbeofidenticallength.Thecutmustbeperfectly alignedwitheachotherandbeofidenticallength.Whengentlypressed together,onlythetipsofthebladesmaymeet,andwhenmorepressureis exerted,thegapbetweenthebladescloses.Thecuttingedgesofcuticle nippersmustbeuniformlyground.Thecuttingabilitymustbeguaranteed alongthefulllengthofthecuttingedges.  NailClippers Thecuttingedgesmustmeetalongtheirentirelength.Thecuttingabilitymust beguaranteedalongthefulllengthofthecuttingedges.  CornCutters Itmustbepossibletofitandremovetheslidereasily.Theblademustbefirmly mountedinthesliderinsuchawaythatthecuttinggapisnotincreasedduring 5

thecuttingactionandthedepthofcuttoleranceisnotexceeded.Forhygiene reasons,theplastichandlesmustbeabsolutelyflushwiththemetalparts. Whenusedforitsintendedpurposes,thecorncuttermustnotbecome deformedbeyondtheyieldpointorbreak.  NailFiles Withnailfiles,allthesurfacesoutsidetheactualfilingzoneandincludingall edgesmustbedeburredandsmooth.Thefilingsurfacesmaybeofthe followingtypes: – coldforgedwithatleasttwostrokes(coldforgednailfiles), – grainsaffixedbyelectrocoating,e.g.sapphire(coatednailfiles),textures createdbyelectroplatingoretchingandothersurfaceswithacomparable fileeffect.  Tweezers Tweezersmustgripperfectlyattheirtips.Thetweezersmustbeabletogripobjects thethicknessofahair.Whenthetweezersareclosed,thetipsmustremainclosed evenifadditionalpressureisapplied.Fortweezersthecomponenthalvesmustbe firmlyweldedtogetherandbeperfectlydeburredallaround.Thespringpositionmust haveanevenapertureangle.Thefunctionofthetweezerpointsmustbeensured.

§ 5 Kind of Using (1) Authorizedusersofthemarkareentitledtousetheterm"Solingen"inconnectionwith cuttingequipment,inparticular (a) tomarkarticleswiththeindication (b) tolabelpackaging,pricelist,prospects,cataloguesandotherbusinessdocuments withtheindication, (c) toaddtheindicationtotheirbusinessname, (d) tousetheindicationaspartoftheirtrademarkinconnectionwithother characterisingterms, (e) toadvertiseforcuttingequipments. (2) Usersofthemark,whodonotresideinSolingenorwhoarenomanufacturersof cuttingequipment,arenotallowedtousethemarkinaway,whichcouldcausedeception aboutthebranchorthedomicileofthecompanyortheoriginoftheproducts. § 6 Rights and Duties (1) IHKistheownerofthecollectivemarkandsoleholderofeveryrightarisingfromthe registrationofthecollectivemark. (2) IncaseofinfringementsofthecollectivemarkIHKisentitledtotakeappropriate measuretostoptheinfringingactsandtopreventfutureinfringements,inparticularIHK may (a) claimdiscontinuance,destruction,informationanddemagestowardsthe responsiblepersons; (b) authorizethirdpersonstotakecivilorcriminalactions; (c) reporttheoffencetopublicprosecutorsandcustomsauthorities. (3) ThemembersofIHK,whousethecollectivemark,areobligedtokeepthese regulations.TheyarealsoobligedtoinformIHK,incasetheytakenoteofmisusingor infringingactivitiesofthecollectivemark. (4) Theusersofthemarkmaynot (a) harmthereputationofthemark,theowner,thecuttingproductsorthecutting industryofSolingen, 6

(b) usethemarkforproducts,whichdonotconformwiththeconditionsdefinedbythis regulations, (c) assigntherightofusingthecollectivemarktothirdpersons. (5) Anyoneusingthe"Solingen"brandnameinacommercialcontextisobligedtodisclose totheChamberofCommerceonrequestallthefactsandtoprovethesebymeansof documentstoenabletheChambertoassesswhethertheconditionsofusearebeing appliedasdefinedinaccordancewith§4above.Theinformationrequiredincludesdetails oftheoriginoftheproducts,blanksandproductparts,theidentitiesofsuppliersandother externalpersonsorcompaniesinvolvedinthemanufacturinganddistributionprocesses, thelocationofmanufacture,theproductionmethodsandqualitycharacteristicsofthe products.Wherethebranduserisnotthemanufacturer,therequirementtodisclose informationrelatestoallthecircumstancesknowntohimrelatingtothenamesand addressesofhissuppliers,thedatethedeliverieswerereceivedandthequantitiesand typesofproducts.
