HELAA Site Number GLAS003 - Land Off Butleigh Road 1.08ha For Upto 30 Dwellings (With 10 Affordable Homes/ 30% Policy Requirement)

1. Introduction & Background

This site was submitted in the earlier stages of the Local Plan Part II Land Allocation process, having been discounted in the current Pre-Submission Consultation tranche of the land allocation process, through the sustainability appraisal that alleges adverse landscape impacts. This stated:

GLAS003 The site lies within the Wearyall Hill Special Landscape Feature therefore the landscape impact of development is likely to be significant.

2. Site Specific Issues

This site is located on the southern edge of the built up area of and comprises of 1.08 hectares of low grade agricultural land, lying in a Flood Zone 1 to the west of Butleigh Road, approximately 500m from the town centre.

The site abuts the existing Development Limit on two side, slopes from north (high ground) to south (low ground) and is well contained; being bounded by a dense residential area to the north and east; and with well established native hedgerows to all boundaries that would be retained.

The site is located on the very eastern edge of the Wearyall Hill Special Landscape Feature (MDLP Policy DP4) and has been discounted for this reason. Nevertheless, the site appears a very logical place for residential development to take place, given that this area lies on the very eastern edge

Mendip Local Plan Part II: Sites & Policies - Issues and Options Consultation of that feature and is an area less valuable than other more open areas on the lower and upper slopes of the surrounding landscape, particularly that further west of this site. It also rounds off development that has taken place to the east of Butleigh Road.

From a sustainability perspective, this site is in an otherwise highly sustainable location with no other constraints, lying only 500m from the town centre and with key bus services stopping nearby in Bere Lane and Street Road to the north and but, a short walk away.

A Landscape & Visual Impact Assessment has been undertaken and is provided with this submission to demonstrate the limited impacts.

3. Housing Land – Demand & Supply

Local Plan Part II – Land Allocation Methodology Comments

Housing Demand The National Planning Policy Framework (NPPF), paragraph 158 states: ‘Each local planning authority should ensure that the Local Plan is based on adequate, up-to-date and relevant evidence about the economic, social and environmental characteristics and prospects of the area. Local planning authorities should ensure that their assessment of and strategies for housing, employment and other uses are integrated, and that they take full account of relevant market and economic signals.’

Section 3 Housing Land 3.1 Confirms the starting point for considering the delivery levels to be obtained from sites is identified in Part I of the Local Plan.

3.2 Confirms the Part I Plan established a requirement for 420 dwellings per annum and this was tested through the Local Plan examination; however, what it fails to acknowledge is that the inspector confirmed that 420 dwellings per annum should be treated as a ‘minima’.

3.5 Confirms that since the adoption of the Local Plan Part I, the council have undertaken a Strategic Housing Market Assessment (SHMA) and this provides an ‘objectively assessed need’ for housing. Section 3.6 considers it reasonable and justified within a range of 411-491 dwellings per annum and recommends that ‘as a starting point, a level towards the higher end of the range would be more robust’.

The starting point for the calculation of ‘objectively assessed need’ is demographic calculations based on the most recent, available population projections. This is made clear in NPPF paragraph 159, which states that the SHMA should be used to establish realistic assumptions about the availability, suitability and the likely economic viability of land to meet the identified need for housing over the plan period, taking into account household and population projections, as well as migration and demographic change ie the most upto date housing land requirements.

In section 3.7 the council recognise this to be the most upto date evidence of housing need and whilst they state this number not to have been tested through examination by the inspector, the fact that the inspector presiding over the adopted Local Plan stated that 420 dwellings per annum was a ‘minima’, should at the very least provide the council assurance that the upper range of 411- 3

Mendip Local Plan Part II: Sites & Policies - Issues and Options Consultation 491 dwellings per annum as recommended in the SHMA, as the most upto date requirements, is not unreasonable; and more realistically, it should guide the council to heeding the advice that they have sought that keeps pointing to a number of dwellings per annum to be way in excess of 420. Not at least, this would follow an approach that is supported at a national level, where the government are looking to boost significantly the supply of housing and to do so as soon as possible.

In order to boost significantly the supply of housing, Local Planning Authorities are required through paragraph 47 of the NPPF to ‘use their evidence base to ensure their Local Plan meets the full objectively assessed need’ and Mendip are simply not taking this approach, despite having clear evidence through the SHMA to the contrary (491dpa against 420dpa = 17% difference). To follow this approach presents the potential for a significant year on year, 17% deficit in housing numbers across the district, falling considerably short of meeting the ‘objectively assessed need’.

Add to the 17% deficit, the 5% buffer required through paragraph 47 of the NPPF and you get a 22% divergence!

The Mendip District - Five Year Housing Land Supply Annual Position Statement - Autumn 2016, states Mendip to have a 5.8 year housing land supply; however, in simple maths and given the figures above, a 17% deficit would bring this back to Mendip having only a 4.8 year housing land supply. With the additional 5% buffer, a 22% deficit would bring this back to Mendip having only a 4.5 year housing land supply (5.8 years less 17% = 4.81 years & 5.8 years less 22% = 4.52 years).

In addition, the Autumn 2016 Annual Land Supply Statement (table 1) confirms that in the 10 year period between the years of 2006 and 2016; it was six of those years where annual delivery exceeded the required 420 dwellings per annum with a range of 458-630 dwellings per annum, thus supporting that there is evidentially a higher demand for housing than the 420 dwellings per annum would suggest and providing further credence to the SHMA report and in fact the upper end of that figure of 411-491 dwellings per annum.

Supply Of Land The NPPF requires that each Local Planning Authority demonstrate that there is a five year supply of deliverable sites for housing development. It is imperative the council only allocate sites that are ‘deliverable’ and ‘developable’, as this will provide the best chance of five year housing land supply targets to be fulfilled.

However, as a Planning Agent that has dealt with more planning applications in Mendip than any other agent, it is apparent that the council are allocating sites that are not ‘deliverable’ or ‘developable’ and furthermore, are allocating sites that do not benefit the support of the owner in wanting to develop and/ or redevelop the site.

An example of this is GLAS001a Avalon Motors, Glastonbury where upto 5 dwellings have been put forward for allocation. A simple discussion with the owner of the land will reveal that redevelopment of this garage site that supports the local Citroen Main Dealer, is simply not financially viable due to a site value of only circa £300k. We expand on that with an example: 5 houses could at best hope to provide a gross site value of circa £400k less demolition and remediation, leaving a site value of circa £300k (ie 5 dwellings at £240k sale value = £1.2 million gross development value. Site value 1/3rd of gross development value = £400k, less £100k demolition and remediation).

However, it is significant, as recognised by the council that this site is required to provide access to GLAS001 at the rear, where upto 62 dwellings are proposed and without this access, there will not be either 5 dwellings or 62 dwellings. The reality is, these 67 dwellings are most unlikely to materialise and certainly not in the next 5 years.

There is also the matter that this site already lies well within development limits and therefore there is no need to specifically allocate it. Moreover, doing so serves only to dilute the aims and aspirations of the Local Plan Part II, which looks to provide any land shortfall through ‘windfall’ infill sites within development limits ie such as these sites. However, you cannot rely on such sites to provide any shortfall, if the numbers of dwellings these sites could provide, are already accounted for within anticipated five year housing land supply targets as you would be counting them twice. Simply put, you cannot expect the fruit of windfall when the fruit has already been picked and eaten!

However, the aforementioned are not the only sites that are not either ‘deliverable’ or ‘developable’. Within Glastonbury there is a particularly acute issue, with the council looking to allocate sites for housing that are neither ‘deliverable’ or ‘developable’ and this shockingly applies to nearly all sites proposed; in summary:

GLAS001a - Avalon Motors As aforementioned

GLAS027 – Frogmore Garage This is a site that has had planning permission for residential development on previous occasions and has proven financially unviable to develop.

As an agent we have reviewed this site for three different developer clients over the last 10 years, with schemes that have varied between the previously consented development for flats, as well as lesser developments for a frontage row of houses.

The site slopes steeply and has aged retaining structures that may require replacing, contamination that requires remediation, archaeological investigation that requires undertaking and significant constraints from adjacent properties, including providing access to third party land.

It is currently in use as a hand car wash providing employment and its commercial value still remains higher than its redevelopment value taking into account additional development costs in addressing these issues.

The site is simply neither ‘deliverable’ or ‘developable’ and already lies inside development limits, meaning allocation is unnecessary.

GLAS055 – Lintells Garage, Wells Road When considering the small size of this site and looking at the pattern of residential development nearby, it is doubtful that the site can accommodate 8 dwellings, unless they are very small; thus meaning, financial return would be very small. Even if 8 dwellings were possible, it will not balance against the other poorly chosen sites for preferred allocation listed herein.

GLAS119 - Allotments, Lowerside Lane This site would facilitate the loss of well used, mature allotment land and is justified through the fact that the constraints around Glastonbury are so significant that this site should be developed. The site also lies in an area of land largely covered by a Flood Zone 2 and sits on low lying land very close to a Flood Zone 1. Whilst it is recognised that flooding issues may be able to be addressed and the allotments may be able to be relocated, this will take time, relocating allotments will be subject to public consultation and almost likely significant local objection and all of this does

Mendip Local Plan Part II: Sites & Policies - Issues and Options Consultation not make this site either ‘deliverable’ or ‘developable’. And despite these issues, this appears to be the best of the sites put forward as preferred sites for allocation.

Quite simply, the list of preferred sites for allocation in Glastonbury fall significantly short of being deliverable or developable and we would argue that the site subject of this submission has more manageable issues and is most certainly ‘deliverable’ and ‘developable’.

As an agent, we have also submitted many applications for self contained units that from a planning use class perspective, are dwellings (C3) with an occupancy restriction. Through questioning the council, it is suspected these types of units are being counted against the five year housing land supply as dwellings, when in fact they provide no full time residential accommodation and as such, most definitely should not count against the supply of housing units. We would ask the council to clearly confirm if this is the case or not and the inspector to qualify the same.

It can only be hoped that the anticipated supply of land does not contain more sites that are not ‘deliverable’ or ‘developable’; or are being counted when they should not, such as in these instances, as five year housing land supply targets simply will not be met.

The Reliance On Large Housing Sites We also contest that the aim to allocate such a high proportion of the required housing to the market towns using larger sites is flawed.

It is widely accepted across the industry that larger sites consistently underperform in terms of housing numbers and delivery times due to planning on large sites being more complex, taking longer and simply not being able to get as many houses on a given area of land today, when compared to the number you could fit on sites in the past. This is due to all the additional space constraints required for higher parking provision, stormwater attenuation and the like and therefore, this comes as no surprise and is somewhat predictable: And this can be evidenced locally.

Immediately to the south of Mendip District Council, lies District Council, who do not have a five year housing land supply and in fact admit to a chronic and consistent undersupply and that the council track record is one of ‘persistent under delivery’. South Somerset state the reason is down to them having allocated most of their housing numbers against large sites in market towns that have underperformed and continue to underperform in terms of delivery times and numbers of houses and as a result, South Somerset are now considering increasing allocation in the on smaller sites, where evidence shows such sites to have consistently performed (reference South Somerset District Council Five-Year Housing Land Supply Paper - September 2017).

Unlike other adjoining councils where due to cities and/ or exceptionally large conurbations, comparison cannot be made; South Somerset with its very similar geographic and demographic to Mendip, makes for an excellent comparison. We can only conclude that if Mendip take the same route with the Local Plan Part II in allocating the majority of housing on large sites, the same fate will occur; and as a result, Mendip are likely at some point to fail on their 5 Year Housing Land Supply with all evidence suggesting this could be sooner, rather than later.

As a result, more smaller sites should be allocated such as this site, which have no significant development issues and are readily ‘deliverable’ and ‘developable’, in order to maintain a 5 year land supply and reduce reliance on larger sites.

Both the NPPF and NPPG provide context from which the supply of housing sites can be determined. NPPF paragraph 47 states that LPA’s should ‘identify and update annually a supply

Mendip Local Plan Part II: Sites & Policies - Issues and Options Consultation of specific deliverable sites…’ and ‘identify a supply of specific developable sites or broad locations for growth, for years 6-10 and, where possible, for years 11-15’.

Footnote 11 & 12 which accompany the text in Paragraph 47 of the NPPF states that: ‘To be considered deliverable, sites should be available now, offer a suitable location for development now, and be achievable with a realistic prospect that housing will be delivered on the site within five years and in particular that development of the site is viable.’ and ‘To be considered developable, sites should be in a suitable location for housing development and there should be a reasonable prospect that the site is available and could be viably developed at the point envisaged’.

4. Why This Site (GLAS003) Should Be Allocated

It is the duty of the council to allocate land that is ‘deliverable’ and ‘developable’. It is clear that in Glastonbury the council are not doing this, with the majority of sites on the preferred list for allocation subject to significant constraints. These sites are at best have considerable development delays and at worst, no likelihood of being developed for many years, if at all.

Whilst GLAS003 as proposed for allocation herein has some landscape impact constraints, these are relatively limited and those which do remain can be sensibly mitigated.

The site otherwise lies in a highly sustainable location a short walk from the town centre and public transport, with no other constraints.

It could potentially provide upto 30 homes, of which 10 would be affordable in line with MDLP Policy Requirement DP11: Affordable Housing, which requires 30% affordable housing in locations such as this.

This site therefore presents a much better option on sustainability grounds than many of the list of sites currently preferred and should be allocated.

PROPOSED RESIDENTIAL DEVELOPMENT OFF BUTLEIGH ROAD, GLASTONBURY, SOMERSET – LANDSCAPE AND VISUAL IMPACT ASSESSMENT

Introduction Clark Landscape Design were appointed to undertake an assessment of the landscape and visual impacts to a proposed residential development of land off Butleigh Road, Glastonbury and to propose landscape mitigation measures to address any impacts identified.

The proposal is for residential development, access and associated works. See location of site below. The red line of the site shows it within the context of Glastonbury.

Approach This assessment has been undertaken in accordance with the ‘Guidelines for Landscape and Visual Impact Assessment, 3rd Edition 2013 (GLVIA3) LI/IEMA’. The assessment has been undertaken by Ian Clark, a Landscape Architect and Chartered Member of the Landscape Institute.

The assessment includes a desk top survey, site investigation, vegetation and photographic survey, and an appraisal and assessment of the potential impacts of the proposals with recommendations for mitigation to address any identified landscape concerns.

LANDSCAPE STATEMENT

Planning and Landscape Background

Designations The site is outside of both the Wearyall Hill and Glastonbury Tor Special Landscape Features. It is not within a Conservation Area and there are no Tree Preservation Orders within the site. The site area of paddock is adjacent to the town settlement boundary. Views from the PROWs are illustrated from photo viewpoints later in the report - appendices 1 and 2. The identified bridleways and public footpaths are not known to be part of any promoted trails and appear to be only moderately used by the ‘wear and tear’ of the routes.

Relevant Planning Policies The key policies from the recently adopted Local Plan are DP1: Local Identity and Distinctiveness; DP4: Mendip’s Landscape; and DP7: Design and Amenity of New Development.

DP1: Local Identity and Distinctiveness 1. All development proposals should contribute positively to the maintenance and enhancement of local identity and distinctiveness across the district. 2. Proposals should be formulated with an appreciation of the built and natural context of their locality recognising that distinctive street scenes, townscapes, views, scenery, boundary walls or hedges, trees, rights of way and other features collectively generate a distinct sense of place and local identity. Such features may not always be designated or otherwise formally recognised. 3. Where development proposal would adversely affect or result in the loss of features or scenes recognised as being distinctive, the Council will balance up the significance of the feature or scene to the locality, the degree of impact the proposal would have upon it, and the wider benefits which would arise from the proposal if it were approved. Any decisions will also take into account efforts made by the applicant to viably preserve the feature, avoid, minimise and/or mitigate negative effects and the need for the proposal to take place in that location.

DP4: Mendip’s Landscape Mendip District is defined by its landscapes. Proposals for development that would, individually o cumulatively, significantly degrade the quality of the local landscape will not be supported. Any decision-making will take into account efforts made by applicants to avoid, minimise and/or mitigate negative impacts and the need for the proposal to take place in the location. As the site lies outside of any nationally or locally designated areas bullet point 3 below is the most pertinent. 3. Outside of designated landscape areas, proposals should demonstrate that their siting and design are compatible with the pattern of natural and man-made features of the Landscape Character Areas, including cultural and historical associations, as detailed in the “Landscape Assessment of Mendip District”.

Mendip Landscape Character Assessment A Landscape Character Assessment of the District was completed in 1997. The proposed development site lies within the ‘Isle of Avalon’ landscape character area but close to the edge of the ‘South Moor and Kennard Moor’ landscape character area.

Isle of Avalon Landscape Character Area The ‘Isle of Avalon’ landscape character area’s key characteristics are:  Prominent hills and ridges;  Small, steep-sided valleys;  Parkland;  Large fields with numerous hedgerow trees;  Patches of open downland;  Locally-prominent twentieth century development; and  Abrupt contrast with surrounding moors. The site lies south and to the east of Wearyall Hill on the edge of the moors. In 12.5.3 the area is described: “A pattern of generally small, sub-rectangular pasture fields, rises up the eastern, southern and northern slopes interspersed with small orchards, dense hedgerows and hedgerow trees.” The last two of the area’s key characteristics best describe the site with locally-prominent twentieth century development above it and with an abrupt contrast with the paddock and surrounding moors.

‘South Moor and Kennard Moor’ Landscape Character Area The ‘South Moor and Kennard Moor’ landscape character area’s key characteristics are:  Open moorland;  Uninhabited;  Scattered willows, some pollarded;  Prominent river leve’s and roads; and  Dominance of surrounding ridges. The southern boundary of the site is defined by a rhyne with a well established hedgerow on its inner bank.

Overall, the landscape of the area around the site cannot be said to have an unspoilt character, since it is substantially affected by locally prominent housing development above the lower slopes of the Wearyall Hill area such as Roman Way and Tor View Avenue and the site itself has a strong urban fringe character. The long line of housing is particularly prominent across the open landscape of Kennard Moor when looking from the south northwards towards the area of Wearyall Hill.

DP7: Design and Amenity of New Development The Local Planning Authority will support high quality design which results in usable, durable, adaptable, sustainable and attractive places. 1. proposals for a new development should demonstrate they: a) are of a scale, mass , form and layout appropriate to the local context. b) protect the amenity of users of neighbouring buildings and lands uses and provide a satisfactory environment for current and future occupants. c) optimise the potential of the site in a manner consistent with other requirements of this policy. d) incorporate all practical measures to achieve energy efficiency through siting, layout and design. e) maximise opportunities for: 1. The use of sustainable construction techniques 2. The use of sustainable drainage systems 3. Renewable energy generation on site 4. The use of water efficiency measures, recycling and conservation 5. Clark Landscape Design g) meet the access needs of a wide range of users h) incorporate appropriate crime prevention measures i) undertake construction in a manner that makes efficient use of materials and minimises waste. 2. all allocations will be the subject of either an appropriately detailed Development Brief or Masterplan or other structured and agreed pre-application process prepared in conjunction with the relevant community. Where a Development Brief/Masterplan is prepared, it will where appropriate, be adopted as a Supplementary Planning Document prior to the granting of planning permission.

Local Plan Part II Within the Local Plan Part II Glastonbury has been designated as a Principal Settlement. A number of sites have already been considered for development of which this site, Ref:GLAS003, is one. This Initial Assessment considers that: “The site is not considered suitable given that it lies within a SLF (Special Landscape Feature) and the setting of Glastonbury is acknowledged as an issue in the Part I Plan.” Under Constraints and Considerations identifies that: “Land forms part of Wearyall Hill SLF.” and that the site is not considered suitable as a Potential Development Option. However, the District wide Assessment of Special Landscape Features, published in February 2011, clearly shows the site well outside of the Wearyall Hill SLF designated site see extract plan below. The main reason for not assessing the site as suitable for development is therefore invalid and it should be reconsidered once its wider landscape assessment has been fully considered.

Summary of planning and landscape background policies and designations The site is outside of any national or local designations and there are no Tree Preservation Orders within the site. The key policies relevant to the landscape of the site from the recently adopted Local Plan are DP1: Local Identity and Distinctiveness; DP4: Mendip’s Landscape; and DP7: Design and Amenity of New Development. The proposed development site lies within the ‘Isle of Avalon’ landscape character area but also close to the edge of the ‘South Moor and Kennard Moor’ landscape character area. However, the landscape of the area around the site cannot be said to have an unspoilt character, since it is substantially affected by locally prominent housing development above the lower slopes of the Wearyall Hill area such as Roman Way and Tor View Avenue and the site itself has a strong urban fringe character. The long line of housing is particularly prominent across the open landscape of Kennard Moor when looking from the south northwards towards Wearyall Hill.

The District wide Assessment of Special Landscape Features, published in February 2011, clearly shows the site well outside of the Wearyall Hill SLF designated site and therefore the main reason for assessing the site as not suitable for development is invalid and it should be reconsidered once its wider landscape assessment has been fully considered.

Landscape and Visual Impact Assessments

Site Description The site lies on the southern boundary of Glastonbury just off the Butleigh Road. It is a gently sloping south facing slope which lies at the base of a small ridge which at its western end is known as Wearyall Hill. It has been grazed at regular intervals.

The access to the site, off Butleigh Road, is via a farm gate set well back from the main road on a hard track.

The site is bounded on the south and west by native species hedgerow including field maple, elder, hazel, hawthorn and willow. There are several small trees along the line of the southern boundary. The eastern roadside boundary is a poor quality hedge of mainly bramble. The northern boundary is made up of old hedgerow and domestic boundary fencing of various types.

There are no trees of high amenity value within the site. Relevant root protection areas for the existing small trees and hedgerows have been considered in the potential for the site to be developed.

There are several small barns and a blue container along the line of the western boundary.

Visual Impacts An assessment of the potential visual impacts of the development has been undertaken from local vantage points including Public Rights of Way (PROW) and local lanes. Positions of the photo viewpoints have been chosen to be representative of the local views of the proposed development site and don’t therefore show all of the viewpoints. However, in assessing the potential impacts the full scope of the views has been considered. Visual impacts are graded from Low to High in five steps: Low - Low/Medium - Medium - Medium/High - and High. The grades are weighted according to their visual impact and their sensitivity i.e. similar views from local lanes, with infrequent use, to ‘A’ roads, with significant traffic volumes, are graded according to their overall impact thus local lanes with infrequent use would be graded as having lower levels of impact compared to busy ‘A’ roads. Each photo viewpoint is numbered and given a location description. An assessment of each view and its assessed impacts is then described with a summary of the potential visual impacts provided.

All photographs were taken with a digital SLR camera set at focal length 55mm which is that agreed to be closest to the view of the onlooker i.e. no wide angle or zoom shots are included.

Photo viewpoint 1 – looking south from Butleigh Old Road onto the junction with Butleigh Road. The eastern corner of the site is to the right of the ‘Give Way’ sign.

Description: PV1 shows the eastern corner looking south from Butleigh Old Road onto the junction with Butleigh Road. The existing boundary hedge is of poor quality containing mainly brambles with no trees. The two trees visible in the middle ground line the rhyne along the southern boundary of the site. The ‘South Moor and Kennard Moor’ can be seen in the middle ground. Visual impacts: The proposed access to the site would be within this area of the site near to or opposite the ‘Give Way’ sign. No housing is proposed within this area of the site. Visual impacts Low/Medium. Mitigation: There is scope for some tree planting within this area and new hedgerow planting on the right hand side of the panorama. It is proposed to retain the longer and middle distance views to the South Moor and Kennard Moor through careful positioning of the tree planting. Summary: Given the above mitigation is should be possible to reduce the visual impacts to Low.

Photo viewpoint 2 – existing entrance to the site off Butleigh Road

Description: This viewpoint shows the existing access gate and track to the site with the bramble hedge on the right and the existing hedgerow on the left. The end of the paddock is bounded by a native species hedgerow and the small barn. The houses directly above the site are clearly visible on the right hand side and those of Tor View Avenue can be seen stretching to the line of the left hedgerow. Visual impacts: This is the general area proposed for the new access road with the existing bramble hedgerow removed and set back within the site. The access road is proposed to run parallel to the southern boundary hedgerow but set back from the hedge to allow for structure planting and flood attenuation measures. The proposed housing will be set down into the site – the site slopes up to the right by several metres – set back from the southern boundary hedgerow by 15m and softened by structural planting. The main visual impact would come from removal of the existing poor quality bramble hedge and new housing. However, the new housing is proposed set back from the road. The overall visual impact because of the impact on the view from passing traffic is assessed to be Medium. Mitigation: The southern boundary hedgerow will be retained and enhanced with additional tree and shrub planting. The houses will be set down within the site and set back from the main road by *m with back gardens and structural planting softening the proposed housing. Use of slate grey roofing or dark brown tiles for the roofs are recommended throughout the development which will help to further reduce visual impact. Summary: Given the above mitigation is should be possible to reduce the visual impacts to Low/Medium.

Description: This viewpoint shows the poor quality bramble hedgerow to the right of PV2. As it slowly climbs north and west up Butleigh Road. The end of the paddock can be seen bounded by a native species hedgerow. The houses directly above the site are locally prominent on the right hand side and those of Tor View Avenue can be seen stretching towards the SLF of Wearyall Hill. Visual impacts: The main visual impact would come from removal of the existing poor quality bramble hedge and new housing. However, the new housing is proposed set back from the road and therefore the overall visual impacts is assessed to be Medium as they would be seen by traffic passing along the Butleigh Road. Mitigation: The proposed housing would be set down into the site and softened by structural planting. The first group of houses would also be set back from the main road by *m with back gardens and structural planting softening the proposed housing. Use of slate grey roofing or dark

Description: This viewpoint shows the site in the context of the existing prominent local housing stretching to the base of the Wearyall Hill SLF. The site is bounded to the west by the blue coloured shed and to the south by the existing native species hedgerow. The housing above the site is particularly visible given the mainly white render frontages give a raw edge to this part of the town. Visual impacts: The main visual impact would come from removal of the existing poor quality bramble hedge and creation of a new access. The overall visual impact is assessed to be Low/Medium as seen from the Bretenoux Road/Butleigh Road junction. Mitigation: The proposed housing would be set down into the site and softened by structural planting to the east and south. The first group of houses would also be set back from the main road by at least 40m with back gardens and structural planting softening the proposed housing. Use of slate grey roofing or dark brown tiles for the roofs are recommended throughout the development as this will further help to reduce visual impact. Summary: Given the setting back of the new housing behind significant structural planting the proposals will help to soften the impact of the existing raw edge to this entrance to the town. It should therefore be possible to reduce the visual impacts to from Low/Medium to Slightly beneficial once the planting is well established.

Description: PV5 shows the eastern corner of the site looking south from Porch Close, just off Butleigh Old Road. The ‘South Moor and Kennard Moor’ can be seen in the middle ground framed by the trees and housing along Butleigh Old Road. Visual impacts: The proposed access to the site would be within this area of the site near to or opposite the ‘Give Way’ sign. Other than the new access road no housing is proposed within this area of the site and the view across to the Moors would be substantially retained. Visual impacts Low. Description: This view is from higher ground to the south 2.6km from the site. Views to it from the Cow Bridge Road are few and far between. This view is from an informal layby. When driving from this spot across the moors views to the site are limited by existing trees and distance even during the winter months. Visual impacts. The visual impacts are judged to be Neutral. Mitigation: Given the distance and lack of views to the site no new mitigation is proposed, however, the southern boundary structural planting will add some additional minor landscape mitigation. Summary: the visual impacts are judged to be Neutral.

Description: This photo viewpoint is taken from the footpath along the southern boundary of the River Brue close to the Butleigh Road. The site can be seen framed by the existing housing higher up the slope. Visual impacts. The visual impacts are judged to be Low. Mitigation: The southern boundary structure planting once established, along with the setting down of the houses and use of darker roofing materials will significantly reduce any visual impacts. Summary: The visual impacts are judged to be Low to Neutral.

This is a glimpsed view with the site only partially visible below the Tor screened by the intervening hedgerows and the southern boundary hedgerow of the site. Visual impacts. Given the limited number of views from the public footpath and the intervening hedgerow and tree vegetation the visual impacts are judged to be Low. Mitigation: The western boundary hedgerow will be retained and enhanced with additional tree planting. The houses will be set down slightly within the site and set back so that their back gardens adjoin the boundary. Use of slate grey or dark brown roofing will further help reduce visual impact. Summary: The visual impacts are judged to be Low reducing to Neutral once the new planting is well established.

Description: This is the view as seen walking along the ‘back’ of the Wearyall Hill SLF. The site can be seen as a triangle of green joining the areas of built development between the houses along Tor View Avenue and the houses to the north of Bretenoux Road. It is bounded to the right by its southern native species hedgerow. Visual impacts. At 800m the proposed housing would be clearly seen but against a backdrop of existing houses which appear like a skirt around the Tor. The houses in the foreground, Roman Way and Hill Head, frame the site’s foreground view. Given the above setting the visual impacts are judged to be Low. Mitigation: The western boundary hedgerow will be retained and enhanced with additional tree planting. The houses will be set down slightly within the site and set back so that their back gardens adjoin the left hand boundary. Use of slate grey or dark brown roofing will further help reduce visual impact. The site’s southern boundary hedgerow will be added to with structural planting and the houses set at least 15m back from the line of the hedgerow. Summary: The visual impacts are judged to be Low reducing to Neutral once the new planting is well established.

Description: This is the view as seen from the Tor looking towards Wearyall Hill SLF. The site can be seen as a diamond of green joining the areas of built development of the houses along Tor View Avenue and the area of houses this side of Butleigh Road. The native species hedgerows of It’s western and southern boundaries can be picked out. Visual impacts. At 1.2km the proposed housing would be seen set back from the southern boundary hedgerow. The housing would be separated from the fields that skirt the lower slopes of Wearyall Hill SLF by the existing hedgerow. The proposed housing would give a ‘stepped’ effect from this view as they join the two main sets of housing. Given the importance of the view from the Tor SLF the visual impacts are judged to be Low/Medium. Mitigation: The western boundary hedgerow will be retained and enhanced with additional tree planting. The houses will be set down slightly within the site and set back so that their back gardens adjoin the boundary. Use of slate grey or dark brown roofing will further help reduce visual impact. The site’s southern boundary hedgerow will be added to with structural planting and the houses set at least 15m back from the line of the hedgerow. Summary: The visual impacts are judged to be Low/Medium reducing to Low once the new planting is well established.

Summary of visual impacts The site is well related to the existing settlement edge of Glastonbury on the edge of the ‘South Moor and Kennard Moor’ landscape character area . Because of local topography very little of the proposed development would be seen from the north of the site or the main roads passing through this part of the town. See the summary of visual impacts in Table 1 below.

Views from Local dwellings Although, in planning terms, residents are not entitled to a view, the visual impacts from the neighbouring properties which look over the site have also been considered. Their views will change from views over open countryside to views over housing to open countryside. However, by cutting the proposed housing into the slope it should be possible to reduce ridge heights by up to two metres which will, combined with the existing height differences, give at least four or five metres of difference in height between the existing floor heights and the proposed roof ridge heights. It is also proposed to have the layout of the development as two streets at 90 degrees to the existing properties and therefore the properties will be able to maintain views across the site to the wider landscape beyond. Overall, including the views from local dwellings, the impact of the residential development has been assessed as Low/Medium and with mitigation this can be reduced to Low. The proposed landscape mitigation measures will also provide a longer term landscape framework to the southern and western boundaries and provide some enhancement to the entrance into the town.

Landscape Impacts The direct impacts on the landscape including hedgerows and trees from the proposed residential development will be in terms of paddock lost to residential development. However, those direct impacts will be minor when set against the extent of the area of the ‘Isle of Avalon’ landscape character area as a whole.

Proposed Mitigation To address the main landscape concerns it is proposed to:

 Keep the new houses as far up the slope as possible by having the access road on the lower part of the site to give room for flood attenuation and a landscape buffer along the southern boundary. This will also help to integrate the new housing with the old when seen from the south, south-east and south-west.  Cut the development into the slope on the higher part of the site to reduce overall ridge heights and maintain views from the neighbouring houses across to the moors.  Provide structure planting between the existing hedgerow and access road to soften any impacts from the south.  The landscape planting to the west will help soften and define the site from both Wearyall Hill and Glastonbury Tor and provide a softer landscape edge to the town.  Remove the existing eastern boundary hedgerow and set it further back into the site to maintain local views from Old Butleigh Road and the main Butleigh Road.  Setting back the development from the road will also maintain views from the junction of Bretenoux Road and Butleigh Road and provide an attractive approach to the town from the south rather than the scruffy, poor quality bramble hedge which is there at present.

Southern and western boundary treatment Existing hedgerows will be carefully managed to encourage thick growth and where necessary reinforced with tree planting and additional hedgerow plants such as hawthorn, field maple and hazel.

The lower southern boundary, where not required for flood attenuation measures, will be planted as a landscape buffer approximately 10m wide using small to medium sized woodland trees such as: hawthorn, crab apple, hazel, holly and field maple.

Topography There is scope for progressively reducing ground levels within the site from small changes at the entrance to the site to up to 2m at the highest part of the site. This should help to reduce ridge heights within the development.

Back Gardens It is proposed that properties with back gardens facing out of the site will be planted with standard trees with fastigiate forms from the following list:  Crataegus Pauls Scarlet  Malus John Downie Ian Clark, Landscape Architect, CMLI, Clark Landscape Design Mobile: 07455 193875; Office: 01823 762446; email: [email protected] 12 Whitehall, Taunton, TA1 1PG

Front Gardens Where feasible short stretches of low hedgerow will be planted in front gardens to provide some enclosure for individual properties using a mix of species from the following: Escallonia, Buxus, Mahonia, Prunus and Eleagnus. Where hedgerow planting is not feasible planting of decorative shrubs will be provided from the following mix of species: Brachyglotis, Cistus, Lavandula, Phlomis, Teucrium, Rosmarinus, Salvia and Santolina.

Roofscapes By using slate grey or dark brown tiles it should be possible to further reduce any visual impact of the proposed development.

LANDSCAPE AND VISUAL IMPACT ASSESSMENT SUMMARY

The site is outside of any national or local designations and there are no Tree Preservation Orders within the site. The key policies relevant to the landscape of the site from the recently adopted Local Plan are DP1: Local Identity and Distinctiveness; DP4: Mendip’s Landscape; and DP7: Design and Amenity of New Development.

The site is well related to the town lying on its southern boundary on the edge of the open countryside. The site lies within the ‘Isle of Avalon’ landscape character area but also close to the edge of the ‘South Moor and Kennard Moor’ landscape character area. However, the landscape of the area around the site cannot be said to have an unspoilt character, since it is substantially affected by locally prominent housing and areas such as Roman Way and Tor View Avenue and the site has a strong urban fringe character. The long lines of housing following the contours of the hill are particularly prominent across the open landscape of Kennard Moor when looking from the south northwards towards Wearyall Hill.

Overall the impact of the residential development has been assessed as Low/Medium and with mitigation this can be reduced to Low. Through careful management of the southern and eastern boundaries it should be possible to provide a much ‘softer’ edge to the town as seen when approaching along the Butleigh Road from the south providing some Enhancement.

The direct landscape impacts are marginal given the small area of paddock affected.

Given the importance of the structural landscape mitigation proposals the client would undertake to provide a landscape management and maintenance plan which would allow them to be maintained independent of the individual properties.

The District wide ‘Assessment of Special Landscape Features’, published in February 2011, clearly shows the site well outside of the Wearyall Hill SLF designated site and therefore the main reason for assessing the site as not suitable for development is invalid. Having undertaken the wider landscape assessment of the proposed development site my assessment is that the proposals with mitigation would generally have a Low visual impact and would also provide some Enhancement to the southern approaches into the town.

South Somerset District Council Five-Year Housing Land Supply Paper (September 2017)

1. Introduction

1.1. This report sets out the latest position on the five-year housing land supply for South Somerset District Council (SSDC), for the five-year period from 1st April 2017 to 31st March 2022. Information and evidence is accurate up to and including 30th June 2017.

1.2. The Council recognises that the information in this report can only represent a ‘snap- shot’ in time. The position regarding the five-year housing land supply is constantly subject to change, whilst every house built, each planning permission granted, and every major change to the delivery timetable for a housing site will affect the position.

2. Background and Context

National policy

2.1. The National Planning Policy Framework (NPPF) (2012) requires that local planning authorities (LPAs) should use their evidence base to ensure that their local plan meets the full, Objectively Assessed Need (OAN) for market and affordable housing in the housing market area.

2.2. The NPPF requires LPAs to identify and update annually a supply of specific deliverable sites sufficient to provide five years’ worth of housing against their housing requirements. To this figure an additional buffer of 5% (moved forward from later in the plan period) should be added, to ensure choice and competition in the market for land.

2.3. If, and where, there has been a record of “persistent under delivery” of housing, the NPPF requires LPAs to increase the buffer to 20% (moved forward from later in the plan period) to provide a realistic prospect of achieving the planned supply and to ensure choice and competition in the market for land.

2.4. The National Planning Practice Guidance (PPG) (March 2014) reiterates the importance of identifying a supply of deliverable sites to provide five years’ worth of housing against housing requirements.

2.5. The PPG also provides a starting point for formulating the five-year Housing Land Supply, clarifying that: “Housing requirement figures in up-to-date adopted Local Plans should be used as the starting point for calculating the five year supply. Considerable weight should be given to the housing requirement figures in adopted Local Plans, which have successfully passed through the examination process, unless significant new evidence comes to light”.

Local Policy

2.6. The Council adopted the South Somerset Local Plan (2006 – 2028) in March 2015; and this confirms the District Council’s housing requirement.

2.7. The Local Plan sets out a housing requirement of 15,950 dwellings to be delivered over the 22 year period. This equates to an annualised average of 725 dwellings per annum.

2.8. The Local Plan is presently undergoing an ‘Early Review’; and it is anticipated that an Issues and Options Document will be published in the Autumn of 2017.

3. Determining the Five-year Housing Requirement

Overview

3.1. Given the status of the Local Plan, the starting point for calculating the five-year housing land supply is the housing requirement set out in Policy SS5 of the Plan.

3.2. In order to reach a conclusion on whether or not the Council can currently demonstrate a five-year supply of housing land, the following component parts need to be examined:

 The basic annual housing requirement;  The five-year basic housing requirement;  The net housing completions since the start of the Local Plan period in 2006;  Whether there is any shortfall against the Local Plan target which needs to be addressed;  The Council’s track record of ‘persistent under delivery’;  The appropriate buffer which should be added to provide choice and competition in the market for land; and  The buffer to be applied to the basic five-year housing requirement figure and the shortfall in housing delivery.

The basic annual housing requirement

3.3. The NPPG is clear that adopted local plans should serve as the starting point for calculating the five-year housing land supply. The basic housing requirement figures set out in SSDC’s Local Plan are:

 an overall housing requirement between 2006 and 2028 of 15,950 dwellings; and  an annualised housing requirement of 725 dwellings pa (15,950 / 22 years).

3.4. Determining the five-year basic housing requirement is calculated by multiplying the annual requirement over a five-year period. This equates to 3,625 dwellings (725 x 5).

Housing completions since the start of the Local Plan

3.5. In order to ensure that the identified housing need is being met, and to understand whether the Local Plan is ‘on track’ to deliver the agreed scale of growth, it is necessary to analyse housing provision over the Local Plan period. The level of completions in South Somerset since 2006 is set out in Table 1 below.

The shortfall in housing delivery

3.6. Analysing the level of net housing completions against the intended housing delivery target shows that there has been a shortfall in terms of meeting the housing target since 2006. The current shortfall in terms of what the Local Plan should have delivered against what has been delivered is 1,107 dwellings.

The shortfall to be addressed

3.7. Neither the NPPF nor the PPG set out a clear methodology for how the shortfall should be addressed. However, the consensus of opinion and legal precedent indicates that LPAs should use what is known as the “Sedgefield” method for addressing the shortfall. This would mean that the shortfall is addressed in the next five years of the plan period. This is in contrast to the method of apportioning the shortfall over the remainder of the plan period (known as the “Liverpool” method).

3.8. Adopting the “Sedgefield” method would mean that the entirety of the current shortfall is added to the five-year basic housing requirement figure. As such, the revised requirements would be 4,732 dwellings (3,625 + 1,107).

3.9. According to best practice, a review of planning appeal decision letters, and legal precedent, the Council’s track record would represent ‘persistent under delivery’. Under-delivery is more a symptom of the performance of the development industry and other market factors than the direct responsibility of the LPA.

3

The appropriate buffer to be added

3.10. Given that the Council’s track record represents ‘persistent under delivery’, according to Paragraph 47 of the NPPF, the Council is required to increase the level of buffer that is applied to the five-year housing land supply position.

3.11. According to Paragraph 47 of the NPPF, rather than the normal 5% buffer that should be applied, the Council must apply a 20% buffer so as to “provide a realistic prospect of achieving the planned supply and to ensure choice and competition in the market for land”.

3.12. Neither the NPPF nor the PPG set out a clear methodology for how the buffer should be applied when an LPA is in a position where there is an identified shortfall.

3.13. Analysing relevant planning inspector decision letters and best practice set out by the Planning Advisory Service indicates that the buffer should be applied to both the basic five-year housing requirement and the shortfall. Should further clarity and best practice emerge, the Council may alter its approach and methodology.

Summary

3.14. Table 2 provides a summary of the current five-year housing requirement in South Somerset. The overall conclusion is that the Council will need to be able to demonstrate a land supply capable of delivering 5,678 dwellings in the next five years, or an annual completion rate of 1,136 dwellings. This is significantly higher than the development industry has managed to deliver in the District each year since 2006.

4. Identifying the Five-year Housing Land Supply

Overview

4.1. Both the NPPF and PPG provide the context from which the supply of housing sites can be determined. The NPPF at Paragraph 47 states that LPAs should: “identify and update annually a supply of specific deliverable11 sites…” and “identify a supply of specific, developable12 sites or broad locations for growth, for years 6-10 and, where possible, for years 11-15”.

4.2. The footnote numbers 11 and 12, which accompany the text in Paragraph 47 of the NPPF state that:

“To be considered deliverable, sites should be available now, offer a suitable location for development now, and be achievable with a realistic prospect that housing will be delivered on the site within five years and in particular that development of the site is viable. Sites with planning permission should be considered deliverable until permission expires, unless there is clear evidence that schemes will not be implemented within five years, for example they will not be viable, there is no longer a demand for the type of units or sites have long term phasing plans”.

and

“To be considered developable, sites should be in a suitable location for housing development and there should be a reasonable prospect that the site is available and could be viably developed at the point envisaged”. (emphasis added).

4.3. The PPG clarifies that planning permission, or allocation in a development plan, is not a pre-requisite for a site being deliverable in terms of the five-year supply. It re-iterates that LPAs will need to provide robust, up to date evidence to support the deliverability of sites, ensuring that their judgements on deliverability are clearly and transparently set out. If there are no significant constraints to overcome (such as infrastructure requirements), sites not allocated within a development plan, or without planning permission, can be considered capable of being delivered within a five-year timeframe.

4.4. The following component parts of the supply of land for housing have been included and Appendix 1 sets out the Council’s supply of housing sites in detail.

Sites with planning permission

4.5. The Council has identified sites within the District which benefit from planning permission (outline, full, reserved matters, prior approval, or permitted development). The Council has made a robust objective assessment of sites with planning permission and has included only a limited number of new dwellings on sites that are expected to remain dormant in the short to medium term.

4.6. The Council has also documented schemes where a planning application is pending a decision. These are not generally included within the first five years’ housing land supply unless there are clear reasons and expectations that the site will be approved and come forward and be delivered within that timeframe.

4.7. In analysing current and future planning applications and planning permissions the changes in permitted development, in use class; and conversions (including barn conversions) generate additional housing supply. For the avoidance of doubt these types of development where it is shown that they generate new housing are included in the calculation of new housing delivery and future housing supply.

4.8. Furthermore, the Council has seen an increase in the number of care homes and extra care homes within the District; and their delivery is included in the calculation of new housing delivery and future housing supply.

Sites with a resolution to grant permission subject to a Section 106 Agreement

4.9. The Council has also identified those sites where it has resolved to grant permission subject to the signing of a Section 106 Agreement. The Council considers that these sites have the same status of those sites which are in receipt of planning permission and has included them within the first five years of the trajectory of site delivery.

Sites within the Housing and Employment Land Availability Assessment

4.10. Sites within the Housing and Employment Land Availability Assessment (HELAA) have been identified in conjunction with the development industry and sites have been deemed as ‘suitable’, ‘available’ and ‘achievable’. The majority of the included HELAA sites are identified as ‘developable’ and therefore included within the later part of the housing trajectory (i.e. Years 6 – 10 and Years 11 – 15). However, some sites have been included within the first five-years of the housing supply, where planning permission has been granted.

Windfall Sites

4.11. The Council has consistently advocated that a proportion of its housing delivery occurs through windfall sites. The geographical extent and rural nature of the District, along with the range of settlement types and size, lends itself to small scale sites coming forward with no prior warning. This is particularly true in the smallest settlements in the District where minor infill plots and single home applications are commonplace. Similarly, Government’s relaxation of permitted development rights and change of use has resulted in additional windfalls.

4.12. The Council has adopted a conservative approach to avoid over-reliance on windfalls contributing to supply. The expectation is that the number of dwellings forthcoming will be greater, but the allowance included in the overall supply is 20 dwellings pa for 2017/2018 (Year 1) and 2018/2019 (Year 2) in order to prevent any double-counting of sites which are already in the system. The allowance is then increased to 50 dwellings pa for 2019/2020 (Year 3), 2020/2021 (Year 4), and 2021/2022 (Year 5), accounting for the greater take up of permitted development opportunities and the continued scale of permission granted to opportunity sites that emerge without prior knowledge.

4.13. The consequence is that 190 dwellings have been added to the supply; this represents 4% of the Council’s overall supply. The Council believes this is an extremely conservative approach to windfall given the nature of development proposals in South Somerset.

5. Conclusion

5.1. The Council’s five-year housing land supply requirement is currently 5678 dwellings.

5.2. Based upon the current assessment of future housing land supply for the period 2016/2017 to 2020/2021, the Council’s deliverable five-year housing land supply is 4,746 dwellings.

5.3. As such, the Council cannot currently demonstrate a five-year supply of housing sites and can only demonstrate a supply equivalent to about 4.2 years.

5.4. This means that the target figure for the next five-year period will grow again and makes achieving that target figure increasingly difficult; the required target is growing due to continued under-delivery, whereas the amount of forecast supply remains approximately the same.

5.5. A major factor in this shortfall is that the level of forecast completions in the District’s largest settlements are still not meeting expectations. Separately – and in combination – , Chard and are not delivering the necessary numbers of dwellings to keep the overall District figures on track.

5.6. The overall conclusion has significant implications for the Council’s decision-making on planning applications.

5.7. Para 14 of the NFFP states that:

“At the heart of the National Planning Policy Framework is a presumption in favour of sustainable development, which should be seen as a golden thread running through both plan-making and decision-taking.”

and

“For decision-taking this means…..

where the development plan is absent, silent or relevant policies are out‑of‑date, granting permission unless:  any adverse impacts of doing so would significantly and demonstrably outweigh the benefits, when assessed against the policies in this Framework taken as a whole; or  specific policies in this Framework indicate development should be restricted”

5.8. Para 49 of the NFFP states:

“Housing applications should be considered in the context of the presumption in favour of sustainable development. Relevant policies for the supply of housing should not be considered up-to-date if the local planning authority cannot demonstrate a 5-year supply of deliverable housing sites.”

5.9. There have been lengthy legal discussions and deliberations for several years over what constitute ‘relevant policies for the supply of housing’ in Local Plans, but there has recently been a ruling made by Supreme Court of Appeal. This now provides

clarity on the relationship between the Council’s Development Plan, its position in respect of its five-year housing land supply, and the approach to decision-making. The details of the relevant case are set out below.

5.10. A development in Cheshire and another in Suffolk were at the centre of the case; one was approved and the other refused. Neither council were at the time able to demonstrate a five-year supply of housing land as required by the NPPF.

5.11. On appeal, the Cheshire Inspector decided that the Council’s Countryside and Green Gap policies were policies for the supply of housing and therefore “out of date”, while the Suffolk Inspector considered the Settlement Boundary and Countryside policies to not be policies for the supply of housing and therefore found them to be “up to date”.

5.12. Both decisions were challenged in the Court of Appeal on the basis the decision-taker had misunderstood the scope of the term “policies for the supply of housing”.

5.13. The legal case brought the two together: Hopkins Homes v Suffolk Coastal District Council and Richborough Estates v Cheshire East Borough Council.

5.14. The Court’s judgment broadened the definition of the “relevant policies for the supply of housing” in paragraph 49 of the NPPF, with the effect that it would refer to all policies that create or constrain land for housing development, such as green belt designation.

5.15. At that time, therefore, where a local authority could not demonstrate an up-to-date five-year land supply, these relevant polices were to be considered as not up to date.

5.16. The two councils were granted permission to challenge the Court of Appeal’s decision in the Supreme Court; the first time Supreme Court has considered the NPPF.

5.17. It found that the Court of Appeal’s interpretation of what “relevant policies for the supply of housing” means was wrong. It said that the “straightforward interpretation is that these words refer to the policies by which acceptable housing sites are to be identified and the five-years supply target is to be achieved. That is the narrow view”.

5.18. “In neither case is there any reason to treat the shortfall in the particular policies as rendering out of date other parts of the plan which serve a different purpose.”

5.19. According to the Supreme Court, the important question is not how to define individual policies, but whether the result is a five-year supply in accordance with the objectives set by paragraph 47.

5.20. “If there is a failure in that respect, it matters not whether the failure is because of the inadequacies of the policies specifically concerned with housing provision, or because of the over-restrictive nature of other non-housing policies. The shortfall is enough to trigger the operation of the second part of paragraph 14.”

5.21. The Supreme Court said it is paragraph 14, not paragraph 49, that provides the “substantive advice by reference to which the development plan policies and other material considerations relevant to the application are expected to be assessed”.

5.22. This means permission should be granted unless adverse impacts would significantly and demonstrable outweigh the benefits when assessed against the NPPF’s policies taken as a whole. This would also apply where specific policies in the NPPF indicate development should be restricted.

5.23. In simple terms, therefore, the implication of not being able to demonstrate a five-year housing land supply is not whether any particular policies within the Council’s Local Plan are deemed to be ‘out-of-date’, but that the weight accorded to the Local Plan is diminished in favour of the NPPF in the determination of planning applications.

9

6. Next Steps

6.1. Together with Mendip, and Taunton Deane Councils, the Council commissioned a Joint Strategic Housing Market Assessment (SHMA) to understand the nature of the housing market, and establish how much housing is required in South Somerset on an annual basis. This was published in October 2016.

6.2. This key piece of evidence will now inform choices and decisions about the amount of housing that is needed in South Somerset, whilst the recently completed HELAA has assisted in identifying potential sites for allocation within the Review of the Local Plan.

6.3. The conclusion of the SMHA is that, if ‘concealed’ households and Class C2 Uses (Care Homes) are included, the annualised assessment of Overall Housing Need (OAN) would be a maximum of 660 dwellings, as set out in Table 3 below.

6.4. It should be noted that this is a lower requirement than the current figure of 725pa, although it is still higher than the number of annual completions secured in the majority of years since 2006. When the Council adopts a Revised Local Plan (2014- 2034) and a lower annual target is potentially adopted, any accumulated shortfall would be counted from the start of the Plan period in 2014 and may be more manageable with the current significant deficit reduced accordingly.
