Department of Health Brisbane, 28th February, 1985 HIS Excellency the Governor, acting by and with the advice of the Executive Council and in pursuance of the provisions of the Health Act 1937-1984, has been pleased to approve of the following Regulations made by the Director-General of Health and Medical Services for the State of Queensland. AMENDMENTS OF "THE POISONS REGULATIONS OF 1973" WHEREAS, by the Health Act 1937-1984, it is amongst other things enacted that the Director-General may make regulations: Now, therefore the Director-General, with the approval of His Excellency the Governor with the advice of the Executive Council, doth hereby make the following Regulations:- !. "The Poisons Regulations of 1973" as previously amended are in these Regulations referred to as the Principal Regulations. 2. Subregulation A2.07 of the Principal Regulations is amended by inserting after Clause (n) the following Clause- (o) Single-use tubes for the estimation of the alcohol content of breath. 3. The Principal Regulations are amended by repealing Regulation AS and substituting the following Regulation- AS. Prohibited Drugs and Poisons. AS.Ol. A person shall not have in his possession, prescribe, dispense, sell, lend, give away, supply nor use any of the following substances unless that person is engaged upon medical or scientific research or analyses and has received the written approval of the Director-General in that regard:- Acetorphine Ally lisopropy lacety1 urea Amidopyrine and its derivatives for human therapeutic use Amygdalin Arprinocid Bithionol for human therapeutic use Buclosamide 2 Amendments-The Poisons Regulations of 1973

Buniodyl sodium Calamus for human therapeutic use Cannabis (Indian hemp) and cannabis resin and extracts and tinctures of cannabis Clioquinol and other halogenated 8-hydroxyquinoline derivatives for internal human use Desomorphine Dienochlor Dulcin Etorphine Flunixin Meglumine for human therapeutic use Ivermectin Ketobemidone Methapyrilene Methfuroxam Methyl Cincophen (methyl ester of phenylcinchoninic acid) Nitro fen Oxyphenisatin for human therapeutic use Sulfallate Tetrahydrocannabinols 1,1,1-trichloroethane in aerosols for therapeutic use Triparanol or a preparation containing any proportion whatsoever of any of the substances listed in this subregulation. 4. Subregulation A6.0 1 of the Principal Regulations is amended by in clause (c)- (i) inserting immediately after the entry "N, N-Dimethyltryptamine" the following entry- "N-Ethyl-1- Phencyclohexylamine (PCE)" (ii) inserting immediately after the entry "Parahexyl" the following entry- "1-(1-Phenylcyclohexyl) Pyrrolidine (PHP or PCPY)" 5. Subregulation A 7.06 of the Principal Regulations is amended by in clause (f) omitting the word "dispensing" and substituting the word "supply". 6. The Principal Regulations are amended by omitting subregulation A7.08 and substituting the following subregulation- A7.08. A school dental therapist who is performing prescribed duties under and within the meaning of the Dental Act 1971-1973 may, subject Amendments-The Poisons Regulations of 1973 3 to these Regulations, use such of those poisons contained in Schedule 2 to these Regulations as are specified hereunder:-

SCHEDULE 2 Ether and substances containing more than 10 per cent of ether except when included in Schedule 4, Schedule 5 or Schedule 6. Auorides- (a) Sodium fluoride in substances for human ingestion containing 2.2 mg or less of sodium fluoride per dosage unit; and (b) other metallic fluoride substances including ammonium fluoride for therapeutic use except- (i) in dentifrices containing 1 000 mgjkg or less of fluoride ; or (ii) in substances containing 15 mgjkg or less of fluoride ion. Lignocaine when included in substances for external use, other than eyedrops, containing ten per cent or less of lignocaine. Mercury, metallic (excluding its salts) except in scientific instruments. Phenol and any homologue of phenol boiling below 220°C, creosote and substances containing more than 3 per cent of such substances or homologues, for therapeutic use. 7. The Principal Regulations are amended by inserting after subregulation A7.08 the following subregulation- A7.09. The Director-General may authorise in writing the obtaining, possession, sale, supply or use of a Schedule 3 poison by a person under the conditions set out in such authority. 8. Subregulation A8.01 of the Principal Regulations is amended by omitting the expression "Schedules 6 or 7" and substituting the expression "Appendix A to Schedule 6, or Schedule 7". 9. Subregulation Bl.Ol of the Principal Regulations is amended by in clause (c) inserting the word "securely" immediately after the word "being". 10. The Principal Regulations are amended by omitting subregulation B1.03 and substituting the following subregulation- Bl.03. A dangerous drug, restricted drug or poison, other than a poison specified in Schedule 5, shall not be sold in a bottle or jar having a capacity of more than two litres, or in any other immediate container unless- (a) the word "Poison" is embossed on the side of such bottle, jar or other immediate container in letters of a height not less than one thirty-second part of the depth of such bottle, jar or other immediate container; (b) the word "Poison" is indelibly written on the. side of such, bottle, jar or other immediate container in a contrasting 4 Amendments-The Poisons Regulations of 1973

colour to the background colour and in letters of a height not less than one thirty-second part of the depth of such bottle, jar or other immediate container; or (c) such bottle, jar or other immediate container is labelled so that- (i) the label is indelibly printed directly onto such bottle, jar or other immediate container; or (ii) in the case of a fibreboard container the label cannot be removed without damage to the container or label. 11. The Principal Regulations are amended by omitting subregulation Bl.07 and substituting the following subregulation- B1.07. (a) A poison specified in Schedule 5 shall not be sold in an immediate container unless such immediate container- (i) is readily distinguishable from a container in which food or drink is sold; and (ii)- (1) has embossed or indelibly written thereon the word "Poison" or the words "Not to be taken" or the words "Not to be used as a food container"; (2) the label is indelibly printed directly on the such immediate container; or (3) in the case of a fibreboard container the label cannot be removed without damage to such container or label. (b) The following poisons specified in Schedule 5, namely­ Methylated Spirit, Kerosene, Mineral Turpentine, Petrol, White Spirit and any other liquid hydrocarbon shall not be sold in a bottle or jar having a capacity of two litres or less unless- (i) the outer surface of such bottle or jar has embossed thereon prominent vertical ribs or grooves or prominent points or stars of sufficient number to render the bottle or jar distinguishable by sight and by touch from bottles or jars ordinarily used as containers for any food, drink, condiment or medicine for internal use; (ii) such bottle or jar if made of glass is coloured brown; and (iii) such bottle or jar complies with the provisions of clause (a) of this subregulation. 12. the Principal Regulations are amended by­ (i) renumbering subregulation Bl.08 as Bl.09; (ii) inserting the following subregulation immediately after subregulation B 1.07. Bl.OS. A poison specified in the following Table shall not be sold in a bottle, jar or can having a capacity as specified in the Table unless such bottle, jar or can is fitted with a closure of a type approved by the Director-General. THE TABLE

13. Subregulation B6.01 of the Principal Regulations is amended by inserting the words "drug or" after the word "any". 14. Subregulation Cl.02 of the Principal Regulations is amended by omitting clause (c) and substituting the following clause- "(c) a poison specified in Schedule 7 unless it is stored in a receptacle or storeroom under lock and key or in a secure place to the satisfaction of the Director-General. The key of such receptacle or storeroom shall remain at all times in the possession of such person or of a responsible person delegated by him. 15. The Principal Regulations are amended by inserting after subregulation C3.07 the following subregulation- "C3.08. The Director-General may in his discretion, suspend or cancel a permit granted by him under this Regulation". 16. The Principal Regulations are amended by repealing Regulation C8 and substituting the following Regulation- "CS. Sale and use of strychnine. CS.Ol. For the purpose of this Regulation strychnine is the poison specified in Schedule 7 as- "Strychnine except when included in Schedule 4". C8.02. A person shall not be in possession of nor use strychnine unless he is- (a) a person so authorised by these Regulations; or 6 Amendments-The Poisons Regulations of 1973

(b) the holder of a permit in Form Bl of Schedule 9 to these · Regulations. C8.03. A person desiring to obtain strychnine shall make application to the Director-General in Form B of Schedule 9 to these Regulations. C8.04. The Director-General may, at his discretion, issue to the applicant a permit in Form B 1 of Schedule 9 to these Regulations. CS.OS. The holder of a permit which has been issued under this Regulation shall not:- (a) use such strychnine for any purpose other than that stated in the permit; (b) store such strychnine at a place other than that stated in the permit; and (c) have any strychnine in his possession after the expiration of the time stated in the permit. C8.06. A person shall not sell strychnine unless the intending purchaser produces a permit in Form Bl: Provided that this prohibition shall not apply to a bona fide wholesale sale by a licensed wholesale seller of poisons to a pharmacist or to another licensed seller of poisons. C8.07. A person who has obtained strychnine as the holder of a permit shall keep such strychnine under lock and key in a secure place. The key of such secure place shall remain at all times in the possession of the holder of the permit or of a responsible person delegated by such permit holder. CS.OS. The permit holder or the responsible person delegated by him shall not at any time leave such strychnine as to be accessible to others. C8.09. A person who has strychnine in his possession at the time this Regulation comes into force shall within the period of three months thereafter notify the Director-General to that effect and make application for a permit to be in possession of and for the use of such strychnine in accordance with the provisions of this Regulation. CS.lO. A person who buys strychnine outside the State shall immediately such strychnine comes into his possession at any place within the State, notify the Director-General to that effect and make application for a permit to be in possession of and for the use of such strychnine in accordance with the provisions of this Regulation. CS.ll. The Director-General may in his discretion suspend or cancel a permit granted by him under this Regulation. Amendments-The Poisons Regulations of 1973 7

17. The Principal Regulations are amended by omitting subregulation D2.04 and substituting the following subregulation- D2.04. A dentist engaged in carrying on the practice of dentistry is hereby authorised only to the extent necessary for the practice of his profession and subject to the provisions of these Regulations- (a) to buy, obtain and administer in the treatment ofhis patients at the time of surgery the following dangerous drugs:- Pethidine Papavetetum Codeine Morphine Oxycodone Pentazocine; (b) to have in his possession upon the premises or place occupied by him for the purpose of the practice of dentistry the dangerous drugs referred to in clause (a) of this subregulation; (c) to prescribe for the purpose of dental treatment of a person whom he is treating in the course of his practice of dentistry the dangerous drugs codeine and pentazocine provided the quantity prescribed does not exceed three days' supply; (d) to buy, obtain and administer in the treatment of his patients and to have in his possession upon the premises or place occupied by him for the purpose of his practice of dentistry a restricted drug; and (e) to prescribe for the purposes of dental treatment of a person who he is treating in the course of his practice of dentistry a restricted drug. 18. Subregulation D2.16 of the Principal Regulations is amended by omitting the words "Anaesthetics, local, being synthetic cocaine substitutes except when included in Schedule 3, lignocaine and prilocaine only" and substituting the following words- "Lignocaine except when included in Schedule 2, Prilocaine". 19. The Principal Regulations are amended by omitting subregulation D2.17 and substituting the following subregulation- D2.17. An ambulance officer employed by a Queensland Ambulance Transport Brigade Committee and who has successfully completed a course at the Queensland Ambulance Transport Brigade Training School approved by the Director-General is hereby authorised to obtain, have in his possession and use the following restricted drug but only to the extent that such drug is required for the due performance of his duties. 20. Subregulation G 1.03 of the Principal Regulations is amended by inserting after clause (i) the following clause- (j) For the sale or supply of a restricted drug to a chiropodist authorised under subregulation D2.19 such written order shall be endorsed "Regulation D2.19" and shall be signed by such chiropodsist with his usual signature. 21. Subregulation 11.01 of the Principal Regulations is amended by in clause (a) inserting the words "in ink" after the word "therein". 22. Subregulation Jl.02 of the Principal Regulations is amended by in clause (b) inserting the words "or his delegate" after the word "subregulation". 23. The Principal Regulations are amended by inserting after subregulation J3.03 the following subregulation- "J3.04. All entries required by this Regulation shall be recorded in ink on the day of the transaction." 24. The Principal Regulations are amended by repealing Regulation 05 and substituting the following Regulation- 0.5 Colouring of Certain Drugs and Poisons. 05.01. A person shall not sell nor use an antibiotic substance packed in an applicator device specially designed for intramammary infusion in animals unless and until such antibiotic substance is suitably coloured with Brilliant Blue FCF or other approved colour as a marker. 05.02. A person shall not sell nor use, for the purpose of pest destruction, a cereal, grain or meal containing a poison unless and until such cereal, grain or meal is coloured in a manner approved by the Director-General. 25. Subregulation 010.01 of the Principal Regulations is amended by omitting clause (b) and substituting the following clause- (b) The provisions of this subregulation shall not apply to­ (1) the laying of baits for the purposes of pest destruction; (2) the application of herbicides for the destruction of noxious weeds or unwanted vegetation; (3) the application of insecticides to a water course, creek, river, dam, or other collection of water for the destruction or control of mosquitoes; or (4) the application of insecticides to the land surrounding a watercourse, creek, river, dam, or other collection of water for the destruction or control of midges by a person- (i) acting under a permit or authority of the Director-General or of a Local Authority; (ii) acting in pursuance of the provision of the Stock Routes and Rural Lands Protection Act, 1944-1984; or Amendments-The Poisons Regulations of 1973 9

(iii) acting on behalf of a Cane Pest and Disease Control Board in pursuance of the provisions of the Sugar Experiment Stations Act 1900-1983. 26. The Principal Regulations are amended by omitting Schedules 1 to 8 inclusive (together with any Appendices) and substituting the following Schedules- 10 Amendments-The Poisons Regulations of 1973 SCHEDULE 1 POISONS Aconite (Root of aconitum napellus). Antimony, compounds of except:- (a) antimony chlorides in polishes; or (b) when included in Schedule 4. Atropine except when included in Schedule 2 or Schedule 4. Belladonna and substances containing more than 0.25 per cent. of the alkaloids of belladonna calculated as hyoscyamine. Bromine (excluding its salts). Brucine except when, used in concentrations of 0.02 per cent. or less for the denaturation of alcohol. Comfrey (symphytum) being preparations and admixtures for internal use of comminuted leaves or dried and powdered root or any part of the dried plant. Coniine. Cotarnine. Croton Oil. Homatropine and substances containing more than 0.25 per cent. of homatropine. Hydrocyanic acid and cyanides for therapeutic use in substances con­ taining more than the equivalent of 0.15 per cent. of hydrocyanic acid. Hyoscine except when included in Schedule 2 or Schedule 4. Hyoscyamine and substances containing more than 0.25 per cent. of hyoscyamine. Hyoscyamus and substances containing more than 0.25 per cent. of the alkaloids calculated as hyoscyamine. Lobelia and substances containing; more than 0.5 per cent. of the alkaloids except preparations for smoking or burning. Mercuric chloride except:- (a) in substances containing 0.5 per cent. or less of mercuric chloride; or (b) in batteries; or (c) when included in Schedule 7. Mercuric iodide except when included in Schedule 2 or Schequle 6. Mercuric nitrate and substances containing more than the equivalent of 3 per cent. of mercury (Hg), in such form. Mercuric-potassium iodide and substances containing more than the equivalent of 2 per cent. of mercuric iodide in such form. Mercuric thiocyanate except when included in Schedule 6. Mercury, organic compounds of, except:- (a) when included in Schedule 2, Schedule 4 or Schedule 6; or Amendments-The Poisons Regulations of 1973 11

(b) ethoxyethylmercury chloride and ethylmercury chloride in Schedule 7; or (c) in substances containing 0.01 per cent or less of mercury as a preservative. Nux vomica. Phosphorus, yellow (excluding its salts) except when included in Sched­ ule 6 or Schedule 7. Savin, oil of. Stramonium and substances containing more than 0.25 per cent. of the alkaloids calculated as hyoscyamine except preparations for smok­ ing or burning. Tansy, oil of. SCHEDULE 2 POISONS Acetic Acid (excluding its salts) and substances containing more than 80 per cent. of acetic acid, for therapeutic use. Acetyldihydrocodeine in compounded preparations containing 1 per cent. or less of acetyldihydrocodeine. Antazoline- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in oral substances labelled and packed for the relief of coughs and colds. Aspirin, whether or not compounded or combined with another sub­ stance, for internal use except where- (a) included in Schedule 4; or (b) not compounded or combined with a therapeutically active substance and- (i) in the form of a tablet or capsule containing not more than 325 milligrams of aspirin with not more than 25 tablets or capsules in each such pack or container or in a primary pack; or (ii) in the form of a powder containing not more than 650 milligrams of aspirin each powder being packed in an immediate wrapper with not more than 12 powders in each such container or in a primary pack; or (iii) in the form of granules, packed in an immediate wrapper containing not more than 650 milligrams of aspirin with not more than 12 immediate wrappers in each such container or in a primary pack. Atropine, except when included in Schedule 4, (a) in substances containing 0.25 per cent. or less of atropine; and (b) atropine sulphate, 0.6 mg tablets in packs of six, when labelled for treatment of organophosphorus poisoning. Bamipine- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in oral substances labelled and packed for the relief of coughs and colds. Belladonna in substances containing 0.25 per cent. or less of the alkaloids of belladonna, calculated as hyoscyamine. Benzamine ·when included in- (i) lozenges, pastilles, tablets or capsules containing 30mg or less of benzamine in each; or Amendments-The Poisons Regulations of 1973 13

(ii) suppositories or bougies containing 200mg or less of ben­ zamine in each; or (iii) substances for external use, other than eye drops, containing 10 per cent. or less of benzamine. Benzocaine when included in- (i) lozenges, pastilles, tablets or capsules containing 30mg or less of benzocaine in each; or (ii) suppositories or bougies containing 200 mg or less of ben­ zocaine in each; or (iii) substances for external use, other than eye drops, containing 10 per cent. or less of benzocaine. Benzoyl peroxide in substances for external human therapeutic use containing 5 per cent. or less of benzoyl peroxide. Bromhexine. Bromodiphenhydramine- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in oral substances labelled and packed for the relief of coughs and colds. Brompheniramine- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in oral substances labelled and packed for the relief of coughs and colds. Buclizine- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in solid substances labelled and packed for the treatment of motion sickness in packs of 10 doses or less; or (iii) in oral substances labelled and packed for the relief of coughs and colds. Bufexamac- (i) in substances containing 5 per cent. or less of bufexamac for external human therapeutic use; or (ii) in suppositories. Butylaminobenzoate when included in- (i) lozenges, pastilles, tablets or capsules containing 30 mg or less of butylaminobenzoate in each; or (ii) suppositories or bougies containing 200 mg or less of buty­ laminobenzoate in each; or (iii) substances for external use, other than eye drops, containing 10 per cent. or less of butylaminobenzoate. Carbaryl in substances for external human therapeutic use containing· 2 per cent. or less of carbaryl. 14 Amendments-The Poisons Regulations of 1973

Carbenoxolone for topical oral use. Carbetapentane except in substances containing 0.5 per cent. or less of carbetapentane. Carbinoxamine- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in oral substances labelled and packed for the relief of coughs and colds. Chloroform (excluding its derivatives) except- (a) in substances containing 10 per cent. or less of chloroform where the chloroform content is declared on the label; or (b) when included in Schedule 4. Chloropyrilene- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in oral substances labelled and packed for the relief of coughs and colds. Chlorpheniramine- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in oral substances labelled and packed for the relief of coughs and colds. Chlorphenoxamine- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in oral substances labelled and packed for the relief of coughs and colds. Cinnamedrine. Cinnarizine- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in solid substances labelled and packed for the treatment of motion sickness in packs of 10 doses or less; or (iii) in oral substances labelled and packed for the relief of coughs and colds. Clemastine- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in oral substances labelled and packed for the relief of coughs and colds. Clemizole- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or Amendments-The Poisons Regulations of 1973 15

(ii) in oral substances labelled and packed for the relief of coughs and colds. Clioquinol, and other halogenated derivatives of 8-hydroxy-quinoline for external human use. Codeine- (i) Subject to paragraph (ii), where compounded or combined in a preparation containing- (a) not more than 10 mg of codeine per dosage unit when in divided preparations; or (b) not more than 0. 5 per cent. of codeine when in undivided preparations; (ii) where compounded or combined with either aspirin or paracetamol or salicylamide in tablets, capsules or powders containing not more than 10 mg of codeine per tablet, capsule or powder whether with or without a substance or quantity of substance not included in a Schedule, and (a) with not more than 25 tablets or capsules in a primary pack; or (b) with not more than 12 powders in each such pack or container or in a primary pack. Cycliramine- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in oral substances labelled and packed for the relief of coughs and colds. - (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in oral substances labelled and packed for the relief of coughs and colds. Deptropine- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in oral substances labelled and packed for the relief of coughs and colds. Dexbrompheniramine- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in oral substances labelled and packed for the relief of co:ughs and colds. Dexchlorpheniramine- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or 16 Amendments-The Poisons Regulations of 1973

(ii) in oral substances labelled and packed for the relief of coughs and colds. Dextromethorphan in compounded preparations containing 1 per cent. or less of dextromethorphan. Dextrorphan in substances containing 1 per cent. or less of dextrorphan. Diamines, phenylene, toluene and all other alkylated benzene diamine derivatives, except when included in Schedule 6. Dicophane (DDT) in substances for human therapeutic use. Dicyclomine in substances containing 0.1 per cent. or less of dicyclomine. Dihydrocodeine in compounded preparations containing 1 per cent. or less of dihydrocodeine. Dimenhydrinate- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in solid substances labelled and packed for the treatment of motion sickness in packs of 10 doses or less; or (iii) in oral substances labelled and packed for the relief of coughs and colds. Dimethindene- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in oral substances labelled and packed for the relief of coughs and colds. Dimethisoquin in substances for topical use. Dimethothiazine- (i) in substances labelled and packed as eye drops or as nasal preparations for topical use; or (ii) in oral substances labelled and packed for the relief of coughs and colds. Diphemanil methylsulphate in substances for topical use.
