The principal display panel shall be large enough to accommodate all the mandatory label information required to be placed thereon by this part with clarity and conspicuousness and without obscuring design, vignettes, or crowding. Where packages bear alternate principal display panels, information required to be placed on the principal display panel shall be duplicated on each principal display panel.

Gluten Free… [21 CDR § 101.91] "gluten-free" means the food either is inherently gluten free or does not contain an ingredient that is… 1) a gluten-containing grain (e.g., wheat, rye, barley, or hybrids like triticale); 2) derived from a gluten-containing grain that has not been processed to remove gluten (e.g., wheat flour); 3) derived from a gluten-containing grain that has been processed to remove gluten (e.g., wheat starch), if the use of that ingredient results in the presence of 20 parts per million (ppm) or more gluten in the food.

NOTE: Also, any unavoidable presence of gluten in the food must be less than 20 ppm.

NOTE: Wheat starch processed to remove gluten can be present in a food so long as the level of gluten in the finished food is less than 20 ppm. A clarifying statement is needed to identify the ingredient is processed to meet the criteria for gluten-free.

NOTE: Statements such “made with no gluten-containing ingredients” or similar can still be made if truthful. More rules coming for fermented and hydrolyzed foods.

Further FDA guidance or possible regulations could in store in the future. Mandatory GMO Labeling: Various states, such as Connecticut and Maine have passed legislation on labeling foods with GMO. Vermont’s act 120 goes into effect July 1, 2016. New York and almost 2 dozen other states are contemplating such labeling as well.

NOTE: These laws are and would be pre-empted by the National Bioengineered Food Disclosure Standard. USDA to draft regulations on matter by about 2018, with a 1 year transition after final regulations are made. All foods under FDA and USDA would be subject to mandatory GMO labeling.
