PUBLIC INPUT REGARDING ITEMS ON THE AGENDA

The following individuals talked about the preservation of Yale Park: Monica Lomas, Julia Roll, Thayer Nichols and Andy Lenderman.

Gene Hill addressed Article 12, Section 10 of the Constitution of New Mexico (Children of Spanish Descent Shall Enjoy Perfect Equality) and said he believes the University is in violation of this section. He said that in 1964, there were 15 Hispanic • professors at UNM--today there are 121. Mr. Hill urged the regents to improve the programs aimed at recruiting Hispanics to the University. He added that in New Mexico 70% of the school-age children are Hispanic and other minorities; however, 70% of the money spent on tuition and student aid goes to Anglos.

2 • ADMINISTRATIVE REpORT -- UNM PRESIDENT RICHARD E. PECK • UNM President Richard E. Peck presented the administrative report as follows: Human Resources Study

The company of William Mercer, Inc. has been hired to conduct the study. They will be provided with an office on campus, and will conduct meetings and interviews at various locations throughout campus. The consultants have a planning session on Monday with the Human Resources Review Team.

Library of Congress/ UNM Press

Librarian of Congress James Billington, sent a letter to Senator Pete V. Domenici about UNM Press and its support to the Library in exploring the possibility of transmitting electronic texts from publishers directly to the Library. As part of this project, the very first book transmitted electronically to the Library was transmitted by UNM Press.

Feder~l Technology Reinvestment Project

• UNM will participate in approximately $8 million in two grants for the Federal Technology Reinvestment Project which was created to further the conversion of defense technology to peacetime uses. Of these two grants, $2.9 million will go to Rio Grande Medical Technologies, Inc. which is collaborating with Sandia Labs and UNM in developing a system for non-invasive arterial blood gas measurement. The second grant in the amount of $4.8 million was awarded to the UNM Research Institute which is collaborating with Sandia Labs and Laguna Industries in developing assistive devices for physically impaired persons.

Princeton Guide to Law Schools

President Peck quoted a piece about UNM in a recent issue of the Princeton Guide to Law Schools: "Extremely high demand for spots in New Mexico's tiny entering class make this fine, inexpensive law school one of the most selective in the nation. No applications, save those with stratospheric numerical credentials, can be certain of gaining admission." President Peck said that in the last class, more women than men were admitted, 100 New Mexicans out of400 applicants were admitted, and 10 out-of­ state students were admitted from 800 applicants.

• 3 oGO 1Ci 6, Public Administration Spanish Master's Program Nineteen students from Mexico and Bolivia will graduate from UNM in July in the only • ongoing Spanish Language Master's Program in Public Administration in the United States, bringing the total graduates from this program to 86. More than 700 graduates of the Latin American Programs in Education (LAPE) over the years now reside in 19 Latin American countries.

Signing of the UNM-OAS General Agreement

On May 24, there will be a ceremony in Washington, D.C. where UNM will sign an agreement with the Organization of American States (OAS) to become the first university to provide technical assistance and education program advice to the OAS member countries.

Arts of the Americas Festival

The College of Fine Arts, as part of its summer 1994 Arts of the Americas festivities, will host a dinner for the Brazilian Ambassador to the United States on June 14. President Peck said that Southwest Airlines is featuring the Arts of the Americas Festival in their In Flight magazine and is considering offering travel packages for the • festival.

Chris Schueler, President, Alumni Association

Mr. Schueler indicated this was his last meeting as President ofthe Alumni Association and thanked the Regents for the opportunity to serve as an adv~sor to the Board of Regents. Beginning in June, the new Alumni Association President will be Ms. Marty Wilson.

Mr. Schueler said the Alumni Association has recently completed an outreach coordination with 8 communities whereby some of the leading citizens of those communities will be directly involved with the President's Office and the Office of Community Relations in order to establish better relationships between the communities 4 • 0001 (;'7

and the University. The Alumni Association anticipates extending this program to other • communities next year. Mr. Schueler said various departments at the University of New Mexico, KNME-TV, the State Department ofHealth, the State Human Services Department and high schools throughout New Mexico have put together three half-hour pilot shows called "Fences"-­ a program for, about and by teenagers. The shows will be computer interactive and students who cannot participate in the studio discourse may comment on the show via a computer from anywhere in the state. This is the first time this has ever occurred in the country.

Bel Campbell, President, Faculty Senate

Regent President Melendres announced the reelection of Professor Campbell as President ofthe Faculty Senate for another year. Professor Campbell said the past year was an extremely educational one for her and said the Faculty Senate is planning to address a major restructuring and a whole new vision of faculty governance to continue the already enhanced communication with the institution.

Don Burge, President, Staff Council

• Mr. Burge said he has received numerous telephone calls regarding the proposed Domestic Partners Policy requesting that either the University cancel the policy or delay it until it can be studied further. Mr. Burge recommended that a task force be formed to look at the various ramifications of the policy. He said it is clear from the phone calls he has received that if the University proceeds with the policy as it is currently written the first casualty of it will probably be the General Obligation Bond issue in November.

Wayne Davenport, President, UNM Foundation

Mr. Davenport said the Foundation is in the process of concluding the Centennial Campaign which, over the past five years, raised $100 million for the University. The Foundation is already thinking about fundraising past the centennial campaign, establishing fundraising priorities to improve the quality of education and the educational experience at UNM.

CANDIDATES FOR DEGREES, SEMESTER II 1993-94 Regent Hecker moved that the Regents ratify candidates for degrees for Semester II, • 1993-94. The Faculty Senate approved the candidates on May 10, 1994. Regent Gallegos seconded the motion.

UNIVERSITY ARENA -- ADA COMPLIANCE

University Counsel Nick Estes reported that the Federal Office for Civil Rights has • accepted the proposal for resolving the question ofhandicapped access to the University Arena (). Mr. Estes requested the Regents approve the Amended Commitment to Resolve, which provides for two additional accessible seating areas for mobility impaired individuals and companion seating in an integrated setting by means of short ramps from the concourse to two new platforms. In total, the two areas will provide 42 additional seating areas for wheelchairs or companion seating. The new areas will be constructed in the summer of 1995 and utilization will be monitored during the 1995­ 96 school year. If warranted by demand, construction of one or more additional platforms may be required, up to a total of 180 accessible seats. This is the maximum required under the Americans with Disabilities Act. The cost will be about $150,000.

Regent Ramo moved approval to authorize the University President to enter into approval of the Amended Commitment to Resolve. Regent Gallegos seconded the motion.

FACILITIES FEE ESTABLISHMENT

Vice President Mc Kinney explained that this is a proposal to take a portion of the current existing mandatory fee and designate it as a facilities fee. In the allocation of the revenue created by the student fee payment, the amount of $2,540,000 was dedicated by the Board of Regents in 1976 to be used to retire bonds issued to finance major capital pr9jects on the campus. Currently, this sum represents about 29% ofthe total annual debt service obligation of the University. This dedication of fee revenue was for the life of the bonds issued at the time, ending in 2006. This amount of fee revenue has been set aside for debt service each year, irrespective of the number of students paying the student fee. Thus, as enrollment has increased, the percent of fee revenue dedicated to debt service has declined. The Regents are requested to establish a facilities fee that would include the debt service obligation, but also could be used for additional capital improvement and equipment needs. The proposal suggests that the Regents could (1) designate a portion of the student fees as a facilities fee that would be sufficient to cover the current debt service obligation, with the portion to be • determined as a dollar amount per FTE students (or per credit hour for part-time students), and (2) remove the termination of the fee revenue commitment in 2006 and make permanent the designation of a facilities fee.

Regent Ramo moved approval. Regent Gallegos seconded the motion.

Regent Gallegos said it is his understanding that the Regents are designating this fee, which allows an accounting assumption to be made and, which will free up present reserves and does not determine what Regents might decide in later years regarding this fee.

STATE BOARD OF FINANCE SEVERANCE TAX RESOLUTION Vice President Mc Kinney explained that this is a request by the State Board ofFinance • that the Regents approve a resolution that essentially certifies the use of the funds for the purposes that they requested. The proposal is in two phases to issue a taxable rate issuance in June and a tax exempt issue in July.

Regent Ramo moved that the Regents certify the funds as requested. Regent Gallegos seconded the motion.

Voice vote was taken and Board members unanimously approved.

MODIFICATION OF UNIVERSITY LEASE FOR MULTI-TENANT BUILDING AT UNIVERSITY CENTER RESEARCH PARK

Vice President Mc Kinney explained that this is a request for approval to modify the University lease from 20 years to 30 years for the Multi-tenant Building at the • University Center Research Park. The UNM Technology Development Corporation (UNMTDC) has obtained interim construction financing at favorable interest rates from a local bank. For long-term financing the UNMTDC intends to issue 30-year bonds, about 70% tax-exempt and 30% taxable rates. The 3D-year term has been selected to try to minimize the annual debt service obligation, which has a direct relationship to the lease rates paid by the University. After evaluating several options, it has been determined that UNMTDC could get the most attractive rates using full debt financing if the lease term from the University is at least equal to the length of the bond issue. Since this is the first debt issuance of the UNMTDC, some consideration has been to insure the debt to make it more attractive in the market. A 30-year lease commitment is necessary for the issuance to have insurance coverage.

Ms. Julie Weaks, Director of the UNM Budget Office, explained that the University received appropriations this year from two general appropriation bills--the standard House Bill 2 and Senate Bill 372. Senate Bill 372 had an emergency clause appended to it; thus the funds from this Bill were appropriated immediately upon signature ofthe Bill by the Governor. The University had planned to budget these funds for the 1994­ 95 fiscal year; however the State Budget Office is requiring that institutions add these funds to their 1993-94 budgets via a Budget Adjustment Request, even if institutions have no plan to spend the funds until 1994-95.

Regent Ramo moved approval of the budget revisions as indicated in the agenda book. Regent Hecker seconded the motion.

Voice vote was taken and Board members unanimously approved.

Motion carried. • ******* VARIOUS CONSTRUCTION PROJECTS

Mr. Roger Lujan, Director of Facility Planning, explained the constructions projects. The first project is a renovation of some third floor space of Northrop Hall. The renovation will create about 1300 square feet of class 100 research space for Radiographic Isotope Research. The project budget is $625,000 and is being funded by a combination ofdepartmental funds from Geology, some Indirect Cost Reimbursement Income Overhead from Grants and some Minor Capital funds from the institution.

The second project is a combination reconstruction/renovation at the Valencia Campus. The project converts approximately 13,500 square feet of space into classrooms. The space previously housed the campus' "interim" Learning Resource Center, but with the completion of the new LRC last year, the space was recaptured for instructional purposes. Also included is additional space in the Administration Building, the Academic Building and a new Storage and Maintenance Facility. The project budget is $1,300,000 and is being funded by a combination of 1992 Valencia County General Obligations Bonds and 1994 New Mexico State Severance Tax Bond proceeds. • 9 OGOli2

The final project is the Los Alamos Campus Learning Resource Center addition. The • project adds 12,000 square feet ofnew space and 5,000 ofrenovated space. The project budget is $1,550,000 and is being funded by a combination of 1992 New Mexico State General Obligation Bonds; 1994 New Mexico Severance Tax Bond proceeds and 1994 Los Alamos county General Obligations Bonds.

Regent Ramo moved approval of all three construction projects. Regent Brazil seconded the motion.

EXTERNAL AUDITOR SELECTION

Vice President Mc Kinney explained that with the approval of the State Auditor, who has conducted the audit for the last two years, the University issued a Request for Proposals (RFP) for a Financial and Compliance Audit. The solicitation for proposals was advertised locally, and a copy of the RFP was mailed to all Independent Public Accountants on the State Auditor's listing. Three proposals were received and the State • Auditor approved all three bid proposals as meeting the criteria outlined in State Auditor's Rule 94-1. An evaluation committee reviewed the three proposals, following the evaluation criteria published in the RFP. Based on this review, it is recommended that Neff & Company and Ernst & Young be retained to perform the Financial and Compliance Audit of the University of New Mexico for the 1994 fiscal year.

Regent Ramo moved approval of the auditor selection. Regent Rembe seconded the motion.

1995/1996 LEGISLATIVE CAPITAL PROJECTS REQUEST

Vice President Mc Kinney explained that this is a request for approval that the Major Capital Improvement Projects identified in the agenda be submitted to the Commission on Higher Education, the Governor and the Legislature for funding during the 1995 Legislative session. -These projects are recommended with the expectation that the capital improvement projects listed for UNM in the 1994 State General Obligation bond resolution are approved by the citizens this fall. If such is not the case, the projects on the GO bond have higher priority in the request for the 1995 session.

The projects listed in the 1995-96 request have been included in previous years' legislative requests by the Regents. Although next session will not be a GO bond session, there is expected to be some Severance Tax bonding available, as well as some • surplus state revenues that might be used for one-time capital projects. Also included for information purposes are the next four years' projections of capital project needs. These reflect the results of college and departmental needs identified through the internal campus budget planning process. The projects listed by years reflect a preliminary priority ranking of major academic and infrastructure needs. The University Planning Council will be reviewing these priorities over the next several months. The Commission on Higher Education requires the five-year planning statement.

Regent Ramo moved approval of the 1995-96 legislative capital projects request. Regent Gallegos seconded the motion.

A few years later, he began writing again, taking enjoyment in it for a period ofabout 10 years before his wife's death in 1990. The emerging volumes in "Mercy of a Rude Steam" continue where "Call It Sleep" left off. It mixes the experiences of a young hoy near the start ofWorld War I with the memories ofan old man near the end ofthis century. 'The fact of a new work published by Henry Roth is akin to hearing that Ralph Ellison is publishing a new work 42 years after 'The Invisible Man,' or J.D. Salinger is preparing a sequel to 'Catcher in the Rye,' and we believe that honoring this great American writer at this moment ... will be a timely and appropriate tribute," said the writer of a letter nom­ inating Roth for the UNM honorary degree.

AMENDED COMMITMENT TO RESOLVE

Pursuant to the authority granted to the U.S. Department of Education, Office for Civil Rights ("OCR"), by Section 504 of the Rehabilitation Act of 1973 and Title II of the Americans with Disabilities Act (" ADA"), the University of New Mexico ("University") agrees to resolve all issues raised in the complaint in Case No. 08932052.

I. By December 1, 1993, the University will complete the following modifications to the University Arena ("Arena"): (1) two concourse level platform seating areas providing twenty additional seats for individuals with mobility impairments; (2) accessible restroom facilities for women and men; (3) accessible drinking fountains; (4) additional curb cuts and ramps; (4) concession stands for use by individuals with mobility impairments; and (5) additional parking for individuals with mobility impairments and additional signage - for same. All modifications must comply with Uniform Federal Accessibility Guidelines or Americans with Disabilities Act Accessibility Guidelines.

II. By May I, 1995, the University will commence construction of two additional accessible seating areas in the Arena that will provide seating for mobility impaired individuals and companion seating in an integrated setting by means of short ramps from the concourse to two new platforms ("the two ramp-down areas"). The two ramp-down areas would • provide access to choice seating approximately three-and-a-half vertical feet below the concourse level of the Arena. One of the two ramp-down areas will be located in Section 26 on the north side of the Arena, while the other would be located in Section 21 on the west side. Both of the two ramp-down areas would be located near accessible concessions stands and restrooms.

In total, the two ramp-down areas will provide 42 additional seating areas for wheelchairs or companion seating. After the completion of the two ramp-down areas, the total number of accessible seats in the Arena will be 82, with the inclusion of the existing four platform areas on the concourse level of the Arena.

If it is determined on or before July 1, 1996 that the demand for accessible seating exceeds the existing capacity for such seating in the Arena, then the University will commence construction of additional accessible seating areas, similar to the first two ramp-down areas, using a phased approach, in order to accommodate the demand. If the demand for accessible seating warrants it, by August 1, 1997, the University will provide sufficient additional accessible seating up to a total of 180 accessible seats. All construction must comply with the Americans with Disabilities Act Accessibility Guidelines. • Commitment to Resolve Page Two • III. The University will submit reports with appropriate supporting documentation verifying the specific actions taken by the University during each reporting period to implement the plan described in Item II, as follows:

a. By October 1, 1994, the University will complete the engineering and planning phase for the design of the two ramp-down areas.

b. 'By May 1, 1995, the University will commence construction of the two ramp­ down areas. In addition, by this date the University will report to the OCR about (1) the selection of a construction engineer for the project and (2) the public relations plan that the University will develop to publicize the two ramp-down areas throughout the University community and the greater-Albuquerque community.

c. By August 1, 1995, the University will complete the construction of the two ramp-down areas. At this time, the University also will describe to the OCR the type of utilization analysis it will undertake during the 1995-96 school year to determine if demand for accessible seating exceeds the existing capacity. This analysis will include a tabulation of the number of seats purchased by persons with mobility impairments and their guests from August 1, 1995 through June 1, 1996. • d. By July 1, 1996, the University will provide the results of its one-year utilization analysis of accessible seating in the Arena, which will have determined whether or not the demand for such seating exceeds the existing capacity. If the existing accessible seating satisfies the demand, this will be the University's last reporting date under the Commitment to Resolve. If it is determined by this date that the existing capacity does not meet the demand for accessible seating in the Arena, then the University will commence construction of additional accessible seating areas in order to accommodate the demand, as described in Item II, using a phased approach.

• • RESOLUTION, NOTIFICATION AND CERTIFICATION WHEREAS, money from the proceeds of severance tax revenue bonds ("Bonds") authorized in the section ofthe Laws ofNew Mexico (the "Act") specified in Exhibit A attached hereto and made a part hereof (the "Exhibit") is needed in the amounts and for the project or projects (the "Projects") specified in the Exhibit.

WHEREAS, the governing body ofthe University ofNew Mexico met on ---, 1994 and adopted the resolution set forth below:

NOW, THEREFORE, BE IT RESOLVED AND CERTIFIED BY THE UNDERSIGNED FOR AND ON BEHALF OF THE UNIVERSITY OF NEW MEXICO:

1. Each Project has been developed sufficiently to justify the issuance of Bonds in the amount stated for each Project, and each Project can proceed to contract within six months ofthe date the Bonds are issued (expected to be around June 15, 1994) and work will thereafter proceed diligently to completion. It is expected that at least 85 percent ofthe proceeds allocated to each Project will be used by three years after the Bonds are issued. By delivery of a copy of this document, the State Board ofFinance ("Board") is hereby notified that money from the proceeds of Bonds is needed for the Projects in the amounts specified in the Exhibit.

2. The Board is hereby requested and instructed to issue and sell Bonds to fund the • Projects in the amounts specified in the Exhibit. 3. All conditions, contingencies and limitations imposed by the Act with respect to each Project and the expenditure of funds with respect thereto, if any, have been satisfied.
