Additional information

The Austrian Task Force on Human Trafficking, headed by the Federal Ministry for European and International Affairs, was set up in 2004 and is charged with coordinating and intensifying the measures in combating human trafficking. It is composed of representatives of all competent ministries, including outsourced agencies, the federal provinces and non-governmental organisations and accompanied by a National Coordinator on Combating Human Trafficking since 2009.

The current legislation on trafficking in persons in Bosnia and Herzegovina covers all forms of exploitation indicated in the UN Trafficking Protocol.

The Third National Action Plan for 2008-2012 is based on a set of guiding principles for all the competent government structures, but also for civil society, which are: principle of human rights; participation and responsibility of authorities to create conditions where all individuals will be able to realise their human rights; interdisciplinary and multi-sectoral approach; principle of non-discrimination; principle of inclusion of civil society; principle of sustainability and international and regional cooperation.

Additional information

According to the referral mechanism for coordination and also taking care of unattended Bulgarian children and children –victims of THB in foreign countries, over the 2012 there were 66 criminal cases for trafficking in persons have been registered. Those cases were taking care from the State Agency for Child protection and 24 children were repatriated from EU countries. Once repatriated most of these children are hosted into crisis centers for children, victim of violence and THB.

Bulgaria’s National Action Plan against Human Trafficking is developed by the National Commission for Combating Trafficking in Human Beings (NCCTHB). It places a strong emphasis on local policies to combat human trafficking, advancement of the work of the established local commissions and expansion of the prevention activities among adolescents, their parents and teachers, ethnic minorities and at border check points.

The current legislation on trafficking in persons in Croatia covers all forms of exploitation indicated in the UN Trafficking Protocol.

Additional information

In February 2012, the Government of Croatia adopted a new National Plan for the period 2012-2015 aimed at the suppression of Trafficking in Persons. In particular, the current Plan has among its goals to strengthen activities to identify victims of trafficking.

Additional information

A National Action Plan is in place for the period 2008 to 2011. The Plan focuses on these four areas: a) coordination of activities and collection of data relating to trafficking in human beings; b) draft amendments to acts and related legal provisions; c) approach towards a solution to exploitation of prostitution; and d) to define a framework strategy to prevent trafficking in human beings.

Estonia introduced the specific offence of trafficking in persons in March 2012. This legislation is covering all forms of exploitation indicated in the UN Trafficking Protocol. Before the introduction of the specific offence, different articles of the criminal code were used to prosecute cases of trafficking in persons, including the offences of enslaving, pimping, aiding prostitution, child stealing and others.

The citizenship of those convicted under the criminal offences used to prosecute trafficking in persons during this period was either Estonian or from Eastern Europe. Some of those convicted did not have a registered citizenship.

Additional information

The Estonian authorities established a national developmental plan for reducing violence for the years 2010-2014; combating trafficking in persons is one of the objectives of the plan. The Plan includes activities aimed at the prevention of trafficking by providing information on trafficking in human beings to the general public and risk groups (especially young people and girls). It also includes activities aimed at preventing and identifying exploitation of the labour force, supporting victims of trafficking in human beings, increasing the efficiency of investigation of cases of trafficking in human beings and establishing and developing networks of cooperation.

The specific offence of trafficking in persons in France covers all forms of exploitation indicated in the UN Trafficking Protocol. The French authorities make use of the offences of trafficking in persons (Art 225-4-1/6), procurement (Art 225-5/10), exploitation of prostitution (Art 225-12- 1/2), labour conditions against human dignity (Art 225-13/16), exploitation of begging (Art. 225- 12-5/7) and organs trafficking (Art. 511-2) to prosecuted cases of human trafficking.

A Second National Action Plan against human trafficking was adopted for the period 2008-2012.

The aims of this National Action Plan are the following: develop victim-oriented approach and improve the efficiency of actions; develop victim support; develop a prevention system; develop a coordinating mechanism; improve the efficiency of law enforcement and justice bodies; develop an information database; and develop a tuition and training system.

The priorities identified by the national authorities in combating trafficking are: respecting the special needs of the endangered group of victims, especially minors or young adults; encouraging regional co-operation; and efficient, punctual, transparent and accountable use of financial resources.

The current legislation on trafficking in persons in Ireland covers all forms of exploitation indicated in the UN Trafficking Protocol.

Additional information

The third National Plan on Preventing and Combating on Trafficking in Human Beings entered into force in January 2014. This plan focuses on five strategic areas (in a total of 53 measures); Prevention, Awareness-raising, Acknowledgement and Investigation; Education, Training and Qualification; Protection, Intervention and Capacity building; Criminal Investigation; Cooperation.

In 2013, Portugal amended the article of the Penal Code regarding trafficking in persons (article 160.º) by Law No. 60/2013 of 23th of August. Nowadays, besides sexual, labor exploitation and removal of organs, begging, and the exploitation of criminal activities were included. It was also included in the same Article 160 that the consent of the victim of trafficking in human beings is irrelevant. Some new aggravating penalties were also included in that article.

Portugal has an Asset Recovery Office (ARO), Law No. 45/2011, of 24th June, that has been changed by the Law 60/2013, of 23rd of August. It states that the use of seized and confiscated funds and the proceeds from trafficking in persons can be channeled to support victims’ assistance and protection programs.

Some legislation has been adapted in order to promote more efficient investigation tools for law enforcement agents. With the recent amendment of Law No. 5/2002, of 11th January (by Law No. 60/2013, of 23th of August), trafficking in persons was included in the list of crimes where a special legal framework for the collection of evidence, breach of confidentiality and loss of property to the State is foreseen. Also, with the latest amendment of Law No. 101/2001, of 25th of August, (by Law No. 60/2013, of 23th of August) undercover actions

for the purpose of preventing and detecting criminal agents were made possible for the crime of trafficking in persons.

In June 2013, the Network for the Support and Protection to Victims of Trafficking (RAPVT) was created. This structure brings together the governmental and nongovernmental organizations working on trafficking in human beings. The RAPVT guarantee better intervention, support and articulate a more organized and sustained on human trafficking and a better source of information for criminal investigation. At the moment of the production of this Report, Portugal has three shelters for victims of trafficking. Two are specific for women and the other is for men - all of them are funded by the state.

There are four Regional Support Networks and Protection to Victims THB (North, Centre, and Alentejo). These structures act to fight trafficking and support its victims and their activities strengthen the work of RAPVT, operationalizing its projects and activities (both networks are envisaged in the 3rd National Action Plan 2014-2017). The purpose is to strengthening assistance to victims (ensuring that services are sufficient available and appropriate to meet the specific needs) and deepening of the multidisciplinary approach to the identification of victims, including through more systematic involvement of multidisciplinary teams in identification of victims of trafficking.

In Portugal, the law enforcement authorities responsible for the investigation of the crime of trafficking in human beings are the Criminal Police (Polícia Judiciária) and the Immigration and Border Services (Serviço de Estrangeiros e Fronteiras).

− ROMANIA −

The National Action Plan for 2011-2014 is divided into four chapters, covering the areas of supporting framework, prevention, victim protection and criminal proceedings. Each strategic aim is divided into specific activities, with responsible entities for implementation, deadlines for implementation, allocated resources and performance

indicators. The supporting framework contains activities on coordinating the institutions together with the legislative framework on knowledge based oriented approach. The prevention activities include activities on public awareness and education, reducing the vulnerability of population at risk and to discourage traffickers. The victims protection activities includes activities on identification and recovery of the victims, protection of witnesses and reintegration of the victims into the country of origin. The criminal proceeding includes activities about improving detection and investigation on trafficking cases, improving international cooperation with law enforcement agencies abroad, and ensuring adequate and non-discriminatory treatment of victims on the part of all participants of criminal cases.

Additional Information

The Centre for Intelligence against Organized Crime (CICO) manages the database “BdTrata”, containing all the information concerning the prevention and the investigations from the different Police forces operating whole Spain. On the base of this information, the CICO is periodically publishing an Annual Report on the Situation of Trafficking in Human Beings in Spain. Additional information

The United Kingdom has implemented a National Action Plan for the period 2011-2015. The Plan strategy focused on four key areas: Improved victim care arrangements; enhanced ability to act early, before the harm has reached the United Kingdom; smarter multi-agency action at the border; and better coordination of law enforcement efforts within the United Kingdom.
