EST: MARIA DE FÁTIMA NETO RELATORA: JUÍZA CÉLIA REGINA REGIS – EM SUBSTITUIÇÃO Por ordem do(a) Excelentíssimo(a) Senhor(a) Juíza CÉLIA REGINA REGIS – em substituição ao Desembargador(a) LIBERATO PÓVOA – Relator(a), ficam as partes interessadas nos autos epigrafados, INTIMADAS do(a) seguinte DECISÃO, Compulsando detidamente os autos, verifico que algumas partes não foram intimadas sobre a sentença recorrida, razão pela qual determino, com fulcro no art. 515, § 4º, do CPC, que sejam dela intimadas: a) Joaquim Maia Leite e sua esposa; b) Joaquim Mendes Vieira, Antonio Dias Cardoso, Umbelino Mendes Vieira, Pedro Mendes Vieira e suas respectivas esposas; e c) José Rodrigues Lima e ANO XXV-DIÁRIO DA JUSTIÇA Nº 3252 PALMAS-TO, TERÇA-FEIRA, 10 DE DEZEMBRO DE 2013 2 sua esposa. Analisando o pleito de assistência judiciária gratuita formulado na segunda apelação (fls. 2.132/2.140), entendo que é o caso de indeferi-lo, considerando que há elementos nos autos que indicam capacidade econômica da parte para arcar com o preparo recursal, quais sejam as atividades profissionais dos apelantes (industrial, engenheiro agrônomo, advogado), bem como o baixo valor das custas do apelo, conforme se depreende do comprovante de preparo do primeiro apelo (fls. 2.122). Por tais razões, indefiro a gratuidade processual e determino a intimação dos segundos apelantes, a fim de que comprovem o recolhimento das custas recursais, no prazo de 5 (cinco) dias, sob pena de deserção. Considerando, ainda, que restou infrutífera a diligência em primeiro grau para restauração de algumas folhas destes autos (fls. 2.222 e 2.241), que a intimação no juízo singular se deu na via editalícia e que tais folhas mostram-se importantes para o deslinde do feito, conforme referências feitas a elas no decorrer do processo, penso ser necessária nova intimação, a qual, todavia, limitar-se-á apenas aos primeiros apelantes e ao Sr. Edvaldo Barboza de Sousa, porquanto são estas as partes que, segundo se extrai das aludidas referências, apresentaram petições e documentos que estariam dentre as folhas sumidas. Portanto, intimem-se também os primeiros apelantes e Edvaldo Barboza de Sousa, agora pela via postal, nas pessoas de seus advogados (respectivamente: Dra. Eny da Silva Soares – subscritora do recurso de fls. 2.117; e Dr. Eder Barbosa de Sousa – substabelecimento de fls. 2.230), a fim de que se manifestem sobre a ausência das fls. 285 a 399, juntando cópias aos autos, para fins de restauração, no prazo comum de 10 (dez) dias. Com ou sem manifestação das referidas partes, findos os prazos de tais providências, volvam-se conclusos os autos, com absoluta urgência, tendo em vista o longo tempo de duração deste processo e a prioridade garantida pelo art. 71 da Lei 10.741/03.     DOI:10.13114/MJH.2016.298 Geliş Tarihi:04.09.2016 Mediterranean Journal of Humanities Kabul Tarihi:16.11.2016 mjh.akdeniz.edu.tr VI/2 (2016) 279-297 Phaselis Batı ve Kuzeybatı Nekropolis’leri The Western and Northwestern Necropoleis of Phaselis Betül GÜREL Öz: Phaselis, Akdeniz‟de sahip olduğu üç doğal limanıyla önemli bir ticaret noktası olarak dikkat çekmektedir. Kent Lykia ve Pamphylia sınırlarının birleştiği noktada yer almaktadır. Bugüne kadar elde edilen arkeolojik veriler, epigrafik belgeler, nümizmatik bulgular ve antik kaynaklar ışığında kentin Arkaik Dönem‟den Doğu Roma Dönemi‟ne dek iskan gördüğü bilinmektedir. Phaselis‟te 1812 yılında başlayan ve kesintilerle 2000 yılına değin uzanan araştırmalar kent tarihi ve yerleşimi hakkında bazı bilgiler sunmasına karşın Phaselis nekropolis‟lerine dair detaylı bir çalışma bulunmamaktadır. Bu durum Phaselis‟in bölge sınırları içerisinde yer alan diğer antik kentlerle mezar mimarisini ve ölü gömme geleneklerini benzerlik ve farklılıklar açısından incelemeyi gerekli kılmaktadır. Kentte çeşitli unsurlarla birbirinden ayrılan üç nekropolis alanı bulunmaktadır. Bu çalışmada, nekropolis araştırmalarının başlangıcı için belirlenen “Batı ve Kuzeybatı Nekropolis” mercek altına alınmaktadır. Bu bağlamda şimdiye değin elde edilen veriler ışığında, nekropolis‟lerin kent içindeki konumu, sınırları, mezar türlerinin tespiti ve dağılımı ekseninde kentin gömü geleneğinin mezar mimarisine yansımalarına dair bilinenler ve yorumlar paylaşılmaktadır. Ayrıca kuzeybatı nekropolis‟te yer alan mezarların topografya üzerindeki dağılımını gösteren harita da çalışma içerisinde yer almaktadır.   • Lycian and Phrygian Names
    LYCIAN AND PHRYGIAN NAMES. ACCORDING to a theory which has been very commonly accepted by archaeologists in this country, the local names of Greece prove that a single language was once spoken there and in Asia Minor which was totally different from Greek, Thraeian, Illyrian, or Phrygian. It was neither Aryan nor Semitic, and resembled that of the Lycian inscriptions. At a later date, whether before or after the arrival of the Greeks, certain Thraeian and Illyrian elements were added, but they contributed little to the sum of geographical names.1 This belief is founded on the occurrence in Greece of local terminations in -a-0-- and especially in -v9-, which are considered to be foreign, and on their identification with the suffixes -acr- and -vB-, which are well known in Lycia, as well as in other districts of Asia Minor, and are derived from the native Lycian language.2 It is supported by the collection of a long list of geographical names from the islands and the mainland of Greece which are not recognisably of Greek origin, and show resemblances, so close and numerous that they can hardly be accidental, to names of places in Asia Minor. The case as stated by Pauli, Kretschmer, and Fick has a very convincing- appearance. But the facts on which it is based seem to be in general inconclusive and in part erroneous.
