WILDLIFE & COUNTRYSIDE ACT 1981

MONMOUTHSHIRE COUNTY COUNCIL DEFINITIVE MAP MODIFICATION ORDER 2018 RESTRICTED BYWAY 53-16 DEVAUDEN

Notice is hereby given that the above referenced Order has been submitted to the Welsh Ministers for determination. Following an earlier exchange of written representations, the Inspector appointed to determine the Order issued a letter in which she proposed to make modifications to the Order as drafted. Following advertisement of those proposals objections/representations have been received.

The start date for the above Order is 23 November 2020.

Consideration of the Order will take the form of exchanges of statements of case and comments on statements of case which contain evidence in respect of the Inspector’s proposed modifications only.

The effect of the Order, if confirmed without modifications will be to will be to modify the Definitive Map and Statement for the area by adding to them: -

Restricted Byway 53-16 commencing at its junction with Public Footpath, Devauden No 177 A at Grid Reference S049060030 (Point A on the Plan) arcing in a generally south south-easterly direction for a distance of approximately 311 metres to its junction with Public Footpaths, Devauden No 183 and 184 at Grid Reference S049160004 (Point B on the Plan), then continuing in a generally south westerly direction, running adjacent to Public Footpaths, Devauden No 183 and 182 for a distance of approximately 362 metres to its junction with Public Footpath, Devauden No 182 at Grid Reference ST49109969 (Point C on the Plan).

Restricted Byway 53-16 continues from its junction with Public Footpath, Devauden No 182 at Grid Reference ST49109969 (Point C on the Plan) in a generally southerly direction for a distance of approximately 106 metres to its junction with Public Footpath, Devauden No 191 at Grid Reference ST49119958 (Point D on the Plan) before again continuing in a generally southerly direction for a further 453 metres to its junction with Unclassified County Roads 53-11 and 53-18 at Grid

Reference ST 49219915 (Point E on the Plan). Here, it proceeds in a generally south south-easterly direction for a distance of approximately 226 metres to Grid Reference ST 49309894 (Point F on the Plan) then again in a southerly direction for a distance of approximately 67 metres to its junction with County Road 53-3 at Grid Reference 8T49299888 (Point G on the Plan). ------

The effect of the proposed modifications(s) would be to modify the Order as follows; Schedule: Part 1, paragraph 1 • Delete all references to “Restricted Byway” and insert “Footpath”. Schedule: Part 1, paragraph 2

• line 8 after ‘the Plan’ insert the following paragraph:

“Restricted Byway 53 – 16 commencing at its junction with Unclassified County Roads 53 – 11 and 53 – 18 at Grid Reference ST 49219915 (Point E on the plan) and running in a generally south south-easterly direction for a distance of approximately 226 metres to Grid Reference ST 49309894 (Point F on the Plan) then again in a southerly direction for a distance of approximately 67 metres to its junction with County Road 53-3 at Grid Reference ST49299888 (Point G on the Plan)”

Schedule: Part 2, Paragraph 1

• Delete all references to ‘Restricted Byway’ and insert ‘Footpath’;

Schedule: Part 2, Paragraph 2

• after line 9 ending in “ST49219915” insert the following paragraph:

“Restricted Byway 53 – 16 commencing at its junction with Unclassified County Roads 53 – 11 and 53 – 18 at Grid Reference ST 49219915 and running in a generally south south-easterly direction for a distance of approximately 226 metres to Grid Reference ST 49309894 then again in a southerly direction for a distance of approximately 67 metres to its junction with County Road 53-3 at Grid Reference ST49299888.”

Timetable for sending in statements of case and comments

Within 8 weeks of the start date [by 18 January 2021]

The Order Making Authority, the applicant and everyone who has made an objection or representation following the proposed modification(s) or any other written representation must ensure their statement of case is received by the Welsh Ministers. As soon as possible after receiving it the Welsh Ministers will send a full copy to the Authority. Copies (excluding copies of any supporting documents - these will be available to view at the Authority’s offices) will also be sent to everyone who has made an objection or representation following the proposed modification(s), the applicant and any other person who has previously written to us in respect of the Order.

Within 14 weeks of the start date [by 01 March 2021]

Everyone who has made an objection or representation following the proposed modification(s), the Authority, the applicant (if applicable) and anyone who has written to us in respect of the Order must ensure their comments on any or every other statement of case is received by the Welsh Ministers. As soon as possible after the above date, the Welsh Ministers will send copies of the comments received to everyone else.

Any other person wishing to make representations in writing to the Welsh Ministers in respect of the above Order must do so in line with the timetable set out above.

In fairness to the other parties everyone should keep to the timetable to ensure that statements of case and comments are received on time.

All parties must keep to the timetable set out above and ensure that statements of case are received by the Welsh Ministers on time. Late documents will be returned.
