A Service Inquiry (SI) is to be held under Section 343 of Armed Forces Act 2006 and in accordance with JSP 832- Guide To Service Inquiries (Issue 1.0 Oct 08). 2. The purpose of this Sl is to investigate the circumstances surrounding the subject land occurrence and to make recommendations in order to prevent recurrence. 3. The Sl Panel is to assemble at the Defence CBRN Centre in Winterbourne Gunner on Fri 5 Jun 15 at 0900L. 4. The Sl Panel comprises: President: WgCdr - Members: Maj W01 MBE 5. The legal advisor to the Sl is Maj - (DSA-Legad) and investigation support/assistance is to be provided by the Land Accident Prevention and Investigation Team (LA IT). 6. The Sl is to investigate and report on the facts relating to the matters specified in its Terms of Reference (TOR) and otherwise to comply with those TOR (at Annex). As the nominated Inquiry Panel for the subject Sl, you are to: a. Investigate and, if possible, determine the cause of the occurrence, together with any contributory, aggravating and other factors and observations. b. Ascertain whether Service personnel involved were acting in the course of their duties. c. Examine what policies, orders and instructions were applicable and whether they were complied with. d. Review the levels of authority and supervision covering the task during which the incident occurred. e. Establish the level of training, relevant competencies, qualifications and currency of the individuals involved in the activity. f. Identify if the levels of planning and preparation were commensurate with the activities' objectives. g. Investigate and comment on relevant fatigue implications of individuals' activities prior to the matter under investigation. h. Determine the state of serviceability of any relevant equipment. i. Determine any relevant equipment deficiencies. j. Assess any Health and Safety at Work and Environmental Protection implications in line with JSP 375 and JSP 418. k. .Determine and comment on any broader organizational and/or resource factors. I. Report and make appropriate recommendations to DG DSA. 2. During the course of your investigations, should you identify a potential conflict of interest between theCA and the Inquiry, you are to pause work and take advice from your DSA Legal Advisor, Hd LAIT and DG DSA. Nationality Law 1.1 The Irish case A new nationality The nationality law of a new state must necessarily provide for two matters: an initial population of nationals on the date of independence, and the acquisition and loss of nationality on an ongoing basis. In the case of the Irish state, the initial population was defined by Article 3 of the Irish Free State Constitution of 1922. Article 3 conferred Irish Free State citizenship upon a person if they were domiciled in the “area of the jurisdiction of the Irish Free State” on the date the state was founded (6 December 1922), provided (a) they had been resident in that area for the previous seven years, or (b) they or one of their parents had been born in “Ireland”.2 A full framework of nationality law, covering all aspects of acquisition and loss of nationality, was not then adopted until the Irish Nationality and Citizenship Act 1935.

Once again, “someone” did not want to adhere to the principles of rules-bound foreign policy and simply acted, failing beforehand to convene an international conference involving all stakeholders, that could draw on the expertise of as many non-governmental organisations as possible! Such a thing is unacceptable, such a thing is un-European, such a country does not belong in the EU, and such a NATO Member State should, if possible, even be expelled from the Alliance, according to some of the particularly agitated critics. Regardless of how many good reasons there might be to denounce Turkey’s intervention, there are two aspects to consider. First, the so-called people's defence militia, the YPG, against which the attack was directed, are not exactly famous in the region as angels of innocence: they are the Syrian sister organisation of the Turkey-based Kurdish PKK Workers Party, which is classified as a terrorist organisation throughout the EU.
