Hope you are well. Nearly a year since I met you over in NY – year has gone very quickly.

Sorry for the delay in updating you on the new forum, and thanks again for your input.

To confirm, the Cabinet Secretary for Culture, and External Affairs has agreed to a repurposed group to better benefit of clans, families, and as a whole has now been formed.

The purpose of the forum is to advance the interests of clan, family and ancestral tourism, including cultural aspects that encourage visitors, building on overseas Scottish connections and the benefits that this has for Scotland more widely.

As part of this work, group membership has been refreshed to cover clan, family and ancestry issues, including maintaining the links with key overseas organisations. To ensure overseas clan interests representation, your participation would of course be very welcome.

If you are agreeable, the first meeting of the group is on the afternoon of 23 November (Scottish time), again with dial in facilities (we hope better than last time, as a different building). The agenda is still to be set, but I would welcome contributions.

I will also be sending out a wider email to all proposed members of the group.

Details of the new group, including revised remit and membership, are attached – you saw an earlier draft – but thanks to a couple of the clan representatives, it went through a number of drafts to ensure that they were content.

Purpose and remit

 Cabinet Secretary led forum to advance the interests of clan, family and ancestral tourism, including cultural aspects that encourage visitors, building on overseas Scottish connections and the benefits that this has for Scotland more widely.

Specifically:

o To be a forum for dialogue and information sharing between the network of clans and families, ancestral tourist groups and the , including its international network.

o To recognise the value of clan, family and ancestral links in increasing awareness of Scotland; of its history, culture and the story it has to tell; and the impact that this has on and through film and media.

o To be a link between Scotland and those worldwide with Scottish ancestry or connections and ensure a key role in the country’s outward focus and to identify opportunities to support the clans’ and families’ value for enhancing Scotland’s reputation and influence through cultural diplomacy.

o To use the network of clans and families, and ancestral linkages, to help boost the Scottish economy through tourism, learning and inward investment, especially through their international presence.

o To create better awareness of the clans inside Scotland and encourage wider engagement (particularly among the young and local people) and to demonstrate that they make a positive contribution to modern Scotland.

o To promote and maximise the economic benefits of the Scottish Clan Event Fund by supporting relevant events that also engage local communities.

o Support clan and family societies which are the leading driver of getting overseas members over here.

o To promote the use of heritage resources and networks in order to attract visitors and enhance their experience.

Subgroups

Suggested that the main group should take the strategic overview to facilitate sharing of best practice, information and intelligence, to support wider engagement, rather than dealing with operational or detailed matters. Such matters should be directed from the forum to individual subgroups to consider.

Subgroups could be both standing and ad hoc, and cover matters such as:

 Genealogy and ancestral provision – link into the Scottish Council of Archives and covering responsibilities of the Scottish Ancestral Tourism Group  Information provision, including development of a clan/ancestral territories map and online information on clans and families.  Event planning and wider overseas engagement

We mentioned that whilst it is late in the day Camilla was approaching the Brick Church and had also suggested potentially doing something in a park.

Hope all is well - I look forward to catching up with you both over the course of Scotland week 2019 – it will be my first Scotland week so I’m looking forward to attending a lot of the events.

As you may be aware the Scottish Government’s approach this year will be two fold – 1) activity and support driven by events ran by our various diaspora groups (which have always been a huge success in the past) and 2) a proactive series of events driven by Team Scotland partners ( Scottish Government, Visit Scotland and Scottish Development International) in order to try and maximise the benefits Scotland week to Scotland.

On the second part, I just wanted to pick up on a couple of things with you directly. The model we are adopting is a pop-up Scotland House – a model that has been adopted in various forms across our international network to generate an awareness of Scotland on the international stage. For Scotland week we are taking over the NeueHouse and have arranged a series of events targeting Business, Tourism, Alumni and of course Diaspora with the venue hosting our annual Alumni and Diaspora receptions. We have worked closely with various key groups to ensure we do not run in direct competition with any other events being hosted by our key Diaspora organisations. The reason I am reaching out is that this is the first in a series of pop-up’s that we will be doing in different US locations – our direction from for consistency is to keep the model in line with other Scotland House engagements that have taken place. This obviously brings with it a naming conflict with what ASF refer to their offices as also during Scotland Week – I am hoping there is not too much to work out here given that we are generating invite only events to a permanent base where as I understand it from ASF’s side as your offices being labelled as Scotland House and events being off – site.

Whilst the model is in its infancy in the US, the plan would be to grow the presence year on year and iron out any lessons learned from this year.

I would be happy to answer any questions/ any concerns you may have but hope you will welcome our team Scotland approach to expanding on the wealth of activity that already constitutes Scotland week and its successes.

1. Definitions and Interpretation

This money will go towards the funding of Scottish North American Leadership Conference (hereby referred to as Project) and will specifically cover the costs of:

2. Purposes of the Grant

This grant is made to enable the Grantee to carry out the Project.

The Grant shall only be used for the purposes of the Project and for no other purpose whatsoever. No part of the Grant shall be used to fund any activity or material which is party political in intention, use, or presentation or appears to be designed to affect support for a political party.

The main objective of the Grant will be to support the issues of engaging and transferring Scottish culture to the next generation.

3. Inspection and Information

The Grantee shall keep the Scottish Government fully informed in the progress of the Project. The Scottish Government should also be informed of any revisions to targets/milestones against which progress in achieving objectives/outcomes is being monitored.

The Grantee shall, on completion of the Project, and within six months of receiving the final instalment of the Grant, submit a project overview to the Scottish Government summarizing the outcomes and performance of the Project. Such an overview shall include statistical data (where applicable) and other information relating to the impact of the project as shall be required by the Scottish Government. The overview should also include receipted costs where applicable.

The Grantee shall also provide any other information that the Scottish Government may reasonably require to satisfy themselves that the Project is consistent with the Agreement. The Grantee shall provide the Scottish Government with prompt access to any information they reasonably require to ensure compliance with these Conditions.

In the event of the Grantee becoming aware of or suspecting any irregular or fraudulent activity that may have any impact on the Project or on the use of the Grant, or any part of it, the Grantee shall immediately notify the Scottish Government of such activity and provide such other information as the Scottish Government may reasonably require in relation to the impact on the Project and the use of the Grant.

4. Confidentiality and Data Protection

The Grantee will respect the confidentiality of any commercially sensitive information that they have access to as a result of the Project.

Notwithstanding the above, the Grantee may disclose any information as required by law or judicial order. All information submitted to the Scottish Government may need to be disclosed and/or published by the Scottish Government. Without prejudice to the foregoing generality, the Scottish Government may disclose information in compliance with the Freedom of Information (Scotland) Act 2002, any other law, or, as a consequence of judicial order, or order by any court of with the authority to order disclosure. Further, the Scottish Ministers may also disclose all information submitted to them to the Scottish or Parliament or any other department, office or agency of Her Majesty’s Government in Scotland, in right of the Scottish Administration or the United Kingdom, and their servants or agents. When disclosing such information to either the or the United Kingdom Parliament it is recognized and agreed by both parties that the Scottish Government shall if it sees fit disclose such information but are unable to impose any restriction upon the information that it provides to Members of the Scottish Parliament, or Members of the United Kingdom Parliament; such disclosure shall not be treated as a breach of this agreement.

The Grantee shall ensure that all requirements of the Data Protection Act 1998 are fulfilled in relation to the Project.

5. Safeguarding Policies

The Grantee must have robust safeguarding policies in place to protect vulnerable groups. The Grantee must also have in place clear processes which must be followed if it becomes aware of specific incidents, including referral to the relevant authorities where necessary. Where the Grantee is working directly through a partner organization, the Grantee is required to have undertaken due in relation to safeguarding arrangements, including obtaining evidence of satisfactory safeguarding policies and / or procedures by the Grantee's partner organization. The Grantee must report all and any cases of suspected abuse or malpractice relating to anyone involved in delivery of the Project or any beneficiary of the Project to the Scottish Government and the relevant authorities immediately. The Grantee must, upon request from the Scottish Government, provide copies of the safeguarding policies and procedures referred to in this clause. In the event of the Grantee becoming aware of or suspecting: o any irregular or fraudulent activity in relation to the Grant or Project, or any part of either of them; and/or o any safeguarding incident by or in respect of any person involved in the Project,

The Grantee shall immediately notify the Scottish Government of such activity or incident and provide such other information as the Scottish Government may reasonably require in relation to the impact on the Project and the use of the Grant. In so notifying Scottish Ministers, the Grantee must also confirm that such irregular or fraudulent activity or safeguarding incident has been referred to the relevant regulatory or other authorities as appropriate, in line with any statutory duty and otherwise in line with any guidance issued from time to time on Notifiable Events by either the Office of the Scottish Charity Regulatory (OSCR) or as appropriate the Charity Commission for and . For the avoidance of doubt, in this agreement, a "safeguarding incident" includes any incident of abuse or mistreatment of any vulnerable person. 6. Publicity

The Grantee shall provide a communications planner to the Scottish Government which includes all publicly released announcements about the sponsored event,

The Grantee shall, where reasonably practicable, acknowledge the contribution of the Scottish Government in all publicity material relating to the Project. The Scottish Government will work with the Grantee to assess appropriate publicity based on the sponsorship amount, and may require to approve the form of such acknowledgement prior to its first publication.

7. Default and Recovery etc. of Grant

The Scottish Government may reassess, vary, make a deduction from, withhold, or require immediate repayment of the Grant or any part of it in the event that: a. The Grantee commits Default; b. The Scottish Government considers that any change or departure from the purposes for which the Grant was awarded warrants an alteration in the amount of the Grant; c. The Grantee fails to carry out the Project d. In the Scottish Government’s opinion, the progress on the Project is not satisfactory; or e. In the Scottish Government’s opinion, the future of the Project is in jeopardy.

8. Termination

The Agreement may be terminated by the Scottish Government giving not less than 3 months’ notice in writing from the date of the notice being sent.

9. Governance

The Grantee shall ensure that adequate internal control and risk management systems are in place and that all resources are used economically, effectively, and efficiently.

What will grant money be used for: The Grant of $10,000 will be used in support of the presentation The Pipes and Drums on the Fountain Terrace, Bryant Park, New York – during Scotland Week 2019. All expenses are incurred ahead of the event – there are no sales from tickets to collect and so we need to secure the support in advance through Grants. We cannot look for commercial sponsorship as that would then change the nature of our permit with NY City and in particular Bryant Park who would look to charge us at a Commercial rate -at this time we are viewed as a Cultural Event. The total budget for the series of 3 performances is American-Scottish Foundation cultural music program presented for the community on the Fountain Terrace of Bryant Park, New York is $19,300 We are requesting an increase from $7000 to $10,000 as our budget has gone up recent years due to several factors:

- We can no longer leave the equipment overnight at Bryant Park in their storage – it has to come in and out which adds an additional $300 per day This is an extra $900 over our previous budget

- We now pay a “donation” to Bryant Park for use of the Fountain Terrace – they did request $10,000 per day – with the help of the NY Parks Department Commissioner it has been reduced to $1500 per day. This is an additional $4500 over our previous budget. We are hoping to maintain it at the same level as 2018. At present we are able to dovetail insurance into our other policy as $425 but we watch to see what occurs around this. To meet our Budget we have a Patron who will again underwrite the Donation to Bryant Park and are looking to secure a Grant through NYC&CO or the Lower Cultural Council. It would help us greatly if the Scottish Government can look to increase our support grant for Bryant Park by $2000. Event Manager $250 per day x 3 plus Travel $1,000 Expenses $250 Musicians - 2 groups per day x 2 days : $1200 x 2 x 2 = $4800 Third day pipe bands : ASF help over $4,800 transportation via CoachUSA (in kind donation of support)

In 2019 the Pipes & Drums on the Fountain Terrace is part of the Migration Festival programming being presented by We have already advised them of our programming and Bryant Park are delighted with the added involvement. We have reached out to Highlands & Islands University and are discussing musicians coming over that we would then feature in Bryant Park programming which would be reflective of the Migration theme around the influence of Scots Irish music on the culture of America.

The ASF presentation of The Pipes and Drums on the Fountain Terrace is one of the few Community (free to the public) events that is held during Scotland Week. ASF are proud to offer this very popular event to the community and believe it is very important to give New Yorkers, and visitors to New York for the Tartan Day Parade weekend, the opportunity to enjoy Scottish culture and become a part of the celebration of Scotland in the USA The programming runs over Tartan Day on April 6th each year and in 2012 ASF realized that it was very important to take a moment to put into context why Tartan Day is celebrated each year. ASF now present an Tartan Day Observance with readings from the Declaration of Arbroath, the Senate Resolutions declaring Tartan Day would be observed each April 6th – and a letter or Proclamation from the Mayor of New York. It is a time for visiting dignitaries to join us on the Fountain Terrace and bring greetings from Scotland and for us to use the performances to highlight what Tartan Day, the New York Tartan Day Parade and Scotland Week is celebrating The setting is very strong too as the backdrop is that of Carnegies New York Public Library. The Concert program is over 3 days and the highlight is the morning performances that take place on the Saturday prior to the Parade. It is now becoming THE meet up place for the crowds to gather prior to the Parade – in 2018 we once again had performances from Dancers (from NY and Canada), and six pipe bands performing The Tartan Day Observance this year will be on FRIDAY APRIL 5th at 12.30 to allow for for VIP Dignitaries to attend the Kirkin of the Tartan as they normally would on the morning prior to the Parade. It also can allow for a “T-ing Up” for the Parade with Press and Media. The Grantee shall also provide any other information that the Scottish Government may reasonably require to satisfy themselves that the Project is consistent with the Agreement. The Grantee shall provide the Scottish Government with prompt access to any information they reasonably require to ensure compliance with these Conditions.

In the event of the Grantee becoming aware of or suspecting any irregular or fraudulent activity that may have any impact on the Project or on the use of the Grant, or any part of it, the Grantee shall immediately notify the Scottish Government of such activity and provide

such other information as the Scottish Government may reasonably require in relation to the impact on the Project and the use of the Grant.

4. Confidentiality and Data Protection

The Grantee will respect the confidentiality of any commercially sensitive information that they have access to as a result of the Project.

Notwithstanding the above, the Grantee may disclose any information as required by law or judicial order. All information submitted to the Scottish Government may need to be disclosed and/or published by the Scottish Government. Without prejudice to the foregoing generality, the Scottish Government may disclose information in compliance with the Freedom of Information (Scotland) Act 2002, any other law, or, as a consequence of judicial order, or order by any court of tribunal with the authority to order disclosure. Further, the Scottish Ministers may also disclose all information submitted to them to the Scottish or United Kingdom Parliament or any other department, office or agency of Her Majesty’s Government in Scotland, in right of the Scottish Administration or the United Kingdom, and their servants or agents. When disclosing such information to either the Scottish Parliament or the United Kingdom Parliament it is recognized and agreed by both parties that the Scottish Government shall if it sees fit disclose such information but are unable to impose any restriction upon the information that it provides to Members of the Scottish Parliament, or Members of the United Kingdom Parliament; such disclosure shall not be treated as a breach of this agreement.

The Grantee shall ensure that all requirements of the Data Protection Act 1998 are fulfilled in relation to the Project.

5. Safeguarding Policies

The Grantee must have robust safeguarding policies in place to protect vulnerable groups. The Grantee must also have in place clear processes which must be followed if it becomes aware of specific incidents, including referral to the relevant authorities where necessary. Where the Grantee is working directly through a partner organization, the Grantee is required to have undertaken due diligence in relation to safeguarding arrangements, including obtaining evidence of satisfactory safeguarding policies and / or procedures by the Grantee's partner organization. The Grantee must report all and any cases of suspected abuse or malpractice relating to anyone involved in delivery of the Project or any beneficiary of the Project to the Scottish Government and the relevant authorities immediately. The Grantee must, upon request from the Scottish Government, provide copies of the safeguarding policies and procedures referred to in this clause. In the event of the Grantee becoming aware of or suspecting: o any irregular or fraudulent activity in relation to the Grant or Project, or any part of either of them; and/or o any safeguarding incident by or in respect of any person involved in the Project, The Grantee shall immediately notify the Scottish Government of such activity or incident and provide such other information as the Scottish Government may reasonably require in relation to the impact on the Project and the use of the Grant. In so notifying Scottish Ministers, the Grantee must also confirm that such irregular or fraudulent activity or safeguarding incident has been referred to the relevant regulatory or other authorities as appropriate, in line with any statutory duty and otherwise in line with any guidance issued from time to time on Notifiable Events by either the Office of the Scottish Charity Regulatory (OSCR) or as appropriate the Charity Commission for England and Wales. For the

avoidance of doubt, in this agreement, a "safeguarding incident" includes any incident of abuse or mistreatment of any vulnerable person. 6. Publicity

The Grantee shall provide a communications planner to the Scottish Government which includes all publicly released announcements about the sponsored event,

The Grantee shall, where reasonably practicable, acknowledge the contribution of the Scottish Government in all publicity material relating to the Project. The Scottish Government will work with the Grantee to assess appropriate publicity based on the sponsorship amount, and may require to approve the form of such acknowledgement prior to its first publication.

7. Default and Recovery etc. of Grant

The Scottish Government may reassess, vary, make a deduction from, withhold, or require immediate repayment of the Grant or any part of it in the event that: a. The Grantee commits Default; b. The Scottish Government considers that any change or departure from the purposes for which the Grant was awarded warrants an alteration in the amount of the Grant; c. The Grantee fails to carry out the Project d. In the Scottish Government’s opinion, the progress on the Project is not satisfactory; or e. In the Scottish Government’s opinion, the future of the Project is in jeopardy.

8. Termination

The Agreement may be terminated by the Scottish Government giving not less than 3 months’ notice in writing from the date of the notice being sent.

9. Governance

The Grantee shall ensure that adequate internal control and risk management systems are in place and that all resources are used economically, effectively, and efficiently.

This will be a preview and in conversation evening prior to the production opening in May with the Goodspeed. The evening will have an audience predominantly drawn from the Scottish American community and friends of Goodspeed. How will this project promote Scotland, Scottish Culture or foster stronger relationships between Scotland and the US? Migrations – we’ll come out to you with a further update ASAP we’re keen to reserve some VIP styled space for you and other key individuals.

Taste of Scotland – due to auditing by our budget team in Scotland ( as the wasn’t passing Parliament….) we have had to split our remaining grant budget – we can support the event but not fully. Apologies we can’t provide the level of funding you are looking for but we can support to the amount of $2500. [redacted] can arrange for the necessary monies to be paid.

3rd of April Scots who built NYC event – one of either me or [redacted] will attend and speak.

Bus – on the wrapping of a bus – Visit Scotland mentioned you could potentially get it done at a fraction of the cost they had been quoted – is that still an option and if so do you know roughly how much it costs?
