Toronto Port Authority’s Proposed Land Use Plan (Humber York, Ward 14 and Toronto , Wards 19, 20, 28, 30 and 32)

(City Council on November 6, 7 and 8, 2001, amended this Clause:

(1) in accordance with the joint confidential report dated November 6, 2001, from the City Solicitor and the Commissioner of Urban Development Services, thereby deferring consideration of Recommendation No. (2) of the Planning and Transportation Committee concerning future levels of activity at the Toronto Island Airport, subject to adding to Recommendation No. (2), as embodied in the joint confidential report, the words “until the Chief Administrative Officer has reported back on the negotiations with the Toronto Port Authority”, so that such recommendations shall now read as follows, the balance of such joint report to remain confidential, in accordance with the provisions of the Municipal Act, having regard that it contains information related to the security of property interests of the municipality:

“It is recommended that:

(1) this report be received for information; and

(2) City Council defer consideration of Recommendation No. (2) of the Planning and Transportation Committee concerning future levels of activity at the Toronto Island Airport, until the Chief Administrative Officer has reported back on the negotiations with the Toronto Port Authority.”; and

(2) by adding thereto the following:

“It is further recommended that:

(a) the Toronto Port Authority be requested to publicize its public consultation meeting in regard to its Land Use Plan, and to hold such meeting in the evening in a central mainland location;

(b) the Chief Administrative Officer be directed to request the Minister of Transport to review and report on a security flight protocol without further delay; and Toronto City Council2 Planning and Transportation Committee November 6, 7 and 8, 2001 Report No. 12, Clause No. 2

(c) the Commissioner of Urban Development Services be requested to ensure that Members of Council are provided with copies of the Airport Study when the report on the Land Use Plan is submitted.”)

(City Council, at the in-camera portion of its meeting, also issued confidential instructions to staff, such instructions to remain confidential, in accordance with the provisions of the Municipal Act, having regard that they relate to the security of property interests of the municipality.)

The Planning and Transportation Committee recommends that:

(1) the report (October 9, 2001) from the Commissioner of Urban Development Services be adopted;

(2) City Council take the position that it does not support any future level of activity at the Toronto Island Airport over and above the current general level of aviation activity and that the Toronto Port Authority be advised of Council’s action in this regard;

(3) the Toronto Port Authority be advised that it is crucial that its Land Use Plan not contradict the City of Toronto’s plans for the development of the Waterfront;

(4) the Hon. David Michael Collenette, Minister of Transport be advised of City Council’s action in this regard and be requested to use his influence to ensure that:

(a) the Toronto Port Authority not be permitted to use paramountcy until the City has finalized its plans for the development of the Waterfront; and

(b) the Toronto Port Authority honours the Tripartite Agreement; and

(5) that the PowerPoint presentation given to the Planning and Transportation Committee by Community AIR be made available to City Council for its meeting on November 6, 2001.

The Planning and Transportation Committee reports having requested:

(1) that the Hon. David Michael Collenette, Minister of Transport be immediately advised of the Committee’s action in this regard;

(2) the Chair of the Planning and Transportation Committee and the Commissioner of Urban Development Services, or her designate, to meet with Murray Chusid, the City of Toronto’s representative on the Toronto Port Authority, to clearly outline the City’s position in this regard and invite him to attend both the November 6, 2001 meeting of City Council and future meetings of the Planning and Transportation Committee when the matter of the Toronto Island Airport and the Toronto Port Authority is discussed; Toronto City Council3 Planning and Transportation Committee November 6, 7 and 8, 2001 Report No. 12, Clause No. 2

(3) the City Solicitor to report to City Council for its meeting on November 6, 2001 on:

(a) the Tripartite Agreement and advise whether this Agreement is still in effect; and

(b) the issues relating to making payments under the Subsidy Agreement prior to approval of the Toronto Port Authority’s Budget by City Council; and

(4) the Commissioner of Urban Development Services to report further on the safety concerns raised by Community AIR, including concerns regarding aircraft flying over large sports venues and large residential neighbourhoods.

The Planning and Transportation Committee submits the following report (October 9, 2001) from the Commissioner of Urban Development Services:

Purpose:

To provide additional information on issues relating to the Toronto Port Authority’s (TPA) proposed land use plan and its fit with the proposed Central Waterfront Part II Plan.

Financial Implications and Impact Statement:

Not Applicable.

Recommendations:

It is recommended that the recommendation in my September 28, 2001 report be replaced with the following: “It is recommended that the Board of Directors of the Toronto Port Authority be requested to defer a final decision on its proposed land use plan until:

(a) the background reports commissioned by the TPA on the future size, role and function of Toronto’s Port and City Centre Airport have been made available for public discussion; and

(b) City Council has had an opportunity to comment on these reports.”

Comments: Central Waterfront Plan On October 9, 2001, Urban Development Services released a new Central Waterfront Part II Plan for public consultation. This plan is based on four key principles which will provide a framework for waterfront renewal. Namely:

To remove barriers and reconnect the city with Lake ; To build a network of spectacular waterfront parks and public spaces; To promote a clean and green environment; and To create dynamic and diverse new communities. The plan also sets out 23 “big moves” which are specific actions that will help the City achieve its bold new vision for the waterfront.

The Central Waterfront Part II Plan recommends the retention of Port functions, generally within the existing land base of the Toronto Port Authority. Any significant expansion of Port operations must be measured against the planning principles embodied in the proposed Central Waterfront Part II Plan.

Potential areas of concern are highlighted in my September 28, 2001 report on the Toronto Port Authority’s proposed land use plan. For example, the TPA plan contemplates expanded Port functions on the Base Lands at the foot of Leslie Street whereas the Central Waterfront Part II Plan identifies these lands as an integral part of a large open space network.

The TPA plan also contemplates expanded airport operations. Although the proposed Central Waterfront Part II Plan does not specifically address the Toronto City Centre Airport, expanded airport operations could seriously affect the quality of life of current and future waterfront residents.

The TPA land use plan implies growth of both the Port and the airport, but does not make specific recommendations about the ultimate size, role and function of these facilities. There are potential conflicts between the City’s waterfront vision and these activities. City Council and the TPA will need to discuss these matters further.

Public Meeting on TPA Land Use Plan

On October 10, 2001, the Toronto Port Authority held a public meeting at the Toronto City Centre Airport to discuss its proposed land use plan. The meeting was attended by a number of Councillors and City staff along with representatives of a number of waterfront community groups.

Public comments were aimed primarily at the airport and were generally not supportive of the plan. Concerns raised included: the financial viability of the airport; air pollution; conflicts with adjacent residential areas; and potential conflicts with recreational boaters.

The public also commented that there needed to be more public consultation about the plan and they were concerned about the relationship between the City and the TPA. Community Air, a group representing Island residents and others concerned about the airport noted that other cities – Chicago and San Diego – had closed their downtown airports due to conflict with urban development.

TPA staff and consultants responded to community concerns by stating that the plan, in fact, only pertained to land owned by the Port Authority and that it was a “status quo” document. They also noted that detailed studies were being done on the airport, Port and financial issues which would answer some questions in more detail. Conclusion:

Given the public response and the fact that further detailed studies on the future of the Port and the City Centre Airport are pending, it would be premature for TPA’s Board of Directors to approve the proposed land use plan now. Instead, the studies commissioned by the TPA should be made available to the public and discussed with City Council and other interested parties.

The Planning and Transportation Committee also submits the following report (September 28, 2001) from the Commissioner of Urban Development Services:

Purpose:

To inform Council of the Toronto Port Authority’s proposed land use plan.

Financial Implications and Impact Statement:

Not Applicable.

Recommendation:

It is recommended that the Board of Directors of the Toronto Port Authority not make a final decision on its land use plan until Council has had the opportunity to discuss the recommendations of the Planning and Transportation Committee at its meeting of November 6, 7 and 8, 2001.

Background:

Section 48(1) of the Marine Act requires the Toronto Port Authority (TPA) to develop a detailed land use plan. It is to contain objectives and policies for the physical development of the real property the TPA manages, holds or occupies and to take into account relevant social, economic and environmental matters and zoning by-laws that apply to neighbouring lands. The authority of the Toronto Port Authority to regulate land use and development is limited by the geographic boundaries of its lands and to purposes related to navigation, transportation of goods and passengers, handling and storage of goods and operation of the Toronto City Centre Airport, in accordance with the Tripartite Agreement, all as set out in Article 7 of the Letters Patent. The lands subject to the proposed TPA land use plan are shown on Map 1 and include:

Toronto City Centre Airport (TCCA) (MT 51 and MT 52) Some dockwall TPA Works Yard along Keating Channel (leased from TEDCO) Outer Harbour Marina TPA headquarters TCCA parking lot at foot of Bathurst Street Harbour Square Park and Ferry Docks Mooring Basin west of Stadium Road Inner Harbour, Outer Harbour and Eastern Beaches (land covered by water) Base Lands (subject to Management Agreement between City and TPA) – south half (to be transferred to TRCA once fill is complete) Ashbridges Bay Sewage Treatment Plan (subject to indenture permitting City sewage treatment)

At its meeting of August 16, 2001 the Toronto Port Authority approved the proposed land use plan for public consultation purposes. A public meeting has been announced for 4:00 p.m. on October 10, 2001 at the Toronto City Centre Airport. Interested parties and members of the general public are invited to submit comments by November 8, 2001, when the TPA is scheduled to adopt the plan incorporating whatever changes it may deem appropriate. It is, therefore, important that City Council finalize its comments on the proposed land use plan at its meeting on November 6, 7 and 8, 2001.

This report provides a summary of some of the issues of interest to the City with respect to the proposed land use plan. Since the next meeting of the Waterfront Reference Group is not scheduled until November 29, 2001, this report is being sent directly to the Planning and Transportation Committee.

Comments:

The Canada Marine Act is clear about the need for any future port plans to take into account relevant social, economic and environmental matters and zoning by-laws that apply to neighbouring lands. While there are statements within the proposed TPA land use plan which appear compatible with and supportive of the emerging City vision for the Central Waterfront, there are other references relating to port and airport expansion that could potentially conflict with the broader City vision.

In order for City Council to properly assess the proposed TPA land use plan, elaboration is needed from the Toronto Port Authority on their plans for the future.

Issues: Container Port:

The proposed land use plan states that the TPA will act to ensure the long term availability of sufficient dockwall and “back-up land” area to meet the foreseeable port needs. The implications of this statement are unclear at this point. The statement raises the possibility that Toronto City Council7 Planning and Transportation Committee November 6, 7 and 8, 2001 Report No. 12, Clause No. 2 there may be land requirements beyond those outlined in the Letters Patent which set out the lands to be managed by the TPA. It is important that the TPA describe to the City its specific needs for an expanded port.

The Base Lands:

The proposed land use plan states that the TPA will continue to review potential future uses of the Base Lands in light of the need to be competitive, efficient and commercially oriented. The notion of expanding commercial port operations on the Base Lands conflicts with the City’s assumption that the Base Lands have been and will remain as open space. The Base Lands, although owned by the TPA, are subject to a Management Agreement with the City which limits the TPA authority over the use of these lands.

Rail Service in Port Lands:

The TPA wants to explore the idea of operating a short-haul rail line in the Port Lands. The network of rail lines in the Port Lands is managed by the Toronto Terminal Railways, TEDCO and the TPA under a specific Agreement. Therefore, any planning of future rail operations needs to be worked out co-operatively among the interested parties. Maintaining all existing lines throughout the Port Lands may not be necessary to adequately service the area by rail and could limit redevelopment opportunities.

Atlas Crane:

The proposed land use plan states that the TPA will advise developers near the Atlas Crane that rail access is and will continue to be a requirement for this use. The Atlas Crane is located on lands owned by TEDCO on Cousins Quay and, if it continues to operate in this location, could limit redevelopment opportunities. There is a question, however, regarding the usefulness of this type of crane to future port operations.

Toronto City Centre Airport (TCCA):

The proposed land use plan promotes airline services that enhance the local, regional or national economy consistent with the Tripartite Agreement. Recent figures show that commercial passenger use of the TCCA has declined steadily since the 1980’s, despite a global increase in air travel. Again the TPA needs to provide further details on how it plans to increase business at the airport. As with the operation of the container port, future operations of the airport need to be assessed in the context of other City policies.

Fees/Charges:

The proposed land use plan contemplates the use of licence fees for utilities and other rights-of-way over or under TPA lands. The plan also contemplates a permitting system for boating in the Inner and Outer Harbour. These fees could represent a significant cost to the City and utility companies and need to be discussed in more detail with affected parties. Public Process/Consultation with City of Toronto:

During the preparation of this proposed land use plan, there were limited opportunities for City staff to discuss the proposals with the TPA. As the plan evolves and is revised, the TPA should consult more fully with the City to facilitate an exchange of information and to ensure compatibility of TPA’s plans with those of the City.

Conclusion:

The proposed TPA land use plan can provide useful input to the City and Waterfront Revitalization Corporation as plans for the waterfront evolve. However, in order for City Council to fully understand the TPA proposals, further details need to be made available as outlined in this report. These details could be provided in a presentation by the TPA to your Committee.

In response to a request from the Planning and Transportation Committee at its meeting on October 15, 2001, this report comments on concerns raised by Community AIR regarding aircraft safety. Financial Implications and Impact Statement:

There are no financial implications resulting from the adoption of this report.

Recommendation:

It is recommended that this report be received for information.

Background:

At its meeting on October 15, 2001, as part of its recommendations on the Toronto Port Authority Land Use Plan and the Toronto City Centre Airport (TCCA), the Planning and Transportation Committee requested:

“that the Commissioner of Urban Development Services report further on the safety concerns raised by Community AIR, including concerns regarding aircraft flying over large sports venues and large residential neighbourhoods.”

Comments:

In its brief to the Planning and Transportation Committee on October 15, 2001, Community AIR expressed a number of concerns related to air safety that are largely summarized in the following statement:

“…the Island Airport, should not be offering flight training operations and other general indeterminate aviation operations, in the very centre of Canada’s largest City, immediately adjacent to: a high density residential neighbourhood; the tallest free standing structure in the world; Canada’s principal financial centre; and one of the country’s major stadiums.”

Aviation safety is a matter that falls principally under federal jurisdiction. The design, operation, security, safety and inspection of airport facilities are governed by The Aeronautics Act. Section 4.2 of the Act states that:

“The Minister is responsible for the development and regulation of aeronautics and the supervision of all matters connected with aeronautics…”.

Transport Canada has approved Airport Zoning Regulations that define and protect the flight paths for take off and landings from the principal east-west runway at the TCCA. These take off and landings occur over the Lake and Port area. There is also a less frequently used north-south runway the flight corridor for which extends over the Garrison Common area and which is not protected by Federal Airport Zoning Regulations. In addition, there is a Keep-out Zone for all water traffic on the ends of the east-west runways which is marked by buoys.

An assessment of the adequacy of the regulations controlling the flight paths and other activities of aircraft using the TCCA is a Federal responsibility and requires the knowledge of experts in the aviation field. As part of any development application in the vicinity of the TCCA, concerns such as noise, traffic and pollution are considered to determine compatibility with airport operations. The Central Waterfront Plan contemplates more intense development. Detailed recommendations will result from further work on development strategies for the Waterfront precincts. Any specific proposals will have to take into consideration the noise and height restrictions resulting from airport operations.

Conclusions:

This report points out that the responsibility for aviation safety rests primarily with the Federal Minister of Transport. The long-term compatibility of continued and/or expanded airport operations in the city’s developing waterfront area depends on a number of factors including aircraft safety. This is best assessed by the Federal Minister of Transport in keeping with his responsibilities as defined in the Aeronautics Act.
