> DEFINITIONS & REMARKS

> Music DVD-video A Music DVD-video is defined as a DVD containing concertregistrations, cabaret performances and/or compilations of clips and/or single-artist-(music)films and/or musical drama productions (i.e. musicals, opera's etc.).

> Music DVD-video Box A Music DVD-video Box is defined as a set containing several Music DVD-video carriers sold as one product.

> Supplementary Music DVD-video A supplementary Music DVD-video is defined as a Music DVD-video containing a maximum of 4 music tracks or 12 fragments which is sold in a box containing at least one other Music DVD-video.

Examples of supplementary Music DVD-videos are so-called Making-of's and Backstage reports. If these contain more than 4 music tracks or 12 fragments the Music DVD-video Box-tariff is applicable (see Music DVD-video Box).

> Hybrid A Hybrid is defined as a combination of Music DVD-video and CD, or Homevideo DVD and Music DVD-video, or Homevideo DVD and CD, which is sold as one product.

> Retentions Under the conditions stated in art. V paragraphs (16) till (18) of the Standaard Agreement, 25% of the sales, for each 6 month accounting period, can be accounted for in due time.

> Bargain sales (Sell out) Licence Bargain sales/Sell out: 10% of the invoiced price ex. VAT. For Bargain sales a minimum licence of 20% of the normal minimumlicence is applicable. The Bargain sales category is applicable on soundcarriers which have been released at least more than one year ago in a higher price category and are deleted from the catalogue after sell out.

> Budget Budget is applicable on sound carriers containing recordings orriginally released more than one year ago and which are re-released at least 35% below the original PPD.

> TV-items (only applicable to Hybrids) An extra deduction of 8% discount off the PPD (including TV ticket, if any) is applicable to TV-items. A minimum of € 10.000,- net invoiced campaign costs is required. Discount is only applicable from the first day of the month in which the campaign starts, until 90 days after this start, with a maximum of two accounting periods.

> PPD-split with bonus (free) products The PPD splits as mentioned above are also applicable when a carrier (CD or DVD) is given for free with the purchase of an other carrier, which is sold as one product. The license for the individual carriers is accounted according to the regular minimum licenses of the regarding carriers.

> DualDisc A Dual Disc is defined as a carrier with on one site a Music DVD-video and on the other side a CD-audio.

For the calculation of the license amount (incl. Minimum license, Maximum number of works/fragments and - if applicable - Promotional allowances, Retentions, Discounts on TV/Radio advertised releases and PPD-split), Dual Discs are considered as 2 carriers in a set/box.

DualDisc consisting of Music DVD-video and CD side > see Hybrid

If mainly (over 50%) audio content (no visuals) is recorded on the DVD-side of a DualDisc, the accounting conditions Stemra/BIEM 2018 for a 2CD Extra are applicable, especially the basic remuneration percentage of 8,712% en the work/fragment limits.

> Music Blu-Ray Video The same conditions as Music-DVD Video apply

> Digital product- and sales information Productinformation and sales must be reported in a digital format.
