02/06/16 Minutes of the last meeting Ref 5/16 for signing - The minutes were agreed by all and signed by the Vice Chairman

Election of Chair and Vice Chair for Lapford Parish Council upon the resignation of Niall McAreavey as a member of the Parish Council. The position of Chairman was vacant upon the resignation by Niall McAreavey. Cllr Hemsworth had indicated to the Clerk that he was willing to take over the position of Chair. It was agreed by all present to accept Cllr Hemsworth as Chairman for Lapford Parish Council. Proposed – Cllr Doe Seconded – Cllr Burrows

The Position of Vice Chair was now vacant and Cllr Briant – Evans was nominated by Cllr Doe to the position. It was agreed by all present to accept Cllr Briant-Evans as Vice Chair for Lapford Parish Council. Proposed – Cllr Burrows Seconded - Cllr Doe

03/06/16 Casual Vacancy A Casual Vacancy had arisen due to an elected member resigning from the Parish Council The Clerk will place the notice of a casual vacancy to the Parish Notice board and on the Website.

04/06/16 Open Forum

MOP - Allotment Association Chairman. There had been no significant assistance from Paul Tucker Three months since application has been made. The Clerk reports that Paul Tucker has met with the Allotment Association around 5 weeks ago. There had not been any contact from Paul Tucker since. The Chair of the Allotment Association expressed his frustrations and felt that if no funding was sought, the allotments could be lost as Kelland House is for sale. The Clerk and District Councillor would be asked to speak with MDDC about progressing this.

MOP – Superfast Broadband is not going to reach all areas of the village, houses on the A377 and Popes Lane will not benefit. A request has been made to the Parish Council to fund a door to door survey on the Broadband Issue seeking resident’s opinion on the matter. Will the Parish Council consider such a survey? This will be added to the agenda for the July meeting.

MOP – Matters relating to access to Popes Lane within the March and April Minutes were not reported accurately. The MOP’s comments were noted for future reference and it is noted that any obligations or actions recorded within past minutes have been positively undertaken.

05/06/16 Matters arising TAP funding was available for road signage improvements. Cllrs Briant-Evans and Burrows have re- surveyed the signs in the parish & noted exactly what is needed in the way of replacement/repair. The clerk will now seek quotes for the production of the signage from Kelland Signs.

06/06/16 Highways Cllr Burrows is still waiting for a reply from Steve Tucker following a meeting in March 2016. Cllr Squires was asked to assist and a request to consider work will be made by Cllr Burrows and the Clerk.

07/06/16 Emergency Plan Committee Further funding for small items was required. There is a shortfall of approximately £50-60 pounds to purchase new equipment. Cllr Squires agreed to fund this from her Locality Budget. Cllr Briant-Evans is still in the process or revising the Emergency Plan. She asked that the clerk supply her with Parish Council headed paper in order that letters can be sent to households identified as at risk of flooding.

It was also noted that direct access to a telephone line in the Orchard Centre was sought by the Committee. It was thought that the Post Office line could be utilized. There may be some concerns with security when sharing with other users. Cllr Squires was asked to ascertain if DCC can directly fund such services.

Up to date information on qualified first aiders within the village was sought by the committee.

Alex Gator was now the Acting Flood Warden for the Parish. He has been trying to access some Flood Warden training, but is finding this difficult.

08/06/16 Regeneration Committee There would be a meeting on Thursday 2nd June to consider the new Terms of Reference.

09/06/16 Youth Club a. Ratification of decision taken at May meeting ref 06/05/16 meeting to seek legal advice on YC deeds and statues with Parish council + update on location of Deeds. The Clerk reported on the issue and the Members were given the opportunity to discuss the matter relating to legal advice being sought on the Trust status of the YC and the relationship with the Parish Council. The Clerk stated that this advice could be sought free from the DALC, now Devon Communities Together. All in favour to progress this with DALC. All in favour Proposed – Cllr Hemsworth Seconded – Cllr Doe The Clerk was also provided with a copy of all deeds & papers relating to Lapford Youth Club in an electronic format for storage and use.

b. Procedural Matters re Regeneration Committee and Youth Club I was noted that the Youth Club is now a separate entity to the Regeneration Committee.

c. To Update on Expenditure incurred and request for grant from PC re Invoice – Steve Eastland – £7246.58. The Youth Club have contacted Steve Eastland and he does not require the full invoice o be settled now and will require a token payment of £1000. Funds will be provided by the Youth Club to the Parish Council who can then reclaim VAT on the invoice.

10/06/16 s.106 agreement between MDDC and Lapford Parish Council re Old Youth Club site for Air Quality and Outdoor Spaces.

Within the process of considering the current planning application, MDDC would require a payment from the applicant / developer to fund improvements to Open Space and Air Quality in . The scale of the application would generate the need to enter into a s.106 agreement between Lapford Parish Council for the payment of £11560. Discussions had taken place at Youth Club committee meetings to seek deferment of the agreement to the purchaser of the site. This information was passed to the Agent Steve Eastland Designs and MDDC agreed to such deferment.

The Parish Council were asked to approve the following. a. Does Lapford Parish Council Agree to enter into a 106 agreement with MDDC for £11,560? b. Does Lapford Parish Council agree to defer the 106 payment to the developer / purchaser of the Old Youth Club?

After discussion and agreed by all present through a show of hands, the above motions were agreed. Proposed – Cllr Wensley Seconded – Cllr Heal

11/06/16 Queen’s Birthday Celebrations. These will happen on the 11th June 2016. The Yeo Valley Christian Fellowship will provide the required insurance cover for the family games.

12/06/16 LYPFT Update Funding Activities continue for phase two. Further discussions on the Junior Play Area with MDDC in respect of leasing the ground are expected soon.

13/06/16 Finance Account Balances a. Current account - £10,859.21 b. Savings account - £4,915.71 c. Loan stock - £983.98

14/06/16 Annual Return and governance statement reviewed, The Clerk had prepared the Annual Return. The document and figures had been audited internally by Andy Epstein. The annual return was viewed by the members and the Chairman completed the Annual Governance Statement. The Annual Return was approved by all members present. 15/06/16 Planning

After discussion it was agreed to Support the application.

It was noted that a previous site meeting had been held and an objection from the Parish Council was made. Cllr Briant-Evans asks about the varying size of the gardens on the application. Clarification will be sought by Cllr Hemsworth.

16/06/16 District and County Councillor’s report.

Cllr Squires TAP funding scheme has changed. Details were provided for a two stage funding process. This is outlined within Z Lentells email below.

Government funding for potholes has increased for this financial year.

Cllr Eginton

Yeo Vale enforcement issues. Nick Sanderson has progressed this matter and compulsory purchase for development is foreseen. Contact with the owner has not progressed the matter.

MDD Play Areas. MDDC have agreed to lease the Junior Play area to the Parish Council on a 25 yr. lease. There are issues with the PCC requiring an extension to the Church Grave Yard. With this in mind, MDDC would require information from the PCC showing their requirements.

Orchard Centre Car Park. Discussion with the Parish Council over a lease has been put on hold by MDDC. MDDC would seek to monitor the development at Lower Town Place prior to committing to a lease of the land.

MOP – in respect to the Church Yard. Member of the PCC states that there is space in the ground and it is now not closing at the start of 2017. Discussions on this aspect of the land will take place at the July meeting.

South West Devolution – according to the BBC the 4 district councils which form Greater (which includes ) are looking at a separate devolution bid. This is untrue.

17/06/16 19. Correspondence a. Z.Lentell MDDC. Email 24/05/16. New TAP fund deadlines. b. P. Tucker MDDC Email 24/05/16. Allotment purchase.

18/06/16 Members Statements Cllr Heal - Work undertaken at Yeo Vale Cottage may encroach onto the Highway. He has informed the relevant department about the issue. Road towards Nymet Rowalnd, nr Ambrosia Close and Old Ambrosie units. Hedge is very overgrown. Cllr squires has been informed and will speak with Steve Tucker on the point.

Cllr Burrows – Lid to dog bin broken at Congregational church, a repair will be investigated. Seating at Eastington - this still needs to be progressed and broken wood needs to be replaced. Repair needs to be undertaken. It was also noted that the grass needs to be cut. Footpath at back of Westgate. Cllr Burrows is progressing this soon and it will be cut by the contractor.

River siding and fence request to Highways - Fence and broken bridge issues continue to be monitored. The MP is involved and Highways are urged to progress the matter.

LL – No Payments in the Lookout Summary. This cannot be undertaken due to space requirements.

Phone Box and Post box at Higher Forches. Can these be painted? Permission to repair will be sought by the clerk.

Cllr Briant-Evans- The Creedy LAG group will now meet in Crediton twice yearly. The last LAG meeting dealt with issues relating to Speed monitoring TAP funding The minutes of the meeting had been supplied to Councillors.

An MOP had rung Cllr Briant-Evans regarding his garden hedge bordering the A377 opposite the garage. The hedge had been flail cut on the road side without his permission, & was now in a ragged, untidy state. It was identified that Highways had undertaken this work. Cllr Briant-Evans will contact the MOP with this information.

Cllr Doe - Fire Prevention for elderly. GD would like to visit frail elderly to arrange a Fire Safety inspection. Any information on this scheme can be obtained from Cllr Doe.

Cllr Hemsworth – A report on the Bury Barton Site visit was given. The visit & subsequent discussion had been minuted.

There were no further topics for discussion and the meeting concluded at 21.40
