Por libelo presentado el día 16 de octubre de 1951, los ciu dadanos doctor CARLOS H. ARANGUREN, JORGE MORRISON, MANUEL LOPEZ BORGES, TEMISTOCLES FERNANDEZ, ALFON SO SUAREZ, ROBERTO BEER, LEONARDO DE ZORDO y ROBER TO MATUTE, todos mayores de edad, casados y domiciliados en la ciudad de Caracas, a excepción del último de los nombrados, domiciliado en la ciudad de Barquisimeto, por intermedio de apo derado, demandaron a la Sociedad Anónima "AEROVIAS VENE ZOLANAS", constituida y domiciliada en Caracas, inscrita en el Registro llevado por el Juzgado de Primera Instancia en lo Mer cantil del Distrito Federal el día 1° de julio de 1943, bajo el núme ro 2566, Tomo A-5 y cuya acta constitutiva fue publicada en la Gaceta Municipal del Gobierno del Distrito Federal número 6.105, de fecha 17 de agosto del mismo año. La demanda se fundamenta en los siguientes hechos: Que el día 15 de diciembre del año próximo pasado y como de doce y media a una pasado meridiano, el avión marca "Douglas" C-47, distinguido con las iniciales Y. V. A. V. U., propiedad de la Com pañía de Transporte Aéreo denominada "AEROVIAS VENEZO LANAS" (AVENSA) S. A., despegó del aeropuerto de la ciudad de Mérida, Estado Mérida, con destino al Aeropuerto de Maique- tía, conduciendo como pasajeros a veintiocho estudiantes, quienes habían comprado previamente sus pasajes y regresaban a esta Capital a pasar pascuas de navidad al lado de sus familiares y entre quienes se encontraban los menores: Juan Ignacio Aran- 2,22 ACCIDENTE AEREO guren, Fredy Morrison, José Ignacio y Francisco Javier López Pacheco, José Vicente Fernández, Aristides y Alfonso José Suárez, Harald Beer, Giorgio de Zordo y Roberto Matute, hijos legítimos de mis representados, respectivamente. -

Washington, DC 20591 December 11, 2000 Re: Newark International Airport—Airline Competition Plan Dear Ms. Woodward: The Port Authority of New York and New Jersey (The Port Authority) is pleased to provide1 the Airline Competition Plan for Newark International Airport (EWR) as is required to be submitted by The Wendell H. Ford Investment and Reform Act for the 21st Century (AIR-21), Pub L. 106-181. The Port Authority is keenly interested in ensuring that residents and businesses in the region are provided with an airport system that provides the highest levels of customer service, generates substantial economic benefits, and provides a large and level platform for airlines to compete for passengers. We view competition as essential to our thriving airport system and are dedicated to allowing existing carriers the opportunity to expand operations and new airlines the opportunity to serve this great metropolitan area. No other airport operator has done more to optimize the operation and efficiency of its facilities to support airline competition. Although the Port Authority is only required by law to submit a competition plan for Newark Airport, that plan must be considered in the context of the overall system of four airports and a commercial heliport owned or operated by the Port Authority within the Port District, an area roughly 25 miles in diameter centering on the Statue of Liberty. -

INTRODUCTION T RADITIONALLY, the airline industry has been highly individualistic. Today's air carriers, almost without exception, are the product of these individualistic pioneering efforts. Yet, during the current decade, there has been a notable trend "to band together" rather than the tradi- tional "go it alone" approach. A manifestation of this trend to join up was the merger movement of the early 1960's. This characteristic was due in large part to the poor financial condition of many of the airlines. As the jet transition took place and the financial health of the airlines improved, the merger wave subsided for a time, and the airlines seemed to return to their usual, independent way of doing business. -

Reseña histórica Para el 29 de septiembre de 1912, cuando se dio el célebre vuelo de Frank Boland sobre Caracas, estábamos en el umbral de la I Guerra Mundial. Es con este conflicto que la aviación pasa a convertirse en un arma poderosa. A comienzos del año 1920, el empresario caraqueño Eloy Pérez suscribe un contrato con el teniente italiano Cosme Renella, para ofrecer en la capital y otras ciudades del país espectáculos que prácticamente eran maniobras ejecutadas por el referido piloto. Recobra gran importancia la necesidad de contar con una aviación militar. El Presidente de la República, General Juan Vicente Gómez, decreta la creación de la Escuela de Aviación Militar de Venezuela el 17 de abril de 1920. El 14 de junio del mismo año, la fábrica francesa de aeronaves entregó al Agregado Comercial de Venezuela en París, Emilio Posse Rivas, los primeros aviones –Caudron G3- para la naciente Escuela de Aviación. Posteriormente, el 19 de diciembre, el General Gómez inauguró solemnemente la Escuela de Aviación Militar. Para 1929, las aviaciones comerciales europea y estadounidense estaban interesadas en incursionar en Venezuela para incluirla en sus rutas internacionales. El 26 de septiembre de este año, regresa Lindbergh en un vuelo experimental de la Pan American. Luego de un corto análisis, solicitan permiso para iniciar sus vuelos; estos comenzaron el 6 de mayo de 1930 desde Maiquetía, donde arrendaron a la Familia Luy una franja de terreno para construir un campo de aterrizaje y una pequeña oficina para atender a los arriesgados pasajeros, hoy Aeropuerto Internacional de Maiquetía. También a fines de 1929, la Compagnie Generales Aeropostale Frances-CGAF-, que estaba ya operando en Brasil, manda por barco un avión Potez de ocho puestos, el cual es armado en Maracay para estudiar las posibilidades de establecerse en Venezuela con sede en la capital aragueña.
