The Miami-Dade County Aviation Department (MDAD) has developed this Community Rela- tions Plan (CRP) for environmental response activities involving hazardous substance discharges at Miami International Airport (MIA). MDAD is conducting activities at this site under the requirements of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), 42 USC §§ 9601 et seq., and the National Oil and Hazardous Substances Pollution Contingency Plan (NCP), 40 CFR Part 300. The NCP was developed by the United States Envi- ronmental Protection Agency (EPA) pursuant to CERCLA requirements.

This CRP is designed to foster community involvement and facilitate communication between MDAD and interested community members. It reflects MDAD’s commitment to address the concerns of local residents, community groups, public officials, and other interested parties related to the cleanup of hazardous substances at MIA.

Throughout MIA’s history, military and industrial facilities at the airport have engaged in the cleaning, repair, maintenance and overhaul of airplanes, airplane parts and engines. Such operations made use of a variety of chemicals including, but not limited to, chlorinated solvents, heavy metals, organic chemicals, acids and caustics, and petroleum products. Many of these materials are classified as hazardous substances under CERCLA. The use of these materials resulted in the generation of a variety of industrial wastes including, but not limited to, contaminated fuel and oil, spent solvents, paint stripping waste, etc. Unfortunately, some of these materials were acci- dentally released into the environment or, under accepted practices of the day, were discharged to the ground or to surface waters and ultimately made their way into the soil, groundwater and sediments at and around MIA.

In cooperation with federal, state and local environmental authorities, MDAD has undertaken to clean up the portions of the environment affected by waste discharges at and around MIA. In so doing, MDAD has elected to conduct the cleanup of hazardous substances in accordance with the requirements of the NCP. One of the major requirements of the NCP is to provide an opportunity for community involvement in the cleanup process.

This CRP will be used by MDAD as a guide to facilitate community involvement in the cleanup of MIA. MDAD recognizes that the community around MIA is diverse and may have a variety of concerns. The activities outlined in this CRP are intended to provide a mechanism for identi- fying and addressing those concerns. MDAD intends to keep community members informed about the progress of cleanup of hazardous substance discharges and to provide appropriate opportunity for public participation in the cleanup process.

This CRP consists of five sections:

• NCP Background: this section provides an overview of the NCP and the NCP cleanup process as well as the roles played by MDAD and state and county regulatory agencies. • Site Description and History: this section briefly describes the site and summarizes its history from 1938 through the present. • Goals of the CRP: this section lists the goals involving MDAD, residents, public officials and other interested parties. • Community Relations Activities: this section describes the activities that MDAD will conduct to achieve its community relations goals at MIA. • Appendices: Appendix A provides a map of the airport with the commonly used names of the different areas. Appendix B provides names, addresses and telephone numbers of federal, state and local officials and other interested parties. Appendix C provides addresses of the information repositories. Appendix D provides a current list of potentially responsible parties.

This CRP draws on information from a variety of sources, including MDAD files, public meetings and community input. The Environmental Engineering Division of MDAD has lead respon- sibility for environmental response activities at MIA and will oversee the implementation of activities outlined in this CRP.

National Contingency Plan

The National Contingency Plan (NCP) is a federal regulation that provides standards and procedures for responding to hazardous substance contamination. This regulation was enacted by EPA pursuant to CERCLA. Under CERCLA, if a party intends to seek recovery of the cost of cleaning up hazardous substance contamination from those parties actually responsible for the contamination (often referred to as “potentially responsible parties” [PRPs]), the cleanup must be performed in a manner that is “consistent” with the NCP. Cleanups will be considered to be consistent with the NCP if the actions are performed in “substantial compliance” with the NCP and result in “CERCLA-quality” cleanups.

The NCP process involves several steps, which can be summarized as: assessment of the nature and extent of contamination; consideration of the potential risk that the contamination poses to human health or the environment; investigation of the alternatives available to address the contamination in a manner deemed acceptable by federal, state and local laws and regulations; selection of the most appropriate remedy; and implementation of the remedy. At various points along the way, the NCP requires that the party conducting the cleanup notify the community of, and offer the community an opportunity to comment on, the cleanup activities.

The presence of numerous contamination locations at MIA complicates the process of managing the cleanup and providing information to interested members of the community. To help in this process, MDAD has developed this Community Relations Plan and has designated its Manager of Environmental Engineering, Mr. Pedro Hernandez, as its primary spokesperson. Among other things, Mr. Hernandez and his designees will be responsible for the following:

• Responding to inquiries and providing information regarding releases at the site; • Informing the community of actions taken at the site; • Notifying immediately affected citizens, state and local officials, and, as appropriate, civil defense and emergency management officials of activities and releases at the site; • Conducting interviews with local officials, residents, public interest groups or other interested or affected parties, as appropriate, to determine their concerns, information needs, and how to involve them in the response process at MIA; • Revising, as necessary, the CRP based on the interviews and other relevant information; • Conducting public meetings, as necessary, to provide updates and to receive public input on significant response activities; • Maintaining a repository for documents and information pertinent to the response activities and providing for public access thereto; and • Utilizing the MDAD Environmental web site as a supplemental method for the dissemination of significant information and documents to the public.

Government Oversight

The Florida Department of Environmental Protection (FDEP) and Miami-Dade County entered into a Consent Order in 1998 (Consent Order), under which the County and MDAD agreed to a process and a timetable for addressing contaminated sites at MIA. The process for accomplishing the cleanup is outlined in the Consent Order which can be obtained from the MDAD EED or can be download from the MIA website at: http://www.miami-airport.com/const/corder.pdf

The Consent Order built upon and incorporated a 1993 Consent Agreement entered into between MDAD and the Miami-Dade County Department of Environmental Resources Management (DERM) pursuant to Chapter 24 of the Miami-Dade County Code. DERM, in addition to en- forcing the requirements of Chapter 24, is the local program administrator for FDEP. DERM is charged with overseeing the cleanup at MIA under both state and local guidelines and with monitoring MDAD’s progress in implementing the requirements of the Consent Order.

Site Description

Miami International Airport is located in Miami-Dade County, Florida. It is bounded on the north by Northwest 36th Street, on the south by State Road 836, on the east by LeJeune Road, and on the west by the Venetian Canal. MIA occupies approximately 3,000 acres of developed land with over 2,000,000 square feet of building space.

MIA is one of the busiest airports in North America. It is sixth in total passengers, third in total landings, and first in total international commercial cargo. Approximately 33,000 individuals work at MIA for public and private sector employers. MIA accounts for approximately $3.5 bil- lion of Florida’s annual economy.

MIA sits atop the Biscayne Aquifer (which underlies much of southeast Florida) in a heavily populated area. The airport is surrounded by several major waterways including the Miami Canal to the northeast, the Tamiami Canal and Blue Lagoon to the south, and the Venetian and FEC Borrow Canals to the west. The town of Miami Springs is located to the north of the airport and the Lower Miami Springs Wellfield is located approximately one-half mile to the north of the airport.

The northern and western portions of the airport are home to a number of cargo companies and fixed-base operators that provide services to the airlines, as well as to facilities operated by the major passenger airlines serving Miami. The passenger terminal is located near the eastern end of the airport and is adjoined by the old Pan American Airways Maintenance Base (Pan Am Main Base). There are three runways at the site, two of which run east and west, and one which runs diagonally from the southeast to the northwest. A fuel farm is located in the southeast portion of the site.

For purposes of tracking the cleanup process and costs, MIA is divided into several sections: Northwest Cargo, Pan Am Tract 1, Eastern Main Base (which are all located on the north side of the airport), Pan Am Main Base, Tank Farm, Terminal Area and Midfield Area. A recent map of the airport depicting these areas is attached as Appendix A.

Site History

Over the past 60 years, the Unite States military, as well as scores of airlines, fixed-based operators, fueling companies, aircraft engine repair shops, and related industries, as well as several railroads, have conducted operations at and around MIA. In connection with these operations, there have been numerous spills, releases and discharges of hazardous substances and petroleum products at various locations at MIA.

MIA Community Relations Plan Ver. 2.0 – May 2001 5 The airport had its beginnings in the late 1920s and 1930s with a small airfield developed by Pan American Airways and Eastern Airlines. This facility was located in the northeast corner of what is now MIA and consisted of several small runways, a couple of hangars and a small terminal building. This facility was originally referred to as Pan Am Field and later became known as the 36th Street Airport. A railroad yard operated by the Seaboard Airline Railroad was located just south of the runways. In the late 1930s, an aircraft parts manufacturing company (Intercontinent Aircraft Corporation) opened a plant adjacent to the east side of the 36th Street Airport.

With the advent of World War II, the United States Army acquired significant amounts of prop- erty to the south and southeast of the 36th Street Airport and constructed two large bases. These bases were commonly referred to as the 20th Street Airport (located in the area that is now the main Terminal) and the Miami Air Depot (which is now referred to as the West Cargo Area). These facilities, along with the 36th Street Airport, were used by the Army as a base for ferrying men and equipment overseas and for conducting aircraft and engine maintenance and overhaul operations. In addition to these facilities, the Army also constructed a maintenance hangar to the west of the 36th Street Airport and, in conjunction with a firm known as Consolidated Vultee (Convair), took over operation of the Intercontinent Aircraft facility.

After World War II, direct military operations at MIA were scaled back to the hangars and various other buildings in the West Cargo area. In turn, the Army facilities were transferred to Dade County and leased to a variety of passenger and cargo airlines, and a variety of maintenance and service providers. Several major airlines (including Pan Am, Eastern, National and Delta, among others) set up maintenance facilities in the 36th Street Area (now referred to as the Eastern Main Base and Pan Am Tract 1 Areas) and in the West Cargo Area. Numerous independent service providers set up maintenance and overhaul operations in the 20th Street Area and the West Cargo Areas.

During the 1950s and 1960s, MIA developed into a major center for engine and aircraft maintenance and overhaul. In the 1950s, a number of companies began to develop the Northwest Cargo Area for purposes of conducting maintenance and cargo operations. In the late 1950s, facilities in the 20th Street Area were razed to make way for what is now the main passenger terminal at MIA. Concurrent with the development of the main terminal, the Fuel Farm and associated fuel hydrant system were developed, and the Northwest Cargo Area was fully developed. In the late 1950s, Delta constructed a new maintenance base to the south of the Terminal, and in the late 1960s, National Airlines constructed a new maintenance base adjacent to the northeast side of the Terminal. Pan Am later merged with National and moved its operations from the West Cargo Area and the Pan Am Tract 1 Area, to the National maintenance base (which then became known as the Pan Am Main Base). Delta merged with Northeast Airlines in the late 1960s and consolidated maintenance operations at Delta’s base on the south side of the Terminal Area.

From the 1950s through the present, over 160 companies conducted operations in the West Cargo Area, and over 100 companies conducted operations in the Northwest Cargo Area. In addition, when Pan Am vacated Pan Am Tract 1 in the early 1980s and Eastern vacated the Eastern Main Base Area in the early 1990s, numerous companies, old and new, set up operations in these areas for purposes of aircraft and engine maintenance and overhaul.

MIA Community Relations Plan Ver. 2.0 – May 2001 6 Throughout much of its history, there have been numerous spills and discharges of hazardous substances to the ground, surface water, and groundwater in virtually every area of MIA. As described in the Consent Order, these spills and discharges have resulted in extensive contamination of the soil, groundwater and sediments at and around MIA. This contamination consists of various organic chemicals, chlorinated solvents, petroleum products (both virgin and contaminated), heavy metals, and a variety of other hazardous substances. To date, the County has spent more than $200 million to investigate and control this contamination. It is estimated that the re- maining cleanup could cost in excess of $200 million.

In addition to conducting the cleanup of contamination at the airport, the County is pursuing legal action to recover a substantial portion of the cleanup costs from those responsible for the contamination, including the U.S. government, its service providers, and the multitude of private companies that operated at or near MIA.

The CRP for MIA has three major goals involving effective two-way communication between MDAD and community members. While such communication does not ensure that community members will agree with all of MDAD’s decisions or the decisions of the oversight agencies re- lating to site cleanup, it does enhance the participation and understanding of community members and enables them to provide informed input to MDAD and raise issues of concern. The three major goals for the program are as follows:

• Provide community members with useful information about the cleanup process. MDAD will use printed materials, meetings and other means to explain the NCP process and indicate how the cleanup process fits into the NCP process.

• Provide timely, site-specific information to community members. MDAD will update interested parties on the progress of the cleanup. In addition, MDAD will make documents concerning the investigation and cleanup available to the public.

• Provide opportunities for community input. MDAD will solicit public input at critical stages of the cleanup process and address comments and questions voiced by community members. These activities are intended to provide an opportunity for individuals and groups to participate in the decision-making process, to obtain feedback addressing their specific concerns, and to enhance remedy selection for the site.

Listed and described below are seven community relations activities for MIA designed to achieve the goals summarized in Section IV. All of these activities will be implemented as required by the NCP.

• Notify residents and interested parties of the progress of cleanup activities. MDAD will announce the release of key documents and publicize the time, place and pur- pose of public meetings.

• Respond promptly and accurately to inquiries from residents, public officials, government agencies and other interested parties. MDAD will make appropriate staff members available to respond to questions regarding MDAD’s activities.

• Maintain and update the local information repository. MDAD will update the information repository’s collection of documents about the cleanup process so that citizens can follow the progress and provide comment.

• Publish public notices. MDAD will publish notices in local newspapers of general circulation to inform the community of key developments, public meetings, the release of documents and the start of public comment periods. Notices will include relevant dates, times and locations, as well as the name, address and phone number of the primary contact person. Notices regarding documents will briefly summarize the documents.

• Conduct public meetings. Public meetings are an efficient means of updating the community on developments and addressing community questions and comments and will be conducted periodically by MDAD. A tape or written transcript of the meetings will be made available to the public.

• Respond to significant comments received during public comment periods. MDAD will prepare written responses to significant comments and information received from community members during comment periods and will make those written responses available to the community.

• Revise the CRP

MDAD will revise the CRP as necessary to address community needs and concerns that are not addressed in the current CRP.

Public Record Access Protocol

In accordance with Chapter 119, Florida Statutes, the Miami-Dade County Aviation Department (MDAD) has developed the following protocol to facilitate public access to documents of record related to environmental response activities at Miami International Airport.

Chapter 119.07(a) states that “Every person who has custody of a public record shall permit the record to be inspected and examined by any person desiring to do so, at any reasonable time, under reasonable conditions, and under supervision by the custodian of the public record or the custodian’s designee.” The custodian of the public record for the Environmental Engineering Di- vision (EED) of MDAD is the manager of the division, Pedro Hernandez, P.E., who has sole re- sponsibility for determining which documentation, if any, is exempt from disclosure (e.g. due to pending litigation) and what constitutes “reasonable time” and “reasonable conditions” for access thereto. In addition, MDAD is authorized by Chapter 119 to require payment of copying charges as well as personnel charges incurred by MDAD in connection with the review. Please refer to Chapter 119, Florida Statutes for further detail.

Persons wishing to review the public record are required to abide by the following procedure:

1. Fill out the Records Request Form (RRF), which is available on the MDAD website, by mail or by fax. You may request a copy by calling 305-869-1513. Provide as much information as possible concerning the documents you wish to review: site name, keyword, building number, facility identification number, document title, date of publication, etc. Fax the completed RRF to 305-876-0239 or mail it to the address above. Please include a daytime phone number and an e-mail address. 2. You will be contacted by phone and by e-mail with an appointment. The amount of time required to respond to your request, and the date and length of time of the appointment, will depend on the factors discussed above. Confirmation of the appointment is requested. If you are unable to keep the appointment, please call 305-869-1513 and your appointment will be rescheduled. 3. At your appointed date and time, please sign in at the reception desk at MDAD Environ- mental Engineering (or other MDAD document repository, as directed). A staff member will give you the files and escort you to a review room. At the discretion of the custodian, his designee may supervise your review of the public record. 4. Documents and files may not be removed from the premises. Charges for copying done internally (for up to 20 pages) will be at the following rates: 15 cents per one-sided or 20 cents per two-sided black-and-white copy for letter- and legal-size documents. The fees for bulk copying (in excess of 20 pages) and copying of oversized documents will be charged ac-

If MDAD determines that copying must be done externally, MDAD will use a County-approved vendor; costs for external copying may exceed the cost of copying done internally. Administrative costs, e.g., hourly rates for support personnel, may be added at MDAD’s discretion. Please see the receptionist or the custodian’s designee for details and to make arrangements. 5. Please return documents and files to the receptionist or to the custodian’s designee.

The determination of reasonable time and conditions for the review will be based on ensuring both that the public has access to the administrative record and that such access does not interfere with the work load, obligations and responsibilities of the EED and its staff. Therefore, the time required to determine whether the requested documents are part of the public record, the date and time allotted for review of that record, and the place designated for the review, will be made on a case by case basis and will depend, in part, on the number of documents requested, the availability of the documents, the availability of space to accommodate a review of that public record, and the availability of Mr. Hernandez’s designee to supervise the review of that record. Requests for review of the public record should specify particular documents or particular environmental response actions. Reviews of the public record shall be arranged during normal business hours. No part of the public record may be removed from the supervision of the custodian or the custodian’s designee.
