    BIBLIOGRAFIE ••~- REVISTA „FAMILIA", SERIA A III-A (1934-1940). INDICE BIBLIOGRAFIC de LUCIA CORNEA Şirul noilor serii ale Familiei a fost inaugurat la 1 martie 1926 de M. G. Samarineanu, care a început la acea dată publicarea seriei a li-a. Aceasta a continuat să apară la Oradea, o dată la lună, pînă în 1929. Fiecare nouă serie a revistei Familia, dintre cele apărute în peri­ oada interbelică, s-a proclamat de continuatoare a vechii publicaţii con­ dusă de I. Vulcan. lncepînd cu luna mai 1934, tot la Oradea, sub conducerea ace­ luiaşi Samarineanu, s-a tipărit cea de-a treia serie a revistei Familia, întreruptă în august 1940, cînd a apărut ultimul număr, prin punerea '.in aplicare a dictatului de la Viena. După această dată revista s-a mutat la Bucureşti, în localul tipografiei Universul, unde şi-a continuat existenţa, din ce în ce mai greu şi cu intermitenţe, sub forma celei de-a patra serii. Redactorul seriilor interbelice ale Familiei, Mihail Gh. Samari­ neanu, macedo-rornân de origine, s-a stabilit la Oradea în 1920 la in­ sistenţele lui George Bacaloglu, care la rîndul său se stabilise aici cu un an înainte şi se făcuse remarcat deja prin întemeierea şi conducerea Reunirmii culturale „Cele Trei Crişuri". Cu o scurtă intermitenţă, timp în care s-a reîntors în Macedonia, Samarineanu a rămas la Oradea pînă în 1940. Timp de cîţiva ani, între cele două serii ale Familiei (1929-1934) a lucrat în redacţia cotidianului orădean Gazeta de Vest. Ca scriitor, Samarineanu a fost cunoscut în deceniul patru ca autorul unor scrieri de importanţă minoră, de inspiraţie balcanică.

    DOI: 10.1515/jles-2018-0003 THE ACTUALITY OF SOME PRINCIPLES AND IDEAS OF LAW PHILOSOPHY ISSUED BY MIRCEA DJUVARA Professor Marţian Iovan PhD „Vasile Goldiş‖ Western University of Arad E-mail: [email protected] (Received: February 2018; Accepted: May 2018) Abstract: The author analyzes in this paper principles and ides of philosophy of law issued by Mircea Djuvara, which preserve their contemporaneity, being useful for the perfecting of the state institutions and of the democracy not only at national level, but also at European Union one. His ideas and logical demonstration on the rational fundamentals of law, the autonomy of the moral and legal conscience, the specificity of truth and of juridical knowledge, the philosophical substantiation of power and Constitution, the principles of the democracy and the connections between the political power and the law are just few of the original elements due to which Djuvara became an acknowledged and respected personality not only in Romania, but also in the experts clubs of the Europe between the two World Wars. Key words: philosophy of law, 20th century, Mircea Djuvara, fundamentals of law. 1. Introduction The philosophical considerations upon law, governing, law-making, justice and equity in Romania occurred and were developed in tight connection with the dynamics of the State institutions and of the law. Systematic writings in this were published in the 19th century starting with the Transylvanian School representatives (especially with Samuil Micu’s works), continuing with works issued by scholars such as Simion Bărnuţiu, Timotei Cipariu, Titu Maiorescu, Teodor Păcăţeanu, Em. Antonescu and others. Their concerns focused on philosophical subject such as: the purpose of law, the idea of law, the fundamentals of law, the juridical values, evolutionism and solidarism in law, what is the Encyclopedia of the Law? etc.

The Romanian age of higher education institutions has proven to be a step in regaining the status of high school like the other existing universities in the country between the wars. The abolition of the Academy and its merger with the Faculty of Law of the University of Cluj, in 1934, was a great loss for the city of Oradea, the values gathered during more that two centuries of high school, representing a solid fundament for the academic education, from this part of the country, after the second world war.

Bărnuţiu‟s contribution to the establishment of the legal education and to the development of the sciences of the Law in the Romanian area during the mid-19th century. Adept of the natural law philosophy, ardent promotor of human and people‟s rights, Bărnuţiu remains a personality of reference in the Romanians‟ history not only for being the political leader and ideologist of the Transylvanian 1848 Revolution, but also for establishing the legal education at the University of Iasi by inspiring himself from the curriculum of the profile schools of law from the Western Europe. Having a unitary conception on the law and on the history of law, considering the law from a systemic perspective, Bărnuţiu contributed into the edification of a modern, constitutional, and democratic State in the united Romanian Principalities. Introduction Simion Barnutiu (1808 – 1864) was an important visionary politician in Transylvania and an outstanding scholar belong to the generation of patriot and revolution intellectuals of 1848, among which we mention George Bariţiu, August Treboniu Laurian, Timotei Cipariu, Alexandru Papiu Ilarian, Avram Iancu, and other. As first professor of law and of the philosophy of law in the Romanian area, S. Barnutiu has the merits of being a pioneer (in the Transylvanian area) in the history of juridical sciences, of the political and juridical philosophy, of the anthropology, of the empiric psychology, logics, pedagogy, language science, dialectology, regarded as a school-creator – “Barnutiu‟s School”.
