INTRODUCTION The term copyright may be used in different senses. It may, for example, be used to describe all of that area of the law dealing with authors’ works, or to describe the particular right granted under the relevant statute protecting such works. Also, different jurisdictions describe the scope of copyright differently. For some, the concept of copyright only refers to productions like literary, dramatic, musical and artistic works; for others, the concept of copyright also includes rights in productions such as sound recordings and films. Within the UK, the main legislative provision regulating copyright law is the Copyright, Designs and Patents Act 1988 (the CDPA) (as amended).

Traversing the history and context of the Tasini case, particularly, explaining the court’s philosophy behind the recognition of a freelancers right over his employer/publisher, the paper highlights the concept of authorship in India and the significant differences in the manner employees and freelancers are treated under the Indian legal system.     LITERARY COPYRIGHT REFORM IN EARLY VICTORIAN ENGLAND: THE FRAMING OF THE 1842 COPYRIGHT ACT CATHERINE SEVILLE Cambridge University Press LITERARY COPYRIGHT REFORM IN EARLY VICTORIAN ENGLAND The Framing of the 1842 Copyright Act Talfourd's ®rst copyright bill was presented in 1837, and the public and parliamentary controversy it provoked is re¯ected in contemporary pamphlets, correspondence and hundreds of petitions presented to parlia- ment, as well as in the changing aims of the bill itself. In addition to the expected debate as to the nature of literary property and the economic effects on the publishing trade, discussion of copyright law raised broader questions: the relative values of literature and science, the importance of public education, the dangers of monopolies and the nature of public interest. In a period of social, political and technological upheaval, these were incendiary matters. Talfourd audaciously demanded not only a considerable extension of copyright term, but also international protec- tion. This theme stems from the 2005 Report on Crown Copyright by the Copyright Law Review Committee and the earlier Ergas Committee Report which are discussed in Chapters 2 and 8 of this thesis.
