The Committee composed of Prof. Giacinto della Cananea (President), Prof. Martina Conticelli (Secretary) and Prof. Mauro Bussani (Member), nominated on 27/03/2019 prot.n. 8820 [Ref. R.F. H2020], met on April 29, 2019, at 3:30 pm through a Conference Call using the software Skype.

Prof. della Cananea and Prof. Conticelli met in the office of Professor della Cananea, in via Birmania, n.91, Rome and Prof. Bussani joined them via Skype.

According to the rules of the call, the Committee has determined the maximum scores to be allocated as follows:

• 40 points out of 100 for the evaluation of the CV, qualifications and publications

• 60 points out of 100 for the evaluation of the interview

Only the candidates who achieve a score of at least 30 points for the evaluation of the CV, qualifications and publications, will be invited to the interview.

The commission deliberates to meet again to evaluate CV, qualifications and publications on 04/05/2019 at 9:00 am through a Conference Call.

The meeting concludes at 4,10 pm.

The Committee composed of Prof. Giacinto della Cananea (President), Prof. Martina Conticelli (Secretary) and Prof. Mauro Bussani (Member), nominated on 27/03/2019 prot.n. 8820 [Ref. R.F. H2020], met on May 4, 2019, at 9:00 am through Conference Call. Prof. della Cananea and Prof. Conticelli were in Rome, in via Birmania n.91, and Prof. Bussani joined them via Skype from .

From the documentation transmitted by the Research Office of the it emerges that 2 applications were received, respectively sent by:

First of all, the President reminds the other members of the committee of the requirements to participate in the competition (a PhD in Legal Studies and knowledge of English and German languages, at least with a B2 level, to be demonstrated through appropriate documentation), and of the requirements of the CV:

• Research and study experiences abroad in the legal field, conducted at foreign renowned institutions (to be indicated in the CV); • Participation as a speaker at international conferences in the field of comparative studies (to be indicated in the CV); • Demonstrable experience on the methodology adopted and the activities carried out within the previously conducted project “The Common Core of European Private ” (to be indicated in the CV).

The Committee reviews the applications and the requirements of the applicants in alphabetical order. The first candidate to be examined is Paola Monaco.

After an analytical and deep analysis of the documentation and adequate discussion, the evaluation committee states that the requirements to participate in the competition (PhD and certification on English and German language) are satisfied. The candidate is admitted to evaluation.

The Committee examines the CV and academic requirements, and the scientific publications, allocating the following scores

The Committee examines the application of the candidate Omissis . From the documentation received it is ascertained that:

- while the attached documentation includes a certification on the English language, the knowledge of the German language (at least B2) is not certified, even though the candidate got a LLM at the ; - the candidate got in 2018 a PhD in Management Accounting at the University of Ljubljana, Faculty of Economics, discussing a dissertation entitled ‘The role of incentive scheme on shaping reference values and influencing decisions about risk and effort’. As the applicant’s CV, the title of her dissertation and the programme of her PhD course attached to the application (where all classes and activities belong to the economic area) make clear, the PhD possessed by the applicant does not meet the requirements of the call, because it does not belong to the legal area.

Therefore, it is ascertained that the candidate does not meet the requirements of the call (art. 2) and consequently the applicant Omissis can not be admitted to the interview.

According to the criteria listed in the call, the candidate Paola Monaco is admitted to the interview that will take place through conference call on May 8, 2019, at 12:00 pm, provided that the candidate agrees to renounce to the notice. Otherwise, the interview will take place on May 30, 2019, at 06:00 pm. The minutes are sent to the administration for every necessary step.

Interview

The Committee composed of Prof. Giacinto della Cananea (President), Prof. Martina Conticelli (Secretary) and Prof. Mauro Bussani (Member), met on May 8, 2019, at 12:05 pm. Prof. della Cananea is present at the Department of legal studies, while Prof. Bussani and Prof. Conticelli are connected via Skype. Doctor Paola Calogero is supporting the evaluation committee for organizational issues. Candidate Paola Monaco is connected from the Department of Legal Sciences, Language, Interpretation and Studies at the University of Trieste, and she is identified by identity card n. 2615273AA, expiration date 18/01/2020.

The Commission asks questions – first in English and German – concerning the experience acquired by the candidate on the comparative law methodology of the “The Common Core of European Private Law” project (during its meetings in Turin and particularly through the participation in the tort law group). The Commission then , in Italian, asks the candidate about her contribution to the preparation of the ‘Common Core’ volumes, her experiences abroad, especially in Austria, and her monograph about comparative tort law.

The interview ends at 12:23 pm. The Committee expresses unanimously a very positive evaluation of the interview, and in particular of the candidate’s comparative law experience, her knowledge of the foreign languages required by the call and, most importantly, her familiarity with the ‘Common Core’ methodology. The Committee assignes to the candidate the score of 57 points.

The final global evaluation is the following: the candidate has a wide expertise and knowledge in the comparative law field, and presents many scientific publications from which her competence with the comparative methodology and with the ‘Common Core’ method fully emerge, coherently with what was required by the call.

The committee proceeds to fill out the complete evaluation of the candidate, declaring Dr Paola Monaco winner of the competition.
