Pursuant to Article 37(2) of the Law on Protection of Competition (“Official Gazette of the RS”, nos. 51/09 and 95/13), Article 192(1) of the Law on General Administrative Procedure (“Official Gazette of the FRY”, nos. 33/97, 31/01 and “Official Gazette of the RS”, no. 30/10), and Article 2(1/6) of the Tariff on the level of compensation for activities within the competence of the Commission for Protection of Competition (“Official Gazette of the RS”, no. 49/11), deciding under the notification on concentration entered under number 6/0-02-901/2015-1, submitted on December 7, 2015 by company Feniks DOOEL (Pvt. Ltd.), with registered seat at the address 31 Jadranska magistrala Street, Skopje – Butel, FYR Macedonia, represented by attorney Srđana Petronijević from Belgrade, 15 Dobračina Street, on December 29, 2015, President of the Commission for Protection of Competition enacts the following

D E C I S I O N

I Concentration of undertakings in summary procedure IS APPROVED created by acquisition of direct control on the part of company Feniks Farma DOOEL (Pvt. Ltd.), with registered seat at the address 31 Jadranska magistrala Street, Skopje – Butel, FYR Macedonia, registered in the Central Registry of the Republic of Macedonia with company registration number 5519578, over target business operations concerning distribution of pharmaceutical products on the territory of Autonomous Province of Kosovo and Metohija, encompassing all listed in the “Asset Purchase Agreement” of November 22, 2015, managed by natural person Gazmend Abraši, citizen of the Republic of Serbia. II IT IS ESTABLISHED that company Feniks Farma DOOEL (Pvt. Ltd.), with registered seat at the address 31 Jadranska magistrala Street, Skopje – Butel, FYR Macedonia, has fully performed against its obligation related to paying determined amount of the fee as compensation for issuing this decision on December 9, 2015, by executing payment in the total amount of EUR 25,000.00 (in words: twenty-five thousand Euro) in the Dinar-currency equivalent value amount calculated at the National Bank of Serbia's middle exchange rate on the day of payment, to the account of the Commission for Protection of Competition maintained with the Treasury Administration of the Ministry of Finance.
