THE COUNTY COUNCIL OF (VARIOUS ROADS, SOUTH) (PROHIBITION AND RESTRICTION OF WAITING AND PARKING PLACES) ORDER 2006

The County Council of Shropshire (hereinafter referred to as “the Council”) in exercise of their powers under Sections 1(1), 2(1) and (2), 4(2), 32(1) and 35(1) of, and Part IV of Schedule 9 to, the Road Traffic Regulation Act 1984 (“the Act”) and all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the Act, hereby make the following Order:

1. (1) This order shall come into operation on 23 October 2006 and may be cited as The County Council of Shropshire (Various Roads, Shrewsbury South) (Prohibition and Restriction of Waiting and Parking Places) Order 2006.

(2) The Traffic Regulation Orders specified in Schedule 1 of this Order are hereby revoked.

2. (1) In this Order -

“disabled person’s badge” has the same meaning as in The Disabled Persons’ (Badges for Motor Vehicles) () Regulations 2000;

“disabled person’s vehicle” has the same meaning as in The Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000;

“parking disc” means a disc issued by a local authority, 125 millimetres square, coloured blue or orange and capable of showing the quarter hour period during which a period of waiting begins.

“Civil Enforcement Officer” means a person authorised by or on behalf of the Comment: Need to include that Shropshire County Council under Section 76 of the Traffic Management Act ll refs to civil enforcement officer are to be read as civil enforcement 2004 to supervise and enforce the road traffic contraventions for which officer Shropshire County Council is the enforcement authority. Comment: See also section 74 TMA 2004 “Penalty Charge” and “Reduced Penalty Charge” means a charge set by Shropshire County Council in accordance with the provisions of Section 77 and Schedule 9 of the Traffic Management Act 2004 and Regulations made thereunder and in accordance with any guidance given by the Secretary of State.

“Penalty Charge Notice” means a notice issued by a Civil Enforcement Officer pursuant to the provisions section 78 Traffic Management Act 2004 and Regulations made thereunder.

(2) For the purposes of this Order, a vehicle shall be regarded as displaying -

a) a disabled person’s badge in the relevant position if -

i. in the case of a vehicle fitted with a dashboard or facia panel, the badge is exhibited thereon so that Part I of the badge is legible from outside the window; or

ii. in the case of a vehicle not fitted with a dashboard or facia panel, the badge is exhibited in a conspicuous position on the vehicle so that Part I of the badge is legible from outside the vehicle.

b) a parking disc in the relevant position if -

i. in the case of a vehicle fitted with a dashboard or facia panel, the disc is exhibited thereon so that the quarter hour period during which the period of waiting began is legible from outside the vehicle; or

ii. in the case of a vehicle not so fitted, the disc is exhibited in a conspicuous position on the vehicle so that the quarter hour period during which the period of waiting began is legible from outside the vehicle.

3. In this order all distances relating to the restrictions imposed have been measured in relation to the roads or the length of road specified in the following manner:-

a) except where otherwise specified a dimension has been measured along the kerbline or edge of carriageway of the roads specified.

b) for restrictions relating to Side Roads, the start point of measurement, when measured from a junction, is the rear of the highway relating to the Main Road.

4. Save as provided in Article 11 of this Order, no person shall, except upon the direction or with the permission of a police constable in uniform or of a civil enforcement officer, cause or permit any vehicle to wait on the sides of roads specified in Schedule 2 to this Order.

5. Save as provided in Article 11 of this Order, no person shall, except upon the direction or with the permission of a police constable in uniform or of a civil enforcement officer, cause or permit any vehicle to wait between the hours of 8:00am and 6:30pm, Monday to Saturday, on the sides of roads specified in Schedule 3 to this Order.

6. Save as provided in Article 11 of this Order, no person shall, except upon the direction or with the permission of a police constable in uniform or of a civil enforcement officer, cause or permit any vehicle to wait between the hours of 8:00am and 6:30pm, Monday to Friday, .on the sides of roads specified in Schedule 4 to this Order.

7. Save as provided in Article 11 of this Order, no person shall, except upon the direction or with the permission of a police constable in uniform or of a civil enforcement officer, cause or permit any vehicle to wait between the hours of 8:30am and 9:30am, and 3:00pm to 4:00pm, Monday to Friday, .on the sides of roads specified in Schedule 5 to this Order.

8. Save as provided in Article 11 of this Order, no person shall, except upon the direction or with the permission of a police constable in uniform or of a civil enforcement officer, cause or permit any vehicle to wait on the side of road specified in Schedule 6 to this Order between the hours of 8:00am and 6:30pm, Monday to Saturday::

a) for a longer period than 40 minutes, or b) if a period of less than 3 hours has elapsed since the termination during the said hours of the last period of waiting (if any) by that vehicle on that side of road.

9. Save as provided in Article 11 of this Order, no person shall, except upon the direction or with the permission of a police constable in uniform or of a civil enforcement officer, cause or permit any vehicle to wait on the side of road specified in Schedule 7 to this Order between the hours of 8:30am and 6:00pm, Monday to Saturday::

a) for a longer period than one hour, or b) if a period of less than 3 hours has elapsed since the termination during the said hours of the last period of waiting (if any) by that vehicle on that side of road.

10. Save as provided in Article 11 of this Order, no person shall, except upon the direction or with the permission of a police constable in uniform or of a civil enforcement officer, cause or permit any vehicle to wait on the side of road specified in Schedule 8 to this Order between the hours of 8:00pm and 7:00am:

a) for a longer period than two hours, or b) if a period of less than 4 hours has elapsed since the termination during the said hours of the last period of waiting (if any) by that vehicle on that side of road.

11. (1) Nothing in Articles 4, 5, 6, 7, 8, 9 or 10 of this Order shall render it unlawful to cause or permit any vehicle to wait on the sides of roads referred to therein for so long as may be necessary to enable -

a) a person to board or alight from the vehicle;

b) goods to be loaded on or unloaded from the vehicle;

c) the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any of the following operations, namely:-

i. building, industrial or demolition operations;

ii. the removal of any obstruction to traffic;

iii. the maintenance, improvement or reconstruction of the said sides of road; or

iv. the laying, erection, alteration or repair in, or in land adjacent to the said sides of road of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus as defined in paragraph 1(1) of the Telecommunications Code contained in Schedule 2 of the Telecommunications Act 1984.

d) the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority, or a water undertaker or a sewerage undertaker, or the Environment Agency in pursuance of statutory powers or duties;

e) the vehicle to be used for the purpose of delivering or collecting postal packets as defined in Section 125(1) of the Postal Services Act 2000;

f) the vehicle to be used for fire brigade, ambulance or police purposes;

g) the vehicle to be used for the purpose of repairing, maintaining or enforcing speed camera equipment;

(2) Nothing in Article 4 of this Order shall render it unlawful to cause or permit a disabled person’s vehicle which displays in the relevant position a disabled person’s badge, and a parking disc (on which the driver, or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the sides of roads referred to in that Article for a period not exceeding three hours (not being a period separated by an interval of less than one hour from a previous period of waiting on the same side of road on the same day).

(3) Nothing in Article 5 of this Order shall render it unlawful to cause or permit a disabled person’s vehicle which displays in the relevant position a disabled person’s badge, and a parking disc (on which the driver, or other person in charge of the vehicle, has marked the time at which the period of waiting began) to wait on the sides of roads referred to in that Article, between the hours of 8:00am and 6:30pm, Monday to Saturday, for a period not exceeding three hours (not being a period separated by an interval of less than one hour from a previous period of waiting on the same side of road on the same day). Disabled persons’ vehicles may wait for an unlimited period outside these times.

(4) Nothing in Articles 6, 7, 8, 9 or 10 of this order shall render it unlawful to cause or permit a disabled person’s vehicle which displays in the relevant position a disabled person’s badge to wait on the sides of roads referred to in those Articles.

PART II AUTHORISATION AND USE OF PARKING PLACES

12. (1) The sides of roads specified in Schedule 9 to this Order are authorised to be used subject to the following provisions of this Order, as parking places for such classes of vehicles in such positions and on such days and during such hours as are specified in relation to that side of road.

(2) Nothing in paragraph (1) of this Article shall restrict the power of the Council or any other local authority, for preventing obstruction of the streets, by order on the occasion of any public procession, rejoicing or illumination or any other appropriate local authority, for preventing obstruction of the highway, or when the streets are thronged or liable to be obstructed, to close any parking place.

13. Where, in Schedule 9 of this Order, a parking place is described as available for vehicles of a specified class or in a specified position, the driver of a vehicle shall not, save as provided in Article 15, permit it to wait in that parking place, except upon the direction or with the permission of a civil enforcement officer or of a police constable in uniform or of a civil enforcement officer:-

a) unless it is of the specified class, or b) in a position other than that specified.

14. On such days and during such hours as the limitation on time specified in Schedule 8 to this Order, under the heading “Maximum period for which vehicles may wait”, the driver of a vehicle shall not, save as provided in Article 15, permit it to wait in a parking place longer than the maximum period permitted for waiting, nor shall the driver, within sixty minutes of leaving that parking place, permit the vehicle to wait again in that parking place.

15. (1) Nothing in Article 13 or in Article 14 shall render it unlawful to cause or permit any vehicle to wait in a parking place for so long as may be necessary:-

a) to enable a person to board or alight from the vehicle;

b) to enable goods to be loaded on or unloaded from the vehicle;

c) to enable the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any building operation or demolition; the removal of any obstruction to traffic; the maintenance, improvement or reconstruction of the parking place so referred to; or the laying, erection, alteration or repair in or near the said parking place of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any telecommunications apparatus as defined in paragraph 1(1) of the Telecommunications Code contained in Schedule 2 of the Telecommunications Act 1984;

d) to enable the vehicle to be used for fire brigade, police or ambulance purposes;

e) to enable the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or a water undertaker or sewerage undertaker, or the Environment Agency in pursuance of statutory powers or duties.

f) the vehicle to be used for the purposes of delivering or collecting postal packets as defined in Section 125(1) of the Postal Services Act 2000

PROVIDED That:

The vehicle waits in the said parking place no longer than is necessary and for the purpose specified.

16. A driver of a vehicle shall not use a parking place:-

a) so as unreasonably to prevent access to any premises adjoining the side of road, or the use of the road by other persons, or so as to be a nuisance;

b) when, for preventing obstruction of the streets, the Council or any other appropriate local authority shall, by order made on the occasion of any public procession, rejoicing or illumination or when the streets are thronged or liable to be obstructed, have closed that parking place and exhibited notice of such closing on or near the parking place.

17. The driver of a vehicle using a parking place shall stop the engine as soon as the vehicle is in position in the parking place, and shall not start the engine except when about to change the position of the vehicle in or to depart from the parking place.

18 No person shall use a vehicle while it is in a parking place, in connection with the sale of any article to persons in or near the parking place or in connection with the selling or offering for hire of his skills or services.

19 Subject to the proviso hereto, when a vehicle is left in a parking place in contravention of any of the provisions contained in Article 13 or in Article 16 a person authorised in that behalf by the Council may remove the vehicle or arrange for it to be removed from that parking place, provided that, when a vehicle is waiting in a parking place in contravention of Article 13(b) a person authorised in that behalf by the Council may alter or cause to be altered the position of the vehicle in order that its position shall comply with that provision.

20. Any person removing a vehicle or altering its position by virtue of Article 19 may do so by towing or driving the vehicle or in such other manner as he may think necessary and may take such measures in relation to the vehicle as he may think necessary to enable him to remove it or alter its position, as the case may be.

21. When a person authorised by the Council removes or makes arrangements for the removal of a vehicle from a parking place by virtue of Article 20, he shall make such arrangements as may be reasonably necessary for the safe custody of the vehicle.

22. The prohibitions and restrictions imposed by this Order shall be in addition to and not in derogation from any restriction or requirement imposed by any regulation made or having effect as if made under the Act or by or under any other enactment.

23. If a vehicle is left at any time in contravention of a provision of this Order a Penalty Charge shall be payable

24. In the case of a vehicle in respect of which a Penalty Charge is payable notification of the Penalty Charge may be given by a Civil Enforcement Officer in accordance with the requirements of Section 78 of the Traffic Management Act 2004 and Regulations made thereunder.
