That in accordance with Section 236A of the Local Government Act, the Council authorises the payment of remuneration to mayor, deputy and councillors on the same percentage basis as 2009 in respect of the current remuneration schedule set out by the Local Government Remuneration Tribunal: noting that the purpose of the remuneration is to cover the cost of attendance (excluding expenses) at “Council business” (as defined in the Expenses Reimbursement Policy for Councillors adopted on 23 September 2008); and further noting that payment of remuneration is to take effect from 1 January, 2010. RECONFIGURING A LOT

1. Condition 1.1(a) (i) be amended as follows;

The reconfiguration of the land must be carried out generally in accordance with:- (a) (i) the approved Proposal Plan EC-001 02 (A1) Revision D and EC-001 04 (A1) Revision C

GENERAL

2. PROPOSAL PLAN

3. The reconfiguration of the land must be carried out generally in accordance with:- (a) (i) the proposed Jensen Bowers plan numbered E.5958-01 Issue C; (ii) the plans, specifications, facts and circumstances as set out in the application submitted to Council;

Except where modified by the conditions of approval and any approval issued there under; and (b) any approval issued under this approval; and (c) any development permit for operational works relating to the reconfiguring of a lot.

TIME FOR COMPLIANCE

4. Unless otherwise specified by these conditions, the conditions must be complied with prior to approval of the Plan of Survey.

PUBLIC UTILITY SERVICES

5. If any existing public utility service including telephone, electricity, water, sewerage or gas needs to be altered or relocated to complete the reconfiguration; the developer must bear the cost of alteration or relocation.

OPERATIONAL WORKS

6. Where operational works are required to be carried out for the reconfiguration, the developer must, within a period of two years from the date of this permit and prior to the commencement of any work, lodge with Council an application for a development permit for operational works. As part of such application, the developer must submit:-

(a) detailed and complete engineering drawings and specifications of the proposed works prepared by a civil engineer, who is both registered under the Professional Engineer’s Act 2002 and is a current Registered Professional Engineer of Queensland; and

(b) a certificate from the engineer who prepared the drawings stating that the design and specifications have been prepared in accordance with these conditions, relevant Council Codes and Planning Scheme Policies and the relevant Australian Standard Codes of Practice.

ELECTRICITY SUPPLY

7. The developer must prior to release of formal Plan of Survey submit a letter from Ergon Energy (or other suitable entity) stating that satisfactory

arrangements have been made with it for the provision of an electricity supply to the subdivision.

SEWERAGE SUPPLY WORKS INTERNAL

8.1 The applicant must provide a separate sewer connection to proposed Lot 2. The full cost of such connections shall be the responsibility of the applicant;

8.2 An inspection point shall be required on the existing house drain servicing the dwelling on proposed Lot 1. The location of the proposed inspection point shall be immediately inside proposed Lot 1 and shall extend to the surface;

8.3 The existing house drain to proposed Lot 1 shall be physically located. If the drain is not completely in proposed Lot 1 with a minimum of 500mm clearance of the proposed boundary, it shall be relocated to provide such clearance.

WATER SUPPLY WORKS INTERNAL

9.1 The applicant will be required to provide a separate water connection to proposed Lot 2. The full cost of such connection shall be the responsibility of the applicant;

9.2 The applicant must provide a certified statement from a licensed plumber that no existing interconnecting water supply plumbing crosses the boundaries between the proposed lots.

2. It was noted that when road closures are in place during the wet season vehicles are not permitted to cross after the water has resided until the road has been inspected for underlying damage. Information regarding procedures for road closures to be circulated to the Ayr Advocate for the attention of the community.

3. Mr. Preedy advised of the new floodsax tool available for funding through the Natural Disaster Resilience Program. Discussion was held regarding the new tool and due to the high cost of the floodsax it was agreed to continue with the current method of sandbagging for flood situations.

Background:

At the Council meeting on 22nd April 2008, Council considered an application from Rapisarda P/L to close a section of George Road and resolved to support the application for a permanent closure of a parcel 30 metres wide and 350 metres long. A recent letter from Groves and Clark, Solicitors, on behalf of Mr Rapisarda indicates that their client did not have the eastern boundary of his lot surveyed prior to constructing a drain and water reuse storage in the road reserve. When the survey for road closure was conducted the encroachment beyond the approved closure was discovered. Consequently Mr Rapisarda now wishes to apply for a road closure 46 metres wide and 411 metres long adjoining the north eastern frontage of his lot along with a strip 15 metres wide and approximately 759.1 metres long adjoining the remainder of his eastern frontage. The area of road closure has increased from 10,500 square metres to approximately 30,290 square metres.

Project Title: Macro-invertebrates and waterway health in Schools

Project Outline: To raise awareness and interest of upper primary students in local environmental issues such as water quality, biodiversity and reef protection. Students will be sampling and assessing water way health through macro-invertebrates. The program will be run fortnightly. A different school will take part each fortnight, allowing classes to see the any changes that have taken place between samplings.

Benefits: This Project will raise students’ awareness of issues such as healthy waterways, biodiversity and how to measure the impacts of pollution on these.

In 2005 the owner, Mr Moloney, erected a shed that encroached onto the road reserve and this encroachment was discovered in a survey for easement creation in 2007. The shed construction was certified by Thuringowa Building Certifiers in 2005.

Re: Application for Permanent Road Closure over an area of about 105 m2, being part of Plantation Avenue abutting Lot 83 on RP730435 (parish of Selkirk, locality of Horseshoe Lagoon) shown as Lot 1 on Drawing TSV2009-08.

I refer to our previous correspondence, sent to your office on 17 September 2009, requesting views on the above permanent road closure (enclosed). To date, we have not received any response and this matter is becoming urgent.

The purpose of the proposed road closure is due to a shed encroachment. It would be much appreciated if council’s views could be forwarded, with particular regard to any required set back distance from the shed, to any new boundary. A response by 1st March 2010 would be greatly appreciated.

Background:

The following comments are from the Manager of Planning & Development, Mr Shane Great: The land is zoned ‘Rural’ with the proposal triggering a ‘code assessable’ development application for reconfiguring a lot (Boundary realignment). The application has been assessed against the Reconfiguration of a Lot Code under the provisions of the Burdekin Shire Council’s IPA Planning Scheme.

The Application: It is the applicant’s intent to create proposed lot 5 to include the existing dwelling house and shed while proposed lot 130 will continue to be used for agricultural activities. The proposed changes will not alter any of the existing agricultural or residential uses.

Site Description/Surrounding Land Uses: The subject site is located opposite Sheep Station Creek with a total area of 89.628ha and has approximately 500m frontage to Waterview Road. The property is currently improved by a single detached dwelling, shed and a sugar cane farm. The surrounding area is primarily agricultural land, with some rural residential housing and sheds on the neighbouring farms.

Effluent Disposal: A site assessment report from Nicoll Beattie Pty. Ltd. confirms that each proposed lot has adequate area to construct proper on-site effluent treatment areas. The report also states that there are no known environmental or public health constraints to the on-site treatment of domestic waste.

Recommendation: Council’s Development Assessment Team members have assessed the application and have included reasonable and relevant conditions as part of the recommended approval. Given that the proposal complies with the provisions contained in Council’s IPA Planning Scheme and in particular the acceptable solutions of the ‘Reconfiguration of a Lot’ zone code, it is recommended that Council approve the application subject to the abovementioned conditions.

Background: Council acting as the Assessment Manager has issued a Development Permit for a Material Change of Use for a multi unit development (4 units) at 105 Munro Street, Ayr. This permit was issued on 15 December, 2009. A letter dated 12 January, 2010 making representations was received from Nola Bosch requesting condition 4.2 be removed from the decision notice. The representations requested that the applicant be relieved from the construction or contribution of a footpath, sighting the fact that there is no footpath in that area of the street and in their opinion a footpath would not be required in the future.

Original condition 4.2 reads:

“Construct a 1.5 wide concrete footpath (100mm thick, F62 mesh and 25mPa) for the full length of the development in Munro Street. Design and natural service levels are to be provided to the Chief Executive Officer for approval prior to construction. As an alternative, pay a contribution in lieu of these works being carried out.”

Officer's Recommendation: Council approves funding of $1000.00 (incl. GST) to the Burdekin Tourism Association to assist in hosting the 2010 Northern Region Volunteers Conference on Wednesday, 3rd March and Thursday, 4th March.

Background

The conference is hosted on a rotational basis throughout the Northern Region (including Townsville, Charters Towers and Hinchinbrook).

It is anticipated that 100 delegates will attend the two day conference.

A request has been received from the Burdekin Tourism Association Inc. to cover the costs to hire the Burdekin Memorial Hall however, such a donation is considered outside the scope of Council’s current sponsorship and donations practice. Furthermore, a precedent could be set should council approve to cover the costs to hire the hall.

Council has previously donated $10,000.00 to the Burdekin Tourism Association Inc. in the 2009-10 financial year to deliver a number of tourism projects. In addition, Council also provides in-kind secretarial support to the association and is heavily involved in organising the conference.

Given the significant economic value that this conference will bring to the community, it is recommended that a donation of $1000.00 be provided to the Burdekin Tourism Association Inc. to assist in hosting the conference.

The Burdekin Car Cruisers Club has been largely self-serving in the financing, organisation, and management of this successful event since its inaugural competition in 2006. The club will hold this year’s event at the Ayr Showgrounds on Saturday, 24th April 2010. The club would like to continue to grow the event through advertising in the Ayr Advocate, The Townsville Bulletin, Bowen Independent, The Daily Mercury Mackay, The Cairns Post, and the Charters Towers Northern Miner.

Background: In 2009, Council contributed $2500.00 (inc. GST) for advertising for the Burdekin Auto Fest in Ayr, Charters Towers, Townsville, Cairns, Bowen and Mackay newspapers. Coloured advertisements, including editorial features, ran in the aforementioned newspapers in the weeks leading up to the event.

Participation numbers for last 4 years are as follows:

2006 Spectators – 600 Entrants – 100 2007 Spectators – 1750 Entrants – 135 2008 Spectators – 3000 Entrants – 135 2009 Spectators – 1500 Entrants - 135

Due to the decline in numbers in 2009, it is recommended that the sponsorship amount be reduced to $2000.00 being similar to the amount that was donated in 2007.

The Burdekin Car Cruisers Club fund advertising in the Street Machine Magazine, the Queensland Street Car Magazine, Unique Cars and the Extreme Street Car Magazine. It also promotes the event through auto clubs in Mackay, Bowen, Rockhampton, Moranbah, Cairns, Charters Towers, and Ingham. The club is seeking Council’s assistance with promoting the event outside the Shire. Regional advertising this year will concentrate around the Burdekin, Townsville, Cairns, Bowen, and Mackay areas.

The Burdekin Car Cruisers Club has provided a copy of its financial statement for the 2009 Burdekin Auto Fest.

In-kind support by Council Officers has included the following: • Update of Community Events Noticeboard in Plantation Park and installation of the sign • Advice on media coverage • Details of media contacts • Compilation of a survey form to assist with gathering data on participation numbers and economic benefit to the district

Australian Assistance to Haiti

Australia will provide an initial $10 million in emergency humanitarian relief and reconstruction assistance in response to the 7.3 magnitude earthquake that struck Haiti close to the capital of Port-au-Prince.

Initial assessments report a large number of casualties and widespread damage with up to five million people adversely affected. The earthquake has brought down buildings including the main hospital. Electricity, water and communications have been cut.

Australia is concerned for the welfare of all those affected by the earthquake and is offering immediate assistance to be coordinated with regional and international efforts.

Australia’s emergency humanitarian funding will be provided to the International Federation of Red Cross and Red Crescent Societies (IFRC), the United Nations, Australian NGOs and the Caribbean Disaster Emergency Management Agency (CDEMA) to supply urgently needed medical assistance, shelter, water and food.

A United Nations Disaster and Assessment Coordination Team (UNDAC) has been mobilised and Australian officials are in contact with the UN assessment team and the CDEMA which is coordinating the response of Caribbean countries.

If you have concerns for the welfare of Australian family and friends in Haiti, you should first attempt to contact them directly. If you are unable to contact them and still hold concerns for their welfare, you should call the Department of Foreign Affairs and Trade’s 24-hour Consular Emergency Centre on 1300 555 135 or (02) 6261 3305.

DONATIONS IN RESPONSE TO HAITI EARTHQUAKE

Australians considering giving towards the relief efforts should ensure any donations they make are to an endorsed Overseas Aid Fund that has deductible gift recipient (DGR) status.

Tax deductibility for donations to be used outside Australia are subject to tight controls and require any newly established funds to go through a lengthy process with the Australian Agency for International Development (AusAID) and the Australian Tax Office.

The Assistant Treasurer is advising that individuals and organisations may prefer to arrange with an existing tax deductible Overseas Aid Fund to collect money on their behalf for the victims of the earthquake.

Taxpayers can check whether an organisation has DGR status on the ABN Lookup website (www.abn.business.gov.au). Information about non-government organisations that operate tax deductible Overseas Aid Funds is also available on the AusAID website (www.ausaid.gov.au).

Donations of $2 or more to DGRs are tax deductible. Donors should keep a receipt for tax purposes.

In natural disasters, delivering aid quickly and through organisations that are equipped to deal with such tragedies is critical to reducing the suffering of affected communities.

I contacted your council in mid-November to let you know that our award-winning injury prevention program, the Spinal Education Awareness Team (SEAT), was being offered FREE to all Queensland schools, including those in the Burdekin region, until 30 June, 2010.

Well, we have some more exciting news – BHP Billiton Cannington Mine has extended their sponsorship for the next 3.5 years, which means SEAT is now free to all Queensland schools until 30 June 2013!

SEAT is made up of 15 men and women, who either have quadriplegia or paraplegia. The presenters are all volunteers and they share their stories and injury prevention messages with tens of thousands of children from Prep to Year 12 each year, to inspire them to stay safe and ultimately prevent them from a lifetime using a wheelchair. Previously, the SEAT program incurred a small fee of $1 per child to recoup some of the administrative costs of the program.

Thanks to BHP’s support, our presenters are on track to speak to 100,000 Queensland school children this year. We’d appreciate any opportunity for you to promote this fantastic offer, whether it be verbally in your dealings with schools, in local newspaper columns or in newsletters to constituents. I’ve attached the SEAT brochure and a media release about the free offer to give you some more background on the program, which you’re more than welcome to distribute to your contacts.

There is currently no cure for a spinal cord injury, which is why the prevention messages of SEAT are so important.

Safety first for Burdekin children

Burdekin Shire Council school children will be among an estimated 300,000 young Queenslanders statewide to benefit from a new three-year sponsorship of a program dedicated to preventing injuries.

With the start of the school year fast approaching, BHP Billiton Cannington Mine has announced it will extend its current one year sponsorship of the Spinal Education Awareness Team (SEAT) program for an additional three years, effective 1 July 2010 to 30 June 2013.

The Mine’s new $450,000 investment into SEAT over three years on top of the $125,000 already invested this financial year will mean the award-winning injury prevention program, which has shared safety messages with more than 1.3 million children to date, will continue to be offered at no cost to schools throughout Queensland for the next three and a half years.

SEAT Manager Carol Haffke said that based on current trends, more than 100,000 students would view the program each year of the new three year sponsorship.

“In the first six months of this financial year since we’ve been able to offer SEAT at no cost, teachers have been very enthusiastic about booking us and more than 65,000 children have viewed a presentation with nearly 6,400 students booked in already for 2010,” she said.

“We are very confident that our 16 presenters, who all have a spinal cord injury and use a wheelchair, will be able to share their own personal stories and powerful safety messages with more than 100,000 children by the end of this financial year.

“This would not have been possible without the support of BHP Billiton Cannington Mine, which clearly is dedicated to safety, given its own Zero Harm policy and its recognition that SEAT can effectively stop children from having accidents and experiencing a lifetime using a wheelchair.

LAUNCH OF YEAR OF WOMEN IN LOCAL GOVERNMENT

The Rudd Labor Government has thrown its support behind the 2010 Year of Women in Local Government, an initiative to improve the participation of women in local government leadership and management.

Minister Anthony Albanese, Minister for Infrastructure and Local Government, launched this initiative in Sydney today.

“This year, the Rudd Government will be providing nearly $500,000 for a range of practical projects to help improve the participation of women in local government,” he said.

It is critical that councils and shires, as the level of government closest to the community, reflect the communities that they seek to represent.

“Local governments make an important contribution to the nation, delivering vital infrastructure and services, such as local roads, community facilities, environmental and waste services, child care and health and welfare services.

“However, less than a third of councillors are women; 20 per cent of senior managers are women; and only seven per cent of Chief Executive Officers are women,” Mr Albanese said.

Minister for the Status of Women, Tanya Plibersek, said she was very proud to be serving in a Government which boasts more women in senior parliamentary positions than any other Australian Government, including the first female Deputy Prime Minister.

“There is no lack of talented women in Australia, and many get their political start in local government. The Australian Government is keen to support more women in these roles.

“Councils are big employers in local communities. Organisations that employ women and people from diverse backgrounds better represent and understand their community leading to better results.

The Government’s commitment includes: • $250,000 for a three-year 50:50 Vision: Councils for Gender Equity program which will audit councils and shires to determine the status and role of women in leadership roles as well as their participation in the workplace. • $100,000 in scholarship funding to enable senior women in local government to participate in the new Executive Leadership Program being developed by the Australian Centre of Excellence for Local Government and the Australia and New Zealand School of Government; • $100,000 to improve the collection of data and reporting on the status of women in the local government sector; and • $40,000 to the Local Government Managers Australia for their 2010 Management Challenge, which will involve around 130 councils identifying strategies to promote gender equity in their councils.

Dear colleagues

If you haven't seen it already, you may be interested in the front page story in today's Australian Financial Review about the four potential constitutional changes currently being examined by the Australian Government (unfortunately it isn't online so I can't link to it).

The Attorney-General, Robert McClelland, is quoted in the article as confirming that the inclusion of local government in the Constitution is one of the four proposals currently being worked on by the Government. The other three relate to a republic, recognition of indigenous people and cooperative federalism. The Attorney also indicated that the Government is looking to pursue these changes in the next parliamentary term.

This is positive news and responds to ALGA's efforts and negotiations on behalf of the sector over the past 12 months with the Government, the Opposition, state and territory governments and minor parties to build momentum on constitutional reform.

The Declared Fish Habitat Area Network Strategy 2009-14 has now been finalised.

The Strategy outlines the current status of the declared Fish Habitat Area (FHA) Network and a way forward for the next 5 years, with links to the Queensland Fisheries Strategy 2009-14.

In 2009 the declared FHA Network celebrated its 40th anniversary. It now protects 880,000 ha of high quality fish habitats that are critical in sustaining our State fisheries. Legal recreational, commercial and indigenous fishing are permitted in declared FHAs.

2010 Intergenerational Report Australia to 2050: Future Challenges.

The report provides a comprehensive study of the challenges that Australia will face over the next 40 years, including an ageing population, escalating pressures on the health system, and the environmental and economic challenges of climate change.

These challenges will place substantial pressure on economic growth, living standards and the federal budget over the next 40 years.

The report demonstrates just how critical it is to plan for the future, invest in productivity and participation, maintain fiscal discipline, and deal with dangerous climate change. Taking modest steps now means we can avoid the need for much more dramatic and painful adjustments in the future.

The report shows clearly that the ageing of Australia’s workforce will present a particular set of economic and social challenges. The proportion of Australia’s population aged 65 and over is projected to almost double over the next 40 years. Today there are 5 working-aged people to every person aged 65 and over. By 2050, this ratio will fall to only 2.7 people.

With proportionately fewer working-age Australians supporting a much larger population of older Australians, ageing and rising heath costs are expected to result in spending exceeding

Today, around a quarter of total Australian government spending is directed to health, age-related pensions and aged care. The report shows this is expected to rise to around half by 2049-50.

The report highlights that productivity growth – producing more output with proportionately fewer workers – will be the major contributor to increases in living standards over the next 40 years.

That’s why the Rudd Government is delivering a far-reaching productivity agenda, including historic investments in vital infrastructure like the National Broadband Network, skills and training, cutting business red tape and the Education Revolution.

The Government is also taking steps to remove impediments to workforce participation and provide incentives and reward for those Australians who choose to remain in the workforce in their later years.

Steps by the Government to grow the economy and ensure strong fiscal discipline, including through the implementation of the Government’s fiscal strategy, will lower future adjustment costs and the economic impacts of the ageing population.

Australia to 2050: Future Challenges also highlights that climate change presents a major threat to Australia’s environment and economic prospects.

The Government is committed to introducing the Carbon Pollution Reduction Scheme (CPRS), which will achieve large-scale reductions in greenhouse gas emissions at least economic cost by steadily transforming the economy.

The Government has already expanded the Renewable Energy Target to ensure that by 2020, 20 per cent of our electricity supply comes from renewable sources. This is complemented by the $4.5 billion Clean Energy Initiative, which will support solar, clean coal and renewable technologies, and the $3 billion Energy Efficient Homes Package, which is helping households improve the energy efficiency of their homes.

Australia to 2050: Future Challenges makes it clear that the decisions that are taken in the near term will be crucial to the economic prospects and living standards of future generations. That’s why the Rudd Government is determined to tackle the big future challenges, so we can leave a stronger, fairer and healthier Australia to future generations.
