"THE POULTRY INDUSTRY REGULATIONS OF 1946"

HIS Excellency the Governor, with the advice of the Executive Council, has, in pursuance of the provisions of "The Poultry Industry Act of 1946," been pleased to make the following Regulations:- 1. The Regulations made under "The Diseases in Poultry Act of 1923," "The Diseases in Poultry Act Amendment Act of 1937," and "The Diseases in Poultry Acts Amendment Act of 1940" are hereby repealed. 1A. These Regulations may be cited as "The Poultry Industry Regulations of 1946." Inserted by regulation published Gazette 2 July 1955, p. 118. 2. These Regulations are divided into four parts, as follows:­ PART 1-DISEASE CONTROL; PART 2-STOCK SUPPLIERS; PART 3-THE SLAUGHTER OF POULTRY FOR HUMAN CONSUMPTION AND EGG STANDARDS; PART 4-GENERAL. T. Part 1

DISEASE CONTROL 3. In this Part, unless the context otherwise indicates, the following term shall have the meaning set against it, that is to say:- "Place of Entry" Brisbane (including South Brisbane Railway Station and Archerfield and Eagle Farm Aerodromes), , , Mackay, , Coolangatta, Killarney, Wallangarra. 2 Regs. 4-9 ~~QULATIONS

4. No person shall travel or remove any poultry or fittings into, within, or out of any place which is subject to an order of quarantine by an inspector, except as hereafter provided, unless and until the quarantine has been removed by the Minister.

5. Every person desiring to move poultry and/or fittings within or out cof .an infected area shall make application to ,an inspector for a permit so to do. Such application shall contain the following particulars:- (a) The name and place of abode .of the owner of such poultry and/ or fittings; (b) The holding on which such poultry and/or fittings are located; (c) The number and description of such poultry and/ or fittings; (d) The date on which it is desired to move such poultry and/or fittings; (e) The place to which it is desired to move such poultry and/ or . fittings; (f) The route and the means of transport by which such poultry and/ or fittings are to be moved. If the inspector is satisfied that such a movement of poultry and/ or fittings is not likely to spread infection or disease he may grant a permit authorising such movement upon such conditions as he may impose and embody in the permit.

6. No person shall move any poultry and/or fittings within or out of an infected area- ( a) Unless he is the holder of a permit from an inspector author­ ising such movement; (b) In contravention of any condition embodied in a permit authorising such movement.

7. No person other than an inspector shall make any alteration in or addition to any permit granted by an inspector.

8. No person shall remove any animal infested with Stickfast Flea from an infected area or move any such animal so infested from any holding within an infected area.

9. Every person desiring to move any dog or cat within or out of an infected area shall make application .to an inspector for a permit so to do. Such application shall contain the following particulars:- (a) The name and place of abode of the owner of such animal; (b) The holding on which such animal is located; (c) The date on which it is desired to move such animal; (d) The place to which it is desired to move such animal; (e) The route .and the means .of .transport by which it is desired to move such animal. If the inspector is satisfied that such a movement is not likely to spread infection or disease he may grant a permit authorising such move­ ment upon such conditions as he may impose and embody in the permit. 10. No person shall move any dog or cat within or out of an infected area- (a) Unless he is the holder of a permit from an inspector authoris­ ing such movement; (b) In contravention of any condition embodied in a permit authorising such movement. 11. Every owner of a holding in an infected area on which any disease affecting poultry is found by an inspector or on which any such disease has been so found within the last preceding three months shall treat all animals on such holding to the satisfaction of an inspector in such manner and for such period as the inspector shall by notice in writing direct. 12. Every owner of poultry kept on a holding in an infected area shall isolate such poultry on such holding by confining such poultry in such a manner as to prevent such poultry from straying or flying from such holding. 13. No poultry slia"U be taken ihto any place whiCh is subject to an order of quarantine except for the purpose of immediate slaughter.

14. When an area is put under quarantine, so much of the surround­ ing country as is considered necessary by the inspector making the quar­ antine order may be declared a buffer area, and no poultry or fittings shall be removed from such area without written permission of an inspector, who shall inspect such poultry and fittings before granting such permission. 15. Every owner of a holding shall at all times keep and maintain such holding free of all rubbish and litter in, on or near the fittings on such holding by burning or otherwise· destroying sucli' rubbish and litter to· the satisfaction of an inspector. 16. Any inspector may before entering upon a holding to inspect poultry give at least twenty-four hours' notice in writing to the owner of such holding requiring him to confine all poultry on such holding or such poultry thereon as the inspector may specify in such notice in such a manner as will permit such inspector readily to inspect the same.

17. All diseased poultry shall be isolated by the person in charge thereof from healthy poultry, and all infected poultry shall be treated by the person in charge thereof to the satisfaction of the inspector, or shall' oe placed by the person in charge thereof in quarantine for such period as an inspector may direct. 18. Every owner of infected poultry kept on a holding shall isolate such poultry on such holding by confining such poultry to the satisfaction of an inspector in such manner and for such period as the inspector shall by notice in writing direct. · 19. When any poultry or fittings or any article or thing used in connection with poultry has been ordered to be destroyed, the inspector to whom the order has been dir~cted by the Minister shall, before G>ndeving. the destruction thereof, give notice of the order to the owner thereof (if known), either personally or by letter addressed to him through the Post Office at his place of business, or, if he has no known place of business, at his last known place of abode. 4 Regs. 20·22 REGULATIONS

20. In the event of it being considered necessary by an inspector, for the purpose of combating an outbreak of disease, to have diseased poultry destroyed, the carcasses of such poultry and all fittings or other things used in connection with such poultry, or which have been in contact with such poultry, shall be disposed of by burning or other means by the person in charge thereof, to the satisfaction of the inspector.

20A. ( 1 ) Where any holding placed in quarantine is infected with the disease of avian pneumoencephalitis the Chief Inspector shall give written notice that the holding is so infected to the occupier or if there is no occupier the owner either by serving him with the notice personally or by registered post. Any occupier or owner so served with a notice who, except with the permission in writing of the Chief Inspector, shall move or send or cause or permit or allow to be moved or sent from the holding during the period the holding is placed in quarantine any poultry, animal, carcass, eggs, manure, fittings, or any other thing whereby the said disease may be spread, shall be guilty of an offence. (2) The Minister may order the destruction or disposal of any poultry, animal, carcass, eggs, manure, fittings, or other thing in an infected area which area is infected with the disease of avian pneumoencephalitis when­ ever such destruction or disposal would tend to prevent the spread of the said disease of avian pneumoencephalitis. Any poultry, animal, carcass, eggs, manure, fittings, or other thing so ordered to be destroyed or disposed of shall be destroyed or disposed of in such manner as the Minister directs in his order or failing such direction in such manner as the Chief Inspector directs. Regulation 19 shall not apply in respect of any order made under this subregulation but a copy of such order shall be served either personally or by registered post upon the owner of anything ordered to be destroyed or disposed of by the Minister under this subregulation before the order is executed. (3) The Minister may upon the recommendation of the Advisory Board make a levy upon organisations representative ofor engaged in the poultry industry and in that event may cause the proceeds of such levy to be applied in paying such compensation as the Advisory Board shall recommend to owners of poultry, animals, carcasses, eggs, manure, fittings, or other things in an infected area as aforesaid destroyed or disposed of under this regulation. Except as aforesaid no compensation shall be paid to owners of poultry, animals, carcasses, eggs, manure, fittings, or other things in an infected area as aforesaid destroyed or disposed of pursuant to an order made under this regulation. 21. Any building or fittings, or place where diseased poultry have been kept, shall be treated by the person in charge thereof, by burning, disinfecting, or otherwise, to the satisfaction of the inspector.

22. No person shall send or cause to be sent on any aeroplane, railway, road, river or ship within the territorial waters of Queensland any infected poultry, fittings, or other thing likely to cause the spread of disease from any holding or place where diseased poultry have been kept. 22A. No person who is not a stock supplier shall supply, send or forward fowl eggs for hatching to a stock supplier except with the written permission of an inspector. Originally inserted by regulation published Gazette 25 April 1959, p. 2357; and substituted by regulation published Gazette 16 April 1966, p. 1983.

23. No person shall use or render down or otherwise prepare for use for food any poultry affected with disease, or any part of such poultry, or any blood or offal obtained from such poultry.

24. Poultry shall not be fed with meat, offal, or blood, unless such meat, offal, or blood has first been thoroughly cooked or desiccated.

25. No person shall, without previous notice in writing to an inspector, and the receipt thereafter from the inspector of a permit in writing so to do, kill or cause to be killed. any infected poultry, the flesh of which is intended for sale for the food of man.

26. No person shall sell or expose for sale, or cause or permit to be exposed for sale, any infected poultry, until such person has received written permission from an inspector so to do.

27. No person shall introduce any poultry into Queensland at any place other than a place of entry.

28. No person shall introduce any fowls into Queensland unless such fowls are accompanied by a declaration and certificate in or to the effect of the form in the First Schedule hereto in the case of day-old chickens and in or to the effect of the form in the Second Schedule hereto in the case of fowls other than day-old chickens: Provided that in the case of fowls other than day-old chickens- (a) If such fowls having been taken out of Queensland for exhibition at a fowls exhibition or fowls show in another State of the Commonwealth are being reintroduced into Queensland direct from and immediately after such exhibition such fowls may be exempted from the agglutination test for pullorum disease if the person who exhibited such fowls at such exhibition or show gave notice in writing to the Under Secretary, Department of Agriculture and Stock, Brisbane, of his intention to so exhibit such fowls and gave in such notice particulars of such fowls, the dates of intended departure from and return to Queensland, the route or routes by which such fowls were to be travelled to and from such exhibition or show, the name of such exhibition or show, and the place where such exhibition or show was to be held, and thereupon obtained from the said Under Secretary a certificate of exemption from such test. Such certificate of exemption shall be produced to the Chief Veterinary Surgeon, the District Veterinary Officer, or the Inspector of Stock to whom application is made for a certifieate in the form in the Second Schedule, and such Chief Veterinary Surgeon, District Veterinary Officer, or Inspector of Stock, as the case may be, shall, before he issues such certificate, strike out and initial that portion of the certificate which relates to the agglutination test for pullorum disease and endorse the certificate "Special Exemption. Exhibited fowls only." 6 Regs. 28A-31 REGULATIONS

(b) If such fowls are being introduced into Queensland from another State of the Commonwealth solely for the purpose of exhibition at a fowls exhibition or fowls show in Queensland, such fowls may be exempted from the agglutination test for pullorum disease, provided that such fowls are to be returned to such State direct from and immediately after such exhibition. In the event of such fowls being exempted from such test the Chief Veterinary Surgeon, the District Veterinary Officer, or the Inspector of Stock, to whom application is made for a certificate in the form in the Second Schedule shall, before he issues such certificate, strike out and initial that portion of the certificate which relates to the agglutination test for pullorum disease and endorse the certificate "Special exemption. Exhibited fowls only." (c) If such fowls are being introduced into Queensland from New South Waks solely for the purpose of slaughter, such fowls may be exempted from the agglutination test for pullorum disease. In the event of such fowls being exempted from such test the Chief Veterinary Surgeon, the District Veterinary Officer, or the Inspector of Stock to whom the application is made for a certificate in the form in the Second Schedule shall, before he issues such certificate, strike out and initial that portion of the certificate which relates to the agglutination test for pullorum disease and endorse the certificate, "Special Exemption-Fowls for Slaughter only." No person shall introduce fowl eggs for hatching into Queensland unless such eggs are accompanied by a declaration and certificate in or to the effect of the form in the Eighth Schedule hereto. Inserted by regulation published Gazette 13 November 1948, p. 2686. 28B. No person shall introduce ducks, turkeys, geese, guinea fowl, or pigeons into Queensland unless such ducks, turkeys, geese, guinea fowl, or pigeons, as the case may be, are accompanied by a declaration and certificate in or to the effect of the form in the Ninth Schedule hereto. Inserted by regulation published Gazette 13 November 1948, p. 2686; and amended by regulation published Gazette 9 June 1951, p. 686. 29. All poultry which are to be introduced into Queensland shall be examined by an inspector at a place of entry, and upon such inspector being satisfied that such poultry are not infected poultry he shall permit such poultry to be so introduced. 30. If an inspector is doubtful whether any poultry introduced by sea are or are not infected, he may temporarily detain them on board ship and cause them to be treated to his satisfaction, or may cause them to be removed to some other ship or to some safe place, at the risk and expense of the owner, there to be quarantined and treated to the satisfaction of the inspector. 31. No carcass of, or fitting or other matter or thing used in connection with, introduced poultry which arrive by ship and which are infected poultry, shall be removed by any person from the ship in which it arrives, except by the written permission and under the supervision of an inspector, and then only to a place to be named by the inspector, there to be dealt with or disposed of as the inspector directs. 32. Every person shall, not less than four nor more than fourteen days, before he introduces any poultry into Queensland, give notice in writing of the proposed introduction of such poultry to the Under Secretary, Department of Agriculture and Stock, Brisbane. He shall set out in such notice the manner in which such poultry are to be introduced, whether by road, railway, sea, or air, and the proposed place of entry. 33. Any inspector may at any time inspect any poultry on any run, holding, saleroom, road, or place. 34. Where an inspector is of opinion that any poultry are infested with poultry lice, poultry ticks, or stickfast fleas he may serve on the owner or person in charge of such poultry a notice in the form of the Third Schedule hereto, requiring him to dip such poultry within the period specified in such notice. Thereupon such poultry shall be dipped by the owner or person in charge in accordance with such notice. 35. The dip shall be a dip approved by the inspector. In any case where the inspector is not satisfied with the dip, he may order such alteration to be effected as he may consider necessary, and such alterations shall be made forthwith. 36. The preparation to be used for the dipping of the poultry shall be one of the recognised proprietary dips to be used of a strength of 1 to 200 parts water, or such other preparation as may be directed by the inspector. 37. The poultry shall be thoroughly immersed in the bath for a sufficient length of time to allow of a complete wetting of the feathers and skin. 38. If in the opinion of the inspector it is desirable to spray or disin­ fect any fittings, yards, shed, or other buildings where poultry are or have been found to be infested. with poultry lice, poultry tick, or stickfast flea, or infected with disease he may order the owner or person in charge of the poultry to carry out such spraying or disinfection of such yards or build­ ings, with an approved spray or disinfectant, in such manner as he may direct, and the owner or person in charge shall carry out such disinfection accordingly.

Part 2

STOCK SUPPLIERS Definitions 39. In this Part the following terms have the meanings set against them respectively, that is to say:- "Stock Supplier"-Any person who carries on, either alone or in connection with any other business, the business of- (i) Hatching chickens for sale; or (ii) Supplying fowl eggs for hatching; or (iii) A poultry dealer, or all or any two of such businesses. "Chicken"-The young of any fowl. 8 Regs. 40,41 REGULATIONS

Accommodation and equipment 40. No stock supplier shall keep or cause or allow to be kept any fowls on the holding or premises on which he carries on his business of a stock supplier unless such fowls are provided with accommodation in accordance with the following provisions:- ( a) For fowls over twenty-four weeks of age the fowl-house shall provide a minimum floor area of two square feet per fowl when such fowls are kept in a house with an adjoining run and the fowlhouse shall provide a minimum floor area of three and one-half square feet per fowl when such fowls are kept in a fowlhouse which is not provided with an adjoining run. (b) For fowls over sixteen weeks of age and under twenty-four weeks of age the fowlhouse shall provide a minimum floor area of one and two-thirds square feet per fowl in fowlhouses when such fowls are kept in a house with an adjoining run, and the fowlhouse shall provide a minimum floor area of three square feet per fowl when such fowls are kept in a fowlhouse which is not ,provided with an adjoining run. (c) For fowls over ten weeks of age and under sixteen weeks of age the fowlh0use shall provide a minimum floor area of one and one-third square feet per fowl in fowlhouses when such fowls are kept in a fowlhouse with an adjoining run, and the fowlhouse shall provide a minimum floor area of two and two-thirds square feet per fowl when such fowls are kept in a fowlhouse which is not provided with an adjoining run. (d) For fowls over six weeks of age and under ten weeks of age the fowlhouse shall provide a minimum floor area of one square foot per fowl when such fowls are kept in a fowlhouse with an adjoining run, and the fowlhouse shall provide a minimum floor area of two square feet per fowl when such fowls are kept in a fowlhouse which is not provided with an adjoining run. (e) For fowls from six days of age to six weeks of age the fowl­ house shall provide a minimum floor area of one-third square foot per fowl in fowlhouses when such fowls are kept in a house with an adjoining run, and the fowlhouse shall provide a minimum floor area of one-third square foot per fowl when such fowls are kept in a fowlhouse which is not provided with an adjoining run. (f) Fowls less than six days old shall be kept in an incubator, incubator room, brooder, or in such other place as an inspector is satisfied provides adequate safeguards against overheating and/ or chilling of such fowls. 41. A stock supplier shall not maintain chickens in a battery brooder unless such brooder provides a minimum accommodation for the chickens kept therein in accordance with the following provisions:- (a) For chickens from one to six days of age the brooder shall provide a floor area of not less than one square foot for every twelve chickens accommodated in such brooder; REGULATIONS Rep.41A-4l 9

(b) For chickens from one to three weeks of age the brooder shall provide a floor area of not less than one square foot for every six chickens accommodated in such brooder; (c) For chickens from three to five weeks of age the brooder shall provide a floor area of not less than one square foot for every three chickens accommodated in such brooder; (d) For chickens from five to six weeks of age the brooder shall provide a floor area of not less than one square foot for every two chickens accommodated in such brooder.

41A. A stock supplier shall not sell, pack, ship, transport, forward, or deliver chickens in any container unless such container complies with the following provisions:- (i) The container shall be in a sanitary condition; (ii) The container shall be effectively ventilated; (iii) The container shall not be readily collapsible; (iv) The container shall not be less than four and one-half inches in height; (v) The container shall provide not less than the following mini- mum floor space:- For 12 chickens, 66 square inches. For 25 chickens, 96 square inches. For 50 chickens, 187 square inches. For 100 chickens, 357 square inches. Provided, however, in any particular case chickens may be kept, packed, sold, shipped, transported, forwarded, or delivered in a container approved by an inspector. 41B. A stock supplier shall at all times keep and maintain his holding and/or premises free from rubbish of all kinds by burning such rubbish or otherwise destroying such rubbish to the satisfaction of an inspector. Inserted by regulation published Gazette 16 May 1953, p. 413.

Hygienic condition vf hatcheries 42. A stock supplier engaged in the business of hatching chickens for sale shall- (a) Keep the room in which any incubator is operated in a clean and sanitary condition at all times; (b) After each hatch is taken off remove and thoroughly wash in an efficient germicidal solution all hatching trays and loose fittings; (c) Where the hatching has taken place in an incubator with a separate hatching compartment, after each hatch remove by vacuum cleaner or brush the dust and fluff from the hatchino compartment and wash or spray the interior surface of th~ hatching compartment and any fittings therein with an efficient germicidal solution; 10 Reg. 43,44 REGULATIONS

(d) Where the hatching has taken place in an incubator which has not a separate hatching compartment fumigate the interior of such incubator with formaldehyde gas using 1t ounces of .formalin ( 40 per cent. formaldehyde) and i of an ounce of potassium permanganate for each 100 cubic feet space; provided that when eggs have been set in such incu­ bator about the time the hatch takes place, this Regulation shall be complied with if such incubator is so fumigated between the period of 72 hours after and 96 hours after such eggs were set; (e) Provide for the use of any person employed by him to deter­ mine the sex of day-old chickens an ample supply of clean water, hand basin, and germicidal solution for ablutionary purposes. 43. Every person employed by a stock supplier for the purpose of determining the sex of day-old chickens shall be provided by the stock supplier with a dust coat or overalls which such person shall wear whilst engaged in determining the sex of day-old chickens. Every person employed in determining the sex of day-old chickens shall thoroughly cleanse his hands prior to and upon completion of the work of the determination of the sex of day-old chickens with the water and germicidal solution supplied by the stock supplier. Quality and number of fowls and size of eggs 44. (a) A stock supplier shall not have or keep any fowl over the age of sixteen weeks as on the first day of May in any year that has not proved negative to a blood test for pullorum disease at such intervals as may be directed by the Chief Inspector; (b) The Chief Inspector may, at his discretion, direct that fowls for breeding purposes only be submitted to a blood test for pullorum disease where such fowls are confined permanently within a shed or sheds not provided with an outside run or runs and where such fowls are not adjacent to that part of the flock which is not used for breeding purposes; (c) Should the percentage of positive reactors to the blood test for pullorum disease where breeding birds only are tested exceed point five per centum, all fowls of or belonging to the stock supplier on his or her premises must be submitted to such further blood tests for pullorum disease at such intervals as may be directed by the Chief Inspector; (d) A stock supplier shall not use for breeding purposes any fowls that have not been approved by an inspector as suitable for breeding purposes; (e) A stock supplier shall keep separate from fowls that have been approved by an inspector any fowls brought to his premises or holding until such fowls have been approved by an inspector; (f) A stock supplier shall not use for hatching purposes any egg less than two ounces in weight; (g) A stock supplier shall not keep less than forty fowls of any one breed, hybrid, or variety; (h) A stock supplier shall not set eggs in an incubator other than eggs supplied by a stock supplier *except eggs supplied by a stock supplier except eggs supplied, sent or forwarded for hatching in accordance with the written permission of an inspector. Substituted by regulation published Gazette 2 April 1960, p. 1601. * The repeated words "except eggs supplied by a stock supplier" should not have appeared in the final printing of the original amendment. Notification of pullorum disease and isolation 45. (a) Every stock supplier shall, when pullorum disease appears among his fowls, or before the expiration of one week after the appearance of such disease, give notice thereof to the nearest inspector or to the Under Secretary, Department of Agriculture and Stock. (b) He shall also forthwith, as far as practicable, separate and continue to keep separate all such diseased fowls from fowls not affected with disease. (c) He shall submit as directed by an inspector to a laboratory of the Department of Agriculture and Stock, specimens of any fowl or fowls infected or suspected of being infected with disease.

Eggs obtained for the business of hatching chickens for sale 46. ( 1) A stock supplier carrying on the business· of hatching chickens for sale shall not for the purpose of such business obtain eggs other than eggs the produce of fowls kept in or upon the premises in respect of which he is registered: Provided that such stock supplier may obtain for the purpose of such business from any other stock supplier eggs which are the produce of fowls kept in or upon the premises of such other stock supplier. (2) A stock supplier shall not supply to any stock supplier carrying on the business of hatching chickens for sale any eggs for the purpose of such business other than eggs the produce of fowls kept in or upon the premises in respect of which he is registered.

General 47. Within one month after the thirty-first day of December in each year every person who was a registered stock supplier carrying on the business of supplying day-old chickens, during the whole or any part of the period of twelve calendar months next immediately preceding the said thirty-first day of December, shall furnish to the Under Secretary at Brisbane a return setting out the number of day-old chickens, pullet day-old chickens, and cockerel day-old chickens sold by him during the whole or any part of that period of twelve calendar months as the case may be. 48. Every person for whom any fowls are tested for pullorum disease by an authorised officer of the Department of Agriculture and Stock shall pay to the Under Secretary of that Department for each day on which testing of such fowls is carried out a fee of Five dollars and forty cents for the first hundred fowls or part thereof tested and for numbers of fowls in excess of one hundred a further fee at the rate of One dollar and seventy cents per hundred. Fees 49. ( 1 ) The Chief Inspector may refuse to grant or renew a registration of any stock supplier or may cancel any such registration already issued if the business of any such stock supplier (having regard to the nature and extent thereof) does not possess proper and sufficient accommodation and equipment as prescribed or such premises is not properly maintained and kP.pt in an hygienic condition. 12 Reg. 50 REGULATIONS

(2) Every registered stock supplier shall pay to the Under Secretary an annual registration fee of Five dollars for and in respect of each business carried on by him. SLAUGHTERING OF POULTRY FOR SALE FOR HUMAN CONSUMPTION, AND EGG STANDARDS 50. ( 1) The owner of premises used for the slaughter of poultry for sale for human consumption shall provide at such premises- (a) An adequate supply of clean water conveniently situated for the use of each person employed in the slaughter of poultry; (b) An adequate supply of hot water for cleansing and sterilising utensils and equipment; (c) An adequate number of bars on which poultry may be suspended for slaughter or hung after slaughter. Such bars shall be of metal or of a material approved in writing by an inspector; (d) An adequate number of tables or benches on which the carcasses of poultry may be placed after slaughter. Each table or bench shall be fitted with a galvanised iron top or with a top of a material approved in writing by an inspector. Every such top shall be maintained in a state of good repair at all times; (e) A galvanised iron or steel bin or bins in which shall be placed all viscera and refuse resulting from the slaughter of poultry; (f) A galvanised iron or steel bin or bins in which all feathers shall be placed; (g) An adequate number of cages made of metal for holding poultry immediately prior to slaughter. Such cages shall be capable of being easily cleaned; (h) An adequate number of enclosures in which poultry may be kept pending slaughter. Such enclosures shall be so placed as not to create a nuisance. Such enclosures shall be maintained in an hygienic manner to the satisfaction of an inspector; (i) A wire-gauze frame of one sixteenth of an inch mesh for each opening in such premises. Every such gauze frame shall completely cover the opening for which it is provided and shall be maintained in a state of good repair at all times. REGULATIONS Reg. SO 13

(2) No person shall use or suffer to be used any premises for the slaughter of poultry for sale for human consumption unless- ( a) Such premises are used solely for the slaughter of poultry for sale for human consumption; (b) The area of the floor space of such premises is in the opinion of an inspector sufficiently large to cope with the slaughtering to be performed; (c) The floor of such premises is of concrete or some other material impervious to· water and constructed in such a manner as to prevent liquid from lying thereon; (d) The floor of such premises is provided with drains for carrying off liquid, and such drains are provided with catch pits to stop all feathers, viscera, and refuse from entering any other drain or sewer; (e) The floor and drains of such premises are kept free of accumulations of refuse; (f) The walls of such premises are of a height of at least eight feet and have their internal surfaces covered with tightly fitting fibro-cement sheets or other approved non-absorbent material to a height of five feet. Where such internal surfaces are covered with fibro-cement sheets supporting studs are to be backed with timber to form a solid base to the satisfaction of an inspector. All interstices are to be covered with fibro­ cement cover strips or other approved material; (g) The roof of such premises is provided with a ceiling at least eight feet from the floor level. Such ceiling shall be con­ structed of timber at least three-quarters of an inch in thick­ ness or of other approved material; (h) The internal surfaces of such walls when constructed of fibro-cement sheets and the ceilings of such premises are painted with a white non-poisonous paint to the satisfaction of an inspector; (i) Such premises are constructed in such a manner as to permit of the entry of natural lighting to the satisfaction of an inspector or are provided with artificial light to the satisfaction of an inspector; (j) Such premises and the equipment at such premises are kept thoroughly cleansed with the aid of water, and during the process of slaughter are kept in a reasonable state of cleanli­ ness and tidiness to the satisfaction of an inspector. ( 3) The· occupier of premises used for the slaughter of poultry for sale for human consumption shall cause- ( a) Each opening in such premises to be covered and kept covered with the wire-gauze frame provided for such opening at all times while such premises are being so used; (b) Each door in such premises to be fitted with a self -closing device and to be kept closed except when in use for ingress or egress; (c) All feathers, viscera, and refuse to be removed from such premises at least once in each day; (d) All liquid falling on the floor of such premises to be conveyed therefrom by drains; 14 Reg. (e) All poultry to be slaughtered within that area of the premises where all openings are covered with wire-gauze frames. ( 4) The occupier of premises used for the slaughter of poultry for sale for human consumption shall keep at such premises a book called a "Poultry Slaughter Book," in which shall be correctly entered immediately after each slaughter of poultry the date, the number, description, and variety of poultry slaughtered, and the names and addresses of the persons by whom or on whose behalf such poultry were delivered for slaughter. (5) No person shall deliver or receive at any premises used for slaughter of poultry for sale for human consumption- ( a) Any diseased poultry; or (b) The carcass of any poultry which has died or been killed before it could be delivered at such premises. (6) If an inspector is satisfied after inspection of any premises used . for the slaughter of poultry for sale for human consumption that- ( a) Such premises or any equipment or utensils kept at or on such premises are in an unclean or unwholesome condition; or (b) Any poultry at or on such premises are diseased or unfit for sale for human consumption; or (c) Such premises do not comply with the provisions of this Regulation; such inspector may by order in writing under his hand- (i) Require the occupier of such premises forthwith to cleanse, disinfect, and render wholesome such premises, eqmpment, and/or utensils, and such occupier shall so comply with such order; (ii) Require the occupier of such premises to slaughter such diseased or unfit poultry and to destroy the carcass thereof either by burning or by smearing and injecting with kerosene or by treating with an approved chemical, and such occupier shall so comply with such order; (iii) Require the owner of such premises to cause such premises to comply with the provisions of this Regulation within a time specified in such order, and such owner shall so comply with such order. (8) When poultry have been sold privately or at auction or other­ wise and slaughtered within forty-eight hours of such sale, the vendor shall refund on demand the purchase price of any poultry condemned by an inspector as unfit for the food of man. The buyer shall demand, and shall take all necessary proceedings to obtain such refund within a period of three months from the date of such sale. (9) When poultry are sold privately or at auction or otherwise and purchased by poultry dealers for consignment to slaughter-houses for poultry, and where such poultry on subsequent slaughter within forty-eight hours of such sale are condemned by an inspector as unfit for the food of man, such poultry dealer shall refund to the owner of the slaughter­ house for poultry the full purchase price paid by such owner for all such carcasses in accordance with Regulation 50 ( 8) hereof, the provisions of which shall, mutatis mutandis, extend and apply to every such transaction between a dealer and an owner of a slaughter-house for poultry. In these Regulations 50 and 50A the following terms have the meanings set against them respectively, that is to say: "Approved"-Approved by the Poultry Slaughtering Officer. "Poultry Slaughtering Officer"-The Poultry Slaughtering Officer appointed under these Acts; this term includes any person for the time being discharging the duties of that office. "License"-A license granted, renewed, or transferred by the Poultry Slaughtering Officer in accordance with the provisions of these Acts and Regulations. "Owner"-The owner, lessee, licensee, or occupier, whether jointly or severally, having charge or control of any slaughter-house for poultry, or the authorised agent or the superintendent of the owner. "Slaughter-house"-Any place with its buildings and appurtenances ·kept or used for the slaughtering of poultry for human consumption provided that the term · does not include any place where any poultry are slaughtered solely for the use and consumption of the owner of such poultry or the members of his family." 50A. ( 1) No person shall slaughter at any place other than at a licensed slaughter-house for poultry any poultry the flesh of which is intended to be used for the food of man: provided that this clause shall not apply to poultry killed solely for the use and consumption of the owner of such poultry or of the members of his family. (2) Any person who establishes or keeps an unlicensed slaughter­ house for poultry shall be guilty of an offence against these regulations. (3) A person shall not be entitled to hold a license for a slaughter­ house for poultry unless he is of, or over the age of twenty-one years, and is the owner thereof, whether jointly or severally, or the authorised agent, manager, or superintendent of the owner or the occupier of such slaughter-house for poultry. (4)- ( a) Every person who desires to obtain a license or the renewal of a license for a slaughter-house for poultry shall make an application therefor in writing to the Poultry Slaughtering Officer in the form of Schedule 11 hereto, as the case may require or to the like effect. Upon the granting of a license for a slaughter-house for poultry, the Poultry Slaughtering Officer shallissue a license in the form of Schedule 12. REGULATIONS Reg.50A 17

(b) Every person who desires to obtain a transfer of a license for a slaughter-house for poultry shall make application therefor in writing to the Poultry Slaughtering Officer in the form of Schedule 13.

(5) The annual fee payable in respect of a license for a slaughter­ house for poultry or the renewal of any such license shall be ten dollars. Such annual fee for the first year shall accompany the application and for the second and each subsequent year shall be paid within thirty days after the First day of January in each year. The transfer fee for any such license shall be two dollars. Such transfer fee shall accompany an application for the transfer of a license in the form of Schedule 13.

( 6) The Poultry Slaughtering Officer may refuse to grant or renew or transfer a license for a slaughter-house for poultry or may cancel any such license already issued if such premises used for the slaughter of poultry are not built as prescribed or do not possess proper and sufficient accommodation or proper and sufficient equipment as prescribed; or are not properly maintained and kept in an hygienic matter; or if the appropriate fee for the renewal of such license has not been paid before the Thirty-first day of January in each year, the Poultry Slaughtering Officer may cancel such license.

( 7) The Poultry Slaughtering Officer may grant a license for a slaughter-house for poultry to an applicant over the age of twenty-one years subject to the following conditions:- (i) The owner of the slaughter-house for poultry submits the prescribed application and pays the prescribed fee in accord­ ance with Clauses 4 and 5 of this regulation. (ii) The premises are so constructed, so maintained, and so equipped as to comply in all respects with the provisions of these regulations. (iii) The owner submits evidence that the establishment and opefation of a slaughter~house for poultry, does not in any way, contravene any ordinance or ordinances of a Local Authority: Provided that the Poultry Slaughtering Officer may grant a pr~ visional license for a slaughter-house for poultry for a period not exceeding three months to enable an applicant to execute such repair work as is in the opinion of the Poultry Slaughtering Officer necessary to render any premises suitable and proper for the slaughter of poultry. The Poultry Slaughtering Officer may in his absolute discretion grant one further provisional license for a period of three months. When a license for a slaughter-house for poultry is granted by the Poultry Slaughtering Officer following a provisional license for such slaughter-house for poultry the date of commencement of such license shall be deemed to be from the date of the granting of such provisional license. The fee for a provisional license shall be ten dollars which amount shall be deemed to be the annual fee payable in respect of the license for such slaughter-house for poultry when such license is granted by the Poultry Slaughtering Officer. 18 Reg, 50A REGULATIONS

( 8) The fees payable by the owner of a licensed slaughter-house for poultry for the purposes of defraying the expenses of inspection of poultry and poultry carcasses offered for sale shall be at the rate of 5c for every twenty-four head of poultry or part thereof slaughtered thereat. Such fees shall be paid by the owner to the inspector on the last day of each month and be accompanied by the return in the form of Schedule 14 hereto: Provided that if less than 500 poultry are slaughtered monthly alL any licensed slaughter house for poultry,, the owner may elect, with the prior approval in writing of the PouLtry Slaughtering Officer, to pay all fees due at three monthly intervals, such fees to be paid on the last day of each period of three months and to be accompanied by the return in the form of Schedule 14 hereto for each of the three months for which fees are payable. Such return shall contain the particulars thereby required in respect of all poultry slaughtered at the slaughter-house during the month. Such return shall include a declaration by the person signing it to the effect that the particulars shown in such return are correct. Such return shall be signed by the owner, or where the owner is a body corporate, by the manager, secretary, public officer, or legally appointed attorney of or for such body corporate. (9) The owner of a licensed slaughter-house for poultry shall be responsible for:- (i) The maintenance of cleanliness and proper sanitary conditions throughout his licensed premises; (ii) The cleanliness of the outer garments of employees handling any carcass; (iii) The thorough and regular disinfection of all knives and equipment; (iv) The thorough cleansing of floors, drains, traps, benches, tables, receptacles and utensils at least once daily with an approved cleansing substance; ( v) The washing of their hands by employees after visiting the privies. (10) The owner of a licensed slaughter-house for poultry shall not permit:- (i) The use of hessian or material of a similar nature as pro­ tective outer garments of employees except in compartments under refrigeration; (ii) Smoking or expectorating in any department of licensed premises containing any poultry carcass; (iii) The chewing of tobacco, the placing of knives in the mouth, the testing of any container used for the packaging of poultry carcasses with air from the mouth, or the sucking of air from any container used for packaging carc::tsses by means of the mouth; (iv) Any person suffering from an infectious disease whether notifiable by law under the Health Acts or not or suffering from objectionable or contagious skin infections, or any REGULATIONS Regs. 51,52 19

person who has unclean or medicated bandages on his person, to take part or be employed in the handling, conveyance or treatment of any poultry carcass; ( v) Any dog, or cat to enter a slaughter-house for poultry. Egg Standards 51. The following shall be classes of eggs for the purposes of these Regulations- " Hen Eggs"-That is to say the eggs of the domesticated fowl. "Duck Eggs"-That is to say the eggs of the domesticated duck. "Chilled Hen Eggs"-That is to say hen eggs which have been subjected to the 'J!>rocess of chilling but have not been subjected to any other preservative treatment. "Chilled Duck Eggs"-That is to say duck eggs which have been subjected to the process of chilling but have not been subjected to any other preservative treatment. "Preserved Hen Eggs"-That is to say hen eggs which have been subjected to any preservative treatment other than the process of chilling. "Preserved Duck Eggs"-That is to say duck eggs which have been subjected to any preservative treatment other than the process of chilling.

Chilling of Eggs 52. ( 1 ) In the process of chilling, eggs shall be placed in a cold storage chamber, the temperature of which shall not be higher than 35 degrees Fahrenheit. (2) No cold storage chamber shall at any time be used for the chilling of eggs unless such chamber is at that time used solely for such purpose and ~s free from all foreign odours. (3) No person shall, without the authority in writing of the Chief Inspector, subject any hen egg or duck egg to the process of chilling unless- ( a) The shell of such egg is clean, uncracked, and free from stains; and (b) Such egg, when candled, is free from blood spots, diffused blood, meat spots, or other impurities, the yolk is translucent or but faintly visible, the white is translucent and firm, and the air cell is fixed and not more than three-sixteenths of an inch in depth. 20 Regs. 53,54 REGULATIONS

( 4) No person shall, without the authority in writing of the Chief Inspector, place any hen egg or duck egg in a cold storage chamber unless such egg has been marked in accordance with the provisions of Regulation 53 of these Regulations. (5) No person shall place any hen egg or duck egg in a cold storage chamber unless- ( a) Such egg has first been packed large end uppermost in a new white odourless filler and flat made of wood plup board, or of a material approved in writing by the Chief Inspector; and (b) Such egg so packed has been further packed in a clean case, constructed of well seasoned softwood or of hardwood which has been smoothly sawn or dressed, or of a material approved in writing by the Chief Inspector. (6) No person shall pack any duck egg in the same case as a hen egg. (7) The person in charge of a cold storage chamber used for the process of chilling shall not, without the authority in writing of the Chief Inspector, accept for chilling in such cold storage chamber any egg which does not comply with the provisions of this Regulation, or which has not been packed in accordance with the provisions of this Regulation.

Marking of Chilled Eggs 53. ( 1 ) Every hen egg and every duck egg shall before chilling be marked on the large end thereof in green indelible ink with a mark circular in shape having an inside diameter not greater than five eighths of an inch. Such mark shall contain within the upper portion thereof the words "Chilled" printed along the inside circumference and within the lower portion thereof the name of the person, firm, company, or organisation delivering such egg for chilling. The address of such person, firm, com­ pany, or organisation may also, if desired, be included within the lower portion of such mark. Each word shall be printed in green indelible ink in sanserif capital letters of eight point full face measurement (condensed type). (2) Such mark and particulars shall be marked on each such egg by the person, firm, company, or organisation delivering such egg for chilling. (3) Any person, firm, company, or organisation who marks any chilled hen egg or chilled duck egg with a mark other than the mark hereinbefore prescribed, or who includes within such mark any particulars other than the particulars hereinbefore prescribed, or who removes, alters, or interferes with any prescribed mark or with any prescribed particulars shown within such mark, shall be guilty of an offence.

54. No person shall sell any chilled hen egg or chilled duck egg unless such egg- (a) Bears the mark and particulars prescribed in Regulation 53 of these Regulations; and (b) Is clean and free from stains; and (c) When candled, after removal from the cold storage chamber, is free from blood spots, diffused blood, meat spots, or other impurities, the white is reasonably firm and clear and the air cell is not greater than three-eighths of an inch in depth. Part 4

GENERAL 55. The forms set forth in the Schedules hereto, with such modifica­ tions as the circumstances may require, shall be used for the purposes for which they are respectively applicable, provided that no such form shall be deemed to be invalid if it is to the like effect of the respective form in the said Schedules set forth, with such modifications as the circumstances may require. 56. Every day-old chicken the sex of which has been determined to be male by a person licensed under this Act as a person qualified to determine the sex of day-old chickens shall be marked by such person with a violet indelible stain, which shall be applied to the plumage of such chicken in such quantity as to render such stain readily discernible. The application of this stain shall be made immediately after the work of determining the sex of day-old chickens on the day such determination is made. 56A. Examination for a license, first class, of a person qualified to determine the sex of day-old chickens under section 18 (c) of this Act shall consist of the sexing of a total of four hundred such chickens com­ prising two lots equal in number and of different breeds or crosses between breeds in not more than sixty minutes with an accuracy of at least ninety-seven per cent.: Provided that the percentage error with either those day-old chickens determined by the examinee as males or those determined as females shall not exceed four per cent. Examination for a license, second class, of a person qualified to determine the sex of day-old chickens under section 18 (d) of this Act, shall consist of the sexing of a total of two hundred such chickens com­ prising two lots equal in number and of different breeds or crosses between breeds in not more than forty minutes with an accuracy of at least ninety-three per cent.: Provided that the percentage error with either those day-old chickens determined by the examinee as males or those determined as females shall not exceed eight per cent. No agent shall be entitled to receive as commission, fees, charges; reward, or other remuneration for or in respect of services or transactions carried out by him in respect of the sale of poultry, any amount in excess of seven and a-half per centum of the gross amount received for the sale of su~h poultry. 58. ( 1) No person except- ( a) A veterinary surgeon registered under "The Veterinary Surgeons Acts, 1935 to 1946," (b) A person authorised in writing under the hand of the Under Secretary, Department of Agriculture and Stock, shall subject any fowls to a test for the disease known as pullorum disease which involves the use of any antigen or other biological product. (2) Any person who has subjected any fowls to a test for the disease known as pullorum disease which involves the use of antigen or other 11 Regs. 58A-61 REGULATIONS biological product shall, within two days thereafter, furnish a report in writing to the Under Secretary, Department of Agriculture and Stock, setting forth- (a) The name and address of the owner of the fowls; (b) The address of the holding where the fowls are kept; (c) The date and place of the test; (d) The description, including the sex of the fowls; (e) The nature of the test; (f) The results of the test with full particulars of same. ( 3) Any person who has subjected any fowls to a test for the disease known as pullorum disease which involves the use of any antigen or other biological product shall, immediately such test is complete, brand any fowl giving a positive reaction to the test by removing a piece from each wattle with the aid of a pair of pliers approved by the Chief Inspector, such mark to be made to a depth of half an inch in all cases where the wattle permits and to a maximum depth where the wattles are not fully developed. No person shall vaccinate _poultry with a living infectious­ laryngo-tracheitis virus unless a permit for such vaccination shall have been granted by the Chief Inspector. Inserted by regulation published Gazette 8 November 1952, p. 1136. 58B. Any person who, in pursuance of a permit, vaccinates any poultry with a living infectious-laryngo-tracheitis virus shall, within two days thereafter, furnish to the Chief Inspector at Brisbane a report in writing stating the owner, number, and location of the poultry vaccinated, and the name of the vaccine used. Inserted by regulation published Gazette 8 November 1952, p. 1136. 59. No person shall remove in whole or in part the wattles of female fowls or brand the wattles of female fowls except for the purpose of branding fowls that have given a positive reaction to a test for pullorum disease. 60. No compensation shall be paid for the destruction of any poultry ordered to be destroyed under the provisions of section 29 (iii) of this Act.

Penalty 61. ( 1) Any person who contravenes or fails to comply with any provision of these Regulations shall, unless for such offence a penalty is expressly provided, be liable to a penalty not exceeding forty dollars, and, if such offence is continued after a conviction therefor, to a daily penalty of not more than four dollars for each and every day during which such offence is so continued. (2) When any proceedings are taken in respect of poultry under these Regulations, the Court may, notwithstanding any change that has taken place in the meantime in the ownership or possession of the poultry, give judgment against the owner of the poultry without any further name or description, and may by such judgment order that the amount of the judgment and costs be levied by seizure and sale of so many of the poultry as are necessary to satisfy the same. ( 3) If any stock supplier registered under the Act is convicted of an offence against these Regulations his ·registration shall be cancelled, and he shall be disqualified from again becoming so registered for such period as the Minister shall fix. 62. (i) Each member of the Poultry Advisory Board appointed in the manner described in paragraphs (d), (e), (f), (g), and (h) of subsection 2 of section 6 of the Acts shall be entitled to a fee of eight dollars forty cents ($8.40) for each day of meeting of that Board attended by him. (ii) Any such member not necessarily absent from his home over­ night for such attendance as aforesaid shall be paid a meal allowance at the rate prescribed by Regulation 79 ( 3) of the Regulations made under "The Public Service Acts, 1922 to 1965." (iii) Any such member necessarily absent from his home overnight for such attendance as aforesaid shall be paid the following additional allowances, namely:- (a) An allowance at the rate prescribed by Regulation 79 (i) (b) of the Regulations made under "The Public Service Acts, 1922 to 1965." (b) An allowance of four dollars twenty cents ($4.20) for each day preceding or succeeding the day or days of. meeting of the Poultry Advisory Board provided that such additional allowance shall not be payable in respect of any day on which the time he is absent from home is less than eight (8) hours. (iv) Each member shall be entitled to a reasonable refund of all fares incurred in travelling to and from the place of meeting of the Poultry Advisory Board: Provided that where a member so elects, he may be issued with a railway requisition for such journey or be paid in lieu thereof a sum equivalent to the money value of such requisition. 63. Nominations of persons for appointment as members of the Poultry Advisory Board (hereinafter in these Regulations referred to as "the Advisory Board") shall be called by the Minister from the bodies hereinafter in this Regulation named in the manner following, that is to say:- (a) Two representatives of the Egg Marketing Boards constituted for the time being under "The Primary Producers' Organisation and Marketing Acts, 1926 to 1965," in respect of whom nominations may be submitted by each or both of the following Egg Marketing Boards:- (i) The Egg Marketing Board; (ii) The Egg Marketing Board; 24 Regs. 64-71 REGULATIONS

Meetings of The Advisory Board 72. (a) The Poultry Advisory Board shall meet at such time on such date and at such place as the Board by resolution or otherwise from time to time determine. (b) Special meetings of the Board shall be called by the Minister upon receipt of a request in writing signed by not less than three members of the Board other than representatives of the Government: Provided that the Minister may at any time call a special meeting of the Board. (c) All the proceedings of the Board shall be entered in a minute­ book to be kept for that purpose, and the names of members present at each meeting shall be entered in such minute-book. (d) The order of business at each meeting shall be as follows:­ (i) Reading, amendment, confirmation, and signature by the chairman of the minutes of the last meeting and of any special intervening meeting; (ii) Business arising out of the minutes; (iii) Reports; (iv) Correspondence; ( v) Questions; (vi) Agenda; (vii) Other business. (e) The regular order of business may be suspended at any meeting by a vote of the majority of the members present. (f) Questions shall be decided viva voce: Provided that any member may require the votes be given by a show of hands and recorded in detail in the minutes. (g) At all meetings of the Board every member shall vote. If a member refuses to vote, his vote shall be counted for the negative. (h) No member shall speak to any question after it has been put by the chairman and a vote taken thereon. (i) In the absence of a member who has given notice of motion, any member present may move such motion. (j) A motion may be withdrawn or amended by the mover with the leave of the Board. (k) Any member proposing a motion or an amendment may be required to deliver it in writing to the chairman. (1) A motion or amendment shall not be discussed except by the proposer unless and until it has been seconded. (m) When amendments have been proposed and negatived or withdrawn, the question shall be put as originally proposed. (n) A question may be superseded- (i) By a motion "That the Board proceed with the next business"; (ii) By a motion "That the Board do now adjourn". ( o) A debate may be closed by the motion "That the question be now put" being proposed, seconded, and carried, which question shall be forthwith put without amendment or debate. (p) As soon as a debate upon a question shall be concluded the chairman shall put the question to the Board. 73. (a) Questions relating to the affairs of the Board may be put to the chairman, or through the chairman, to any member, but the chairman may disallow any question which in his opinion should not be put. HIS Excellency the Governor, acting by and with the advice of the Executive Council and in pursuance of the provisions of "The Poultry Industry Acts, 1946 to 1965," has been pleased to make the following amendments to "The Poultry Industry Regulations of 1946," to take effect as and from the First day of January, 1971. JOHN A. ROW. 1. Regulation 51 is amended- (a) By repealing the paragraph commencing "Duck eggs"; (b) In the paragraph commencing "Chilled Hen Eggs" by inserting after the word "chilling" the words "and whether with or without prior oiling"; (c) By repealing the paragraph commencing "Chilled Duck Eggs"; and (d) By repealing the paragraph commencing "Preserved Duck Eggs".

2. The following new ·Regulation 51A is inserted after Regulation 51:- "Quality Standards 51 A. ( 1) A person shall not sell a hen egg for human consumption unless such hen egg is a first quality hen egg provided that nothing in this Regulation contained shall prevent the sale of an egg other than a first quality hen egg if sold as egg pulp. (2) A first quality hen egg shall be a hen egg- (i) The shell of which is clean, uncracked and free from stain; and (ii) The shell of which is not thin or misshapen; and (iii) Which, when candled, is free from bloodspots or any inclusions whatsoever; and (iv) The yolk of which is translucent or faintly visible; and (v) The white of which is translucent and firm; and (vi) The air cell of which is fixed and is not more than one-quarter of an inch in depth and only slightly tremulous." 3. The following new Regulation 51B is inserted after Regulation 51A:- "Grade Standards S,IB. A person shall not sell a first quality hen egg unless such hen egg is graded according to the following standards:- (i) Hen eggs weighing less than 'It ounces each but not less than 1t ounces each with an average weight of not less than 18 ounces to the dozen shall be graded as "SMALL HEN Boos"; Gov. Gaz., 31st October, 1970, pages 820-2 2 (ii) Hen eggs weighing less than 2 ounces each but not less than 1t ounces each with an average weight of not less than 21 ounces to the dozen shall be graded as "STANDARD HEN Eoos"; (iii) Hen eggs weighing not less than 2 ounces with an average weight of not less than 24 ounces to the dozen shall be graded as "LARGE HEN EGGs"."

4. The following new Regulation 51c is inserted after Regulation 51B:- "Marking of Eggs According to Grade Standards 51c. (1) A hen egg shall, before being sold for human consumption be stamped with a mark which shall contain in the upper half thereof the grade standard of such egg and in the lower half thereof an identification symbol as allotted by the Chief Inspector to an Egg Marketing Board constituted for the time being under "The Primary Producers' Organisation and Marketing Acts, 1926 to 1965," or to any person engaged in the production of hen eggs for sale for human consumption in the State of Queensland. The allocation of such identifi­ cation symbol shall be subject to the following conditions:- (i) An Egg Marketing Board so constituted or a person so engaged in the production of hen eggs who, in the State of Queensland, sells eggs for human consumption shall make application in writing to the Chief Inspector for an identification symbol; ~(ii) Such Board or person shall satisfy the Chief Inspector that it or he is competent to grade eggs in accordance with Regulation 51A and 51B and that it or he has the necessary equipment so to do; (iii) The Chief Inspector may at any time subject to the approval of the Minister withdraw such identification symbol for good cause shown. Nothing in this Regulation contained shall be deemed to prevent an Egg Marketing Board or a person so allotted an identification symbol from including within the said mark a further identification symbol on its or his own behalf. Each letter or numeral shall be printed in sanserif capital letters of eight p(>int full face measurement (condensed type). (2) An Egg Marketing Board or a person referred to in sub-regulation ( 1) of this Regulation shall before selling an egg for human consumption, grade and mark such egg or cause it to be graded and marked in accordance with the requirements of these Regulations. (3) The following marks shall be used and the following letters included therein to describe the grade standard of each egg:- (i) The mark for a "Small Hen Egg" shall be in a violet indelible ink, circular in shape having an inside diameter not greater than five-eighths of an inch and ·shall contain in the upper half thereof the letters "SML" which shall designate the grade standard "SMALL HEN EGG"; (ii) The mark for a "Standard Hen Egg" shall be in a violet indelible ink, circular in shape having an inside diameter not greater than five-eighths of an inch and shall contain in the upper half thereof the letters "STD" which shall designate the grade standard "STANDARD HEN EGG"; 3 (iii) The mark for a "Large Hen Egg" shall be in a violet indelible ink, circular in shape having an inside diameter not greater .than five-eighths of an inch and shall contain in the upper half thereof the letters "LGE" which shall designate the grade standard "LARGE HEN EGG".

( 4) A person shall not sell for human consumption a hen egg which has not been stamped with a mark as herein­ before prescribed nor stamp a hen egg with a mark other than ·as hereinbefore prescribed, nor include within (such mark any particulars other than the particulars hereinbefore prescribed or permitted or -remove, alter or interfere with any prescribed mark or with any prescribed or permitted particulars shown within such mark. (5) A person shall not sell for human consumption a hen egg whereon the mark as prescribed is illegible."

5. The following new Regulation 51D is inserted after Regulation 51c:- "Obligation to Mark Eggs According to Grade Standards 51o. A person shall not- (i) Sell a hen egg or chilled hen egg unless (a) Such hen egg or such chilled hen egg has been stamped with a mark as prescribed in Regulation 51c of these Regulations; and (b) There is prominently displayed in a readable position attached to .the receptacle in which such hen egg or chilled hen egg is contained or upon any carton in which such hen egg or chilled hen egg is packed, a notice, placard or sign on which is legibly printed, stencilled, or written the grade of such hen egg or chilled hen egg; (ii) Affix to hen eggs for sale for human consumption or to any receptacle or carton used for ·the purpose of displaying such hen eggs, or use in relation to any such display, any notice, placard, or sign on which are particulars or terms other than .those used to describe hen eggs in Regulations 51A -and 51B of these Regulations unless such ·hen eggs are "chilled hen eggs" in which case they shall be described as "chilled hen eggs". (iii) Display for sale by retail a hen egg or chilled hen egg in such a position that it is exposed to the sun or contamination by animals, by odours or by any other means. (iv) Sell any eggs which are packed or contained in any ~ase, pa~kin? material, carton, receptacle or contamer which IS unclean or which has become contaminated by contact with any deleterious substance. ( v) Sell ·hen eggs of different grades in -the one receptacle or carton."

6. The following new Regulation 51B is inserted after Regulation Slo:- "Powers of an Inspector 51 B.. Subject to these R~gulations, an Inspector may­ ( I) Enter any place m upon or from which eggs are sold; 4 (ii) Inspect any eggs found therein and open any container or containers or package, or packages containing eggs or which is suspected .to contain eggs; (iii) Seize, detain and remove any eggs which after inspection he is satisfied are not classed or marked in accordance with the provisions of these Regulations."

7. Sub-regulation (3) of Regulation 52 is repealed and the following sub-regulation (3) is inserted in lieu thereof:- "(3) A person shall not without the authority in writing of the'Chief Inspector subject a hen egg to the process of chill­ ing unless such hen egg is a first quality hen egg and has been graded in accordance with the provisions of Regulation 51B of these Regulations."

8. Sub-regulation ( 4) of Regulation 52 is repealed and the following new sub-regulation ( 4) is inserted in lieu thereof:- "(4) Except with the written authority of the Chief Inspector, a person shall not place in a cold storage chamber for chilling a hen egg .that has not been stamped with a mark in accordance with the provisions of Regulation 53 of ·these Regulations. Such authority may be unlimited in time or be for any part-icular period stated :therein and in either case may be revoked by the Chief Inspector at his discretion".

9. Sub-regulation (5) of Regulation 52 is amended by deleting therefrom the words "or duck egg".

10. Sub-regulations (6) and (7) of Regulation 52 ·are repealed and the following new sub-regulation (6) inserted in lieu thereof:- "(6) Except with the written authority of the Chief Inspector, a person shall not accept for chilling in a cold storage chamber a hen egg whioh has not been packed in accordance with this Regulation or which has not been stamped with a mark in accordance with .the provisions of Regulation 53 of ·these Regulations."

11. Sub-regulation ( 1) of Regulation 53 is repealed and the following new sub-regulations (1), (2) and (3) of Regulation 53 inserted in lieu thereof:- "(1) Except as provided in Regulation 52 ( 4) of these Regulations, a hen egg shall before chilling be stamped with a mark in green indelible ink which shall contain in ·the upper half thereof the grade standard of suoh egg in accordance with the provisions of Regulation 51B of these Regulations and in the lower half thereof an identification symbol as allotted by the Chief Inspector. The word "CHILLED" shall appear in the centre of ·the mark. Each word or numeral shall be printed in sanserif capit.al letters of eight point full face measurement (condensed type). 5 {2) Such identification symbol shall be allotted in accordance with .the provisions of Regulation 51c of these Regulations. (3) The following marks shall be used .and the following letters included therein to describe the grade standard of each egg:- (i) The mark for a "Chilled Small Hen Egg" shall be circular in shape having an inside diameter not greater .than five-eighths of an inch and shall contain in the upper half thereof the letters "SML" which shall designate the grade standard "SMALL HEN EGo"; (ii) The mark for a "Chilled Standard Hen Egg" shall be circular in shape having .an inside diameter not greater than five-eighths of an inch and shall contain in ·the upper half thereof the letters "STD" which shall designate th~< grade standard "STANDARD HEN EGo"; (iii) The mark for a "Chilled Large Hen Egg" shall be circular in shape having an inside diameter not greater than five-eighths of an inch ·and shall contain in the upper half thereof the letters "LGE" which shall designate the grade standard "LARGE HBN Boo.""

12. Sub-regulation (2) of Regulation 53 is renumbered sub-regulation ( 4) of Regulation 53.

13. Sub-regulation (3) of Regulation 53 is renumbered sub-regulation (5) of Regulation 53 and is amended by delet­ ing .the words "or chilled duck egg" where they occur. 14. The following new sub-regulation (6) is added after sub-regulation (5) of Regulation 53:- "(6) Except with the written authority of the Chief Inspector, a person shall not remove from a cold storage chamber, a chilled hen egg that does not bear the mark and particulars prescribed in ·this Regulation. Such authority shall be issued subject .to any conditions wh~ch. rna~ bt: Jaid down by the C_hief lns~tor and may be unhmtted 10 ttme or be for a particular penod stated therein and in either case may be revoked by the Chief Inspector at his discretion."

(2) A first quality hen egg shall be a hen egg- (i) The shell of which is clean, uncracked and free from stain; and (ii) The shell of which is not thin or misshapen; and (iii) Which, when candled, is free from bloodspots or any inclusions whatsoever; and (iv) The yolk of which is translucent or faintly visible; and (v) The white of which is translucent and firm; and (vi) The air cell of which is fixed and is not more than one-quarter of an inch in depth and only slightly tremulous. ( 3) A person shall not sell a second quality hen egg for human consumption: Provided that a person may sell a second quality hen egg for the purpose of incorporating the contents of such egg with other ingredients in order to produce a commercial product for human consumption. ( 4) A second quality hen egg shall be a hen egg not being a first quality hen egg- ' (i) Which is free from foreign matter or excreta adher­ ing to the shell thereof; and (ii) Which is not affected by rots of any description; and (iii) The shell membranes of which are intact; and (iv) Which has not been subjected to incubation."

A person shall not sell a first quality hen egg unless such hen egg is graded according to the following standards:- (i) Hen egr:' weighing less than 1 t ounces each but not less than ll- ounces each with an average weight of not less than 15 ounces to the dozen shall be graded as "PULLET EGGS"; (ii) Hen eggs weighing less than It ounces each but not less than 1! ounces each with an average weight of not less than 18 ounces t.o the dozen shall be graded as "SMALL HEN EGGs"; (iii) Hen eggs weighing less than 2 ounces each but not less than I i ounces each with an average weight of not less than 21 ounces to the dozen shall be graded as "STANDARD HEN EGGs"; (iv) Hen eggs weighing not less than 2 ounces with an average weight of not less than 24 ounces to the dozen shall be graded as "LARGE HEN EGGS"." 3. The first paragraph of Subregulation (1) of Regulation 5Ic is repealed and the following paragraph is inserted in lieu thereof:- "Marking of Eggs According to Grade Standards 51 c. ( 1) A hen egg shall, before being sold for human consumption be stamped with a mark which shall contain in the upper half thereof in the case of a first qu;;Jity hen egg the grade standard of such egg and in the case of a second quality hen egg the quality of such egg, and in the lower half thereof an identification symbol as allotted by the Chief Inspector to an Egg Marketing Board constituted for the time being under '"The Primary Producers' Organis.ation ami Market­ ing Acts, 1926 to 1965," or to any person engaged in the production of hen eggs for sale for human consumption in the State of Queensland. The allocation of such identification symbol shall be subject to the following conditions:-" 4. Subregulation (3) of Regulation 5Ic is repealed and the following Subregulation ( 3) is inserted in lieu thereof:- " ( 3) The following marks shall be used and the following letters included therein to describe in the case of first quality hen eggs the grade standard of each egg and in the case of second quality hen eggs the quality of each egg:- (i) The mark for a "Pullet Egg" shall be in a violet indelible ink, circular in shape, having an inside diameter not greater than five-eighths of an inch and shall contain in the upper half thereof the letters "PLT" which shall designate the grade standard "PULLET EGG". 3 {ii) The mark for a "Small Hen Egg" shall be in a violet indelible ink, circular in shape having an inside diameter not greater than five-eighths of an inch and shall contain in the upper half thereof the letters "SML" which shall designate the grade standard "SMALL HEN EGG"; (iii) The .mark for a "Standard Hen Egg" shall be in a violet indelible ink, circular in shape having an inside diameter not greater than five-eighths of an inch and shall contain in the upper half thereof the letters "STD" which shall designate the grade standard "STANDARD HEN EGG"; (iv) The mark for a "Large Hen Egg" shall be in a violet indelible ink, circular in shape having an inside diameter not greater than five-eighths of an inch and shall contain in the upper half thereof the letters "LGE" which shall designate the grade standard "LARGE HEN EGG". (v) The mark for a "Second Quality Hen Egg" shall be in a red indelible ink, circular in shape having an inside diameter not greater than five-eighths of an inch and shall contain in the upper half thereof the numeral and letters "2ND" which shall desig­ nate a "SEcoND QUALITY HEN EGG"." 5. Paragraphs (i), (ii), and (iii) of Subregulation (3) of Regulation 53 are repealed and the following paragraphs (i), (ii), (iii) and (iv) are inserted in lieu thereof:- "(i) The mark for a "Chilled Pullet Egg" shall be circular in shape having an inside diameter not greaier than five-eighths of an inch and shall con­ tain in the upper half thereof the letters "PLT" which shall designate the grade standard "PULLET EGG". HIS Excellency the Governor, acting by and with the advice of the Executive- Council;. in: pursuanee of the· pravisions- of "The~ Poult-ny Industry Acts, 1946 to 1965," has been pleased to amend "The Poultry Industry Regulations of 1946" as follows. 1. Regulation 2 is amended by omitting the word "four" and inserting in its stead the word "five" and inserting therein after the words a-ad figure "Part 4--General", the words and figure "PART 5-MANUFACTURE AND PASTEURISATION OF EGG-PULP".

2. Immediately following Regulation 75, the following heading, and Regulations 76 to 118 both inclusive are inserted:- "Part 5 MANUFACTURE AND PASTEURISATION OF EGG-PULP Definitions 76. In this Part, unless the context otherwise indicates or requires, the terms used shall have the meanings respectively assigned to them by Section 4 of "The Poultry Industry Acts, 1946 to 1965," and the following terms' shall' have· and' include the meanings- set against them respectively that is to say:- "Approved"-Approved by an Inspector; "Chief Inspector"-The Chief Inspector appointed under this Act; "Eggs"-Fowl eggs, but not including inedible eggs; "Egg-Pulp"-Whole eggs which have been broken out from the shell in a manufacturing room and mixed together to form a pulp intended to be sold for human consumption: The term includes liquid whole egg; "Egg-Pulping Plant"-Premises in respect of whieh a person holds a license for the manufacture thereat of egg-pulp; "Egg-pulp Pasteurising Plant"-Premises in respect of which a person holds, in addition to a license for the manufacture of egg-pulp, a license for the pasteurising thereat of egg-pulp; "Equipment"-Without limit to the ordinary meaning of the term, any machinery, appliance, implement, apparatus, tool, instrument, utensil, container, receptacle, bucket, can, pail, tray, dish, strainer, tank, basket, vessel, table, bench, or other thing whether of the same kind as the things before enumerated or not, used or apparently used for any purpose ih connection with the manufacture and/Oir pasteurisation of egg-pulp; *Published in Gazette, dated 20th January, 1973 Vol. CCXLII, No. 7, pages 157-170. 2 Amendments-Poultry Industry Regulations "Frozen Egg-Pulp"-Egg-pulp which has been frozen in an approved container; "Inedible Eggs" -Eggs which are unfit for human consumption. The term includes eggs that- (a) Are contaminated with odours foreign to normal eggs; (b) Are musty and mouldy; (c) Have been in an incubator; (d) Are dirty with cracks in the shell and ruptured shell membranes and with the contents exuding; (e) Have portions of the shell and shell membranes missing and with the contents exuding; (f) Are the ova from slaughtered birds; (g) Have the following defects-black rot, blood ring, bloody egg, mixed or red rot, sour rot or white rot; or (h) Have adhering to the outside of their shells any foreign material or excreta; "License to manufacture Egg-Pulp"-A license granted to a person under the provisions of this Part of these Regulations to manufacture egg-pulp at the egg-pulping plant particularised therein; "License to Pasteurise Egg-Pulp"-A license granted to a person under the provisions of this Part of these Regulations to pasteurise egg-pulp at the egg-pulp pasteurising plant particularised therein; "Licensee"-The person named in a license granted, renewed or transferred under the provisions of this Part of these Regulations; "Manufacturing Room"-A room forming part of an egg-pulping plant kept or used for the purpose of egg breaking and for the manufacture and/or pasteurisation of egg-pulp; "Pasteurised Egg-pulp"-Egg-pulp which has been heat treated and cooled in the method prescribed by these Regulations; "Pasteurised Frozen Egg-pulp"-Pasteurised egg-pulp which has been frozen in an approved container; "Premises"-A building or part of a building or place of storage used in connection with such building; "Sell"-To agree to sell, or offer or expose for sale, or keep or have in possession for sale, or receive, consign, send, forward, or deliver for or on sale or authorising, causing, permitting, suffering, or attempting any of such acts or things.

Licensing of egg-pulping plants 77. (1) A person shall not use any premises as an egg-pulping plant unless such premises are licensed under this Part of these Regulations. (2) A person who establishes or keeps an unlicensed egg-pulping plant shall be guilty of an offence against these Regulations. 78. ( 1) A person who desires to obtain a license for an egg-pulping plant shall make application therefor to the Chief Inspector in the form of Schedule 15 hereto. Such application shall be accompanied by a fee of Ten dollars ($10). Amendments-Poultry Industry Regulations 3

(2) A licensee of an egg-pulping plant who desires to renew the license for such egg-pulping plant shall make application to the Chief Inspector in the form of Schedule 15 hereto and such application shall be lodged at least one calendar month prior to the date of expiry of such license. Such application shall be accompanied by a fee of Ten dollars ($10). (3) A licensee of an egg-pulping plant who desires to obtain approval for the transfer of the license thereof to another person shall make application to the Chief Inspector therefor in the form of Schedule 16 hereto and shall attach the license thereof to such application. Such application shall be accompanied by a fee of Five dollars ( $5).

79. ( 1) The Chief Inspector on being satisfied that the whole of the requirements of this Part of these Regulations has been complied with and upon payment of the prescribed fee, may grant a license, renew a license or approve of the transfer of a license as the case may be. (2) The Chief Inspector may grant a provisional license for an egg-pulping plant for a period not exceeding three (3) months to enable an applicant to effect to such premises such changes, improvements, or repairs, and/or to install therein such equipment as is in the opinion of the Chief Inspector necessary to render such premises suitable and proper for their licensing as an egg-pulping plant under this Part of these Regulations. Particulars of such required changes, improvements, repairs or equipment shall be endorsed on the provisional license so issued to the applicant. (3) The holder of a provisional license if, for a good cause shown is unable to comply fully with the requirements endorsed on such provisional license, may apply to the Chief Inspector for an extension of time to enable compliance to be had with such requirements and the Chief Inspector may extend such provisional license for one further period not exceeding three ( 3) months. The provisional license shall be endorsed with particulars of such extension. · ( 4) The fee for a provisional license shall be Ten dollars ( $10). Such fee shall be inclusive of the fee otherwise payable in respect of the license for such egg-pulping plant if and when such license is granted by the Chief Inspector.

80. ( 1 ) A license or renewal of a license to manufacture egg-pulp at the egg-pulping plant specified therein shall be in the form of Schedule 17 hereto and shall continue in force from the date of the grant thereof until and inclusive of the Thirty-first day of December next ensuing there­ after, unless such license is sooner cancelled under the provisions in that behalf contained in this Part of these Regulations. (2) In the case of approval granted to the transfer of a license, such approval shall be in the form of Schedule 18 hereto and the license shall be endorsed appropriately and returned to the applicant.

81. The Chief Inspector shall keep a register of all applications received by him pursuant to Regulation 78 of these Regulations, and shall record in such register the manner in which each such application has been dealt with by him. The Chief Inspector shall allot a number to each license granted by him. 4 Amendments-Poultry Industry Regulations

82. ( 1 ) Where at the date of publication of these Regulations, a person is carrying on the business of manufacturing egg-pulp intended for human consumption at premises of which he is the owner or occupier, such person shall within a period of twenty-one (21) days after such date, make application to the Chief Inspector in the form of Schedule 15 hereto for the granting to him of a license under this Part of these Regulations. (2) On receipt of such application the Chief Inspector may in his discretion refuse the application or grant to the applicant a license in the form of Schedule 17 hereto or issue a provisional license pursuant to the provisions of Regulation 79 of these Regulations.

83. The Chief Inspector may refuse to grant a license or the renewal of a license or to approve the transfer of a license or may cancel an existing license where- (a) The premises used or proposed to be used as an egg-pulping plant do not comply with or are not being properly main­ tained and kept in an hygienic manner in accordance with the provisions of this Part of these Regulations; (b) The equipment used or intended to be used therein or the conveniences provided or intended to be provided thereat does or do not comply with or is or are not being properly main­ tained and kept in an hygienic manner in accordance with the provisions of this Part of these Regulations; (c) The applicant, or the proposed transferee is not of the full age of twenty-one (21) years at the date of the application; (d) In the case of an application under the pro_visions of sub­ regulations (1) or {2) of Regulation 78 of these Regulations the applicant is not or no longer is the owner or the occupier of the premises to which such application relates; or (e) In the case of an application under the provisions of sub­ regulation ( 3) of Regulation 7 8 of these Regulations the proposed transferee will not be or become the owner or occupier of the premises to which such license relates. (f) In the case of an application by an applicant who is a grower of the commodity eggs as defined by Order in Council relating to The Egg Marketing Board made in pursuance of the provisions of "'The Primary Producers' Organisation and Marketing Acts, 1926 to 1966," on the Fourteenth day of January, 1926 (as amended from time to time), if such applicant is not the holder of a Certificate issued to him by the said Board exempting him from the provisions of Section 15 of the said Acts in respect of sales, disposals or uses otherwise of any part of the commodity eggs for the purposes of processing, manufacturing or treatment of the contents of eggs or any part of such contents.

84. If a licensee of an egg-pulping plant ceases to be the owner of the premises to which such license relates before an application has been lodged with the Chief Inspector for approval of the transfer of such license to the purchaser of such premises, the license shall immediately thereupon be deemed to be cancelled and the licensee shall in response to a demand made upon him by the Chief Inspector in that behalf, deliver up to the Chief Inspector such license. 85. If the licensee of an egg-pulping plant not being the owner of the premises to which such license relates ceases to be the occupier of such premises before an application has been lodged for the approval of the transfer of such license to the new occupier, such license shall immedi­ ately thereupon be deemed to be cancelled and the licensee shall in response to a demand made upon him by the Chief Inspector in that behalf deliver up to the Chief Inspector such license. 86. The licensee of an egg-pulping plant shall maintain at all times such egg-pulping plant and equipment therein in a clean and sanitary condition to the satisfaction of an Inspector. 87. A person shall not deliver to, nor receive at, nor bring into or upon, nor process at, an egg-pulping plant, inedible eggs. 88. Except in accordance with the provisions of Regulation 117 ( 1 ) of these Regulations a person shall not use a licensed egg-pulping plant for any purpose other than the manufacture of egg-pulp. 89. A person shall not use any premises as an egg-pulping plant unless such premises are of sound approved construction and are so situated as in the opinion of an Inspector, will avoid direct contamination from poultry or other livestock. 90. A person shall not use any premises as an egg-pulping plant unless an Inspector is satisfied with respect thereto that- ( a) The walls of such premises are constructed of concrete, brick, tiles or other approved material impervious to water having a smooth internal surface or are lined internally wfth fibro­ cement, metal or other approved sheeting material impervious to water; (b) The internal surfaces of such walls or linings are maintained in good repair and are painted with non-poisonous paint at such periods as is necessary to maintain them in a clean and sanitary condition; and (c) The ceiling of such premises is constructed of fibro-cement or other similar material painted with non-poisonous paint at such times as is necessary to maintain it in a clean and sanitary condition, and not less than seven feet six inches (7' 6") above floor level at its lowest point. 91. ( 1 ) A person shall not use any premises as an egg-pulping plant unless the floor of such premises is constructed of concrete or other approved material impervious to water. ( 2) Such floor shall- ( a) Have a smooth surface, and be sloped and drained so that all liquid spilt thereon is able to flow therefrom without impediment; and (b) Be at all times kept in good repair, smooth and free from cracks and inequalities. 92. A person shall not use any premises as an egg-pulping plant unless- ( a) Each opening to the exterior of such premises is covered with gauze of wire, fibreglass, plastic or other approved material of a mesh that will exclude flies; 6 Amendments-Poultry Industry Regulations

(b) All external doorways thereof are provided with a light swing frame door closely fitting and covered with gauze that will exclude flies; (c) Each such door is provided with a self-closing device and is kept closed save when in use; and (d) Such gauze and doors are maintained in a clean condition and in a state of good repair at all times. 93. ( 1) A person shall not use any premises as an egg-pulping plant unless such premises are adequately ventilated to the satisfaction of an Inspector by means of openings to the oute:t:_ air covered by gauze of a mesh that will exclude flies therefrom. ( 2) The provisions of subregulation ( 1 ) of this Regulation shall not apply to premises ventilated by a mechanical system of ventilation approved in writing by the Chief Inspector. 94. A person shall not use any premises as an egg-pulping plant unless such premises are adequately and uniformly lighted to the satisfac­ tion of an Inspector. 95. A person shall not use any premises as an egg-pulping plant unless separate rooms of adequate size are provided thereat for the purposes of egg breaking and manufacture of egg-pulp and for the storage of eggs respectively: Provided, however, that such storage room may be used for the washing of eggs pursuant to the provisions of Regulation 110 (c) of these Regulations. 96. Except in accordance with the provisions of Regulation 117 ( 1 ) of these Regulations a person shall not use the manufacturing room of an egg-pulping plant for any purpose other than for egg breaking and for the manufacture of egg-pulp. 97. A person shall not use the manufacturing room of an egg-pulping plant unless such room and equipment therein is thoroughly cleansed by the use of hot water, steam, or other approved method immediately prior to the commencement of, and immediately after the completion of, each processing run. 98. A person shall not use any premises as an egg-pulping plant unless all drains and traps in or about such premises are at all times kept in a clean and sanitary condition to the satisfaction of an Inspector. 99. A person shall not use any premises as an egg-pulping plant unless such premises are so constructed as to prevent the harbouring of vermin in or about such premises. 100. A person shall not at an egg-pulping plant use a table or other horizontal surface (whether moveable or a fixture) for any purpose in connection with the manufacture of egg-pulp unless such table or horizontal surface is provided with a surface of stainless steel. 101. A person shall not at an egg-pulping plant use therein any breaking equipment, or can, container or other receptacle used in the manufacture and carriage of egg-pulp unless all such equipment is made of stainless steel or other approved material. 102. A person shall not at an egg-pulping plant store thereat any material not essential to the current production of egg-pulp unless the storage of such material is approved of by an Inspector. 103. The licensee of an egg-pulping plant shall provide or cause to be provided thereat- ( a) An adequate supply of potable water and an adequate system for the heating of sufficient water for the cleansing of all equipment used in such plant; (b) A wash-up basip. constructed of staihless,, steel or other approved material of sufficient size to enaBle the· equipment used therein to be thoroughly cleansed; and (c)'. Odo:urJess; soap,. paper towel dispensers andl disposable paper towels: em hot air driers for cil'lansing· of hands of all persons engaged in handling of eggs or in the manufacture· of egg-pulp.

104. The licensee of an egg.:.pulping plant shall provide sufficient refrigeration facilities and accommodation to enable all egg-pulp· manu­ factured and stored thereat to be: precooled' or hard frozen: as required by the provisions of Regulation 111 (e) (f) of these Regulations.

105. The licensee of an egg-pulping plant shall be responsible in respect of his licensed premises for- (a) The maintenance of cleanliness and proper sanitary conditions throughout such premises; (b) Ensuring that each person engaged in. handling of eggs or iil. the manufacture of egg-pulp wears clean, washable clothing including a washable or disposable head covering and main­ tains personal cleanliness; (c) The thorough cleansing of all containers, breaking equipment, tanks, strainers, pipes and all other equipment used in the manufacture of egg-pulp, with the aid of water heated to a temperature of one hundred and eighty degrees Fahrenheit or eighty-two and one-fifth degrees Celsius (180°F or 82·2°C) to which has been added an approved sanitising agent, or steam or other approved method immediately prior to the commencement of and immediately after the comple­ tion of each processing run; (d) Ensuring that where equipment is used in the egg-breaking process on a continuous or production line basis, the surfaces of such equipment in contact with eggs, egg shells or the contents of such eggs shall be cleansed and sanitised immediately prior to the commencement of each processing run; and (e) Ensuring that where machines are used in the egg-breaking process, such machines shall be dismantled at the end of each day's work, and all parts thereof after cleansing with an approved sterilant shall be rinsed and air-dried; and (f) The thorough cleansing of floors, walls, benches, tables, drains and traps, in, upon or about such premises with the aid of hot water and an approved cleansing substance, at least once daily after the manufacture of egg-pulp has been completed.

106. A person shall not smoke nor expectorate in any part of the premises of an egg-pulping plant. 8 Amendments-Poultry lndu~try Regulations

107. A person suffering from an infectious disease whether notifiable by law under "The Health Acts, 1937 to 1967," or not or suffering from an objectionable or contagious skin infection, or who has unclean or medicated bandages upon any part of his person, shall not take part nor be employed in the handling, conveyance or manufacture of egg-pulp. 108. A person shall not allow a fowl, dog, cat or other animal to enter an egg-pulping plant. 109. A person shall not at an egg-pulping plant- (a) Break eggs either by hand or machine except into containers made from stainless steel or other approved material; or (b) Break eggs by hand unless each egg is inspected for odour and appearance. 110. A person shall not at an egg-pulping plant use a machine for the breaking of eggs unless- ( a) Such machine is approved by the Chief Inspector; (b) The eggs to be broken therein have been candled to exclude any inedible egg within twenty-four (24) hours of breaking out or within such period as may be approved by the Chief Inspector; and (c) Immediately prior to breaking out by such machine the eggs to be broken therein have been cleansed with water containing an approved sanitising agent at a temperature of not less than one hundred and twenty degrees Fahrenheit or forty-nine degrees Celsius (l20°F or 49°C) and rinsed in water at such temperature and air dried or by such other method as may be approved by the Chief Inspector. 111. In respect of the manufacture of egg-pulp a licensee of an egg­ pulping plant shall be responsible for ensuring that- (a) Egg-pulp containing blood spots or meat spots found when eggs are broken out is not used unless such blood spots or meat spots are removed by means of a sterile spoon prior to straining and blending and such egg-pulp is otherwise of satisfactory quality; (b) Egg-pulp is strained by a method approved by the Chief Inspector and a complete blending of yolk and albumen is effected without the production of excessive froth; (c) An adequate supply of strainers made of stainless steel or other approved material is readily available to enable frequent changes of strainers to be made; (d) When eggs have been broken out, the contents thereof are passed continuously through subsequent stages of the manu­ facturing process and not delayed at any intermediate stage; (e) Where strained egg-pulp is to be pasteurised by the licensee or where the licensee has arranged to transport egg-pulp other than frozen egg-pulp to a licensed egg-pulp pasteurising plant, such egg-pulp is precooled to a temperature not exceeding thirty-eight degrees Fahrenheit or three and three­ tenths degrees Celsius ( 38 °F or 3 · 3 °C) immediately following breaking out and thereafter not permitted to exceed such temperature at any time prior to commencement of pasteurisation; Amendments-Poultry Industry Regulations 9

(f) Where strained egg-pulp is to be filled into cans and held frozen for any period before pasteurising, such egg-pulp is precooled to a temperature not exceeding thirty-eight degrees Fahrenheit or three and three-tenths degrees Celsius (38°F or 3 · 3 oc) before filling into such cans: Provided that where facilities do not exist at the egg-pulping plant for the precooling of egg-pulp, the requirement of this sub-regulation shall be met if each can on being filled with egg-pulp is placed immediately in a freezer and the contents thereof hard frozen within twenty-four (24) hours of their being placed in such freezer; and maintained in a hard-frozen condition until such egg-pulp is delivered to a licensed egg-pulp pasteurising plant; (g) Each can on being filled with strained egg-pulp is capped with a tightly fitting metal lid and placed in a freezer and the filling of cans with egg-pulp effected in such a way as will minimise frothing; and (h) Empty cans are stored with their lids on so that they may be kept free from dust, vermin, insects and foreign matter. 112. A person shall not at an egg-pulping plant use any cans for the storage or carriage of egg-pulp unless such cans are inspected immediately prior to use and found to be free from the presence of water, foreign matter or abnormal odours.

113. A person shall not at an egg-pulping plant use for the manufacture of egg-pulp inedible eggs or eggs having an off odour or abnormal appearance. Any such eggs immediately when found shall be rejected and placed into a vessel as required by the provisions of Regulation 114 of these Regulations and any container or other equipment with which such eggs have come in contact shall be thoroughly cleansed and disinfected.

114. A person shall not at an egg-pulping plant keep nor cause to be kept egg shells and rejected eggs unless such egg shells and rejected eggs are contained in a vessel made of metal with a close fitting lid. Such vessel shall be kept outside the manufacturing room except when in actual use and shall be emptied and the internal and external surfaces thereof thoroughly cleansed at least once on each day used.

115. ( 1) A person shall not sell to the public, egg-pulp or frozen egg-pulp which has not been pasteurised in accordance with the provisions of Regulation 116 of these Regulations, but may sell such egg-pulp or frozen egg-pulp to the licensee of an egg-pulp pasteurising plant subject to the provisions of sub regulation (2) of this Regulation. (2) The licensee of an egg-pulp pasteurising plant may accept egg­ pulp for pasteurising from the licensee of an egg-pulping plant subject to the following conditions- (a) Such egg-pulp is received as frozen egg-pulp in a hard frozen condition or if such egg-pulp is received other than as frozen egg-pulp, then at no time since its manufacture has the temperature of the egg-pulp exceeded thirty-eight degrees Fahrenheit or three and three-tenths degrees Celsius (38°F or 3·3°C); 10 Amendments-Poultry Industry Regulations

(b) Such egg-pulp when thawed out or when received in liquid form is normal in appearance and has no objectionable odour; (c) The moisture content of such egg-pulp does not exceed seventy-five point five per centum (75 · 5%) of the total volume thereof; (d) The Chief Inspector is advised in writing in the form of Schedule 19 hereto, of the name and address of the licensee from whom such egg-pulp (either frozen or in the liquid state) was purchased, the license number of his premises, the date of receival and the quantity of egg-pulp received.

(3) Prior to pasteurisation, an Inspector may at his discretion or upon request, sample egg-pulp at an egg-pulp pasteurising plant or egg­ pulping plant and submit such samples to the Resazurin test. Should any sample of egg-pulp so submitted fail the Resazurin test in a period of less than five (5) hours at a temperature of eighty-six degrees Fahrenheit or thirty degrees Celsius (86°F or 30°C), the egg-pulp from which the sample was taken, shall be disposed of to the satisfaction of an Inspector.

Pasteunisation of egg-pulp 116. ( 1) A person shall not sell to the public egg-pulp or frozen egg-pulp unless it has been pasteurised by being- ( a) Retained in approved equipment at a temperature not lower than one hundred and forty-eight degrees Fahrenheit or sixty-four point four degrees Celsius (148°F or -64·4°C) for at least two and one-half (2!) minutes and immediately thereafter cooled to a temperature below thirty-eight degrees Fahrenheit or three and three-tenths degrees Celsius (38°F or 3 · 3°C); or (b) Retained at such other temperature and for such other time as may be approved by the Chief Inspector. ( 2) Such pasteurised egg-pulp shall satisfy the alpha-amylase test described in the "Liquid Egg (Pasteurisation) Regulations, 1963" of the United Kingdom (Statutory Instruments 1963:1101503) or such other test as may be approved by the Chief Inspector and shall not- ( a) Contain salmonellae organisms when tested in samples of 50 grams or more; (b) Contain more than 20 coliform organisms per gram when tested by plating on Violet-Red-Bile Agar or Deoxycholate­ Lactose Agar medium and incubated at ninety-eight and three­ fifths degrees Fahrenheit or thirty-seven degrees Celsius (98·6°F or 37°C) for 24 hours; or (c) Have a total plate count greater than 10,000 micro-organisms per gram when incubated at eighty-six degrees Fahrenheit or thirty degrees Celsius (86°F or 30°C) for 72 hours. ( 3) All apparatus used in the process of pasteurisation at an egg­ pulp pasteurising plant shall include such devices as may be necessary to ensure a constant flow rate of egg-pulp, thermostatic control of the heating of the egg-pulp and the automatic diversion of flow of any whole egg-pulp not sufficiently heated. ( 4) Egg-pulp shall not be pasteurised at an egg-pulp pasteurising plant unless approved temperature recording appliances are used to indicate and record in compliance with the requirements of subregulation ( 1) of this Regulation. Licensing of egg-pulp pasteurising plants 117. ( 1) A person shall not pasteurise egg-pulp at any premises unless such person is the holder of a license for the manufacture of egg­ pulp at an egg-pulping plant situated in and upon such premises, and which license has been granted under this Part of these Regulations and is the holder of a license in the form of Schedule 17 hereto to pasteurise egg­ pulp granted in accordance with the provisions of subregulation (2) of this Regulation. (2) A person who desires to obtain or renew a license for an egg­ pulp pasteurising plant shall make application therefor to the Chiet Inspector in the form of Schedule 15 hereto and the conditions applying to the granting, renewal and cancellation of licenses as provided under this Part of these Regulations shall apply to such application. Notwithstanding the provisions hereinbefore in this subregulation (2) contained a license shall not initially be granted unless the applicant for such license, submits to the Chief Inspector for approval, plans and specifications of the premises and equipment proposed to be used for the pasteurisation of egg-pulp. (3) A licensee of an egg-pulp pasteurising plant who desires to obtain approval for the transfer of the license thereof to another person shall make application to the Chief Inspector therefor in the form of Schedule I 6 hereto and the conditions applying to the approval of a transfer as provided under this Part of these Regulations shall apply to such application. ( 4) A separate fee shall not be required for the licensing, renewing of a license or the approving of a transfer of a license of an egg-pulp pasteurising plant where the premises are licensed as an egg-pulping plant under this Part of these Regulations. 118. ( 1) When any matter or thing is by this Part of these Regula­ tions directed or forbidden to be done, or where any authority is given by these Regulations to any person to direct any matter or thing to be done, or to forbid any matter or thing to be done, and such matter or thing so directed to be done remains undone or such matter or thing so forbidden to be done, is done, in every such case every person offending against such direction or prohibition shall be guilty of an offence against this part of these Regulations. (2) A person guilty of an offence against this part of these Regula­ tions shall be liable to a penalty not exceeding Two hundred dollars ($200). . Additionally in the case of a continuing offence against this Part of these Regulations the offender shall be liable to a daily penalty not exceeding Twenty dollars ( $20)." 12 Amendments-PouLtry Industry Regulations

HIS Excelkncy the Governor, acting by anu with the advice of the Executive Council and in pursuance of the provisions of the Poultry Industry Act 1946-1979, has been pleased to make the following Regulations. MIKE AHERN.

I. The Poultry Industry Regulations of 1946 are in these Regulations referred to as the Principal Regulations. 2. The Principal Regulations are amended by repealing regulations 51B, 51 c and 51 D and the head notes thereto and substituting the following regulations and head notes:- "Grade Standards 5lB. ( 1) A person shall not sell any hen egg unless such hen egg has been graded and tested for quality in accordance with these regulations. (2) Hen eggs shall be graded and tested for quality by- ( i) The Egg Marketing Board, constituted under the Primary Producers' Organisation and Marketing Act 1926-1983; (ii) The Central Queensland Egg Marketing Board, constituted under the Primary Producers' Organisation and Marketing Act 1926-1983; or (iii) A check egg grader, that or who has been allotted an identification symbol by the Chief Inspector. ( 3) First quality hen eggs shall be graded to the following grade standards- (i) hen eggs weighing less than 45 grams each but not less than 40 grams each with an average weight of not less than 480 grams to the dozen shall be graded as "PULLET EGGS"; (ii) hen eggs weighing less than 50 grams each but not less than 45 grams each with an average weight of not less than 540 grams to the dozen shall be graded as "SMALL HEN EGGS"; (iii) hen eggs weighing less than 55 grams each but not less than 50 grams each with an average weight of not less than 600 grams to the dozen shall be graded as "STANDARD HEN EGGS"; ( iv) hen eggs weighing less than 60 grams each but not less than 55 grams each with an average weight of not less than 660 grams to the dozen shall be graded as "LARGE HEN EGGS"; (v) hen eggs weighing not less than 60 grams each with an average weight of not less than 720 grams to the dozen shall be graded as "EXTRA LARGE HEN EGGS".

( 4) Second quality hen eggs shall be gradeJ as '·SECOND QUALITY HEN EGGS".

Marking of eggs according to Grade Standards, and Identification Symbol Sic. (I) A hen egg shall not be solJ for human consumption unless stamped with a circular mark in inddiblc ink and having an inside diameter not greater than 16 millimetres which contains- (i) in the upper half- ( a) in the case of a first quality hen egg, the grade standard of such egg; or (b) in the case of a second quality hen egg, the quality of such egg; and (ii) in the lower half, the identification symbol of the Board or check egg grader grading the egg. (2) (a) First quality hen eggs shall be marked in violet indelible ink. (b) Second quality hen eggs shall be marked in red indelible ink. (c) Each letter or symbol required to be stamped on an egg shall be printed in sanserif capital letters of eight point full face measurement (condensed type) . ( 3) For the purposes of marking hen eggs- ( i) the grade standard "PULLET EGGS" shall be designated by the number "40"; (ii) the grade standard "SMALL HEN EGGS" shall be designated by the number "45"; (iii) the grade standard "STANDARD HEN EGGS" shall be designated by the number "50"; (iv) the grade standard "LARGE HEN EGGS" shall be designated by the number "55"; ( v) the grade standard "EXTRA LARGE HEN EGGS" shall be designated by the number "60"; (vi) the grade Second Quality Hen Eggs shall be designated by the number and letters "2ND". (4) (a) An application for an identification symbol shall be made in the form in Schedule 20 hereto. Such application shall be accompanied by a fee of $30.00. (b) The Chief Inspector may grant or refuse an application or grant an application either in whole or in part subject to such terms and conditions as he thinks fit. (c) The Chief Inspector may at any time, subject to the approval of the Minister, withdraw such identification symbol. 3

Obligation to mark eggs according to Grade Standards Slo. A person shall not, in the Districts set forth in Regulation 54:­ (i) sell or offer for sale a hen egg unless- ( A) such hen egg has thereon a legible mark as prescribed by Regulation 51c; and (B) there is prominently displayed in a readable position attached to the receptacle in which such hen egg is contained or upon any carton in which such hen egg is packed, a notice, placard or sign on which is legibly printed, stencilled, or written the grade standard of such hen egg; (ii) subject to these regulations, affix to hen eggs for sale for human consumption or to any receptacle or carton used for the purpose of displaying such hen eggs, or use in relation to any such display, any notice, placard, or sign on which are particulars or terms other than those used to describe hen eggs in regulations 51A and 51B; (iii) display for sale by retail a hen egg in such a position that it is exposed to the sun or contamination by animals, by odours or by any other means; (iv) sell any egg which is packed or contained in any case, packing material, carton, receptacle or container which is unclean or which has become contaminated by contact with any deleterious substance; (v) sell hen eggs of different standards or grades in the one receptacle or carton; (vi) sell a hen egg the prescribed mark on which has been removed, altered or interfered with."

The Regulations made under the Poultry Inclustry Act 1946- 1979 pubiished in the Gazette on the 3rd March, 1947, as previously amended, are in these Regulations referred to as the Principal Regulations. 2. Regulation 49 (2) of the Principal Regulations is amended by omitting the expression "$20" and substituting the expression "$25". 3. Regulation 78 of the Principal Regulations is amended by:- ( a) in subsection ( 1), omitting the expression "$30" and substituting the expression "$36". (b) in subsection (2), omitting the expression "$30"and substituting the expression "$36". 4. The amendments to the Principal Regulation~, set out above, shall come into force on the 1st February, 1984.

1. The Poultry Industry Regulations of 1946 as previously amended are in these Regulations referred to as the Principal Regulations. 2. Regulation 51 of the Principal Regulations and the head-note thereto is repealed. 3. (1) Subject to this regulation, the Principal Regulations are amended by- {a) in regulation 51B, omitting subregulation (3) and substituting the following subregulation :- "(3) First quality hen eggs shall be graded to the following grade standards- (i) hen eggs weighing less than 45 grams each but not less than 38 grams each with an average weight of not less than 456 grams to the dozen, shall be graded as "ECONOMY EGGS"; (ii) hen eggs weighing less than 52 grams each but not less than 45 grams each with an average weight of not less than 540 grams to the dozen shall be graded as "MEDIUM EGGS"; (iii) hen eggs weighing less than 59 grams each but not less than 52 grams each with an average weight of not less than 624 grams to the dozen shall be graded as "LARGE EGGS"; (iv) hen eggs weighing less than 66 grams each but not less than 59 grams each with an average weight of not less than 708 grams to the dozen shall be graded as "EXTRA LARGE EGGS"; ( v) hen eggs weighing not less than 66 grams each with an average weight of not less than 792 grams to the dozen shall be graded as "JUMBO EGGS"." (b) in regulation 51 c, omitting subregulation ( 3) and substituting the following subregulation:- "(3) For the purpose of marking hen eggs- (i) the grade standard "ECONOMY EGGS" shall be designated by the letter "E"; (ii) the grade standard "MEDIUM EGGS" shall be designated by the letter "M"; (iii) the grade standard "LARGE EGGS" shall be designated by the letter "L"; (iv) the grade standard "EXTRA LARGE EGGS" shall be designated by the letters "XL"; (v) the grade standard "JUMBO EGGS" shall be designated by the letter "J"; (vi) the grade "SECOND QUALITY HEN EGGS" shall be designated by the expression "2ND"."
