Cb'"nsti tution No.MABHAP-1087/14/CR 2/87/20- In exercise of of-India the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all existing rules and orders issued in this behalf .g and in force in the State of Maharashtra or any part thereof, the Governor of Maharashtra is hereby j( pleased to make the following rules regarding the Government Servants (Qther than Jud~cial Department Servants) Marathi Language Examination in the State l! of Maharashtra, namely:-
1. These rules may be called the Maharashtra Government Servants (Other than Judicial Depart- ment Servants) Marathi Language Examination Rules, 1987. . 2. In these rules, unless the context otherwise requires --
(8) ttAppendix" means an Appendix appended to these rules;
(b) "Board"means the Adhoc Board (Marathi ' Language Examinations) General Administra- tion Department, Mantralaya,Bombay 400 032, constituted by Government Resolution, General Administration Department,No.TRG- 1462-M, dated the 14th February, 1963; (c) lIexaminations" means the Lower and Higher level Marathi language examinat~ona prescr\~edunder these ruies and held by the Bofird from time to time; (d) "existing rules" means the rules and orders in force for Gazetted and non-Gazetted . Government Servants for Marathi Language Examination, immediately before the date ,~ of publication of these rules in the Official Gazettee; \. ..- (e) "Government" means the Government of - Maharashtra; (f)' "Government Servant" means any person appoir.ted by nomination, promotion or transfer to a Gazetted post or~non-Gazetted Class III post, in ahy Department or Office under the administrative control of Govern- ment and includes officers belonging to the All India Services whether transferable or non-transferable, but snaIl not include any judicial Officers or any non-Gazetted, ~25(6,00O-1-88)-5 Class III Judicial Department Servants; ~ ".- ~ =--

(g) !tHighSt~ndard Examination" means the Higher Standard Examination in Marathi Language prescribed under these rules held by the Board, from time to time; (h) ttLowerStandard Examination" means ~he Lower Standard Examination 1n Marathi Language, prescribed under these rules and held by the Board, from time to time; ~ (i) "Secondary School Certificate Examina- tion" means a final examination conducted by a Divisional Board constituted under the Maharashtra Secondary and Higher Second~ry Education Boards Act, 1965 (Mah..XLIof 1965), at the end of the secondary stage of education as defined in that Act.
3. Subject to the provisions of rule 4, every Gazetted or non-Gazetted Government Servant shall be required to pass the -
(i) Lower Standard Examination 'before the the expiry of two years from the date of coming into operation of these rules or from the date of his appointment, which- ever is later; and (ii) Higher Standard Examination before the expiry of two years after his passing the Lower Standard Examination.
Note:An Officer belonging to the All India Services who is exempted from passing the Lower Standard Examination under sub~rule (6) of rule 4 of these rules, shall be required to pass the Higher Standard Examination within four years from the date of his joining the State service.
4. (1) Notwithstanding anything contained in rule 3, a Government Servant shall be , exempted from passing of the examinations if, ......
(1) he has passed the examinations according to the existing rules; (ii) he was eligible for exemption or was exempted under the existing rules;

C' .' 12 -: (6) An' Offic,er belonging to the All India Services shall be exempted from pass;ing the Lower Standard Examination if he has, passed the Marathi language examina-' tion during the period of his training
in the National Aca,demy. " ' '5. <: , A Government 'Servant who fails to pass tl)e :> examinatipnswithin the prescribed period, shall, after the expiry of the said period, be liable to have his increments withheld ,until. J1epasses the examination or examinations, as the case ,may be, or is exempted from passing the same' under the' provisions, of rul~ 4.' Examimtion '-- For passing the Marathi" Language Examination 50% marks should be obtained in each of the written papers as well as "in the. or.alexamination. 60% marks should be obtained. either in the written papers or in the oral examination for claiming exemption.' . . . , Provision of grace marks:- A candidate fail~ng either in the \'rritten papers or in the oral examination by 4-5 marks, may be allowed maximum 5 grace marksiheither of the vrritten papers or in the oral examination so, ho\'rever,that the have maximum grace marks will be ten only. A candidate must II' obtained 50% marks in'aggr~gate in the \'Trittenand oral exami- nation. His result will be declared with the remark "Passed with the grace marks". The concession of grace marks is rtr- available only in the case of those candidates who are appearing for the"entire (Two written papers and oral) examina- 7fCI\ tiQn.
