OXFORDSHIRE COUNTY COUNCIL ( 7.5 TONNE MAXIMUM GROSS WEIGHT RESTRICTION) ORDER 2007

The Oxfordshire County Council ("the Council") in exercise of their powers under Sections 1(1), 2(1), 2(2), and 2(4) of the Road Traffic Regulation Act 1984 ("the Act") and all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the Act, make the following Order:

1. This Order shall come into operation on the 24 th September 2007 and may be cited as the Oxfordshire County Council (Oxfordshire 7.5 tonne Maximum Gross Weight Restriction) Order 2007.

2. In this Order, except where the context otherwise requires, the following expressions have the following meanings:

"articulated vehicle" means a vehicle with a trailer so attached to it as to be partially superimposed upon it;

"goods vehicle" means a motor vehicle trailer constructed or adapted for use for the carriage or haulage of goods or burden of any description;

"maximum gross weight" means: (a) in the case of a motor vehicle not drawing a trailer or in the case of a trailer. its maximum laden weight; (b) in the case of an articulated vehicle, its maximum laden weight (if it has one) and otherwise the aggregate maximum laden weight of all the individual vehicles forming part of that articulated vehicle; and (c) in the case of a motor vehicle (other than an articulated vehicle) drawing one or more trailers, the aggregate maximum laden weight of the motor vehicle and the trailer or trailers drawn by it.

"maximum laden weight" means: in relation to a vehicle (including a vehicle which is a trailer), (a) in the case of a vehicle as respects which a gross weight not to be exceeded in Great Britain is specified in Construction and Use requirements (as defined by Section 41 (8) of the Road Traffic Act 1988). the weight so specified; (b) in the case of a vehicle as respects which no such weight is so specified, the weight which the vehicle is designed or adapted not to exceed when in normal use and travelling on a road laden .

"trailer" means a vehicle drawn by a motor vehicle. •

3. (1 ) Any reference in this Order to any enactment shall be construed as a reference to that enactment as amended or replaced by any subsequent enactment.

(2) Words importing the masculine gender shall also include the feminine gender and words in the singular include the plural and vice versa.

(3) The restrictions imposed by this Order shall be in addition to and not in derogation from any restriction or requirement imposed by any other enactment.

(4) Any reference in this Order to a numbered Article shall unless the context otherwise requires be construed as a reference to the numbered Article bearing that number in this Order.

4 Save as provided by Articles 5 & 6, no person shall, except upon the direction or with the permission of a police constable in uniform or a traffic warden, cause or permit any goods vehicle with a maximum gross weight exceeding 7.5 tonnes to proceed in any of the lengths of road specified in Schedule 2 to this Order.

5 Nothing in Article 4 of this Order shall have effect so as to prevent such access as may be reasonably required, for vehicles of any class or description, to any premises or land situated on or adjacent to any such. lengths of road, or any other premises or land accessible for vehicles of that class or description from, and only from any such length 'of road, for the picking up or setting down of passengers, or for loading onto or, unloading from the vehicle in any such length of road.

6. Nothing in Article 4 of this Order shall render it unlawful to cause or permit a vehicle to proceed in any such length of road:

(1) if it is being used for police, fire or ambulance services purposes,

(2) in connection with any of the following: (a) undertaking any building operation, demolition or excavation in or adjacent to the length of road; (b) moving any obstruction to traffic from the length of road; (c) undertaking works in the length road, in relation to any sewer or water main or in relation to the supply of gas, water, electricity or communication services: (d) undertaking works to any traffic sign or road lighting in that road; (e) carrying out any statutory functions of a local authority;

(3) if it is being used for Military training operations.

2 ~ / 7. The Orders specified in Part 1 of Schedule 1 to this Order are hereby revoked .

8. The Orders specified in Part 2 of Schedule 1 to this Order are amended in the manner and to the extent shown therein.

Amendments:

14 The Oxfordshire County Council (Milton and Sutton Courtenay) (Weight and Width Restrictions) Order 1977, is amended by deleting Article 3( 1) and the Schedule to the Order.

15 The Oxfordshire County Council (Whitchurch Area) (Prohibition of Heavy Commercial Vehicles and Width Restrictions) Order 1980, is amended by deleting Articles 2 & 3(1) and Part 1 of the Schedule.

The following lengths of road in the Parishes stated shall be subject of a 7.5 tonnes maximum gross weight limit (with exemptions):

1 Kidlington

Service Roads, Kidlington:

i) The service road which lies to the west of A4260, Oxford Road, Kidlington, from its junction with Kidlington Roundabout for a distance of 1,110 metres north west; ii) The service road which lies to the east of A4260, Oxford Road, Kidlington from the northern boundary line of No. 287 Oxford Road to the northern boundary line of No. 145 Oxford Road, Kidlington, a distance of 800 metres;

2 Kidlington, Gosford

Bicester Road:

Bicester Road, Kidlington from its junction with A4260 Oxford to Banbury Road to its junction with Bicester Road, Gosford;
