One percent (1%) of these revenues 8 shall be credited to the general fund as an administrative fee, 9 and the remainder shall be distributed as follows: 10 11 (iii) Except as provided by W.S. 9-4-605(a), and as 12 otherwise provided in this paragraph, twenty-six and one-quarter 13 percent (26 1/4%) to the highway fund subject to allocations under 14 W.S. 9-4-607. For 29 the fiscal years commencing July 1, 2016 and July 1, 2017 funds 30 July 1, 2021 through July 1, 2025, three million dollars 31 ($3,000,000.00) under this paragraph shall first be distributed 32 to the general fund transportation information system account 33 created by W.S. 31-1-204; 34 35 39-17-111. Distribution. 36 37 (c) The department shall credit to appropriate accounts 38 based upon deductions from the taxes collected under this article 39 in the following order: 40 41 (ii) Deduct an amount collected on fuel used in 42 snowmobiles, computed by multiplying the number of snowmobiles for 43 which registration and user fees have been paid during the current 44 fiscal year under W.S. 31-2-404(a)(i) and 31-2-409(a)(ii) times 45 twenty-eight dollars and seventy-five cents ($28.75) plus the 46 number of gallons of gasoline used by snowmobiles for which 47 registration fees have been paid during the current fiscal year

4 1 under W.S. 31-2-404(a)(ii) times the current gasoline tax rate as 2 defined by W.S. 39-17-104(a)(i). The number of gallons used by 3 commercial snowmobiles shall be reported to the department by all 4 businesses offering commercial snowmobile recreational leasing. 5 Except as otherwise provided in this paragraph, the amounts 6 computed shall be credited to a separate account to be expended by 7 the department of state parks and cultural resources to improve 8 snowmobile trails in Wyoming. In each fiscal year for the period 9 commencing July 1, 2021 and ending June 30, 2025, the department 10 of state parks and cultural resources shall report monthly to the 11 department of transportation the amount of federal highway funds 12 it receives that may be used for recreation purposes, including 13 snowmobile trails. Amounts that are to be credited to the 14 department of state parks and cultural resources under this 15 paragraph for the remainder of the fiscal year shall be reduced 16 until the reductions equal the amounts reported. An amount equal 17 to the reductions shall be credited to the transportation 18 information system account created by W.S. 31-1-204. If at the end 19 of the fiscal year the total of amounts reported in that year 20 exceeds the amounts credited under this paragraph to the 21 transportation information system account in the same fiscal year, 22 the department shall continue the reductions for not more than one 23 (1) month in a subsequent fiscal year; 24 25 (iii) Deduct an amount collected on fuel used in 26 motorboats, computed by multiplying the number of motorboats 27 numbered during the current fiscal year under W.S. 41-13-102 plus 28 the number of nonresident motorboats for which aquatic invasive 29 species fees have been paid during the immediately preceding fiscal 30 year in accordance with W.S. 23-4-204 times twenty-eight dollars 31 and seventy-five cents ($28.75). Except as otherwise provided in 32 this paragraph, the amount computed shall be credited to a separate 33 account to be expended by the department of state parks and 34 cultural resources to improve, construct, maintain, operate and 35 ensure the safety of facilities for use by motorboats and motorboat 36 users at state parks and state recreation areas and to provide 37 grants to governmental entities for improvement, construction, 38 maintenance, operation and ensuring the safety of publicly owned 39 boating facilities at public parks and recreational facilities. In 40 each fiscal year for the period commencing July 1, 2021 and ending 41 June 30, 2025, the department of state parks and cultural resources 42 shall report monthly to the department of transportation the amount 43 of federal highway funds it receives that may be used for 44 recreation purposes, including boating facilities. Amounts that 45 are to be credited to the department of state parks and cultural 46 resources under this paragraph for the remainder of the fiscal 47 year shall be reduced until the reductions equal the amounts

5 1 reported. An amount equal to the reductions shall be credited to 2 the transportation information system account created by 3 W.S. 31-1-204. If at the end of the fiscal year the total of 4 amounts reported in that year exceeds the amounts credited under 5 this paragraph to the transportation information system account in 6 the same fiscal year, the department shall continue the reductions 7 for not more than one (1) month in a subsequent fiscal year; 8 9 (iv) Deduct an amount collected on fuel used in off- 10 road recreational vehicles, computed by multiplying the number of 11 off-road recreational vehicles for which user registration fees 12 have been paid during the current fiscal year under W.S. 31-2- 13 703(a) times eighteen dollars and forty cents ($18.40). Except as 14 otherwise provided in this paragraph, the amount computed shall be 15 credited to a separate account to be expended by the department of 16 state parks and cultural resources to improve off-road 17 recreational vehicle trails in Wyoming. In each fiscal year for 18 the period commencing July 1, 2021 and ending June 30, 2025, the 19 department of state parks and cultural resources shall report 20 monthly to the department of transportation the amount of federal 21 highway funds it receives that may be used for recreation purposes, 22 including off-road recreational vehicle trails. Amounts that are 23 to be credited to the department of state parks and cultural 24 resources under this paragraph for the remainder of the fiscal 25 year shall be reduced until the reductions equal the amounts 26 reported. An amount equal to the reductions shall be credited to 27 the transportation information system account created by 28 W.S. 31-1-204. If at the end of the fiscal year the total of 29 amounts reported in that year exceeds the amounts credited under 30 this paragraph to the transportation information system account in 31 the same fiscal year, the department shall continue the reductions 32 for not more than one (1) month in a subsequent fiscal year. 33 34 Section 3. The department of transportation and the 35 department of enterprise technology services shall, based on total 36 historical usage for the period from July 1, 2015 through June 30, 37 2020, determine the percentage of use made by all users of the 38 department of transportation's revenue information system. The 39 department shall assess each state agency a user fee equal to the 40 agency's percentage of use times one million dollars 41 ($1,000,000.00). The department shall report the assessment to the 42 state auditor's office. On the first day of each fiscal year 43 commencing July 1, 2021 through June 30, 2026, the auditor's office 44 shall transfer from each state agency's appropriation to the 45 transportation information system account created in 46 W.S. 31-1-204, an amount equal to the agency's annual assessment. 47 This section is repealed effective July 1, 2026.

The department of transportation shall apply for 3 any federal funds available or that may become available, including 4 any funds available through additional Coronavirus Aid, Relief, 5 and Economic Security (CARES) Act funding, for purposes of 6 replacing the revenue information system in use on July 1, 2020. 7 The department shall report the receipt of any such federal funds 8 to the state auditor. Funds credited to the transportation 9 information system account created in W.S. 31-1-204 pursuant to 10 section 3 of this act, W.S. 9-4-601(n) as created by this act and 11 W.S. 39-14-801(e)(iv) as amended by this act shall be reduced by 12 the amount of federal funds received. Should the amount of federal 13 funds received be less than the total of all funds distributed to 14 the account from the sources specified in this section, the 15 reduction shall be applied pro rata to each source. The state 16 auditor shall credit to each assessed state agency's appropriation 17 the amount of funds reduced from assessments under section 3 of 18 this act. Funds reduced from remaining sources shall be credited 19 to the highway fund. The reductions provided in this section shall 20 be implemented only to the extent they will not result in the loss 21 of federal funds.". 22 23 Page 13-line 14 Delete "Section 3" and insert "Section 5". 24 BURKHART, CHAIRMAN
