THE OF STOCKTON-ON-TEES ENVIRONMENTAL 7.5 TONNE WEIGHT RESTRICTION ORDER 2020

The Council of the Borough of Stockton-on-Tees (“the Council”) in exercise of its powers under Sections 1, 2, 4 and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended, (“the Act”) and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order:

1. This Order shall come into operation on the 15th day of October 2020 and may be cited as The Borough of Stockton-on-Tees, Environmental 7.5 Tonne Weight Restriction Order 2020.

2. In this Order “civil enforcement officer” shall mean a person employed by the Council as a Civil Enforcement Officer or other officer authorised by the Council to enforce traffic restrictions.

3. No person shall, except upon the direction or with the permission of a police officer in uniform, or a civil enforcement officer, cause or permit any vehicle exceeding 7.5 tonnes maximum gross weight to enter or proceed along the lengths of the road specified in the Schedule hereto.

4. Nothing in Article 3 shall apply to i) public transport vehicles namely buses as defined in Section 1 of the Public Passenger Vehicles Act 1981 or any community transport vehicle being a vehicle originally adapted to carry more than eight passengers which has been modified to carry wheelchairs. ii) emergency vehicles iii) vehicles exceeding the weight limit that require access to premises along a road specified in the Schedule where there is no other access other than along that road iv) a vehicle, if it cannot conveniently be used for such purpose in any other road, being used in connection with building, industrial or demolition operations (subject to obtaining the prior written consent of the Council); the removal of any obstruction to traffic; the maintenance, improvement or reconstruction of the said roads; or the laying, erection, alteration or repair in or on the roads or land adjacent to the roads of any sewer, main, pipe or apparatus for the supply of gas, water or electricity or any telecommunications apparatus as defined in the Telecommunicatons Code contained in Schedule 2 to the Telecommunications Act 1984 (or any successor legislation); v) any vehicle if it cannot be conveniently used for such purposes in any other road, being used in the service of a local authority or water authority in pursuance of statutory powers or duties

5. The following Orders shall be revoked: -

“The County of () (Weight Restriction) Order 1981” is revoked in its entirety.

“The Borough of Stockton-on-Tees (Wolviston Back Lane, ) (Weight Restriction) Order 2006” is revoked in its entirety.

“The Borough of Stockton-on-Tees (The Linkway/Saunton Road, Billingham) (Prohibition of Heavy Commercial Vehicles) Order 1987” is revoked in its entirety.

“The Borough of Stockton-on-Tees (, Stockton-on-Tees) (Weight Restriction) Order 1997” is revoked in its entirety.

“The Borough of Stockton-on-Tees (Port Clarence, Stockton-on-Tees) (Weight Restriction) Order 1997 (Amendment Order) 2016” is revoked in its entirety.

“The County of Durham (Roads Restriction) Order 1949” is revoked in its entirety.

“The County of Durham (Roads Restriction) (No.2) Order 1949” is revoked in its entirety.

“The County of Durham (Roads Restriction) (No.3) Order 1949” is revoked in its entirety.
