Will the Minister of RURAL DEVELOPMENT be pleased to state:-

(a) whether a number of Non-Governmental Organisations (NGOs), both Indian and foreign are closely associated with various rural development schemes and if so, the details thereof along with major contribution of such organisations in the field; (b) whether a number of NGOs were blacklisted and if so, the details of such NGOs during the last three years and the current year, State/UT-wise; (c) whether the Council for Advancement of People’s Action and Rural Technology has provided financial assistance to the NGOs blacklisted as well as those under funding restriction category; (d) if so, the details thereof and the reasons therefor; and (e) the corrective action taken by the Government and the outcome thereof?

(a) to (e) A Statement is laid on the Table of the House. Statement referred to in reply to Lok Sabha Starred Question No. 223 due for reply on 12.03.2015.

(a) Yes Madam. NGOs are associated in the implementation of National Rural Livelihood Mission (NRLM) and Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA). NGOs are implementing agencies of Mahila Kisan Sashaktikaran Pariyojna (MKSP) which is a sub- component of NRLM. Details are at Annexure ‘I’. Further the initiative of Deen Dayal Upadhaya Grameen Kaushalya Yojana (DDUGKY) of NRLM (the placement linked skill development programme for rural youth) is being implemented in partnership with private sector, public sector and Civil Society Organisations (CSOs). Details are at Annexure -II

In addition, two NGOs have been selected as `NRLM Support Organisations` (NSOs) to provide support in livelihood training to members of community institutions and video based dissemination of good agricultural practices. They are:-

(a) The Government provides grants-in-aid to Non Government Organisations (NGOs) for implementing various Schemes for welfare of Scheduled Castes, Other Backward Classes, Senior Citizens, Victims of alcoholism and sub- stance abuse and Persons with Disabilities under the following schemes:- I. Scheme of Grant-in-aid to Voluntary and other Organizations Working for Scheduled Castes The main objective behind the scheme is to involve the voluntary sector and training insti- tutions of repute to improve educational and socioeconomic conditions of the target group i.e. Scheduled Castes with a view to upgrade skill to enable them to start income generating activities on their own or get gainfully employed in some sector or the other. II. Scheme of Free Coaching for SC and OBC Students The objective of the Scheme is to provide qualitative coaching for Group-A&B examinations conducted by UPSC, SSC, Railway Recruitment Boards, State Public Service Commissions, Officers Grade Examinations conducted by banks, insurance companies, PSUs and finishing course/job oriented course for employment in the private sector in fields, such as, IT, bio-technology, etc. III. Assistance to Voluntary Organizations working for welfare of OBCs The aim of the scheme is to involve the voluntary sector to improve educational and socio- economic conditions of the target group i.e. OBCs, with a view to upgrade skill to enable them to start income generating activities on their own or get gainfully employed in some sector or the other. IV. Integrated Programme for Older Persons The main objective of the Scheme is to improve the quality of life of the Older Persons by provi- ding basic amenities like shelter, food, medical care and entertainment opportunities and by encouraging productive and active ageing through providing support for capacity building of Government / Non-Governmental Organizations / Panchayati Raj Institutions / local bodies and the Community at large. V. Assistance for Prevention of Alcoholism and Substance (Drugs) Abuse The objectives of the Scheme are: i) To create awareness and educate people about the ill-effects of alcoholism and substance abuse on the individual, the family, the workplace and society at large; ii) To provide for the whole range of community based services for the identification, motivation, counseling, de-addiction, after care and rehabili- tation for Whole Person Recovery (WPR) of addicts to make a person drug free, crime free and gainfully employed. iii) To alleviate the consequences of drug and alcohol dependence amongst the individual, the family and society at large; iv) To facilitate research, training, documentation and collection of relevant information to strengthen the above mentioned objectives; and v) To support other activities which are in consonance with the mandate of the Ministry of Social Justice & Empowerment in this field.

VI. Assistance to Disabled Persons for Purchase/ Fitting of Aids/Appliances (ADIP) The main objective of the Scheme is to assist the needy disabled persons in procuring durable, sophisticated and scientifically manufactured, modern, standard aids and appliances to promote physical, social, psychological reha- bilitation of Persons with Disabilities by reducing the effects of disabilities and at the same time enhance their economic potential. Assistive devices are given to PwDs with an aim to improve their independent functioning, and to arrest the extent of disability and occurrence of secondary disability. VII. Deendayal Disabled Rehabilitation Scheme (DDRS)

(i) To create an enabling environment to ensure equal opportunities, equity, social justice and empowerment of persons with disabilities. (ii) To encourage voluntary action for ensuring effective implementation of the People with Disabilities (Equal Opportunities and Protection of Rights) Act of 1995.

(b) The details of State-wise assistance provided to NGOs during the previous financial year and the current year is given at annexure I(a-g) hereto. The information in respect of NGO-wise release is being compiled and will be laid on the Table of the House. (c) The Ministry conducts evaluation/ monitoring of the schemes to enhance transparency and accountability in the following manner: (i) Fresh/subsequent releases of grants to imple- menting agencies during a year are made only on receipt of Utilization Certificates in respect of previous year’s grants. (ii) Review of schemes/programmes by the officers of the Ministry during their visits to the States. (iii) The schemes / programmes implemented through NGOs are monitored by respective State Governments/UT Administrations. (iv) The Ministry sponsors evaluation studies from time to time through independent evaluation agencies, inter alia, to check efficacy of the scheme and check proper utilization of funds by the implementing agencies under various Schemes / Programmes, (v) Inspection of NGOs across all States / UTs by officers of the Ministry. (vi) Periodic review meetings are held at the level of Minister and senior officers with their counterparts in the States/UTs, including through video conferences, and (vii) An Online process portal has been instituted since 1-4-2014 for online submission of applications for grants and subsequent processing online at district level, State level and in Ministry, for enhancing efficiency and transparency in the disposal of grants. In the event of proven misappropriation of funds by an NGO, the Ministry initiates action to blacklist that NGO. The deficiencies found during the review and monitoring process are mainly non-submission of utilization certificates in time and inadequate book keeping by the grantee organisations. Show-cause notices have been issued to 87 NGOs and 10 NGOs were blacklisted during the period in question.

(d) State Government`s recommendation supported by report of inspection by District officials is insisted upon while processing and releasing subsequent grants to an NGO. From time to time, surprise inspections are also conducted by the officials to ascertain whether NGOs are functioning properly and grants being utilised for the purpose for which granted.

Will the Minister of SOCIAL JUSTICE AND EMPOWERMENT be pleased to state:- (a) whether the Government is aware of fake NGOs or non-existent NGOs receiving funds from the Government; (b) if so, the details thereof, State-wise; (c) whether reports from the Collectors/ States concerned are being obtained regularly about the functioning of the NGOs; (d) if so, the details thereof along with the names of the NGOs blacklisted on the reports of the Collectors/States during the last two years, State-wise; and (e) if not, the reasons therefor?

MINISTER OF STATE FOR SOCIAL JUSTICE AND EMPOWERMENT (SHRI VIJAY SAMPLA) (a): No Madam. There has been no report from State Governments of fake or non-existent NGOs, receiving funds for implementation of the schemes of the Ministry of Social Justice & Empowerment, during the last two years. (b): Does no arise. (c) to (e): Grants-in-aid is provided to NGOs which are recommended by State Level Multi- disciplinary Grant-in-Aid Committee supported by inspection reports in prescribed format. Complaints of misuse of funds, if any, are investigated through enquiry/inspection and further release of grant-in-aid is considered only on receipt of a satisfactory report. In cases wherein, prima-facie irregularities are found, show cause notice is issued to the organization concerned with the approval of competent authority and further necessary action is taken as per provisions of the Scheme. During the last two years two NGOs namely Chitragupt Shikshan sansthan, Varanasi, Uttar Pradesh and Dhalopar Rural Development, Karimganj, Assam have been blacklisted on the basis of complaints received against them. In one case State Government of Bihar has recently blacklisted an NGO namely Pandit Bacchan Pandey Mahila Vikas Sansthan in District Gopalganj, on grounds of misuse of Government grants and other irregularities. During inspection visits carried out by officials of the Ministry during the year a total of fortyone Non- Governmental Organisations were found closed or non-existent, in various States. (b) if so, the details thereof during each of the last three years and the current year, State-wise; and

(c) the corrective steps taken/proposed to be taken to check embezzlement of Government grants by NGOs and to lessen the scope of corruption while sanctioning the grants to NGOs? ANSWER

(a): No Madam. There have been no complaints regarding rampant corruption in the sanctioning of grants to NGOs. Sporadic complaints have been received regarding misappropriation of funds by NGOs.

(b): The details are given in Annexure.

(c): The following corrective steps have been taken/proposed to be taken to check embezzlement of Government grants by NGOs:

(i) Funds are released to the NGOs after receipt of recommendation of the State Level Grant- in-Aid Committee, Inspection Reports, Utilization Certificate and Audited Accounts.

(ii) Surprise inspections of the NGOs by the officers of the Ministry,

(iii) The schemes/programmes implemented through NGOs are also monitored by respective State Governments/UT Administrations.

(iv) The Ministry sponsors evaluation studies from time to time through independent evaluation agencies, inter alia, to check proper utilization of funds by the implementing agencies under various Schemes/Programmes.

(v) In the event of proven misappropriation of funds by an NGO, the Ministry initiates action to blacklist the NGO.

(vi) To reduce the scope of corruption while sanctioning the grants to NGOs and in order to bring greater transparency and speed up processing and releasing GIA to the NGOs, the Scheme of Assistance to NGOs has been made online with effect from 01.04.2014.

Delhi 1 2014 This NGO is running three projects funded by GOI under the scheme of GIA to NGO working for SCs. The functioning of these projects have been found satisfactory. In the past, the library project of this NGO was inspected on 03.07.2012 and due to unsatisfactory work of this NGO it was blacklisted. Later this projects was again inspected on 28.06.2013 and the NGO was de-blacklisted. Recently another complaint has been received through Central Vigilance Commission. The matter is under examination. Uttar Pradesh 1 2014 On receipt of complaint, GIA was stopped to this NGO. Recently the Ministry Officials also inspected the project and found its functioning not satisfactory. Maharashtra 1 2011 State Government has been requested to arrange a fresh inquiry on the allegations made in the complaint and furnish a report thereon. The report is awaited. 2 Assistance to Madhya 6 (i) 2010 The NGOs have been Voluntary Pradesh (ii) 2011 blacklisted. Organizations Maharashtra 1 2014 Working for Welfare of OBCs. (c) whether the Government has made certain improvement in the guidelines for providing grants-in-aid to the NGOs and if so, the details thereof;

(d) whether the Government conducts periodic monitoring and evaluation to review/check the utilisation of funds provided to such NGOs; and

(a) Yes, Madam. The Government provides financial assistance to Non-Governmental Organisations (NGOs) who are working for the welfare of Scheduled Castes, Other Backward Classes, Senior Citizens, drug dc-addiction and Persons with Disabilities.

(b): State-wise and Scheme-wise details of NGOs provided assistance during the years 2011-12, 2012-13, 2013-14 and 2014-15 (upto 31-10-2014) are given in Annexure.

(c): The processing of applications by Non-Governmental Organsations (NGOs) for Grant-in-Aid to implement schemes of the Ministry, have been made mandatorily online w.e.f. 1.4.2014.

(d) & (e): Yes, Madam.

The following mechanisms are in place to monitor proper utilization of funds by the NGOs:

(i) Funds are released to the NGOs after receipt of recommendation of the State Level Grant- In-Aid Committee, Inspection Reports, Utilization Certificate and Audited Accounts.

(ii) Surprise inspections of the NGOs by the officers of the Ministry.

(iii) The schemes/programmes implemented through NGOs are also monitored by respective State Governments/UT Administrations.

(iv) The Ministry sponsors evaluation studies from time to time through independent evaluation agencies, inter alia, to check proper utilization of funds by the implementing agencies under various Schemes/Programmes.

(v) In the event of proven misappropriation of funds by an NGO, the Ministry initiates action to blacklist the NGO.

The Government provides grants-in-aid to Non Government Organisations (NGOs) working for implementing various Schemes for welfare of Scheduled Castes, Other Backward Classes, Senior Citizens Victims of alcoholism and substance abuse and Persons with Disabilities.

The details about number of NGOs, funds sanctioned/released and utilized Scheme-wise, State-wise during each of the last three years and current year is given at Annexure-I hereto. Twenty-six cases of alleged misuse of funds by grantee NGOs have come to the notice of the Government. The details of NGOs who were allegedly found misusing funds and the action taken against them in the matter is given at Annexure-II hereto. The Ministry ensures monitoring of the schemes to enhance transparency and accountability in the following manner:

(i) Fresh/subsequent releases of grants to implementing agencies during a year are made only on receipt of Utilization Certificates in respect of previous year’s grants.

(ii) Review of schemes/programmes by the officers of the Ministry during their visits to the States.

(iii) The schemes / programmes implemented through NGOs are also monitored by respective State Governments/UT Administrations.

This NGO is running three projects funded by GOI under the scheme of Development Society, GIA to NGO working for SCs. The functioning of these projects have New Delhi been found satisfactory. In the past, the library project of this NGO was inspected by Officer of this Ministry on 3.7.2012 and due to unsatisfactory work of this NGO, it was blacklisted vide order dated 24.12.2012. Later this project was again inspected on 28.6.2013 and the NGO was de-blacklisted vide order dated 3.2.2014. Recently, another complaint has been received through Central Vigilance Commission. The matter is under examination.

MINISTER OF STATE IN THE MINISTRY OF HOME AFFAIRS (SHRI KIREN RIJIJU)

(a) & (b): Yes Madam. Notices were sent to 21,493 associations, who were found to have not submitted Annual Return under Foreign Contribution (Regulation) Act, 2010 (FCRA, 2010) for the years 2006-07, 2007-2008 and 2008-2009. They were asked to reply along with postal proof or any other proof, of having sent the same within the stipulated period. In respect of 4138 associations, letters dispatched from the Ministry of Home Affairs were returned undelivered by the Post Office as the addressees were not found. After due consideration by the competent authority, the registration of these 4138 associations was cancelled. The State-wise details is annexed.

(c): Ministry of Home Affairs vide Notification No. SO 1070 (E) dated 26.04.2013 has laid down quantum of penalty for non-furnishing of returns within the stipulated period, which ranges from 2% to 5% of the foreign contribution received during the financial year, with the minimum amount of Rs.10,000/- and Rs.500/- per day of delay beyond 180 days from the last date prescribed for filing the return. Besides, Outreach Seminar on FCRA 2010 are organized in various States to sensitize the associations to file return on time.

TRANSPARENCY IN NGOS ACCOUNT 5th December, 2014

Will the Minister of FINANCE be pleased to state:- (a) whether the Government has given any direction to Non-Governmental Organisations (NGOs) to keep a transparent account; (b) if so, the details thereof; (c) whether any NGOs are found misusing of funds; and (d) if so, the details thereof during the last three years, amount and State-wise?

FINANCE MINISTER: (SHRI ) a) & b) As per provisions of Income-tax Act, 1961 (`Act1), if the total income of an NGO during any financial year exceeds the prescribed taxable limits, the said NGO has to get its accounts audited and furnish the `report of audit` within the `due-date` as prescribed in the Act. Further, NGOs are required to invest or deploy surplus funds at their disposal only in accordance with section 11(5) of the Act. They are also required not to use or apply the income or property of the trusts for the benefit of `related persons` specified under sub-section 3 of section 13 of the Act. There are several checks and balances in the Act and also under the Income tax Rules to ensure that accounts are maintained by the NGO in a proper manner.

Lok Sabha 49 c) & d) Instances of misuse of funds may be detected in those cases which are subjected to scrutiny. In such cases, necessary action as per law is taken, if required which includes taxing the income claimed as exempt by the NGO. However, the consolidated list of NGOs that have been found misusing the funds is not maintained in a centralized manner, `State-wise` and `amount-wise`.

(d) if not, the reasons therefor and the steps taken by the Government to ensure full utilisation of such funds; and (e) the number of cases of misuse of such funds unearthed by the Government and the action taken in this regard?

MINISTER OF THE STATE IN THE MINISTRY OF SOCIAL JUSTICE AND EMPOWERMENT (SHRI MANIKRAO HODLYA GAVIT)

(a) The State/UT-wise funds allotted and released to the Non-Governmental Organisations (NGOs) under the `Central Sector Scheme of Assistance for Prevention of Alcoholism and Substance (Drug) Abuse` during the last 3 years and the current year including Karnataka is given in the Annexure-I.

(b) to (d) Yes, Madam. The Non-Governmental Organisations submit Utilization Certificate for the grant- in-aid provided to them on year to year basis under the scheme. Further release of grants-in-aid to a Non- Governmental Organisation is dependent on utilization of previous grants released.

(e) Complaints against NGOs are received by the Ministry from time to time and these are referred to the concerned State Governments for investigation. Release of grant in aid to such NGOs is also stopped till receipt of satisfactory inquiry report from the concerned State Government. However, no case of misutilisation of funds has been brought to the notice of the Ministry by the State Governments.

(c) the number of NGOs who have not furnished their annual accounts/reports along with the action taken against them during the said period, State/UT-wise; and

(d) the steps taken by the Government to ensure proper utilisation of funds by these NGOs? ANSWER

(a): Ministry of Home Affairs deals with the NGOs who have received funds from foreign countries only. During the last three years foreign contribution received by Associations registered and Association that were granted prior permission under the Foreign Contribution (Regulation) Act 2010 (FCRA) are given below:-

In respect of 2011-12, some more data is still under compilation. State-wise details are given at Annexure-I, II and III. NGO wise details are posted on public domain of Foreigners Division.

(b): On the basis of the complaints of various violations of FCRA, 24 cases have been referred to CBI and 10 cases have been referred to State Police for investigation. Details are given at Annexure (IV) and (V).

(c): 21493 associations were found to have not submitted Annual Returns for the years 2006-07, 2007-08 and 2008-09. Letters were sent to them to explain as to why they should not be directed not to accept Foreign Contribution without prior permission of the Central Government as per provision of FCRA. They were asked to reply alongwith postal proof or any other proof, if any, of having sent the same within stipulated period. In respect of 4138 associations, the letters dispatched from the Ministry of Home Affairs were returned undelivered by the Post Office as the addresses were not found. After due consideration by the competent authority, the registration of these associations under FCRA was cancelled. The list of the such associations was posted on public domain of Foreigners Division, Ministry of Home Affairs website. State wise list of cancelled NGOs is at Annexure – VI.

(d): The Government monitors the receipt and utilization of foreign contribution received by any ‘person’ including Non-Governmental Organizations (NGOs) in the country in terms of the Foreign Contribution (Regulation) Act, 2010 and the Rules framed there under the Act. The FCRA, 2010 provides for NGOs to receive foreign funds after registration or prior permission. Every application of NGOs for registration or granting Prior Permission is decided with inputs from the concerned security agencies. The NGOs who have been registered/given prior permission for receiving foreign funds are required to submit Annual Accounts for each financial year within a period of nine months from the closure of the financial year i.e. by 31st December. Such Annual Accounts are to be submitted in the prescribed format duly audited by a Chartered Accountant. FCRA provides for a reporting mechanism by the recipients of foreign contribution as well as by the Banks. These are scrutinized and wherever required, physical inspection is conducted. Based on the findings of the inspection team, appropriate action is taken. ANNEXURE

(a) whether the Government has banned Several Non-Governmental Organisations (NGOs) from receiving foreign funds and has also frozen the accounts of same NGOs following allegations of violation of law;

(b) if so, the details thereof, separately, State-wise;

(c) whether it is a fact that such bans issued on various NGOs have been set aside by the High Courts at various places recently; and

(d) if so, the details thereof? ANSWER

MINISTER OF STATE IN THE MINISTRY OF HOME AFFAIRS (SHRI MULLAPPALLY RAMACHANDRAN)

(a) & (b): Government has prohibited 70 associations from receiving foreign funds and frozen accounts of 37 associations on violation of Foreign Contribution Regulation Act. List of such organizations is given at Annexure-I and Annexure-II respectably.

(c) & (d): Madurai Bench of Madras High Court in its judgment dated 16.10.2012, relating to Rural Uplift Centre, Nagercoil and Good Vision, Kanyakumari, set aside the prohibition receiving foreign contribution. However, it has been made clear in the Court order that it is open to the respondent (Ministry of Home Affairs) to take any action (if need be), after following the principles of natural justice.

(a) whether the Non-Governmental Organisations (NGOs) who received foreign funds are submitting audited records as required under the existing laws;

(b) if so, the details thereof and if not, the reasons therefor along with the action taken against such NGOs during each of the last three years and the current year, State-wise; and

(c) the effective measures taken by the Government to ensure submission of audit records by such NGOs?

MINISTER OF STATE IN THE MINISTRY OF HOME AFFAIRS (SHRI MULLAPPALLY RAMACHANDRAN)

(a): Yes, Sir.

(b) to (c): The Government monitors the receipt and utilization of foreign contribution received by any ‘person’ including Non-Governmental Organization (NGOs) in the country in terms of the Foreign Contribution (Regulation) Act, 2010 and the Rules framed thereunder.

Association which had not submitted Annual Returns for 2006-07, 2007-08 and 2008-09 were sent letters individually to explain as to why they should not be directed not to accept Foreign Contribution without prior permission of the Central Government as per provision of FCRA. They were asked to reply alongwith postal proof or any other proof, if any, of having sent the same within stipulated period for each year.

In respect of 4138 association, the letters dispatched from the Ministry of Home Affairs were returned undelivered by the Post Office as the addresses were not found. After due consideration by the competent authority, the registration of these associations under FCRA was cancelled. The list of the such associations was posted on public domain of Foreigners Division, Ministry of Home Affairs website. State wise list of cancelled NGOs is at Annexure-‘A’.

(a) whether the Union Government has received any complaints with regard to involvement of Non- Governmental Organisations (NGOs) who are receiving funds from abroad, in suspicious activities, money laundering, launching agitations against the Government including nuclear reactors being set up in the country;

(b) if so, the details thereof and the details of such cases reported and the action taken against them during each of the last three years and the current year, State-wise;

(c) whether there are reports that such funds are being used by the foreign intelligence agencies for subversive activities in the country; and

(d) if so, the details thereof and the preventive steps taken by the Union Government to check such cases in future including suitable amendments to the Foreign Contribution Regulation Act to give harsher punishment to the guilty?

MINISTER OF STATE IN THE MINISTRY OF HOME AFFAIRS (SHRI MULLAPPALLY RAMACHANDRAN) (a) & (b): There are reports that certain Non-Governmental Organisations receiving foreign funds were engaged in launching agitations against Government and nuclear power plants. On the basis of the complaints of various violations of FCRA, 24 cases have so far been referred to CBI and 10 cases have been referred to State Police for investigation as given in Annexure I and II. (c): No such information is available.

(d): In view of (c) above, does not arise.

(a) the details of Centrally Sponsored Schemes which are being run under the Ministry through Non- Governmental Organisations (NGOs) for the welfare of different sections of the society along with the amount of grants sanctioned and released by the Union Government for implementation of those schemes during each of the last three years, State and scheme-wise;

(b) the cases of misuse/ misappropriation of funds by the NGOs and the action taken by the Union Government against such NGOs during each of the last three years and ihe current year, State-wise and scheme-wise;

(c) whether there is any proposal for restructuring the funding procedure for NGOs so that they can avail adequate and timely funds under various schemes;

(d) if so, the details thereof; and

(e) the steps being taken by the Government to devise ways and means for better monitoring of the flagship schemes and to enhance transparency and accountability?

(a) Non Governmental Organisations (NGOs) are granted funds by this Ministry under various Central Sector Schemes. State-wise and Scheme-wise details of funds released to the NGOs during the last three years is given at Annexure-I.

(b) State-wise and Scheme-wise number of complaints relating to misuse/ misappropriation of funds by the grantee NGOs during the last three years and the current year is given at Annexure-II. These complaints were forwarded to State Government/other organizations for enquiry and report. In such cases, Ministry withholds further release of funds to NGOs. pending enquiry, and takes action for their blacklisting in the event of receipt of adverse enquiry report.

(c) to (e) It is an ongoing process. The Ministry ensures better monitoring of the schemes to enhance transparency and accountability in the following ways: (i) Fresh/subsequent releases of grants to implementing agencies during a year are made only onreceipt of Utilization Certificates in respect of previous year`s grants, which have become due. (ii) Review of schemes/programmes by the officers of the Ministry during their visits to the States, (iii) The schemes/programmes implemented through NGOs are also monitored by respective StateGovern me nts/UT Administrations, (iv) The Ministry sponsors evaluation studies from time to time through independent evaluationagencies, inter alia, to check proper utilization of funds by the implementing agencies under various Schemes/Programmes, (v) In the event of proven misappropriation of funds by an NGO, the Ministry1 initiates action toblacklist the NGO.
