SUBJECT: 40 MPH SPEED LIMIT B4598 AT LLANFAIR KILGEDDIN

1. PURPOSE:

To consider the proposed Order subsequent to representations received following advertisement in accordance with the Local Authorities Traffic Orders (Procedure) (England and ) Regulations 1994.

2. RECOMMENDATIONS:

Not to hold an inquiry into the proposal

To approve the proposed Order as consulted and advertised upon to implement the Order.

3. KEY ISSUES:

Following numerous concerns raised by representatives of the local regarding road safety and inappropriate vehicular speeds on the B4598 in the vicinity of the school at Llanfair Kilgeddin, County Council has undertaken a review and assessed that the B4598 in the vicinity of the school would be appropriate for a 40 mph speed limit as set out in the Welsh Government’s Setting Local Speed Limits policy. Automated vehicular speed and volume counts were undertaken at two locations over a 7 day continuous period and the mean speeds recorded over both directions at each of the two count locations were 42 mph and 41 mph respectively and are deemed to satisfy the current guidance on setting a 40 mph speed limit.

The local elected member, Local Community Council and Heddlu Police have confirmed their support in writing for the proposed 40 mph speed limit.

A single objection has been received from a member of the general public.

4. REASONS:

The new Traffic Regulation Order is desirable to provide a more appropriate speed limit on the B4598 adjacent to the school at Llanfair Kilgeddin and enhance the level of road safety for all highway users in particular those using the main junction of the B4598 with Llanover Road (R53).

Regulation 9 of the Local Authorities’ Traffic Orders (Procedure) (England and Wales) Regulations 1996 enables the Council to hold a public inquiry into the proposal if there are unresolved objections. The purpose of such an inquiry would be for the proposal to be explained and subjected to examination; and for the public to be given the opportunity to make their views known. Should a public inquiry be held then it would not be possible for it to be implemented for at least six months.

Officers consider that in view of the fact that the objections received have been considered and addressed as set out in the report, that the Council’s proposals do not warrant the holding of any inquiry.

5. RESOURCE IMPLICATIONS:

The costs of the proposed Traffic Regulation Order, road markings and signage are being funded by Monmouthshire County Council and are included in the current road safety and traffic management programme.

6. SUSTAINABLE DEVELOPMENT AND EQUALITY IMPLICATIONS

There are no sustainability issues regarding lowering the speed limit at this location.

NOTICE IS HEREBY GIVEN that Monmouthshire County Council of County Hall, Rhadyr, Usk, Monmouthshire, NP15 1GA ("the Council") propose to make a Road Traffic Regulation Order as follows:

Effect of the Order: to introduce a mandatory 40mph speed limit on the B4598 near Llanfair Kilgeddin in order to raise the level of road safety.

Proposed 40 Mph Speed Limit B4598 near Llanfair Kilgeddin

Schedule: The B4598 from a point 65 metres north‐east of it’s junction with St.Mary’s Close to a point 30 metres south‐west of it’s junction with Llanover Road ( R53). The unnamed road between St.Marys Close and the R53 (Llanover Road) from it’s junction with St.Marys Close in a generally south‐westerly direction for a distance of 20 metres.

Statement of Reasons:

Following concerns received from the local community regarding the level of road safety and vehicular speeds on the B4598 near the hamlet and school in Llanfair Kilgeddin, Monmouthshire County Council undertook further investigations and is proposing to provide a mandatory 40 mph speed limit on the B4598 as per the attached plan in order to raise the level of road safety.
