Headline Partner Moves in January – August 2018

Introduction

In this report we look back on 250 partner moves during the first eight months of 2018. We are still seeing high demand for partners, and particularly for teams, but there has been a slight slow-down in activity over the last few months. Unless there is a dramatic pick up in the last third of the year, we are on course to see fewer than 400 moves in 2018 for the first time in many years.

It is hard to pinpoint the reasons behind this reduction, but a couple of things do stand out:

1. There are fewer law firms – mergers take firms out of the market, lock partners in and, often, there is a period when newly merged firms don’t lose partners whilst people wait and see what the new entity looks and feels like. 2. Arguably it is harder for partners to move than ever before. Firms are expecting more, and their due diligence and processes are improving. This would help explain why demand from firms for partner talent still feels high but there is less actual movement than in previous years.

It’s the US firms who are again keeping recruiters busy, with their appetite for laterals remaining seemingly insatiable. Interestingly, they are continuing to recruit beyond their traditional hiring sweet spots of private equity and finance. Of the 36 moves in litigation which we mention in this report, 22 (61%) are to US or merged US-UK law firms. In restructuring, 8 out of 11 moves so far in 2018 are to US headquartered firms, whilst in projects and energy, the numbers are even higher with 9 out of the 11 moves reported featuring partners joining US or merged US-UK firms.

For all the critics of lateral hiring, it is only by taking partners from rival firms that US firms have been able to build their presence in London. Whilst some firms have been more successful than others, the phenomenal growth of firms such as Latham, Kirkland and White & Case has been, and continues to be, predicated on hiring the best partners from elsewhere. Newer arrivals like Cooley and Goodwin Proctor have also been busy building from scratch over the last 5 years and, whilst not every lateral is as successful as his/her business plan might have initially predicted, there can be no doubt that aggressive hiring is working for these firms. As US firms continue to build their market share, they also now need to recruit from one another as much as from their traditional UK rivals. For example, recent restructuring hires included Milbank recruiting a 4-partner team from Cadwalader, and Latham taking a 2-partner team from Sidley.

Many moves in the City create a chain reaction which is particularly noticeable in specialist practice areas. For example, Freshfields lost litigation partner Justin Watts to WilmerHale in 2017. One year later and they have replaced him by recruiting Chris Stothers and 3 of his colleagues from Arnold & Porter to fill the gap. Sticking with IP, Ashurst lost Mark Lubbock to Brown Rudnick but recruited David Wilkinson from Clydes. Whilst these are not necessarily like for like replacements, each time a firm loses a partner, they must consider whether to replace and this leads to a merry-go- round effect.

Looking at the top 12 most active lateral hirers of 2018, we see a real mix of firms. In order to get a more holistic view of the hiring strategies of these firms we have spent some time analysing their hires:

TOP TIER US FIRMS

Latham & Watkins

Latham is a firm which likes to make big splashes in the market and so far in 2018 it has tempted the highly rated restructuring pair of Yen Sum and Jennifer Brennan from Sidley Austin, Carl Fernandes from in financial services, the finance litigation duo of Jon Holland and Andrea Monks from and, most recently, Brendan Moyle, ’s head of infrastructure M&A and Allen & Overy infrastructure finance partner Conrad Andersen. It’s a galacticos strategy which is reaping rich dividends.

White & Case

The largest UK headquartered firm in The City, with 450 lawyers in London, White & Case has had a busy eight months, hiring 7 partners across a number of different practice areas. Emmie Jones from and Mike Weir from Jones Day join the private equity practice; Shane McDonald from Hudson Advisors joins the finance team; contentious regulatory partner Chris Brennan moves from , and litigators David Robertson from Bryan Cave Leighton Paisner (a construction specialist), Hannah Field-Lowes from Weil Gotshal and Steven Baker from Cadwalader add to the ranks.

Kirkland & Ellis

Kirkland has taken 5 partners so far in 2018 but its recent hiring strategy feels very different, with 4 of their hires being senior associates stepping up into partnership roles for the first time – financial services lawyers Romin Dabir from Macfarlanes and Sarah Thompson from Linklaters; competition lawyer Mark Gardner from Arnold & Porter and restructuring lawyer Matthew Czyzyk from Milbank. However, when Kirkland want to flex its financial muscles, it can also strike right at the top of the market with its hire of IP partner Nicola Dagg from Allen & Overy, one of the senior moves of the year.

Milbank

Milbank has historically not hired at the pace of White & Case, Latham and Kirkland, but 2018 has been a very active year with the firm capturing two significant teams and, in the process, adding 6 partners to the London office. The New York firm took a team of 4 restructuring partners from Cadwalader led by Yusahan Ng, closely followed by a 2-partner high yield team from Shearman.

These 4 elite firms between them have hired 25 partners and, worryingly for the firms with which they are competing for market share, they are losing very few partners. We counted 6 leavers in total from these firms but 3 of these were senior associates or counsel moving for immediate partnership elsewhere. Latham, Kirkland and Milbank haven’t lost any of their existing partners to rivals in London so far this year. And whilst White & Case has lost three partners in 2018, one of these leavers went to a client - James Greig moving to Barclays - and one moved to Memery Crystal which, fine firm as they are, can’t really be considered as a direct competitor. The only partner departure to a rival from any of these 4 firms was capital markets partner Michael Doran swapping White & Case for Baker McKenzie.

INTERNATIONAL FIRMS

In contrast to the elite, firms outside this group must often feel that increasing partner numbers is a zero-sum game with as many departures as arrivals. To be fair, some losses will be more keenly felt than others, so it is wrong to judge a firm’s success or failure rate in the lateral market on numbers alone. However, what can be said with a degree of certainty, is that however successful these firms are, there are always a handful of partners who can be tempted away by bigger, more profitable US

practices. These firms therefore have to work hard to maintain market share, knowing that some of their best people will not be there forever.

The firms below have all made sterling efforts in the recruitment market. The real worry is for those firms that are losing partners and not replacing their revenue elsewhere.

Hogan Lovells

It’s been a mixed 2018 for Hogan Lovells on the senior lateral front with 5 arrivals but also 5 departures. On the positive side, the firm was joined by corporate energy partner Sarah Shaw from Allen & Overy, structured finance lawyer Jennifer O’Connell from CACIB, Nicola Fulford from Kemp Little in data protection, international trade expert Aline Doussin from and Tom McFarlane also joined as Head of Transfer Pricing from Alvarez & Marsal.

However, the firm has also seen the loss of finance litigators Jon Holland and Andrea Monks to Latham & Watkins, corporate lifesciences partner Robert Darwin to Dechert, international arbitration partner Richard Kiddell to Joseph Hage Aaronson and commercial partner Paul Joukador who moved to RPC.

Eversheds Sutherland

Eversheds has a spring in their step post-merger and has been able to attract people to its international platform with 6 new partner arrivals in London this year. Interestingly all of its hires this year have come in relatively specialist areas – investment funds, employment, competition, real estate tax, consumer finance and personal injury. However, like other international firms, it has also lost people, with 8 departures over the last 8 months.

Baker McKenzie

Bakers seems to be on something of a mission to redefine their London office with 6 hires so far in 2018, following on from 6 in 2017. The recent focus has been very much on strengthening their transactional practices, with 5 hires in finance (Matthew Cox and 2 senior associates joining as partners from Ropes, Michael Doran arriving from White & Case - as noted above - and US capital markets lawyer Megan Schellinger moving from Linklaters where she was a senior associate). The other joiner was Kathy Honeywood, a corporate partner from Clifford Chance. However, there were 2 senior departures from the firm, with securitisation partner Jonathan Walsh joining Ashurst and financial services partner Arun Srivastava jumping ship to Paul Hastings.

Ashurst

A good 2018 for Ashurst with 5 partners joining the firm – Jonathan Walsh from Baker McKenzie (as mentioned above) and senior associate Tom Picton from Clifford Chance in securitisation; real estate litigator Alison Hardy from Squire Patton Boggs; construction litigation partner Tom Duncan from Mayer Brown and IP specialist David Wilkinson from Clyde & Co. The firm only had one departure with long-standing IP partner Mark Lubbock moving to Brown Rudnick.

Mayer Brown

Some good hires for Mayer Brown in 2018 as the firm pulled off a finance team move from Fried Frank and a corporate crime team hire from . In addition, the firm took Neil Evans as a private equity partner from Simpson Thacher where he was an associate. Leaving the firm were Tom Duncan to Ashurst (as noted above) and insurance partners Angus Duncan and Mandip Sagoo to Clyde & Co.

Morgan Lewis

The firm recently announced an audacious raid on Freehills with the hire of a 3- partner corporate/private equity team of Mark Geday, Nicholas Moore and Tomasz Wozniak. They join 2018 arrivals Paul Denham from Dorsey and Georgia Quenby from Reed Smith. There were 2 departures, with energy partner Lewis Jones moving to Baker Botts and real estate tax partner Paul Beausang joining Eversheds.

So, for these 6 International firms the score sheet is 32 arrivals (6 of these were senior associates joining as partners) but 21 departures. Of these 21 leavers, 20 were existing partners.

UK FIRMS

DWF

DWF has continued to aggressively grow its London office with 6 hires so far this year to add to the 7 lateral partners who joined their London office in 2017. Whilst larger City firms are looking to expand into the regions, DWF is one of several regional based firms still looking to grow in the City. Other firms to keep an eye on in this bracket are Gateley, off the back of their successful IPO, and Keoghs who took over ’s insurance practice earlier in the year.

Memery Crystal

Elsewhere in the market, we see well managed and profitable commercial firms of all shapes and sizes hiring talent. Especially prominent this year has been Memery Crystal, who have added 5 partners to their ranks. Impressively, many of their hires come from much bigger, more international firms and so this year they have welcomed new faces from , White & Case, Squire Patton Boggs and McGuire Woods.

These 12 firms between them have hired 68 partners so far this year. 4 of them – Kirkland, Eversheds, Baker McKenzie and DWF – were also in our top hiring firms of 2017. In terms of busy areas, disputes, finance and corporate are all pretty much neck and neck, between them contributing to 43% of total moves so far this year.
