All , including CBD, attach themselves to certain receptors in the body to produce their effects. The human body produces certain cannabinoids of its own. The body has two receptors for cannabinoids called CB1 and CB2 receptors. CB1 receptors are found all around the body, but many are in the brain.

VI. Methods of consumption

Terpinolene is also found in apple, cumin, lilac and tea tree, and has a smoky or woody scent. All terpenes have the same molecular formula, weight and framework, but they differ in the placement of the carbon-carbon double bonds. It is the terpenes, not the cannabinoids that are responsible for the aroma of hemp plants. Terpinolene is unusual among the terpenes and cannabinoids, as it is neither anti-inflammatory nor analgesic. It does help fight cancer like most other cannabinoids, and it is anti-fungal, as well as anti-bacterial. Terpinolene is also a sedative which may also may be helpful in cancer treatment, if patients are having difficulty sleeping, as it works in conjunction with other terpenes and cannabinoids like linalool and cannabinol. So how can this terpene aid the effects of hemp’s “main constituents? Oil from the plant’s leaves, roots and seeds were tested, with the leaf oil containing the highest levels of terpinolene at 20%. All three were found to have antibacterial effects against E. coli, golden staph and several others. The leaf oil was the most potent, including against the fungal species.

When the main compounds of these oils were tested individually, terpinolene was the most potent against all microbes in both the disc test and when measuring mean inhibitory concentration (MIC). This included activity against Candida albicans, a common fungal infection. Overall, terpinolene may be another phytochemical behind the reported superiority of whole hemp extracts over CBD alone, though research on human participants and on hemp strains with high levels of this terpene are needed.

Currently Being Studied For Antimicrobial: Terpinolene may possess antimicrobial properties but there has yet to be a study which looked at solely its antibacterial abilities; everything has looked at whole-plant oil extracts. In 1995, researchers examined tea tree oil for its antimicrobial properties and found it to have significant potential as an antimicrobial agent. Tea tree oil is made up of numerous terpenes including terpinolene but also cineole, linalool, and over a dozen others.

A decade later in 2005, a team of researchers looked at the essential oil from Diplotaenia damavandica, a plant native to Iran whose oil is made up of 20% terpinolene. They found it to be effective against E coli and various other pathogens including Staphylococcus aureus (the non-drug resistant cousin of MRSA) and Staphylococcus epidermidis, a related bacteria commonly acquired in hospitals.

An article published by Natural Product Research in 2010, looking at the oil from a different Iranian plant, which had only a 6.12% terpinolene content, found the oil to be an effective antibacterial agent. An article published in 2011 by Natural Product Communications looking at the oil from bicolor Gypsophila, a plant in the clove family, found its oil to have a moderately strong effect against bacteria and a potent one against fungi.

With the discovery of cannabinoid receptors in the late 1980’s and early 1990’s, it became clear that there were specific binding sites for both Phytocannabinoids and endo-cannabinoid products in nervous system tissues. These receptors have been found in all vertebrate life forms including reptiles, fish, birds, amphibians and mammals. There are now two recognized cannabinoid receptors in human beings and they are as follows:

Cannabinoid Receptor #1 (CB1) is found in the brain specifically in the basal ganglia, limbic system and also in the hippocampus. These receptors have also been found in other areas of the brain in lesser concentrations including the cerebellum and the medulla oblongata. It appears that when endo- cannabinoids or Phytocannabinoids that are found in CBD Hemp plants, bind to these receptor sites in the brain, analgesic and anti-emetic effects are mediated.

Cannabinoid Receptor #2 (CB2) are found in the peripheral nervous system and in the microglia of the human cerebellum and also in the immune system, especially the spleen. It appears that CB2 receptors are responsible for anti-inflammatory remediation. These second receptors were discovered in 1993 and they are not thought to be generally distributed in the human body unless there is some form of injury or neuro-inflammatory condition that is chronic in nature. The binding of cannabinoids to the CB2 receptor site likely results in the clinical benefit of decreasing pain reception in chronic inflammatory conditions.

The scientific literature suggests that a medical benefit from utilization of CBD Full Spectrum Hemp Extract is because of the inherent ability of the Phytocannabinoids found in the plant material to bind to the multiple receptors that are already present in the human body as outlined. The Phytocannabinoids that bind to the cannabinoid receptors in the human body are concentrated in a vicious resin that is produced in the glandular structures in the bud of the plant, which are known as trichromes. In addition to cannabinoids, this resin is rich in terpenes and is responsible for the foul odor that is generally associated with the cannabis plant. Phytocannabinoids are nearly insoluble in water but are found to be soluble in lipids, alcohol, and other non-polar organic solvents.

At least 85 Phytocannabinoids have been isolated from the cannabis plant. (THC), cannabidiol (CBD), being the two most common.

Legal Opinion Letter

SUMMARY: CBD obtained from the mature stalks of the cannabis plant is legal to buy and sell throughout the United States. Further, CBD obtained from the flowers of industrial hemp plants—grown in states that are compliant with the 2014 U.S. Farm Bill—may be processed, sold and transported throughout those states and other states (unless a state has laws barring CBD). Ohio does not have any laws barring CBD.

2014 FARM BILL: The Farm Bill defines and permits the growth, cultivation and research of industrial hemp, under defined parameters. See Agricultural Act of 2014, Pub. L. 113-79, title. VIII, Section 7606. The Farm Bill distinguishes “industrial hemp” and “marijuana” based on the concentration of the psychoactive compound THC contained in each product. As such, Congress recognized that industrial hemp products derived from any part of the plant (including the flower) can be used for industrial purposes and would not fall under the Controlled Substances Act as long as the plant was cultivated to be below 0.3% THC concentration. Accordingly, CBD extracted from flowers and leaves of the industrial hemp plant is legal if produced, sold and processed in a state, which has enacted hemp laws pursuant to the 2014 Farm Bill.

Since the passage of the 2014 Farm Bill, Ohio has not implemented legislation allowing industrial hemp research or pilot programs

2016 SPENDING BILL: Congress passed the Spending Bill provisions, expressly prohibiting the government from spending funds in contravention of the Farm Bill and thus, prohibiting the DEA from interfering with the interstate transportation of industrial hemp grown pursuant to the Farm Bill. See Consolidated Appropriations Act, 2016 Pub. L. No. 114-113, Section 763, 129 Stat. 1175, 2285 (2016).

As such, pursuant to the 2016 Spending Bill, industrial hemp may be processed, transported to and sold in states that have not enacted industrial hemp laws pursuant to the 2014 Farm Bill. See also USA v. Marin Alliance for Medical Marijuana

CONTROLLED SUBSTANCES ACT: As you cannot find CBD listed in the Controlled Substances Act, it does not appear that Congress scheduled CBD. This is contrary to the DEA’s position.

FEDERAL DRUG ADMINISTRATION: The FDA considers CBD an “unapproved new drug.” In February 2016, the FDA issued a warning letter to companies that manufacturer and market hemp oils claiming to be “rich in CBD” and promising cures for conditions such as cancers, autism and epilepsy—none of which have been tested by the FDA. The FDA has not moved in court to shut down any CBD companies or seize products. The workaround for companies selling CBD is simply to make no medical claims and link to outside independent research thus, allowing buyers to draw their own conclusions.

OHIO LAW: Pursuant to the Farm and Spending Bills, CBD Oil derived from Industrial Hemp is legal in all fifty states, as this plant never has more than trace amounts of THC. The possession and use of CBD oil derived from Hemp is legal, but possession and use of CBD oil derived from marijuana would be governed by Ohio’s medical marijuana laws. Accordingly, it is illegal to possess CBD derived from marijuana unless permitted under Ohio’s medical marijuana laws. The following forms of medical marijuana are permitted under Ohio’s Medical Marijuaba laws: oils, tinctures, plant materials, edibles and patches.
